    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Una de las maneras en que el ordenamiento jurídico español articula la participación de todos los ciudadanos en los asuntos públicos es mediante las organizaciones de carácter económico y social cómo son los sindicatos y las asociaciones empresariales, organizaciones que contribuyen a la defensa y la promoción de los intereses económicos y sociales que le son propios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Así, la Constitución española en su artículo 7 otorga trascendencia política a estas organizaciones y dispone que contribuyan a la defensa y la promoción de los intereses económicos y sociales, mientras que en el artículo 9.2 determina que corresponde a los poderes públicos promover las condiciones para hacer efectivas la libertad y la igualdad de los individuos y de los grupos a los cuales pertenecen, a la vez que deben facilitar la participación de la ciudadanía en la vida política, económica, cultural y social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por su parte, el Estatuto de autonomía de las Illes Balears declara igualmente el valor de la concertación social y la participación de los interlocutores en la vida administrativa pública y su contribución a la satisfacción de los intereses generales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Este reconocimiento de la participación institucional de las organizaciones empresariales y sindicales se enmarca en la línea de facilitar procesos de concertación y diálogo social, de forma que se trata de tener en cuenta los agentes sociales para adoptar medidas que afectan al conjunto de la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En este sentido, la Organización Internacional del Trabajo indica que el diálogo social incluye todo tipo de negociaciones y consultas entre representantes de los gobiernos, los empresarios y los trabajadores sobre temas de interés común relativos a las políticas económicas y sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por lo tanto, resulta incuestionable la importancia de la participación institucional por medio del diálogo social con los representantes de los empresarios y de los trabajadores al objeto de tener en cuenta sus experiencias y opiniones, y así conseguir su plena cooperación y apoyo en la ejecución de la tarea política en todos los sectores productivos, pero resulta especialmente esencial en un sector tanto relevante en la economía de las Islas Baleares como es el de la hostelería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por este motivo, el Gobierno de las Illes Balears y las organizaciones empresariales más representativas de los sectores de la hostelería y de la restauración han considerado necesario iniciar un conjunto de actuaciones destinadas a la mejora de las condiciones de trabajo de los trabajadores y trabajadoras de los sectores indicados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Con este objetivo, después de abrir negociaciones dirigidas a la consecución de un diálogo entre el Gobierno y los agentes sociales para mejorar las condiciones de trabajo, se han logrado sendos acuerdos, uno de ellos para el trabajo de calidad en el sector de la hostelería de las Illes Balears, y el otro para la ocupación de calidad y la lucha contra la competencia desleal en el sector de la restauración de las Illes Balears. Ambos acuerdos integran un pacto de naturaleza bilateral entre las organizaciones sindicales y empresariales de las áreas de la hoteleria y la restauración, y otro de carácter tripartito entre la Consejería de Trabajo, Comercio e Industria y las organizaciones sindicales y empresariales de las áreas indicadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En base a esta participación institucional se aprueba esta convocatoria, que tiene por objeto apoyar al diálogo social de las organizaciones empresariales y sindicales firmantes de los acuerdos mencionados con el fin de hacer el seguimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La Orden de consejero de Trabajo y Formación, de 4 de mayo de 2005, modificada por la Orden de la consejera de Trabajo y Formación de 16 de julio de 2008, establece las bases reguladoras en materia de trabajo y formación (BOIB núm. 104, de 26 de julio) y, en los apartados 2.2 y 2.3 del artículo 1, incluye el fomento del hecho sindical y la participación institucional de las organizaciones empresariales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;De conformidad con el artículo 37.2 del Texto refundido de la Ley de subvenciones, aprobado por medio del Decreto legislativo 2/2005, de 28 de diciembre, en la redacción hecha por la Ley&amp;nbsp;18/2016, de 28 de diciembre, antes mencionada, el consejero de Modelo Económico, Turismo y Trabajo&lt;strong&gt; &lt;/strong&gt;puede autorizar el pago anticipado de la subvención hasta un máximo del 75&amp;nbsp;% del importe de la subvención con las garantías que correspondan, siempre que la entidad beneficiaria acredite que no dispone de recursos suficientes para financiar transitoriamente la ejecución de la actividad que se subvenciona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;De acuerdo con el artículo 14.2 del Texto refundido de la Ley de subvenciones, aprobado por medio del Decreto legislativo 2/2005, de 28 de diciembre (BOIB núm. 196, de 31 de diciembre), el procedimiento para conceder las subvenciones se iniciará siempre de oficio mediante convocatoria cuando la selección de los posibles beneficiarios deba hacerse en régimen de concurrencia. El artículo 15 del mismo Texto refundido establece el contenido mínimo de la convocatoria de ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por otra parte, el artículo 3 de la Orden de bases ya mencionada establece que las correspondientes convocatorias se aprobarán mediante una resolución de la consejera o del consejero competente en materia de trabajo y formación, y se publicará en &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Estas subvenciones se han incluido en la línea IV.1.2 del objetivo IV del Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para los ejercicios 2018-2020, aprobado por el Acuerdo del Consejo de Gobierno de 9 de marzo de 2018 (BOIB núm. 31, de día 10).