    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 14&amp;nbsp;de noviembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para las Inversiones&amp;nbsp;en la Transformación y la comercialización de productos agrícolas, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;del FOGAIBA, con fecha 23&amp;nbsp;de agosto&amp;nbsp;de 2019, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;"INFORME PROPUESTA DE RESOLUCIÓN / RESOLUCIÓN DE REVOCACIÓN &lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 14&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/11/2015 se publicó en el BOIB núm. 168, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en la transformación y la comercialización de productos agrícolas&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;20/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;06&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2017 tuvo entrada en el Registro del GOBIERNO DE BALEARES, número registro 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;6&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;78&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2017, la solicitud de ayuda presentada por &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;FRANJA ROJA SL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;., &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;on NIF: &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;B-5&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;539249, para la convocatoria 2017_1.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Analizada toda la documentación presentada, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;12&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2018, el vicepresidente del FOGAIBA dictó Resolución de concesión de la ayuda, a cargo de la anualidad 201&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, a favor del interesado por un importe de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;44&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;241&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;84&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;€,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;que corresponde a una inversión aprobada de 107.055,93€, &amp;nbsp;cofinanciados en un 53,00% por el FEADER, 14,10% la AGE, y 32,90% la CAIB, distribuidos de la siguiente manera:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;23.448,18€ con cargo a la línea FEADER núm. 050460010441104&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;14.555,56€ con cargo a la CAIB&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.238,10€ con cargo a la AGE&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.El día &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;14/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;05/2019 interesado registró de entrada (reg&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;14808/2019) la solicitud de pago final de la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Revisados los documentos justificativos de los gastos realizados para llevar a cabo la actuación objeto de la ayuda el servicio gestor considera&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;a.Que la inversión "Depósitos" ha sido iniciada antes de la fecha de solicitud de ayuda, ya que la fecha de pago de la primera factura es de 06/05/2017 y por tanto no es una inversión admisible.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;b.Que el importe de la inversión justificada correctamente, descontando la inversión de depósitos, es de 20.934,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Con fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;28/05/2019 el Servicio de Ayudas al Desarrollo Rural ha emitido informe desfavorable y propuesta provisional de revocación total de la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;28/05/2019 se notifica al interesado, mediante publicación en la página web http://www.caib.es, dicha propuesta provisional, concediéndole un plazo de 10 días para presentar las alegaciones oportunas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 05.06.2019 (registro 16310/2019) el interesado presenta alegaciones a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a mencionada&amp;nbsp;propuesta provisional, dentro del plazo establecido.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Consideraciones jurídicas&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.El expediente se ha tramitado de acuerdo con la normativa reguladora de estas ayudas, según la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13 de noviembre de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en la transformación y la comercialización de productos agrícolas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. El punto 4 del apartado Cuarto de la Convocatoria establece que: "Sólo serán subvencionables los gastos realizados después de la presentación de la solicitud de ayuda, y en el caso de obra civil e instalaciones fijas, además de la visita previa de inspección por parte del órgano competente, in situ, que acredite que las inversiones no estaban iniciadas (excepto en el caso de los gastos previstos en el punto 2.c "costes generales", que se podrán realizar antes de la presentación de la solicitud), de conformidad con lo dispuesto en la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015 (...). La actuación subvencionada deberá haber sido realizada y pagada por el beneficiario en el período comprendido entre la fecha de comienzo del período de elegibilidad previsto en el párrafo anterior y el plazo previsto en el punto 1 del apartado undécimo de esta Resolución. "&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. De acuerdo con el punto 4 del Capítulo 3 de la parte I de las Directrices de la Unión Europea aplicables a las ayudas estatales en los sectores agrícola y forestal y en las zonas rurales de 2014 2020 (2014 / C 204/01): Las ayudas a los sectores agrícolas y forestal y a las zonas rurales solo podrán considerarse compatibles con el mercado interior si tienen efecto incentivador. Existe un efecto incentivador cuando la ayuda cambia el comportamiento de una empresa de tal modo que esta emprenda una actividad adicional que contribuya al desarrollo del sector, actividad que no habría realizado sin la ayuda, o que solo habría emprendido de una manera limitada o diferente. Sin embargo, la ayuda no debe subvencionar los costes de una actividad en los que la empresa habría incurrido en cualquier caso, ni debe compensar el riesgo empresarial normal de una actividad económica.”&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. De acuerdo con el punto 1 del apartado Décimo de la Convocatoria: "Son obligaciones de los beneficiarios las siguientes: Realizar las inversiones o actividades auxiliables durante el periodo establecido (...)"&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. De acuerdo con el punto 2 del apartado Undécimo de la Convocatoria: "La actuación subvencionada deberá estar realizada y pagada por el beneficiario en el período comprendido entre la fecha de comienzo del período de elegibilidad previsto en el apartado cuarto de la presente resolución y el plazo previsto en el punto anterior, que será también especificado en la resolución de concesión ."&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. De acuerdo con el punto 9 del apartado Undécimo de la Convocatoria: "Sin embargo, en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada, se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que la finalidad de la subvención, dada su naturaleza, sea susceptible de satisfacción parcial, y siempre y cuando se acerquen de modo significativo al cumplimiento total de los objetivos previstos y supongan al menos un 50% de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial."&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. La inversión "Depósitos" se pagó por el beneficiario, mediante transferencia bancaria, el día 05/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;06/2017, y la fecha de la solicitud de ayuda es de día &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;20.06.2017.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. El importe del proyecto aprobado es de 110.604,60 €, y que con la solicitud de pago presentada ha justificado correctamente 20.934,00 € de inversión, que supone el 18.93% de la inversión.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. El interesado alega:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1. “De la inversión “Depósitos”, un total de 25.677,60€ se realizó un anticipo a fecha de 05/06/2017, mientras que el resto de la misma se hizo con posterioridad a la fecha de la presentación de la solicitud de ayuda, puesto que era la única opción para que el proveedor de los depósitos nos asegurara su entrega en Septiembre 2017 para la vendimia...”&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. “Según establece el punto 4 del apartado Cuarto de la convocatoria, entendemos que sólo el anticipo realizado puede considerarse un gasto realizado con anterioridad a la presentación de la solicitud de ayuda, mientras que el resto, un total de 59.914,40€ sí que estan dentro del plazo establecido ”&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;El interesado admite que el anticipo se hizo antes de la solicitud de ayuda "para asegurar la entrega en septiembre". Esta convocatoria estaba abierta desde enero de 2017, por tanto el interesado podría haber presentado la solicitud antes de hacer el pedido, no hay ninguna justificación de haber comenzado la inversión o el pedido antes de presentar la solicitud.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Respecto a que sólo se debería considerar como gasto anterior a la solicitud la parte del anticipo pagada y aceptar el resto del gasto de depósitos, esto no es admisible ya que el pedido y pago anticipado forma parte del actuación en sí de adquisición de depósitos, y por lo tanto toda esta actuación está comenzada antes de la solicitud. A pesar el resto de pagos sean posteriores, la actuación no es admisible.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Se desestiman todas las alegaciones, considerando que la inversión se empezó en el momento de pagar el anticipo día 05/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;06&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;17, anterior a la fecha de la solicitud de ayuda (&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;20/06/17), por tanto toda la inversión de "Depósitos" se considera no admisible por incumplimiento del requisito de la Convocatoria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10.De &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ac&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ue&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;rd&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o&amp;nbsp;con el artículo 109 de la Ley 39/2015, de régimen jurídico de las administraciones públicas, las Administraciones públicas podrán revocar en cualquier momento sus actos, expresos o presuntos, no declarativos de derechos y los de gravamen, siempre que la revocación no sea contraria al ordenamiento jurídico.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11.De &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ac&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ue&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;rd&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o&amp;nbsp;con el artículo 43 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones, procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención; como consecuencia, queda sin efecto el acto de concesión.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Conclusión&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo lo expuesto anteriormente, se desestiman todas las alegaciones presentadas por el interesado. Se considera que se han incumplido los apartados 4.4, 10.1, 11.2 y 11.9 de la convocatoria, para presentar un justificante de gasto anterior a la solicitud de ayuda, por&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;no realizar las inversiones durante el plazo establecido, p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;or&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;no realizar &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;el gasto en el período de elegibilidad previsto, y por no justificar con justificantes admisibles un mínimo del 50% de la inversión aprobada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Se considera que la justificación del pago de la ayuda mediante facturas, extractos y justificación de transferencias dentro del plazo establecido constituye un requisito para el cobro de la ayuda concedida, y el incumplimiento de esta obligación, por no realizarse con los términos y en los plazos establecidos en la normativa, implica la posibilidad de revocar la ayuda otorgada a FRANJA ROJA SL, mediante la Resolución de concesión de 12/12/2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Asimismo, la no justificación correcta y admisible de, al menos, el 50% de la cantidad total de inversión aprobada en la resolución de concesión inicial, supone un incumplimiento de los compromisos adquiridos, y corresponde revocar toda la ayuda concedida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Además, en la solicitud de ayuda del interesado, de día 20/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;06&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2017, declaró "Que la inversión no está empezada en el momento de presentar esta solicitud." Al haber presentado un justificante de pago con fecha anterior demuestra que esta declaración no era cierta. El incumplimiento de un requisito (el no inicio de las actuaciones) es causa de revocación total de la ayuda, sin poder eliminar este hecho y tomar en consideración el resto de inversiones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;En virtud de cuanto antecede, dado el Decreto 64/2005, de 10 de junio, de creación del FOGAIBA; en virtud de la Orden de la Consejera de Agricultura y Pesca de 23 de diciembre de 2005 donde se dispone que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Informe-Propuesta de Revocación&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Se informa desfavorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Procedir a la revocación total de la resolución de ayuda concedida a FRANJA ROJA SL con NIF B-57539249, mediante Resolución de concesión del vicepresidente del FOGAIBA de día 12/12/2018, la cual concedía al interesado una ayuda para un importe de 44.241,84 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;El importe de la ayuda a revocar está cofinanciado por 53,00% por el FEADER, 14,10% la AGE, y 32,90% la CAIB, distribuidos de la siguiente manera:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.238,10 € con cargo a la AGE&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.En consecuencia, dejar sin efecto la mencionada resolución de concesión de la ayuda y proceder al archivo de las actuaciones del expediente ITC 2017_1 / 052.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Notificar esta resolución al interesado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Contra esta Resolución se podrá interponer recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con lo establece en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015 del procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
