El 15 de septiembre de 2015 se publicó en el Boletín Oficial de las Illes Balears (BOIB) núm. 136, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015-2019, subvenciones para la creación de empresas de jóvenes agricultores (modificada por la Resolución del presidente del FOGAIBA publicada en el BOIB núm. 54, de 30 de abril de 2016).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El 20 de marzo de 2018, el consejero de Medio Ambiente, Agricultura y Pesca (por abstención del vicepresidente del FOGAIBA) dictó la Resolución de modificación de la cofinanciación de ayudas concedidas y no pagadas hasta el 31 de diciembre de 2017 y financiadas en el presupuesto de 2018, RMC1, de fecha 20 de marzo de 2018, para la creación de empresas de jóvenes agricultores para los años 2015-2019.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En fecha 14 de octubre de 2916 se dictó la Resolución de concesión (R15), que se publicó en el Boletín Oficial de las Illes Balears núm. 37, de día 29 de octubre, en la que se incluía una concesión de ayuda al beneficiario Juan Simeón Triay Benejam, con NIF 41746460B, correspondiente al expediente CEJA2015_1/122, y con un importe de prima de 50.000,00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 4 de noviembre de 2016 (con RGE núm. 18682/2016) se presentó la solicitud del primer pago parcial de la prima (50 %), esto es por un importe de 25.000,00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El 31 de julio de 2019 (RGE núm. L95E19476), el beneficiario presentó la solicitud del segundo pago de la prima (50 %), que son 25.000,00 € restantes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. En fecha 28 de agosto de 2018 (RGE núm. L95E20959), l beneficiario presentó en la Delegación de Ciutadella la solicitud de modificación del Plan Empresarial, en el sentido de que informa que por razones técnicas y económicas ha cambiado de explotación agraria y se ha incorporado como socio cultivador de la sociedad Algendar Vell SRM, con NIF J57876773, núm. de RIA 18560, y que por eso no tiene previsto realizar la medida de explotación prioritaria ecológica (10.000,00 €), ahora bien, continua con las medidas correspondientes a la prima base, a la explotación prioritaria y prioritaria ganadera.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A pesar de que realiza una modificación al Plan Empresarial, continua cumpliendo con los requisitos que establece la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por ello, implica hacer una revocación parcial de 10.000,00 €, por tanto, el pago correspondiente al 2º tramo será de una cuantía de 15.000,00 € (esto es, 25.000,00 € correspondiente del 2º tramo, menos 10.000,00 € correspondiente a la medida de explotación prioritaria ecológica a la cual ha renunciado).</span></p> <ol> </ol> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></strong></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%">1. Resolución de 10 de julio de 2015 del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.</span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%">2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020. </span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%">3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></p> <p style="margin-bottom:0cm; text-align:left"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%"><strong>Propuesta de resolución </strong></span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%">Por todo ello, se informa favorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:</span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%">1. Aceptar la modificación del Plan Empresarial que ha presentado el señor Joan Simeón Triay Benejam, con NIF 41746460B, y por tanto modificar la ayuda concedida en la Resolución de concesión de 14 de octubre de 2016, expediente CEJA2015_1/122, con los términos detallados en el anexo I.</span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%">2. Revocar parcialmente la Resolución de ayuda concedida al beneficiario, correspondiente al 2º pago de la prima, por el importe y con los datos detallados en el anexo II de esta Resolución, que es un total de 1 expediente y que empieza y finaliza por Joan Simeón Triay Benejam, que suma un total de 10.000,00 €, relativa a la linea de ayuda Creación de empresas de jóvenes agricultores.</span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%">3. Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones del beneficiario serán las indicadas en el anexo III.</span></span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif"><span style="font-size:12px"><span style="line-height:100%">4.
