![CDATA[<p><span style="display:none">&nbsp;</span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Aprobado por la Junta de Gobierno Local, en sesión ordinaria celebrada el día 17 de septiembre de 2019, se hace público a los efectos pertinentes lo siguiente:</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>"BASES ESPECÍFICAS DE LA CONVOCATORIA DEL PROCESO SELECTIVO PARA CUBRIR COMO PERSONAL FUNCIONARIO DE CARRERA TRES PLAZAS VACANTES DE LA CATEGORÍA DE POLICÍA LOCAL DEL AYUNTAMIENTO DE POLLENÇA MEDIANTE EL PROCEDIMIENTO EXTRAORDINARIO.</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>PRIMERA. Objeto de la convocatoria, procedimiento de selección y normativa</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La presente convocatoria tiene por objeto regular el proceso selectivo para proveer, como funcionarios de carrera, tres plazas de la categoría de policía local, vacantes y dotadas presupuestariamente, ocupadas por personal funcionario interino, correspondientes a la Oferta de Empleo Público del año 2018, por el sistema de acceso de turno libre. Estas plazas corresponden a la escala de Administración Especial, subescala de Servicios Especiales, clase policía local, Grupo de clasificación C1, del Ayuntamiento de Pollença.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. El procedimiento de selección será el de concurso-oposición mediante el procedimiento extraordinario de acceso a las plantillas de las policías locales de las Islas Baleares previsto en la disposición transitoria primera del Decreto ley 1/2017, de 13 de enero, de modificación de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, y de la Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Islas Baleares, y de medidas en materia de coordinación de las policías locales de las Islas Baleares.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. Se aplicarán a estas pruebas selectivas las presentes bases; de forma prevalente el Decreto ley 1/2017, de 13 de enero, de modificación de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, y de la Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Islas Baleares, y de medidas en materia de coordinación de las policías locales de las Islas Baleares; el Decreto 100/2012, de 7 de diciembre, por el que se establecen los criterios de revalidación y actualización de los diplomas de cursos de aptitud de los policías locales, así como la Ley 4/2013, de 17 de julio, de coordinación de las policías locales de las Islas Baleares, con la modificación efectuada por la Ley 11/2017, de 20 de diciembre; el Decreto 40/2019, de 24 de mayo, por el que se aprueba el Reglamento marco de coordinación de las policías locales de las Islas Baleares y se modifica el Decreto 55/2017, de 15 de diciembre, del Fondo de Seguridad Pública de las Islas Baleares en todo lo que no contradiga el Decreto ley 1/2017; el anexo 3 «Pruebas físicas» del Decreto 28/2015 de 30 de abril, por el que se aprueba el reglamento marco de coordinación de las policías locales de las Islas Baleares; el Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el Texto refundido de la Ley del Estatuto básico del empleado público; la Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Islas Baleares y el Acuerdo de Pleno del Ayuntamiento de Pollença respecto a los niveles de exigencia del conocimiento de la lengua catalana en los procedimientos selectivos de acceso a la función pública y para ocupar puestos de trabajo del Ayuntamiento de Pollença, así como las demás disposiciones legales aplicables a la policía local.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4. Las bases de esta convocatoria se publicarán en el Boletín Oficial de las Islas Baleares. En el Boletín Oficial del Estado se publicará el anuncio de la convocatoria que debe llevar la denominación de la escala y la categoría de las plazas convocadas, el número de plazas, el ayuntamiento que las convoca, el sistema de acceso, el procedimiento selectivo, los medios de impugnación y la fecha y número del Boletín Oficial de las Islas Baleares en el que se han publicado las bases.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>SEGUNDA. Requisitos de los aspirantes</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para ser admitidas en estas pruebas selectivas, los interesados ​​deben cumplir, en la fecha de finalización del plazo de presentación de solicitudes y durante todo el proceso selectivo, los requisitos siguientes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Tener la nacionalidad española.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Tener dieciocho años cumplidos.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Estar en posesión del título de bachillerato, técnico o equivalente, o estar en condiciones de obtenerlo en la fecha en la que finalice el plazo de presentación de solicitudes. En el caso de titulaciones expedidas en el extranjero, deberá aportar la correspondiente homologación del Ministerio de Educación y Formación Profesional.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Tener el diploma de aptitud del curso de formación básica de la categoría de policía local expedido por la EBAP o el órgano competente del ámbito de las Islas Baleares y en plena validez.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) No padecer enfermedad o defecto físico o psicofísico que impida o disminuya el desarrollo correcto de las funciones, en relación con el cuadro de las exclusiones que se determinan en el anexo 5 del Decreto 40/2019 de 24 de mayo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) No haber sido separado del servicio de la Administración local, autonómica o estatal, ni estar inhabilitado para el ejercicio de la función pública.