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por todo ello, de acuerdo con los preceptos indicados, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La presente resolución tiene por objeto aprobar la convocatoria de concesión de ayudas destinadas a apoyar la participación institucional de las organizaciones sindicales y de las organizaciones empresariales firmantes del Acuerdo para la ocupación de calidad en el sector de la hostelería de las Islas Baleares, y del Acuerdo para la ocupación de calidad y la lucha contra la competencia desleal en el sector de la restauración de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Bases reguladoras&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las ayudas previstas en esta convocatoria se rigen por la Orden de consejero de Trabajo y Formación de 4 de mayo de 2005, por la que se establecen las bases reguladoras de las subvenciones en materia de trabajo y formación, modificada por la Orden de la consejera de Trabajo y Formación de 16 de julio de 2008 (BOIB núm. 104, de 26 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Partidas presupuestarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Las ayudas concedidas se abonarán con cargo a la partida presupuestaria 19601 322B01 48000.00 de los presupuestos generales de la comunidad autónoma de las Illes Balears para el año 2019, por un importe total de doscientos mil euros (200.000&amp;nbsp;€).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Ámbito temporal de la convocatoria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las actividades objeto de subvención se deben llevar a cabo entre el 1 de noviembre de 2018 y el 31 de octubre de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quinto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Entidades beneficiarias y requisitos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Las entidades beneficiarias son las organizaciones sindicales y empresariales firmantes del Acuerdo para la ocupación de calidad en el sector de la hostelería de las Illes Balears y del Acuerdo para la ocupación de calidad y la lucha contra la competencia desleal en el sector de la restauración de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Los requisitos que deben acreditar las entidades solicitantes son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) No estar sometidas a ninguna de las prohibiciones para ser beneficiarias de las ayudas establecidas en el artículo 10 del Texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Estar al corriente de las obligaciones con la Seguridad Social antes de dictar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) Estar al corriente de las obligaciones tributarias con el Estado y con la comunidad autónoma de las Illes Balears antes de dictar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Sexto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Acción y gastos subvencionables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. La acción subvencionable consiste en el apoyo a la participación institucional de las organizaciones empresariales y sindicales firmantes del Acuerdo para la ocupación de calidad en el sector de la hostelería de las Islas Baleares, y del Acuerdo para la ocupación de calidad y la lucha contra la competencia desleal en el sector de la restauración de las Islas Baleares, al objeto de hacer el seguimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Se pueden subvencionar los siguientes gastos, relacionadas con la participación institucional de las organizaciones empresariales y sindicales firmantes de los Acuerdos mencionados:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Gastos de personal, excepto las indemnizaciones por despidos y jubilaciones anticipadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Alquileres de las sedes de los sindicatos y de las organizaciones empresariales y sindicales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) Reparaciones, mantenimiento y conservación de instalaciones y de equipos de oficina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;d) Gastos de suministros y comunicaciones (agua, luz, teléfono, Internet, correo, mensajería y similares).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;e) Gastos correspondientes a material de oficina, equipamientos, servicios, suscripción a publicaciones y primas de seguros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;f) Gastos de desplazamiento, manutención y alojamiento de los representantes de las entidades solicitantes originadas por la participación institucional indicada, a quienes son aplicables los límites sobre indemnizaciones por razón del servicio para el personal funcionario de la Administración autonómica de acuerdo con la categoría que corresponda. En ningún caso se considerarán subvencionables los gastos de representación o por asistencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;g) Gastos correspondientes a jornadas, seminarios, encuentros, mesas redondas, conferencias y actividades similares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;h) Gastos correspondientes a servicios prestados por personas ajenas a las entidades solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;i) Gastos de comunicaciones, publicidad y propaganda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;j) Cualquier otro gasto necesario para la participación institucional de las entidades solicitantes relacionadas con el seguimiento de los acuerdos de referencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Séptimo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. La cantidad asignada a esta convocatoria se repartirá en dos partes iguales entre las organizaciones empresariales y sindicales firmantes del Acuerdo para la ocupación de calidad en el sector de la hostelería de las Islas Baleares, y del Acuerdo para la ocupación de calidad y la lucha contra la competencia desleal en el sector de la restauración de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Los 100.000&amp;nbsp;€ que corresponden a las dos organizaciones sindicales firmantes de los acuerdos mencionados se repartirán en partes iguales entre estas, de forma que corresponden 50.000&amp;nbsp;€ a cada una.