    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De conformidad con el acuerdo plenario de este Ayuntamiento sobre las modificaciones puntuales de las ordenanzas fiscales, y en cumplimiento del artículo 17.4 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo, se publica el texto íntegro de la siguiente ordenanza fiscal (incluyendo las modificaciones aprobadas):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;«&lt;strong&gt;ORDENANZA REGULADORA DEL PRECIO PÚBLICO PARA LA PRESTACIÓN DE SERVICIOS DE LA ESCUELA MUNICIPAL DE MÚSICA Y DANZA DE ANDRATX&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 1.- Fundamento y naturaleza&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Conforme a lo previsto en los artículos 127 y 41 del Texto Refundido de la Ley Reguladora de las Haciendas Locales (Real Decreto Legislativo 2/2004), el Ayuntamiento de Andratx establece el precio público para la prestación de los servicios de la Escuela Municipal de Música y Danza de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 2.- Obligación de pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La obligación de pagar el precio público nace desde que se inicia la prestación de los servicios de la Escuela Municipal de Música y Danza de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 3.- Obligados al pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Están obligados a pagar el precio público quienes ser beneficien de los servicios prestados, o si es el caso, los padres o tutores legales si el beneficiario es menor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 4.- Cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.1 La cuantía del precio público regulado en esta ordenanza es anual o temporal, según el punto 4 de este artículo, y consiste en las tarifas que se establecen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.2 La cuantía del precio público, en el caso de los cursos anuales, se tiene que acreditar en el inicio del curso escolar. En el caso de cursos temporales, esta cuantía se tiene que acreditar en el momento de iniciar el curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.3 La tarifa de este precio público es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Que el usuario en el momento de la inscripción en el curso correspondiente tenga una edad igual o superior a 65 años, edad que debe justificar con la presentación del DNI o un documento similar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Para jubilados y pensionistas que acrediten su condición, con acuerdo previo motivado de la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;D.- TARIFA PARA ALUMNOS DE LA ESCUELA QUE FORMEN PARTE DEL CORO INFANTIL DE ANDRATX / CORO MUNICIPAL / BANDA DE MÚSICA / GRUPO DE XEREMIAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Esta tarifa será de aplicación únicamente para alumnos que durante el año anterior hayan colaborado en el coro, banda o grupo de xeremias y que no hayan faltado injustificadamente a los conciertos de invierno y verano del curso escolar anterior y previo informe favorable de la Dirección de la Escuela de Música y aprobado por la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Para los alumnos que estén matriculados en distintas asignaturas, la aplicación de esta tarifa se llevará a cabo con el siguiente orden: Lenguaje musical, canto y cualquier otra asignatura.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 5.- Normas de gestión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Matrícula. En el caso de antiguos alumnos, el pago de la matrícula se tiene que efectuar en el periodo establecido por la inscripción, y en el caso de los nuevos alumnos, cuando hayan sido admitidos. La matrícula, que grava la actividad administrativa de inscripción, se debe pagar por cada alumno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Tarifa:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.1 Curso anual: La tarifa puede ser abonada totalmente antes de comenzar el curso, o bien de forma fraccionada en tres cuotas trimestrales que se tienen que liquidar a principio de cada trimestre y que se tienen que presentar al cobro mediante domiciliación bancaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.2 Cursos temporal: En el caso de cursos temporales, la tarifa se debe abonar antes de comenzar el curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.3 Curso mensual: En el caso de cursos mensuales, la tarifa se debe abonar al principio de cada mes mediante domiciliación bancaria, salvo el mes en que se produzca el alta, que se debe abonar a la ventanilla.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Si la admisión del alumno se produce con posterioridad al inicio del curso, se tienen que abonar las cuotas trimestrales que correspondan&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Bajas en el servicio:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.1 Las bajas de cursos anuales tienen que ser formalizadas por los usuarios o responsables antes de acabar el trimestre anterior en que tengan que producir efecto, Una vez comprobadas por la dirección de la escuela, y tramitada la documentación correspondiente, se producirá la baja de la cuota del resto de trimestres del curso escolar, y en caso de haber abonado la cuota completa, se deben devolver los trimestres no vencidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.2 Las bajas de los cursos temporales deber ser formalizadas por escrito antes del inicio del curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.3 Las bajas de los cursos mensuales se tienen que formalizar por escrito por los usuarios o responsables antes del día 20 del mes anterior en que tengan que producir efecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En ningún caso se devolverá la matricula.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No se puede formalizar la baja ni devolver la cuota si se incumplen los periodos anteriormente señalados, de tal forma que las bajas solo tienen efectos si son comunicadas en el tiempo establecido y en la forma adecuada y son presentadas en el registro general de entrada o en cualquier otro de los lugares establecidos en la ley 30/1992, de régimen jurídico de las administraciones publicas y procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. Asistencia a clase: es obligatorio estar al corriente de pago de matricula y cuotas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) A principios de curso será obligatoria la presentación del recibo de matrícula y de la 1ª cuota.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) En el segundo y tercer trimestre del curso, el no cumplimiento de la obligación de pago supondrá la baja automática y la prohibición de asistencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 6.- Exenciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los minusválidos y discapacitados psíquicos y físicos que tengan un grado de minusvalía igual o superior al 33%. La solicitud se ha de presentar junto con la inscripción y, para concederla, es necesario el acuerdo previo motivado de la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 7.- Delegación en la Junta de Gobierno Local&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Conforme a lo previsto en el artículo 47.1 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, en relación con el artículo 23.2.b) de la Ley reguladora de las bases de régimen local, se delega en la Junta de Gobierno la fijación o modificación de la cuantía de los precios públicos por usuario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 8.- Infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las infracciones y las sanciones en materia tributaria se han de regir por lo que dispone la Ley General Tributaria y su normativa de desarrollo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSICIÓN FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Esta ordenanza entra en vigor una vez se haya publicado completamente el texto en el Boletín Oficial de les Illes Balears y haya transcurrido el plazo previsto en el artículo 65.2 de la Lei 7/1985, de 2 de abril, y estará en vigor hasta que se modifique o se derogue expresamente.&lt;span style="color:#000000"&gt;»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
