    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De conformidad con el acuerdo plenario de este Ayuntamiento sobre las modificaciones puntuales de las ordenanzas fiscales, y en cumplimiento del artículo 17.4 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo, se publica el texto íntegro de la siguiente ordenanza fiscal (incluyendo las modificaciones aprobadas):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;«&lt;strong&gt;ORDENANZA REGULADORA DEL PRECIO PÚBLICO PARA LA PRESTACIÓN DE SERVICIOS DE ACTIVIDADES FORMATIVAS, CULTURALES, LÚDICAS Y DE TALLERES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 1.- Fundamento y naturaleza&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De acuerdo con el que prevén los artículos 127 y 41 del Texto refundido de la Ley reguladora de las haciendas locales (Real decreto legislativo 2/2004), el Ayuntamiento de Andratx establece el precio público por la prestación de servicios de actividades formativas, culturales, lúdicas y de talleres.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 2.- Obligación de pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La obligación de pagar el precio público nace desde que se inicia la prestación de los servicios objete de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 3.- Obligados al pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Están obligados a pagar el precio público las personas que participen o asistan a las actividades reguladas en esta ordenanza o, si es el caso, los padres o tutores legales si el beneficiario es menor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 4.- Cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.1. La cuantía del precio público puede ser anual, temporal o mensual, según el epígrafe correspondiente, y consiste en las tarifas que se establecen en el punto 4 de este artículo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.2. La cuantía del precio público, en el caso de cursos anuales, se tiene que acreditar al empezar el curso escolar. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En el caso de cursos temporales, esta cuantía se tiene que acreditar en el momento de empezar el curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.3. La tarifa de este precio público es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;em&gt;EPÍGRAFE PRIMERO. ACTIVIDADES ESCUELA DE ADULTOS&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Para los jubilados y pensionistas que acrediten su condición, con acuerdo previo motivado de la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Esta tarifa será de aplicación únicamente si se cumplen uno de estos requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Que el usuario en el momento de la inscripción en el curso correspondiente tenga una edad igual o superior a 65 años, edad que debe justificarse con la presentación del DNI o un documento similar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Para los jubilados y pensionistas que acrediten su condición, con acuerdo previo motivado de la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 5.- Normas de gestión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Matrícula: En el caso de los antiguos alumnos, el pago de la matrícula se tiene que efectuar en el periodo establecido para la inscripción, y en el caso de los nuevos alumnos, al haber sido admitidos. La matrícula, que grava la actividad administrativa de inscripción, se tiene que pagar por alumno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Tarifa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.1 Curso anual: La tarifa anual puede ser abonada totalmente antes de empezar el curso, o bien de forma fraccionada en tres cuotas trimestrales que se tienen que liquidar a principio de cada trimestre y que se tienen que presentar al cobro mediante domiciliación bancaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.2 Curso temporal: En el caso de cursos temporales, la tarifa se tiene que abonar antes de empezar el curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.3 Curso mensual: En el caso de cursos mensuales, la tarifa se tiene que abonar a principio de cada mes mediante domiciliación bancaria, salvo el mes en que se produzca el alta, que se tiene que abonar en la ventanilla.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Si la admisión del alumno en un curso anual se produce con posterioridad a la fecha de inicio del curso, se abonarán las cuotas trimestrales que correspondan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Bajas en la prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.1. Las bajas de cursos anuales las tienen que formalizar los usuarios o responsables antes de acabar el trimestre anterior en qué tengan que tener efecto. Una vez comprobadas por la dirección de la escuela, y tramitada la documentación correspondiente, se producirá la baja de la cuota del resto de trimestres del curso escolar, y en caso de haber abonado la cuota completa, se volverán las cuotas de los trimestres no vencidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.2. Las bajas de los cursos temporales tienen que ser formalizadas por escrito antes de empezar el curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.3. Las bajas de los cursos mensuales las tienen que formalizar por escrito los usuarios o responsables antes del día 20 del mes anterior en qué tengan que tener efecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En ningún caso se devolverá el importe de la matrícula.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No se puede dar de baja ningún usuario ni devolver ninguna cuota si no se cumplen los periodos anteriormente mencionados, de tal forma que las bajas solo tienen efectos si son comunicadas en el tiempo establecido y en la forma adecuada, por escrito, ante el registro general de entrada o en cualquier otro lugar de los previstos en la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. Asistencia en clase: es obligatorio estar al corriente de pago de matrícula y cuotas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A) A principios de curso será obligatoria la presentación del recibo de matrícula y de la 1ª cuota.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;B) En el 2.º y 3.º trimestre del curso, el no cumplimiento de la obligación de pago supondrá la baja automática y la prohibición de asistencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 6.- Exenciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.-Los minusválidos y discapacitados psíquicos y físicos que tengan un grado de minusvalía igual o superior al 33%. La solicitud se tiene que presentar junto con la inscripción y, para concederla, es necesario el acuerdo previo motivado de la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Los alumnos de la ESO y bachillerato matriculados en centros públicos o concertados del municipio de Andratx en los cursos de catalán y castellano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Las personas con una problemática social grave, previo informe motivado del Departamento de Servicios Sociales. Esta exención será de carácter rogado y resuelta la petición de exención por Decreto de la Concejalía de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 7.- Delegación en la Junta de Gobierno Local&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Conforme a lo previsto en el artículo 47.1 del Texto refundido de la Ley reguladora de las haciendas locales, en relación con el artículo 23.2 b) de la Ley reguladora de las bases de régimen local, se delega en la Junta de Gobierno Local la fijación o la modificación de la cuantía de los precios públicos por usuario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 8.- Infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las infracciones y las sanciones en materia tributaria se tienen que regir por lol que dispone la Ley general tributaria y la normativa que la desarrolla.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSICIÓN FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Esta ordenanza entra en vigor a partir del 1 de enero de 2018 al haber sido publicado completamente el texto en el Boletín Oficial de les Illes Balears continuará vigente hasta que se modifique o se derogue expresamente.»&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