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Los 100.000&amp;nbsp;€ que corresponden a las organizaciones empresariales firmantes de los acuerdos indicados se deben distribuir de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Una ayuda mínima lineal de 73.000&amp;nbsp;€ a repartir a partes iguales entre las dos organizaciones empresariales firmantes de los acuerdos mencionados, de forma que corresponden 36.500&amp;nbsp;€ a cada una.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Los 27.000&amp;nbsp;€ restantes asignados a las organizaciones empresariales, una vez deducida la ayuda mínima lineal señalada en el párrafo anterior, se deben distribuir en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.º La cantidad resultante de la minoración indicada se debe dividir por el número total de representantes de las entidades firmantes de los acuerdos mencionados presentes en la constitución de la Comisión Negociadora del XV Convenio colectivo sectorial de la hostelería de la Comunidad Autónoma de las Illes Balears, según el acta de constitución correspondiente, momento en que las partes negociadoras se reconocen como tales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.º El valor medio de cada representante se debe multiplicar por el número de representantes de cada entidad firmante de los acuerdos mencionados presentes en la constitución de la Comisión Negociadora indicada en el párrafo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) La cuantía total de la ayuda será la suma de los importes que correspondan a cada entidad en concepto de mínimo lineal y de incremento previstos en las letras &lt;em&gt;a)&lt;/em&gt; y b) de este apartado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. La falta de solicitud de las ayudas o el incumplimiento de los requisitos por alguna o algunas de las posibles entidades beneficiarias previstos en el apartado quinto no implica el incremento de las ayudas para el resto de entidades solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Octavo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. El plazo para presentar las solicitudes es de quince días a partir del tercer día hábil siguiente a la publicación de esta convocatoria en &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Los modelos oficiales de solicitud de las ayudas se pueden obtener a la Dirección general de Trabajo y Salud Laboral, de la Consejería de Modelo Económico, Turismo y Trabajo, ubicada en la plaza de Son Castelló, 1, de Palma, y también en el web de la Consejería, a la dirección de Internet &lt;span style="color:#000000"&gt;&amp;lt;&lt;/span&gt;&lt;span style="color:#0000ff"&gt;&lt;span style="color:#000000"&gt;https://www.caib.es/seucaib/es/tramites/tramite/3885690&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Las solicitudes se presentarán en el Registro General de la Consejería de Modelo Económico, Turismo y Trabajo, o por cualquiera de las formas previstas en derecho de acuerdo con el artículo&amp;nbsp;16.4 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;De conformidad con el artículo 14.2 de la Ley 39/2015, están obligados a relacionarse a través de medios electrónicos con las administraciones públicas para efectuar cualquier trámite de este procedimiento administrativo, al menos, los sujetos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) &lt;/em&gt;Las personas jurídicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) &lt;/em&gt;Las entidades sin personalidad jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c) &lt;/em&gt;Quienes representen un interesado que esté obligado a relacionarse electrónicamente con la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:100%"&gt;De acuerdo con el artículo 68.4 de la Ley 39/2015, si alguno de los sujetos a los que hace referencia el artículo 14.2 presenta su solicitud presencialmente, las administraciones públicas requerirán al interesado para que la subsane a través de su presentación electrónica. A estos efectos, se considerará como fecha de presentación de la solicitud aquella en la que haya sido realizada la subsanación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Las entidades solicitantes deben efectuar la petición de la ayuda por medio de quien las represente legalmente, con la acreditación adecuada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Si la solicitud no cumple los requisitos legales y los exigidos en la Orden de bases reguladoras y esta convocatoria, se requerirá a la entidad interesada para que, en el plazo de diez días, subsane la deficiencia o aporte los documentos preceptivos, con indicación de que, si así no lo hiciera, se le tendrá por desistido de su petición, previa resolución que deberá ser dictada en los términos previstos en el artículo 21 de la Ley&amp;nbsp;39/2015 antes mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Noveno&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Documentación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Junto con la solicitud, se deben adjuntar