font-size:12px"><span style="line-height:normal">El apartado 8. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 30 de enero de 2018 , por la que se convocan subvenciones para el «Fomento de la Agricultura Ecológica», especifica que la resolución se notificará a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones públicas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Con fecha 26 de febrero de 2015, se publicó el BOIB núm. 29 la Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014- 2020.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Con fecha de 1 de febrero<strong> </strong>de 2018 se publicó en el BOIB núm. 15, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2018 de las ayudas destinadas al Fomento de la Agricultura Ecológica.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Con fecha 13 de diciembre de 2018, se publica en el BOIB núm. 156, una modificación por la cual se modifican los créditos y las cofinanciaciones.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Los interesados señalados en el Anexo I adjunto han presentado, dentro del plazo establecido y en la forma requerida, la documentación prevista en la convocatoria, y se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero, a partir del 1 de enero de 2006.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Ley 39/2015, de 1 de octubre del Procedimiento Administrativo Común de las Administraciones Públicas.</span></span></p> </li> </ol> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Propuesta de resolución de concesión</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Por todo ello y de acuerdo con el apartado octavo de la convocatoria, se informa favorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:</span></span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Aprobar la subrogación del expediente detallado en el anexo I, y por las anualidades que quedan por pagar (2019 y 2020)</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Conceder la ayuda solicitada al nuevo beneficiario por los importes y con los plazos detallados en el Anexo II, que son un total de 1 expediente y que empieza con PEDRO JOSE OSUNA JIMENEZ (NIF 37337308M) y acaba con PEDRO JOSE OSUNA JIMENEZ (NIF 37337308M), que suma un importe total anual de TRES MIL OCHOCIENTOS NOVENTA EUROS CON VEINTE CENTIMOS (3.890,20€), relativa a la línea de ayudas "Fomento de la Agricultura Ecológica. AECU 2018. "</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Autorizar y disponer el gasto señalado a cada uno de los beneficiarios con cargo a los presupuestos y porcentajes de cofinanciación detallados en el Anexo II.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Determinar la superficie comprometida por beneficiario y grupo de cultivo detallado en el Anexo II.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de los beneficiarios serán las indicadas en el Anexo IV.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Mantener sin disminuir la superficie comprometida a nivel de grupo de cultivo, independientemente de que pueda variar la ubicación del cultivo dentro de las parcelas que integran la explotación agraria o de los cambios de las parcelas donde se ubica el cultivo. Este compromiso se considera cumplido con una tolerancia máxima de disminución de la superficie comprometida de 0,1 ha en grupos de cultivo que tengan hasta 0,5 has de superficie comprometida y un 10% en aquellos de más de 0,5 has de superficie comprometida.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Cumplir las parcelas lo establecido en las normas genéricas y específicas de cada cultivo sobre producción ecológica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Mantener y actualizar el cuaderno de explotación específico para la agricultura ecológica donde se inscribirán operaciones de cultivo y actuaciones realizadas (abono, fitosanitarios, cultivo, etc.) en cada una de las parcelas (o grupo de parcelas en caso de ser el mismo cultivo), con indicación de la fecha de realización y las incidencias, si las hubiera.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Participar, durante el período de compromiso, en actividades de formación relacionadas con la agricultura ecológica.
