    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;El apartado 8&lt;/span&gt;&lt;span style="color:#212121"&gt;.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de &lt;/span&gt;&lt;span style="color:#212121"&gt;25&lt;/span&gt;&lt;span style="color:#212121"&gt; de enero de 201&lt;/span&gt;&lt;span style="color:#212121"&gt;8&lt;/span&gt;&lt;span style="color:#212121"&gt;, por la que &lt;/span&gt;&lt;span style="color:#212121"&gt;se convocan ayudas destinadas al pago compensatorio para zonas con limitaciones específicas para el año 201&lt;/span&gt;&lt;span style="color:#212121"&gt;8&lt;/span&gt;&lt;span style="color:#212121"&gt;, especifica que la resolución expresa se notificará a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares, &lt;/span&gt;&lt;span style="color:#212121"&gt;y se hará de acuerdo con los términos previstos en el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;El vicepresidente, en fecha 5 de diciembre de 2019, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;Convocatoria 2018&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;1. En fecha de 30 de enero de 2018 se publicó en el BOIB núm. 14, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria, para el año 2018, de las ayudas destinadas al pago compensatorio para zonas con limitaciones específicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la mencionada Resolución, el plazo de presentación de solicitudes de la convocatoria terminó el día 30/04/2018, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 1.298 solicitudes de ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;4. En fecha 1 de agosto de 2019 se notifica, mediante publicación en la página web &lt;span style="color:null"&gt;http://www.caib.es&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#0000ff"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;un requerimiento de documentación concediendo un plazo de 10 días para aportar la documentación solicitada, informando que transcurrido este plazo se darán por desistidas las solicitudes de ayuda si los interesados no han realizado ninguna aportación.&lt;/em&gt;&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;5. Dentro del plazo establecido, los interesados indicados en el&lt;strong&gt; &lt;/strong&gt;Anexo I adjunto, presentan la documentación indicada pero resulta insuficiente para saber si cumplen con todos los requisitos establecidos en la convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;6. En fecha 27 de septiembre de 2019 se notifica, mediante publicación en la página web&lt;span style="color:null"&gt; http://www.caib.es, &lt;/span&gt;&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;un segundo requerimiento de documentación concediendo un nuevo plazo de 10 días para aportar la nueva documentación solicitada, informando que transcurrido este plazo se darán por desistidas las solicitudes de ayuda si los interesados no han realizado ninguna aportación. También se pueden dar por denegadas las solicitudes, si habiéndose aportado toda la documentación no se cumplen los requisitos establecidos en la convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#0000ff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. Los interesados indicados en el Anexo I aportan la documentación requerida en el punto anterior, pero después del estudio completo del expediente se observa que continúan sin cumplir con la condición de agricultor no pluriactivo establecido en el punto 1b del apartado Tercero de la convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;15. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero, a partir del 1 de enero de 2006.&lt;/em&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;16. Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas.&lt;/em&gt; ​​​​​​&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Propuesta de resolución de denegación&lt;/em&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo ello, se informa desfavorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;1.Denegar las solicitudes presentadas por los interesados indicados en el Anexo I, por incumplimiento del requisito que se indica en dicho Anexo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2. Declarar concluido el procedimiento y archivar los expedientes detallados en el Anexo I.&lt;/em&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3. Notificar la resolución a los interesados del Anexo I.&lt;/em&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