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g) No tener antecedentes penales por delitos dolosos.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">h) Poseer los permisos de conducción de las clases A2 y B en vigor.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">i) Comprometerse a llevar armas y, en su caso, a utilizarlas, mediante una declaración jurada.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">j) Estar en posesión del nivel B2 (antes nivel B) del conocimiento de la lengua catalana. Los certificados serán los expedidos por la Escuela Balear de Administración Pública, o los expedidos u homologados por la consejería competente en materia de política lingüística, o los reconocidos según la Orden del consejero de Educación, Cultura y Universidades de 21 de febrero de 2013.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>TERCERA. Presentación de solicitudes</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Las solicitudes para tomar parte en el proceso selectivo se ajustarán al modelo normalizado de solicitud (Anexo IV) deberán dirigirse a la alcaldía y se presentarán en el Registro del Ayuntamiento. El modelo normalizado de solicitudes se encontrará a disposición de los interesados, en el Registro General de este Ayuntamiento, y en la página web www.ajpollenca.net, a partir de la apertura del plazo para su presentación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">También podrán presentarse por las formas previstas en el artículo 16 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas o, en las formas previstas en el artículo 38.4 de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, hasta que, de acuerdo con lo dispuesto en la disposición final séptima de la Ley 39/2015, de 1 de octubre, produzcan efectos las previsiones relativas al registro electrónico de apoderamientos, registro electrónico, punto de acceso general electrónico de la Administración y archivo único electrónico.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. El plazo general de presentación de solicitudes es de veinte días hábiles a partir del día siguiente a aquel en el que se publique la convocatoria en el Boletín Oficial del Estado. Cuando el último día del plazo sea inhábil se entenderá prorrogado al primer día hábil siguiente.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. Junto con la solicitud rellenada adecuadamente, las personas aspirantes deben adjuntar:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Una declaración responsable de que el aspirante cumple los requisitos exigidos en las bases, con referencia siempre a la fecha de expiración del plazo señalado para presentar las solicitudes.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Declaración, en su caso, de tener el certificado de superación de las pruebas de aptitud física de la EBAP en los términos que se establecen en el artículo 165.3 del Decreto 40/2019 a efectos de quedar exentas de hacer las pruebas físicas del proceso selectivo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso de que la persona aspirante solicite la exención de la prueba de aptitud psicológica y de personalidad en los términos establecidos en el anexo 1 punto 3 del Decreto Ley 1/2017, se deberá hacer constar y presentar la acreditación correspondiente junto con la solicitud.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No requieren presentación aquellos documentos que se encuentren en poder del Ayuntamiento convocante o se pueda comprobar la información por técnicas telemáticas según se regula en el artículo 28 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. En este último caso el interesado debe indicar en qué momento y ante qué órgano administrativo presentó los documentos mencionados, y las administraciones públicas deben solicitar electrónicamente a través de sus redes corporativas o de una consulta a las plataformas de intermediación de datos u otros sistemas electrónicos habilitados al efecto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Administración puede requerir del solicitante la aportación formal de la documentación sustituida por la declaración responsable en cualquier fase del procedimiento selectivo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Con la formalización y presentación de la solicitud, el aspirante da su consentimiento al tratamiento de los datos de carácter personal que son necesarios para tomar parte en la convocatoria y para el resto de la tramitación del proceso selectivo, de acuerdo con la normativa vigente en materia de Protección de Datos de Carácter Personal.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Los aspirantes quedarán vinculados a los datos que se hagan constar en su solicitud. El domicilio y teléfono que figuren en la misma se considerarán válidos a efectos de notificaciones, siendo responsabilidad exclusiva de los candidatos tanto los errores descriptivos, como la no comunicación durante el proceso de selección de cualquier cambio en los datos de la solicitud.