CAIB CAIB 2019-10-23 43350 10474 es 43348 CAIB text/html ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Pleno del CONSELL DE MALLORCA, a la sesión ordinaria de día 10 de octubre de 2019, acordó lo siguiente: </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&lt;&lt;1. Aprobar, de acuerdo al artículo 15 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley reguladora de las Haciendas Locales, provisionalmente la modificación de algunos preceptos de la Ordenanza fiscal reguladora de la tasa para servicios de inspección técnica de vehículos que presta el Consell de Mallorca, que resultan redactados en los siguientes términos:</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">“Artículo 1º- FUNDAMENTO&lt;A[FUNDAMENTO|CIMIENTO]&gt;, NATURALEZA Y ÁMBITO GEOGRÁFICO</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.En uso de &nbsp;las facultades atribuidas por los artículos 133.2 y 142 de la Constitución española y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local y conforme a lo que disponen los artículos 15 a 19 del Real decreto legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley reguladora de las haciendas locales, el Consell Insular de Mallorca establece la tasa para inspección técnica de vehículos, que se rige por esta Ordenanza fiscal, cuyas normas se atienen alo previsto en el artículo 132 en relación al 157 del citado Real decreto legislativo 2/2004</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.El ámbito de aplicación es Mallorca</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 2º- HECHO IMPONIBLE</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constituye el hecho imponible de la tasa que el Consell de Mallorca preste los servicios encaminados a comprobar que un vehículo, matriculado o que deba matricularse en España, sea apto para ser utilizado en la vía pública y que disponga de las características de seguridad y de protección del medio ambiente establecidas en la legislación vigente.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 3º- SUJETO PASIVO </span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La persona titular o arrendataria a largo plazo del vehículo es sujeto pasivo, sin perjuicio de que se aplique lo dispuesto en los artículos 35 y 36 de la Ley 58/2003, de 17 de diciembre, general tributaria.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 4º- TASA</span></strong></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La cuantía pagada por el servicio de ITV es una tasa que consiste en una cuantía fija.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La tasa se exigirá de acuerdo con los preceptos descritos en el anexo I.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si cabe a las cuantías descritas al anexo I deben sumarse, las tasas actualizadas descritas en la Ley 6/1979, de 2 de octubre, sobre tasas de la Jefatura Central de Tráfico.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las tasas pueden ser objeto de revisión periódica no predeterminada o de revisión no periódica siempre que se justifique con una memoria económica.</span></p> </li> </ol> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 5º- EXENCIONES Y BONIFICACIONES</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No se concede ninguna exención ni bonificación en la exacción de esta tasa.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 6º- DEVENGO</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se devenga la tasa y nace la obligación de contribuir en el momento en que se inicia la actuación administrativa que constituye el hecho imponible.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 7º- LIQUIDACIÓN E INGRESO</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El procedimiento de ingreso, según lo previsto en el artículo 27 del Real decreto legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley reguladora de haciendas locales, es el de autoliquidación; el sujeto pasivo tiene que autoliquidar la tasa medidante cualquiera de los medios siguientes:</span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Mediante tarjeta de crédito o débito en los lugares de atención de cada una de las estaciones, utilizando la aplicación informática de gestión y recaudación de tributos del CONSELL DE MALLORCA.</span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cualquier entidad financiera colaboradora del CONSELL DE MALLORCA utilizando el correspondiente documento de liquidación, expedido desde la aplicación informática de gestión y recaudación de tributos del CONSELL DE MALLORCA. </span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por vía telemática a través de la pasarela de autoliquidación disponible en la sede electrónica del CONSELL DE MALLORCA cuando el Consejo haya establecido las condiciones para utilizar este medio de autoliquidación con la validación de la Tesorería de la Administración. </span></p> </li> </ul> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 8º- INFRACCIONES Y SANCIONES</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todas las cuestiones relativas a la calificación de infracciones tributarias y también a las sanciones que corresponden en cada caso, se aplican las disposiciones contenidas en el Título IV de la Ley 58/2003, de 17 de diciembre, general tributaria.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">DISPOSICIÓN FINAL</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La presente Ordenanza, es de aplicación una vez publicada en el Boletín Oficial de las Islas Baleares y transcurrido el plazo previsto en el artículo 65.2 de la Ley 7/1985, de 2 de abril y permanecerá en vigor hasta su modificación o derogación expresa.</span></p> <p>&nbsp;&nbsp;</p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif;