los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Documento fehaciente que acredite la representación de la persona que actúa en nombre de la entidad solicitante. La representación se puede acreditar por cualquier forma válida en derecho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Estatutos de la entidad solicitante, excepto que consten actualizados en el Registro de Asociaciones Empresariales y Sindicales de la Dirección general de Trabajo y Salud Laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) Acreditación de no estar sometido a ninguna de las prohibiciones establecidas en los apartados 1 y 2 del artículo 10 de la Ley de subvenciones, aprobada mediante Decreto legislativo 2/2005, de 28 de diciembre, que se deberá realizar según lo previsto en el apartado 6 del mismo artículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;d) En cuanto al requisito previsto en el punto 2.&lt;em&gt;b)&lt;/em&gt; y 2.&lt;em&gt;c)&lt;/em&gt; del apartado quinto de la Resolución de convocatoria, la solicitud de las ayudas implica la autorización para que la Consejería de Modelo Económico, Turismo y Trabajo pueda obtener información sobre el cumplimiento de las obligaciones con la Seguridad Social y de las obligaciones tributarias con el Estado y con la Comunidad Autónoma de las Illes Balears. No obstante, la entidad solicitante también puede aportar los certificados correspondientes de la Tesorería General de la Seguridad Social y de la Agencia Estatal de la Administración Tributaria que acrediten que se encuentra al corriente de dichas obligaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;e) Justificación que la entidad solicitante no dispone de recursos suficientes para financiar la ejecución de la actividad que se subvenciona, en caso de que la entidad solicite el pago anticipado del 75&amp;nbsp;% del importe de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;f) Justificación de las circunstancias excepcionales que permiten hacer el pago anticipado sin exigencia de ninguna garantía previa, en el supuesto de que así lo solicite la entidad interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;g) Declaración responsable de las persones representantes orgánicas o voluntarias de la entidad solicitante en que se exprese el compromiso incondicional que la ayuda que se concede se destinará a la participación institucional de la entidad en las comisiones de seguimiento respectivas de los acuerdos mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;h) Declaración responsable de veracidad de datos bancarios, debidamente rellenada y firmada según el modelo que se puede encontrar en la dirección de Internet &amp;lt;&lt;span style="color:#0000ff"&gt;&lt;span style="color:#000000"&gt;http://www.caib.es/sacmicrofront/archivopub.do?ctrl=MCRST4786ZI161593&amp;amp;id=161593&lt;/span&gt;&lt;/span&gt;&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Décimo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Régimen de concesión de las ayudas &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;De acuerdo con el artículo 5.5 de la Orden de bases reguladoras, la concesión de las ayudas se realizará en régimen de concesión directa, dado que no son necesarias la comparación ni la prelación de todas las solicitudes entre sí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Undécimo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Instrucción y resolución del procedimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. El órgano competente para instruir el procedimiento de tramitación de solicitudes es la Dirección General de Trabajo y Salud Laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. De conformidad con el artículo 7 de las bases reguladoras, las solicitudes de ayudas deben ser resueltas motivadamente por el consejero de Modelo Económico, Turismo i Trabajo, previa propuesta de la directora general de Trabajo y Salud Laboral, y con el informe de la técnica o del técnico competente. En las resoluciones de concesión se fijará con carácter definitivo la cuantía individual de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. El plazo máximo para dictar y notificar la resolución es de tres meses a contar desde la finalización d&lt;span style="color:#000000"&gt;el periodo de presentación de solicitudes&lt;/span&gt;. Transcurrido dicho plazo sin dictarse resolución expresa, la solicitud deberá entenderse desestimada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. La notificación de la resolución se realizará con las exigencias y en la forma que establecen los artículos 40 y siguientes de la Ley 39/2015, de 1 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Duodécimo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Concurrencia de ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. La percepción de las ayudas que establece esta convocatoria es compatible con otras ayudas o subvenciones que reciba la entidad beneficiaria de cualquier Administración pública u otras entidades públicas o privadas que aisladamente o en concurrencia con estas, sean destinadas a las mismas acciones que son objeto de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. En todo caso, cuando las ayudas de esta convocatoria se tengan que compatibilizar con otras subvenciones y ambas se concedan a una misma entidad beneficiaria para idéntica finalidad, su importe no puede alcanzar una cuantía que, aislada o conjuntamente con subvenciones o ayudas de la misma o de otra Administración, o de otras entidades públicas o privadas, supere el coste de la actividad que el beneficiario debe llevar a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimotercero&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Justificación y pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. De acuerdo con el artículo 37.2 del Texto refundido de