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>CUARTA. Admisión y exclusión de las personas aspirantes</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Finalizado el plazo de presentación de solicitudes, en el plazo máximo de diez días hábiles, se publicará en el tablón de anuncios del Ayuntamiento y en la página web www.ajpollenca.net una resolución por la que se aprueba la lista provisional de personas admitidas y excluidas, con indicación de la causa de exclusión. En la resolución en la que se publique la lista provisional de admitidos y excluidos de las pruebas selectivas, deberá constar la fecha, la hora y el lugar en el que se llevarán a cabo los ejercicios de la fase de oposición con indicación de si deben llevarse a cabo en una o más sesiones, y con el intervalo mínimo entre ejercicio y ejercicio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo caso, con el fin de evitar errores y, si se producen, posibilitar su subsanación en tiempo y en forma, las personas interesadas tienen que comprobar no sólo que no figuran en la relación de personas excluidas sino que, además, sus nombres constan en la relación pertinente de personas admitidas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los aspirantes excluidos u omitidos dispondrán de un plazo de diez días hábiles, a contar desde el día siguiente de la mencionada publicación, para corregir el defecto o adjuntar el documento que sea preceptivo. En caso de que no se subsanen, dentro de este plazo, las deficiencias que hayan motivado su exclusión, la solicitud se tendrá por no presentada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Una vez finalizado el plazo a que se refiere el párrafo anterior y subsanadas, en su caso, las solicitudes, el alcalde dictará resolución, en el plazo máximo de diez días hábiles, de aprobación de la lista definitiva de personas admitidas y excluidas. Esta resolución se hará pública en los mismos lugares indicados para la resolución provisional.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El hecho de figurar en la relación de personas admitidas no prejuzgará que se les reconozca a las personas aspirantes la posesión de los requisitos exigidos para participar en el proceso selectivo. Si de la documentación que deben presentar al superarlo se desprende que no poseen alguno de los requisitos, perderán todos los derechos que pudieran derivarse de su participación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>QUINTA. El tribunal calificador</strong> (Art. 183 Decreto 40/2019)</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El órgano de selección es colegiado y la composición se ajustará a los principios de imparcialidad y profesionalidad de sus miembros y se debe respetar el principio de representación equilibrada de mujeres y hombres, salvo por razones fundadas y objetivamente motivadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La composición de los tribunales debe ser predominantemente técnica; todos los miembros deben tener titulación igual o superior a las exigidas para el acceso a las plazas convocadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El personal de elección o de libre designación política, el personal funcionario interino y el personal eventual no podrá formar parte de los órganos de selección. Tampoco pueden formar parte los representantes de los empleados públicos, sin perjuicio de las funciones de vigilancia del buen desarrollo del procedimiento selectivo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas representantes sindicales que participen en el procedimiento selectivo, con estas funciones de vigilancia y <span style="color:red">vela</span>, deben pertenecer a organizaciones sindicales que tengan la consideración de más representativas y que cuenten con más del 10% de representantes en el ámbito del municipio de la convocatoria, con un máximo de un representante por cada sindicato con el límite de cuatro miembros por cada procedimiento selectivo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La pertenencia a los órganos de selección será siempre a título individual; no se puede ejercer esta representación por cuenta ajena.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El Tribunal Calificador estará constituido por cinco miembros y el mismo número de suplentes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">a) Presidente o presidenta: designado por el ayuntamiento convocante entre el personal funcionario de carrera de experiencia reconocida.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">b) Vocales:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- un vocal propuesto por la Dirección General Emergencias e Interior, competente en materia de coordinación de policías locales, nombre de la persona titular y suplente</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- un vocal propuesto por la Escuela Balear de Administración Pública, nombre de la persona titular y suplente</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- un vocal designado por el ayuntamiento convocante, nombre de la persona titular y suplente.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Un secretario: persona designada por el ayuntamiento convocante con voz y voto, nombre de la persona titular y suplente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El tribunal no puede constituirse ni actuar sin la asistencia de más de la mitad de sus miembros, titulares o suplentes indistintamente, sin presidencia ni secretario. Las decisiones se adoptarán por mayoría.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El tribunal podrá acordar la incorporación, en las tareas, de personal asesor o especialistas en todas o alguna de las pruebas, que pueden actuar con voz pero sin voto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Los miembros del tribunal y los asesores deben abstenerse de intervenir cuando concurran las circunstancias previstas en el artículo 23 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público. Asimismo, deberán notificar esta circunstancia a la autoridad que los nombró.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La abstención y la recusación de los miembros del tribunal se regulará por los artículos 23 y 24 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, y los artículos 22 y 23 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Las decisiones adoptadas por el tribunal se pueden recorrer en las condiciones que establece el artículo 121 de la Ley 39/2015.