    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dª Emiliana Pérez García, Letrada de la Administración de Justicia, del Juzgado de Primera Instancia número cinco de Manacor, por el presente hago saber: que en este Juzgado se ha seguido procedimiento de Juicio Verbal de Desahucio por Precario 214/2018 entre BANKIA SA, ANGEL FERNANDEZ PAVO, MARIA DEL CARMEN CORDOBA ARROYO, OCUPANTES DESCONOCIDOS DE LA FINCA SITA EN CALLE VIA ARGENTINA Nº 44 DE FELANTIX, en el que se ha dictado Sentencia cuya &lt;strong&gt;PARTE DISPOSITIVA &lt;/strong&gt;es del tenor literal siguiente: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;"FALLO &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;QUE ESTIMANDO ÍNTEGRAMENTE LA DEMANDA interpuesta por BANKIA SA CONTRA LOS OCUPANTES DESCONOCIDOS DE LA FINCA SITA EN CALLE VIA ARGENTINA Nº 44 DE FELANTIX, 07200, posteriormente identificados D. ANGEL FENANDEZ DAVO Y DOÑA MARIA DEL CARMEN CORDOBA ARROYO ENTRE OTROS: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1º) DEBO DECLARAR Y DECLARO QUE LOS ACTUALES OCUPANTES DE LA FINCA SITA EN CALLE VIA ARGENTINA Nº 44 DE FELANTIX, 07200 LA OCUPAN SIN TÍTULO ALGUNO Y POR TANTO SE HALLAN EN SITUACIÓN DE PRECARIO, &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2º) QUE PROCEDE EL DESAHUCIO DE DICHOS OCUPANTES &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3º) QUE DEBO CONDENAR Y CONDENO A LOS DEMANDADOS Y A CUANTAS PERSONAS OCUPAREN LA FINCA CON ELLOS A DESALOJAR EL INMUEBLE DE LA PARTE DEMANDANTE DEJÁNDOLO LIBRE, VACUO Y EXPEDITO DENTRO DEL PLAZO QUE MARCA LA LEY, CON APERCIBIMIENTO DE LANZAMIENTO SI NO PROCEDEN AL DESALOJO VOLUNTARIO &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4º) CON EXPRESA IMPOSICIÓN DE LAS COSTAS CAUSADAS A LA PARTE DEMANDADA. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Notifíquese esta resolución a las partes, haciéndoles saber que contra la misma, cabe RECURSO DE APELACION en ambos efectos, que conforme al artículo 458 de la LEC (tras su redacción por la LEY 37/2011), se presentará directamente ante este juzgado en el plazo de VEINTE DÍAS contados a partir del siguiente a la notificación de la presente resolución, en el que se deberá exponer las alegaciones en que basen la impugnación, además de citar la resolución apelada y los pronunciamientos que impugnan, para su posterior sustanciación ante la Ilma. Audiencia Provincial de Palma de Mallorca. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para su interposición será necesario acompañar copia del resguardo de ingreso de 50 euros en la "Cuenta de Depósitos y Consignaciones" abierta a nombre de este Juzgado, requisito exigido por la Disposición Adicional 15ª de la LO 1/2009 de 3 de noviembre, sin cuyo requisito no se le dará trámite." &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Y como consecuencia del ignorado paradero de los &lt;strong&gt;OCUPANTES DESCONOCIDOS DE LA FINCA SITA EN CALLE VIA ARGENTINA Nº 44 DE FELANITX, 07200, y los posteriormente identificados D. ANGEL FERNANDEZ DAVO Y DOÑA MARIA DEL CARMEN CORDOBA ARROYO&lt;/strong&gt;, se extiende la presente para que sirva de cédula de notificación. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En MANACOR, a tres de mayo de dos mil diecinueve. &lt;/span&gt;&lt;/p&gt;
