CAIB 42630 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El día 30 de junio de 2020 finaliza el periodo de ejercicio del cargo de los directores de los centros docentes públicos de las Illes Balears que fueron nombrados en fecha&nbsp; de 1 de julio de 2016 por un periodo de cuatro años mediante la Resolución de la directora general de Personal Docente de 13 de julio de 2016&nbsp; per la cual se nombran directores de centros docentes públicos de acuerdo con la Resolución del Consejero de Educación y Universidad de 12 de noviembre de 2015 (BOIB nº. 91, de 19 de julio de 2016) y mediante la Resolución de la directora general de Personal Docente de 13 de julio de 2016&nbsp; per la cual se nombran directores de centros docentes públicos de acuerdo con la Resolución del Consejero de Educación y Universidad de 23 de diciembre de 2015 (BOIB nº. 91, de 19 de julio de 2016).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;De conformidad con lo que prevé el apartado 2 del artículo 136 de la Ley orgánica 2/2006, de 3 de mayo, de educación (LOE), los directores pueden optar por continuar en el ejercicio del cargo si, al final de cada periodo, la tarea que han desarrollado es evaluada positivamente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.&nbsp;Mediante la Orden del consejero de Educación y Cultura de 18 de febrero de 2010 (BOIB núm. 30, de 23 de febrero, y corrección de errores publicada en el BOIB núm. 33, de 27 de febrero), se aprobaron las bases que rigen la selección, el nombramiento y el cese de los órganos de gobierno de los centros docentes públicos no universitarios de las Illes Balears. De acuerdo con esta Orden, los directores pueden renovar su cargo hasta completar un total de tres periodos consecutivos de cuatro años (doce años).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.&nbsp;El artículo 139.3 de la LOE determina que los directores tienen que ser evaluados al acabar el periodo de ejercicio de su cargo. De acuerdo con el artículo 15 de la Orden de 18 de febrero de 2010, la inspección educativa es la encargada de evaluar la tarea realizada por los directores al final del periodo de ejercicio del cargo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El artículo 136.2 de la LOE determina que los criterios y los procedimientos de evaluación tienen que ser públicos y objetivos y tienen que incluir los resultados de las evaluaciones individualizadas, a las que hace referencia el artículo 144, realizadas durante el mandato, que, en todo caso, tienen que considerar los factores socioeconómicos y socioculturales del contexto y el seguimiento de la evolución en el tiempo. El artículo 7 del Decreto 81/2004, de 17 de septiembre, que regula la consolidación personal parcial del complemento retributivo específico por el ejercicio del cargo de director en los centros docentes públicos de las Illes Balears, establece los criterios para evaluar el ejercicio del cargo de director en centros docentes públicos no universitarios.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. De acuerdo con lo que se ha expuesto anteriormente, es necesario establecer el procedimiento de evaluación de los directores de los centros docentes públicos que finalizan el periodo de ejercicio de su cargo el 30 de junio de 2020 y el procedimiento que estos directores tienen que seguir para optar a continuar en el cargo durante un nuevo periodo de cuatro cursos escolares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley orgánica 8/1985, de 3 de julio, reguladora del derecho a la educación (BOE nº 159, de 4 de julio, y suplemento en catalán nº 7 de 1985).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;La Ley orgánica 2/2006, de 3 de mayo, de educación (BOE nº 106, de 4 de mayo, y suplemento en catalán nº 11, de 16 de mayo).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.&nbsp;El Decreto 36/2001, de 9 de marzo, por el que se regula la Inspección Educativa en el ámbito de la enseñanza no universitaria (BOIB nº 33, de 17 de marzo).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.&nbsp;El Decreto 81/2004, de 17 de septiembre (BOIB nº 134, de 25 de septiembre), modificado por el Decreto 136/2007, de 31 de octubre (BOIB nº 167, de 8 de noviembre), que regula la consolidación personal parcial del complemento retributivo específico por el ejercicio del cargo de director en los centros docentes públicos de las Illes Balears. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Orden del consejero de Educación y Cultura de 18 de febrero de 2010 por la que se aprueban las bases para la selección, el nombramiento y el cese de los órganos de gobierno de los centros docentes públicos no universitarios de las Illes Balears (BOIB núm. 30, de 23 de febrero, y corrección de errores publicada en el BOIB núm. 33, de 27 de febrero).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.&nbsp;La Resolución del consejero de Educación y Universidad de 15 de noviembre de 2017 por la que se establecen los criterios para determinar la tipología de los centros docentes públicos no universitarios y la asignación de equipos directivos (BOIB núm.152, de 14 de diciembre).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, y a propuesta del director general de Planificación, Ordenación y Centros, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Establecer el procedimiento que se tiene que seguir para evaluar a los directores de los centros docentes públicos no universitarios de las Illes Balears que acaban el periodo de ejercicio del cargo el 30 de junio de 2020 y quieren optar a seguir ejerciéndolo por un nuevo periodo, así como el procedimiento que estos directores tienen que seguir para optar a seguir en el cargo. Este procedimiento aparece descrito en el anexo 1 de esta Resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;Aplicar en el marco del proceso de renovación lo que prevé la Resolución del Consejero de Educación y Universidad de 15 de noviembre de 2017 per la cual se establecen los criterios para determinar la tipología de los centros docentes públicos no universitarios y la asignación de equipos directivos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.&nbsp;Hacer pública la relación de los centros y los directores afectados por esta Resolución, con la revisión de la tipología (anexo 2).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.&nbsp;Establecer los criterios de evaluación de la función directiva que se tienen que aplicar (anexo 3).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.&nbsp;Ordenar que esta Resolución se publique en el <em>Boletín Oficial de las Illes Balears</em> y determinar que entre en vigor al día siguiente de haberse publicado.