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SEXTA. Fases del sistema de selección</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El procedimiento de selección es el de concurso oposición. El concurso oposición consiste en la realización sucesiva de las fases de oposición y de concurso, por este orden.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La fase de oposición consiste en la realización de las pruebas previstas en la convocatoria a fin de determinar la capacidad y la aptitud de los aspirantes. La fase de oposición tiene carácter eliminatorio y es necesario superarla para poder pasar a la fase de concurso.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La fase de concurso consiste en la valoración de los méritos que aleguen los aspirantes. Esta fase no tiene carácter eliminatorio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La puntuación total se obtiene de la suma de las puntuaciones en las dos fases. La puntuación de la fase de oposición representará un 60% de la puntuación alcanzable en el proceso selectivo. La fase de concurso representará un 40% del total de la puntuación alcanzable en el proceso selectivo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SÉPTIMA. Pruebas de la fase de oposición</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todas las pruebas de esta fase son de carácter obligatorio y eliminatorio. Es necesario superar la prueba anterior para poder pasar a la siguiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si alguna de las aspirantes no puede completar el proceso selectivo a causa de un embarazo de riesgo o de parto o puerperio, debidamente acreditados, su situación quedará condicionada a la finalización del proceso y a la superación de las fases que hayan quedado aplazadas, las cuales no se podrán demorar de forma que se menosprecie el derecho del resto de los aspirantes a una resolución del proceso ajustada a tiempos razonables, lo que deberá ser valorado por el Tribunal; en todo caso, las pruebas deberán llevarse a cabo antes de la publicación de la lista provisional de los aspirantes que hayan superado el proceso selectivo y que serán nombrados funcionarios en prácticas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Prueba de aptitud física</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tiene por objeto comprobar, entre otros aspectos, las condiciones de fuerza, agilidad, flexibilidad y resistencia de los aspirantes. Esta prueba consiste en la superación de las cinco pruebas parciales que se determinan en el anexo 3 del Decreto 40/2019, de 24 de mayo, por el que se aprueba el Reglamento marco de coordinación de las policías locales de las Islas Baleares, rectificado por Acuerdo de Consejo de Gobierno de 26 de julio de 2019 de corrección de errores (BOIB 103 de 07.27.19) (Anexo II). Las pruebas físicas se deben superar globalmente, de acuerdo con el baremo y los méritos que señala dicho anexo. El resultado global de esta prueba se otorgará siempre que el aspirante haya superado un mínimo de cuatro de las cinco pruebas parciales con una nota mínima de 5 o superior y que en la otra prueba parcial la nota sea igual o superior a 3. La nota media de apto se otorgará siempre que el resultado sea igual o superior a 5; si es inferior a 5, será de no apto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas que acrediten el certificado en vigor de aptitud física de la EBAP indicado en el artículo 163.3 del Decreto 28/2015, de 30 de abril, quedan exentas de hacer las pruebas físicas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las aspirantes que estén embarazadas o en periodo de posparto en la fecha de realización de las pruebas físicas, lo que impide o dificulta la realización de esta prueba, y siempre que lo acrediten mediante certificado médico, deben ponerlo en conocimiento del Tribunal Calificador, con carácter previo a la realización de la prueba o el ejercicio. En este caso llevarán a cabo el resto de las pruebas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si se superan estas, la calificación de la fase de oposición queda condicionada a la superación de las pruebas de aptitud física en la fecha que el Tribunal determine, una vez desaparecidas las causas que motivaron el aplazamiento. No se sumarán las dos fases si en una de las dos se obtiene una puntuación inferior a 10 puntos.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para aprobar este ejercicio será necesario obtener 20 puntos como mínimo.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que el Tribunal acuerde la anulación de alguna o algunas de las preguntas, por haber detectado de oficio algún error manifiesto durante la realización del ejercicio o porque éste se detecte como consecuencia de las alegaciones que posteriormente se presenten, se ajustará el valor de cada pregunta para conservar la puntuación máxima posible.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El tiempo para realizar este ejercicio es de 90 minutos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Prueba de aptitud psicológica y de personalidad</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta prueba consiste en la exploración psicotécnica para acreditar niveles de aptitudes y también en la exploración de la personalidad y actitudes de los aspirantes con el fin de determinar los perfiles generales y específicos que exige el ejercicio del puesto de trabajo policial.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El ejercicio consiste en responder a una prueba o pruebas de aptitud, personalidad y actitud de los aspirantes con el fin de determinar los perfiles generales y específicos que exige el ejercicio del trabajo policial propuestas por profesionales de la psicología que harán de asesores del Tribunal Calificador.