font-size:12px"><span style="line-height:normal"><span style="color:#212121">El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015, por la cual se convocan subvenciones para inversiones a las explotaciones agrarias, correspondientes a los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante la publicación en el Boletín Oficial de las Islas Baleares, de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></p> <ol> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Con </span>Fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares nº 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y&nbsp; 26 de junio de 2018.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el apartado sexto de la Resolución mencionada, el plazo para presentar las solicitudes acabó el día 30 de junio de 2017. </span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los interesados mencionados en el anexo I han presentado, en tiempo y forma, toda la documentación´ necesaria prevista en la convocatoria, y se ha comprobado que cumplen los requisitos exigidos para poder ser beneficiarios de estas ayudas.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se publicó en la web <span style="color:null"><em>http://www.caib.es</em> la propuesta provisional </span>de concesión de las ayudas solicitadas.&nbsp; (INEA2017_1_9_PRO) &nbsp;que se notificó &nbsp;el 30 de septiembre de 2019.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dentro del plazo establecido, los interesados correspondientes han presentado&nbsp; alegaciones.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Una vez evaluadas las alegaciones presentadas y de acuerdo con los criterios de elegibilidad de la convocatoria, a los beneficiarios les corresponde una ayuda máxima detallada en el <strong>a</strong><strong>nexo I</strong>.</span></span></span></li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</span></li> </ol> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Propuesta de resolución de concesión parcial</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><span style="line-height:120%">Por todo eso, se informa favorablemente y&nbsp; se propone al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:</span></span></span></p> <ol> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Conceder la ayuda solicitada a las personas beneficiarias por los importes y con los plazos detallados en el<strong> anexo I</strong>, que son un total de 2 expediente y que empieza con <strong>JUAN MIGUEL GELABERT NIELL</strong> y termina con<strong> MATIAS RAMIS CIFRE</strong>, que suma un importe total de <strong>116.253,47 </strong>euros, relativa a la linia de ayuda&nbsp; “Inversiones a las explotaciones agrarias”. </span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Autorizar y disponer el gasto señalado en cada una de las personas beneficiarias con cargo a los presupuestos y porcentajes de cofinanciamiento detallados en el <strong>anexo I</strong>.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Determinar que, de acuerdo con lo que establece la convocatoria de referencia, las obligaciones de las personas beneficiarias serán las indicadas en el <strong>anexo II </strong></span></li> <li><span style="font-family:Times New Roman,Times,serif; width:100%"> </span>​​​​​​​OBLIGACIONES DEL BENEFICIARIO</strong></span></p> <ol class="decimal"> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Realizar las inversiones o actividades auxiliadas en el plazo establecido.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en los términos y plazos determinados en esta Resolución.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ejercer la actividad agraria en cualquier explotación y mantener las inversiones realizadas durante al menos cinco años, contados desde la fecha de pago de la ayuda.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Incrementar un 5% los ingresos agrarios iniciales en uno de los cinco años siguientes en el pago de la ayuda, excepto en los casos de inicio de actividad contemplados en el punto 1.2 del apartado tercero.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cumplir las normas comunitarias aplicables a la inversión de la cual se trate y las específicas que se puedan señalar en función del tipo de explotación.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Adoptar las medidas que sean necesarias para proporcionar información al público y dar publicidad.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Someterse a los controles que lleve a cabo la Administración, necesarios para comprobar la concesión correcta de la ayuda y el mantenimiento posterior de los compromisos.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cumplir los compromisos adquiridos para la concesión de la ayuda.</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Mantener los requisitos y condiciones exigibles con respecto a la explotación y a la persona beneficiaria, a los cuales hace referencia el apartado tercero de esta Resolución.</span></li> </ol> <p><span style="font-family:Times New Roman,Times,serif;