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación, Universidad e Investigación en el plazo de un mes a contar desde el día siguiente al de su publicación en el BOIB, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">También se puede interponer directamente un recurso contencioso-administrativo ante la Sala Contenciosa del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de haberse publicado en el BOIB, de acuerdo con el artículo 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.</span></p> <p> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Palma, 21 de octubre de 2019</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>El consejero de Educación, Universidad e Investigación</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Martí X. Objeto</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta Resolución tiene por objeto fijar el procedimiento de evaluación de los directores de los centros docentes públicos no universitarios de las Illes Balears que figuran en el anexo 2 y el procedimiento que tienen que seguir para optar a continuar en el cargo durante un nuevo periodo de cuatro cursos escolares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El nombramiento por este nuevo periodo de ejercicio del cargo de director está condicionado a la evaluación positiva de la tarea desarrollada durante el periodo anterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2. Procedimiento de evaluación</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Departamento de Inspección Educativa tiene que evaluar la tarea desarrollada por los directores de los centros (que figuran en el anexo 2) de acuerdo con los criterios de evaluación (que se incluyen en el anexo 3) en un plazo de 90 días hábiles a contar desde el día siguiente de haberse publicado esta Resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El jefe del Departamento de Inspección Educativa tiene que designar a los inspectores responsables de la evaluación de cada director y lo tiene que notificar a los interesados. El inspector responsable puede contar con la colaboración de otros inspectores del Departamento para llevar a cabo las actuaciones derivadas del procedimiento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El procedimiento de evaluación tiene que constar, necesariamente, de los puntos siguientes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) La valoración del desarrollo de la tarea directiva a lo largo de todo el periodo de ejercicio del cargo de director.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Una entrevista o entrevistas con el director.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) La información contrastada de todos los sectores de la comunidad educativa del centro de referencia y el análisis de la documentación pertinente.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) La audiencia previa del director, referida a las conclusiones de la evaluación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Finalmente, el Departamento de Inspección Educativa tiene que emitir un informe motivado con la calificación global de la evaluación, positiva o negativa, que se tiene que enviar al director general de Planificación, Ordenación y Centros.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3. Comunicación de la opción de continuar en el cargo</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los directores de los centros docentes públicos que figuran en el anexo 2 disponen de un plazo de 15 días naturales a contar desde el día siguiente al de la publicación de esta Resolución para comunicar la opción de seguir ejerciendo el cargo por un nuevo periodo de cuatro años.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La opción de continuar en el cargo se tiene que comunicar al correo electrónico <em>autoritzacions@dgplacen.caib.es</em> mediante el modelo que figura en el anexo 4 de esta Resolución, que también se encuentra en la página web <em>http://dgplacen.caib.es</em>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4. Propuesta de actualización del proyecto de dirección</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.1. Los directores que hayan optado por continuar en el cargo tienen que elaborar la propuesta de actualización de su proyecto de dirección y la tienen que colgar en el programa de gestión de centro (GestIB) en el apartado Centro / Documentos institucionales / Proyecto de dirección, en un plazo de 60 días naturales a contar desde el día siguiente al de la publicación de esta Resolución, con el título <em>Actualización del PD (2020-2024)</em>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.2. De acuerdo con lo que establece el artículo 14.3 de la Orden del consejero de Educación y Cultura de 18 de febrero de 2010, la propuesta de actualización del proyecto de dirección tiene que incluir al menos una valoración relativa a la consecución de los objetivos planteados en el proyecto anterior, una propuesta de mejora y el planteamiento de nuevos objetivos para el periodo siguiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.3. El director tiene que dar a conocer la actualización de su proyecto de dirección al claustro y al consejo escolar.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.4. El proyecto de dirección tendrá vigencia durante el nuevo periodo de cuatro años de ejercicio del cargo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5. Nombramiento por un nuevo periodo</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El director general de Planificación, Ordenación y Centros tiene que proponer a la directora general de Personal Docente el nombramiento de los directores que hayan obtenido de la inspección educativa una evaluación positiva de la tarea desarrollada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Corresponde a la directora general de Personal Docente dictar la resolución de nombramiento, con efectos desde el 1 de julio de 2020 y por un periodo de cuatro años, de los directores que hayan obtenido una calificación global positiva en la evaluación. Contra esta resolución, que pone fin al procedimiento, se puede interponer un recurso de alzada ante el consejero de Educación, Universidad e Investigación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La directora general de Personal Docente y el director general de Planificación, Ordenación y Centros tienen que resolver todas las cuestiones que sean necesarias de forma pertinente para llevar a buen término lo que se prevé en esta Resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cuanto a la competencia para tramitar el procedimiento, de acuerdo con el Decreto 21/2019, de 2 de agosto (BOIB nº. 106, de 2 de agosto), modificado por el Decreto 22/2019, de 19 de agosto &nbsp;(BOIB nº. 116, de 24 de agosto), corresponden a la Dirección General de Planificación, Ordenación y Centros las competencias en materia de planificación educativa, coordinación, régimen orgánico y funcionamiento de los centros docentes.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px;
