2019-10-11 2019-10-15 CAIB 10132 2019-10-15 41723 41724 es ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El Concejal de Educación y Primera Infancia en fecha 10 de octubre de 2019, ha dictado la siguiente resolución:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Decreto del Concejal de Educación y Primera Infancia por el cual se conceden subvenciones para transporte a los estudiantes del Término Municipal de Ses Salines a otros centros escolares de enseñanza secundaria no obligatoria (exceptuando estudios universitarios) para el curso 2019-2020.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Antecedentes</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. El 5 de septiembre del año 2019 se publicó en el BOIB número 122 la Resolución del Concejal de Educación y Primera Infancia por la cual se convocan subvenciones para transporte a los estudiantes del Término Municipal de Ses Salines a otros centros escolares de enseñanza secundaria no obligatoria (exceptuando estudios universitarios) para el curso 2019-2020.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. En fecha 3 de octubre del año 2019 finalizaba el plazo para presentar solicitudes a dicha convocatoria. Y, una vez revisadas las solicitudes, todas ellas cumplen los requisitos establecidos y presentan completa, la documentación exigida en las Bases.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Fundamentos de derecho</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. La ley General de Subvenciones 38/2003, de 17 de noviembre y el reglamento que la desarrolla aprobado por Real Decreto 887/2006, de 21 de julio.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones de la Comunidad Autónoma de las Islas baleares ( BOIB núm. 196, de 31 de diciembre).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. El Decreto del Concejal de Educación y Primera Infancia de 3 de septiembre de &nbsp;2019 por el cual se convocan subvenciones para transporte a los estudiantes del Término Municipal de Ses Salines a otros centros escolares de enseñanza secundaria no obligatoria (exceptuando estudios universitarios) para el curso 2019-2020.(BOIB número 122, de 5 de septiembre de 2019).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">4. El artículo 6 y 15 de la Ordenanza General núm. 15, reguladora de subvenciones del Ayuntamiento de Ses salines (BOIB núm. 116, de 21 de agosto de 2004).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">5. Ley 39/2015, de 1 de Octubre, de procedimiento administrativo común de las administraciones públicas.</span></span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Resolución</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. Admitir todas las solicitudes presentadas, ya que todas ellas cumplen con los requisitos establecidos y aportan la documentación completa establecida en las Bases.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. Autorizar, disponer, reconocer la obligación y ordenar el pago de las ayudas económicas que se relacionan a continuación en el Anexo I, en concepto de subvenciones para transporte a los estudiantes del Término Municipal de Ses Salines a otros centros escolares de enseñanza secundaria no obligatoria (exceptuando estudios universitarios) para el curso 2019-2020, por un importe de 50 € (cincuenta euros), cada una de ellas con cargo a la aplicación presupuestaria 4422.481.00 del presupuesto de gastos 2019.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. Publicar la presente Resolución en <em>el Boletín Oficial de las Islas Baleares, </em>en la Base Nacional de Subvenciones, en el Tablón de anuncios del Ayuntamiento y en la página web del Ayuntamiento de Ses Salines (www.ajsessalines.net).</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Interposición de recursos</span></span></strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Contra la presente Resolución, que pone fin a la vía administrativa, se puede interponer un recurso potestativo de reposición ante el mismo órgano administrativo que dictó el acto, en el plazo de un mes desde el día siguiente a su publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">También se puede interponer directamente un contencioso-administrativo, ante el Juzgado Contencioso Administrativo de las Islas Baleares, en el plazo de 2 meses, desde el día siguiente a la publicación (art. 46.1 de la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción Contencioso-Administrativa).