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El resultado de esta prueba es en términos de apto o no apto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Están exentos de realizar esta prueba las personas que acrediten que en los últimos tres años han superado una prueba igual a la exigida en este apartado, lo que deberá acreditarse con la solicitud. Concretamente se consideran válidas las pruebas psicotécnicas del I y II macroproceso extraordinario de la CAIB.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>OCTAVA. Calificaciones de los ejercicios</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La calificaciones de los ejercicios deberán hacerse públicas el día que se acuerden y deberán publicarse en el tablón de anuncios del Ayuntamiento así como en la página web (www.ajpollenca.net). Los aspirantes podrán presentar por escrito en el registro del Ayuntamiento en el plazo de tres días hábiles a contar desde el día siguiente a la publicación del resultado de cada ejercicio, las observaciones o alegaciones que consideren oportunas, que deberán ser resueltas de forma motivada por el Tribunal en todo caso antes de las 48 horas previas al inicio del ejercicio siguiente. A los efectos señalados, se facilitará la vista de los ejercicios de los opositores.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Relación provisional de personas aprobadas y revisión de exámenes</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Finalizados todos los ejercicios de la fase de oposición, el tribunal hará pública en el tablón de anuncios del Ayuntamiento y en la página web (www.ajpollenca.net) la lista provisional de personas que lo hayan superado, con indicación del DNI y de la puntuación obtenida. La relación de personas que han superado la fase de oposición será determinada por la superación de todos los ejercicios eliminatorios. La puntuación final de la fase de oposición de cada aspirante será el resultado de la suma de las puntuaciones obtenidas en los ejercicios eliminatorios.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que dos o más aspirantes obtuvieran la misma calificación total, se deshará el empate sucesivamente siguiendo estos criterios: la puntuación otorgada al segundo ejercicio; si persiste, la puntuación del primer ejercicio y, si persiste, el Tribunal lo resolverá por sorteo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los aspirantes dispondrán de un plazo de 10 días hábiles, a contar desde la publicación de las listas provisionales, para hacer reclamaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Terminado este plazo, el Tribunal dispondrá de 7 días hábiles para resolver las reclamaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Lista definitiva de personas aprobadas en la fase de oposición</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resueltas las reclamaciones, el Tribunal publicará en el tablón de anuncios del Ayuntamiento y en la página web (www.ajpollenca.net) las listas definitivas de aprobados en la fase de oposición.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>NOVENA. Fase de concurso</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La fase de concurso constituirá un 40% del proceso selectivo. El baremo de méritos de la fase de concurso del concurso oposición es el que figura en el anexo I.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Alegación y acreditación de los méritos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el plazo de diez días hábiles contados a partir del día siguiente al de la publicación de las listas definitivas de aprobados de la fase de oposición, los aspirantes que formen parte de las mismas tienen que alegar y acreditar ante el Tribunal Calificador, según el modelo del anexo V, los méritos que se indiquen en el anexo I, mediante documentos originales o fotocopias compulsadas en el registro del Ayuntamiento o en cualquier otra de las formas establecidas en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los méritos se acreditarán y se valorarán siempre con referencia a la fecha de finalización del plazo de presentación de solicitudes en el procedimiento selectivo. En ningún caso se valorarán méritos que no hayan sido alegados y presentados en la forma establecida durante este plazo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que alguno de los méritos esté en poder del ayuntamiento convocante, los aspirantes pueden solicitar que se incorpore de oficio a la solicitud un extracto de los que figuran en el expediente personal con referencia al último día del plazo de presentación de la solicitud en el procedimiento selectivo. Relación de aprobados</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Listas de aspirantes seleccionados del concurso oposición</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Finalizada por parte del Tribunal la valoración de los méritos aportados se harán públicas en el tablón de anuncios del ayuntamiento y en la página web del ayuntamiento (www.ajpollenca.net) las listas provisionales de puntuaciones obtenidas en la fase de concurso, así como la lista provisional de aspirantes seleccionados del concurso oposición. Los aspirantes dispondrán de cinco días hábiles para hacer reclamaciones, a contar desde la publicación de las listas provisionales.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las reclamaciones presentadas serán resueltas por el Tribunal en un plazo de siete días hábiles.