text/html es 910 628533 2019-11-11 45547 ![CDATA[Notificación de Resolución de concesión a los beneficiarios de las ayudas R45 de fecha 16 de octubre de 2019, al amparo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 10 de julio de 2015, por la cual se convocan subvenciones para inversiones a las explotaciones agrarias para los años 2015-2019]] es 11231 ![CDATA[<p><span style="line-height:120%"><span style="line-height:120%"><span style="color:#212121">El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015, por la cual se convocan subvenciones para inversiones a las explotaciones agrarias, correspondientes a los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante la publicación en el Boletín Oficial de las Islas Baleares, de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></p> <p><span style="line-height:120%"><span style="line-height:120%"><span style="color:#212121">Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></p> <p><span style="color:#212121">&nbsp;El vicepresidente, en fecha 16 de octubre de 2019, firmó la siguiente Resolución:</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><em>«INFORME PROPUESTA DE RESOLUCIÓN / RESOLUCIÓN DE CONCESIÓN</em></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><em>Programa de Desarrollo Rural de las Islas Baleares 2014-2020</em></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><em>Medida 4.1- Ayuda a las inversiones a las explotaciones agrarias (INEA)</em></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><em>Convocatoria: INEA 2017_1</em></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><em>Grupo: INEA2017_1/R45 Id: 8668</em></strong></p> <p><strong>Antecedentes</strong></p> <p><span style="color:#212121">1. Con </span>Fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares nº 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y&nbsp; 26 de junio de 2018.</p> <p>2. De conformidad con el apartado sexto de la Resolución mencionada, el plazo para presentar las solicitudes acabó el día 30 de junio de 2017.</p> <p>3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</p> <p>4. Las personas interesadas señaladas en el <strong>anexo I</strong> adjunto han presentado, dentro del plazo establecido y en la forma apropiada, toda la documentación necesaria prevista a la convocatoria, y se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda.</p> <p>5. Las actuaciones solicitadas por los interesados cumplen con los requisitos establecidos a la convocatoria con el fin de poder ser subvencionables.</p> <p><span style="line-height:120%"><span style="line-height:120%"><span style="color:black">6. Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria no hay ningún impedimento para resolver estos expedientes sin afectar a lo que dispone los apartados séptimos y octavos de la convocatoria. </span></span></span></p> <p><strong>Fundamentos de derecho</strong></p> <p>1. Resolución de 10 de julio de 2015 del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y&nbsp; 26 de junio de 2018.</p> <p>2. Orden del Consejero<span style="display:none">&lt;A[consejero|conseller]&gt;</span> de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por<span style="color:green"><span style="display:none">&lt;A[por|para]&gt;</span></span> la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</p> <p>3. Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</p> <p> </p> <p style="text-align:center"><strong>Propuesta de resolución de concesión</strong></p> <p><span style="line-height:120%"><span style="line-height:120%">Por todo eso, se informa favorablemente y&nbsp; se propone al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:</span></span></p> <p>1. Conceder la ayuda solicitada a las personas beneficiarias por los importes y con los plazos detallados en el anexo I, que son un total de <strong>2</strong> expedientes&nbsp; que empieza&nbsp; con <strong>SERFOAG, S.L. </strong>y termina con <strong>CAN MACIANET SC</strong>, que suma un importe total de <strong>107.836,63</strong> euros, relativa a la linia de ayuda&nbsp; “Inversiones a las explotaciones agrarias”.</p> <p>2. Autorizar y disponer el gasto señalado en cada una de las personas beneficiarias con cargo a los presupuestos y porcentajes de cofinanciamiento detallados en el <strong>anexo I</strong>.</p> <p>3. Determinar que, de acuerdo con lo que establece la convocatoria de referencia, las obligaciones de las personas beneficiarias serán las indicadas en el <strong>anexo II </strong></p> <p>4. line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>&nbsp;OBLIGACIONES DEL BENEFICIARIO</strong></p> <p>- Realizar las inversiones o actividades auxiliadas en el plazo establecido.</p> <p>- Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en los términos y plazos determinados en esta Resolución.</p> <p>- Ejercer la actividad agraria en cualquier explotación y mantener las inversiones realizadas durante al menos cinco años, contados desde la fecha de pago de la ayuda.</p> <p>- Incrementar un 5% los ingresos agrarios iniciales en uno de los cinco años siguientes en el pago de la ayuda, excepto en los casos de inicio de actividad contemplados en el punto 1.2 del apartado tercero.</p> <p>- Cumplir las normas comunitarias aplicables a la inversión de la cual se trate y las específicas que se puedan señalar en función del tipo de explotación.</p> <p>- Adoptar las medidas que sean necesarias para proporcionar información al público y dar publicidad.</p> <p>- Someterse a los controles que lleve a cabo la Administración, necesarios para comprobar la concesión correcta de la ayuda y el mantenimiento posterior de los compromisos.</p> <p>- Cumplir los compromisos adquiridos para la concesión de la ayuda.</p> <p>- Mantener los requisitos y condiciones exigibles con respecto a la explotación y a la persona beneficiaria, a los cuales hace referencia el apartado tercero de esta Resolución.</p> <p>Se informa a los beneficiarios que sus expedientes se encuentran a su disposición y consulta al servicio de Ayudas al Desarrollo Rural del FOGAIBA (calle de la Reina Constanza, 4 de Palma).</p> <p> </p> <p style="text-align:center">Palma, 6 de noviembre de 2019</p> <p style="margin-bottom:0px;