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Relaciones definitivas de las puntuaciones de la fase de concurso y relación definitiva de aspirantes que han superado el proceso selectivo</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Resueltas las reclamaciones, el Tribunal debe aprobar la relación definitiva de las puntuaciones de la fase de concurso y la relación definitiva de aspirantes que han superado el proceso selectivo, publicándola en el tablón de anuncios del ayuntamiento y en la página web del ayuntamiento <span style="color:null">(www.ajpollenca.net</span>)</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">La relación contendrá, como máximo, tantas personas aprobadas como plazas se convocan. Esta relación será elevada al órgano competente para su aprobación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La aprobación de la relación de aspirantes que han superado el proceso selectivo y que serán nombrados como funcionarios en prácticas será publicada en el Boletín Oficial de las Islas Baleares y en la página web del ayuntamiento (www.ajpollenca.net )</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sin embargo, con el fin de asegurar la cobertura de las plazas convocadas, cuando haya renuncias de aspirantes seleccionados antes del nombramiento como funcionario en prácticas o bien los que se han propuesto no cumplen alguno de los requisitos de la base 2, el Tribunal elevará al órgano convocante una relación complementaria de los aspirantes que vayan a continuación de las propuestas, por orden de puntuación, para su posible nombramiento como personal en prácticas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Presentación de documentación de las personas que han superado el proceso selectivo</strong><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Las personas aspirantes disponen de un plazo de veinte días hábiles, desde la fecha de publicación de la aprobación de la relación de aspirantes que han superado el proceso selectivo, para presentar en el Ayuntamiento los documentos que acrediten que cumplen los requisitos que exige la convocatoria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El incumplimiento de este plazo o el hecho de que del examen de la documentación presentada se deduzca que los aspirantes no cumplen los requisitos que se exigen en la convocatoria, supondrá la pérdida del derecho a ser nombrados funcionarios en prácticas y quedarán sin efecto todas las actuaciones anteriores relativas a su nombramiento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>UNDÉCIMA. Fase de prácticas en el Ayuntamiento</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La persona o personas que superen el proceso selectivo y acrediten que cumplen los requisitos que exige la convocatoria serán nombrados funcionarios en prácticas de la categoría de policía local por el alcalde/alcaldesa al inicio de este periodo. En ningún caso puede ser nombrado personal funcionario en prácticas un número de personas superior al de plazas convocadas por el Ayuntamiento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El período de prácticas tendrá una duración de seis meses.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las personas aspirantes que no superen el período de prácticas de acuerdo con el procedimiento de calificación previsto en la convocatoria, perderán el derecho a su nombramiento como funcionarios de carrera, mediante resolución motivada de la autoridad que haya hecho la convocatoria, a propuesta del órgano responsable de la evaluación del período de prácticas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los funcionarios en prácticas recibirán las retribuciones que correspondan a la categoría de las prácticas de acuerdo con lo dispuesto en el artículo 34 bis de la Ley 4/2013, modificada por la Ley 11/2017, de 20 de diciembre.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El tribunal calificador elevará al alcalde/alcaldesa la lista definitiva de las personas aspirantes declaradas aptas y no aptas, quien resolverá y ordenará su publicación en el plazo de quince días hábiles. Dicha resolución, que agota la vía administrativa, se puede recurrir en los términos que establece el artículo 123 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que alguna de las personas aspirantes sea calificada como no apta en la fase de prácticas, en la misma resolución se requerirá a las personas aspirantes resultantes del proceso selectivo que hayan aprobado todas las pruebas y no hayan obtenido plaza por orden de puntuación del concurso oposición, para ser nombrada funcionaria en prácticas. Dicha resolución, que agota la vía administrativa, se puede recurrir en los términos que establece la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DUODÉCIMA. Valoración de la fase de prácticas en el municipio</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Las prácticas tienen por objeto valorar la aptitud para ejercer las funciones propias de la categoría de policía. font-size:12px"><strong>5.- Valoración de los cursos de formación</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sólo se valorarán los diplomas o certificados de actividades formativas y cursos impartidos por la Escuela Balear de Administración Pública, las universidades, las escuelas universitarias y las entidades promotoras de formación continua y también los impartidos en otros centros de formación oficial de seguridad pública o cualquier administración pública, siempre que estén debidamente documentados y expedidos por la entidad correspondiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cuanto a los cursos o actividades expresados ​​en créditos se entiende que cada crédito equivale a 10 horas, salvo los créditos ECTS que equivaldrán a 25 horas. En caso de que los cursos indiquen créditos y horas tendrán preferencia las horas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.1 Formación relacionada con el área profesional.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se valoran, para cada puesto de trabajo, las acciones formativas siempre que estén directamente relacionadas con las funciones propias del puesto al que se accede.