la Ley de subvenciones, se podrá abonar el 75&amp;nbsp;% de la subvención concedida una vez que la entidad beneficiaria certifique que se han iniciado las actuaciones que se subvencionan y siempre que acredite ante la Consejería de Modelo Económico, Turismo y Trabajo que no dispone de recursos suficientes para financiar transitoriamente la ejecución de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. De conformidad con el artículo 25.3.b) del Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears, en relación con el citado artículo 37.2 del Texto refundido de la Ley de subvenciones, el consejero de Modelo Económico, Turismo y Trabajo podrá eximir a la entidad beneficiaria de presentar garantía siempre que concurran circunstancias excepcionales que así lo aconsejen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. El 25&amp;nbsp;% restante del importe de la subvención concedida, o el 100&amp;nbsp;% en el supuesto de que no se haya concedido el pago anticipado, se abonará a la entidad beneficiaria una vez que se haya justificado el importe total concedido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. La entidad beneficiaria de la subvención está obligada a justificar la aplicación de los fondos a la finalidad que sirvió de fundamento para conceder la subvención en los términos que dispone el artículo 39 del Texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. La justificación se documentará mediante la cuenta justificativa, que se compondrá de los siguientes documentos, de conformidad con los modelos que se adjuntan a la presente convocatoria como anexo 1:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Memoria de las actividades llevadas a cabo y de los criterios objetivos de imputación, para la correcta comprensión de la actividad efectivamente realizada y su relación con el proyecto presentado por el beneficiario y aprobado por la Administración. Además, la memoria debe incluir toda la información necesaria para la correcta interpretación y comprensión de la justificación de gastos presentada y su imputación al proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Relación de los justificantes imputados, mediante una lista numerada, ordenada sistemáticamente según la naturaleza del gasto y que detalle todos los documentos que permitan la acreditación del cumplimiento de las condiciones impuestas de la subvención, así como su coste.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) Documentación justificativa de los gastos efectuados por un importe igual o superior al presupuesto presentado junto con la solicitud, previsto en el apartado noveno, letra &lt;em&gt;g)&lt;/em&gt;, que debe incluir una copia compulsada de las facturas y de los demás documentos de valor probatorio equivalentes y ajustarse a las previsiones establecidas en el Real Decreto 1496/2003, de 28 de noviembre, por el que se aprueba el Reglamento del IVA &lt;span style="color:#000000"&gt;(BOE núm. 286, de 29 de noviembre). Además, se adjuntarán los justificantes de pago de las facturas, como pueden ser los extractos o los certificados bancarios destacados convenientemente o recibos de los proveedores en los que conste la fecha, el sello, la razón o la denominación social, y el NIF o CIF del proveedor y la firma y la identificación de la persona que lo firma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. En cualquier justificante que no sea imputable en el 100&amp;nbsp;% de su importe, se acompañará un escrito en el que se detalle el criterio de imputación usado para hacer el cálculo. En el caso de modelos de cotización a la Seguridad Social, cuando la justificación no incluya la totalidad de los trabajadores se presentará, junto con los boletines de cotización, una relación exclusiva de los trabajadores cuyos gastos se imputan y se indicarán con detalle los cálculos efectuados, porcentajes aplicados, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. De acuerdo con el artículo 31.3 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, cuando el importe del gasto subvencionable supere las cuantías establecidas en &lt;span style="color:#000000"&gt;la Ley 9/2017, de 8 de noviembre, de contratos del sector público, por la que se transponen al ordenamiento jurídico español las directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014 (BOE núm.&amp;nbsp;272, de 9 de noviembre), para el contrato menor (40.000&amp;nbsp;€ en el caso de contratos de obra, de concesión de obras o de concesión de servicios, o 15.000&amp;nbsp;€ cuando se trate de contratos de servicios y suministros)&lt;/span&gt;, la entidad debe solicitar como mínimo tres ofertas de diferentes proveedores, con carácter previo a la contratación del compromiso para la obra, la prestación del servicio o la entrega del bien, salvo que por las características especiales no haya en el mercado un número suficiente de entidades que la realicen, presten o suministren, o salvo que el gasto se haya efectuado antes de la solicitud de la subvención. La elección entre las ofertas presentadas, que se deberá aportar en la justificación o, en su caso, con la solicitud de subvención, se realizará conforme a criterios de eficiencia y economía. En caso de que la elección no recaiga en la propuesta económica más ventajosa deberá justificarse expresamente en una memoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Si en el momento de presentar la documentación justificativa el gasto subvencionable supera la cuantía correspondiente a los contratos menores se deberá, aportar las diferentes ofertas presentadas y también una memoria en la que se justifique expresamente la elección en el supuesto de que ésta no recaiga en la propuesta económicamente más ventajosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8. Se puede requerir a la entidad beneficiaria para que aporte cualquier otra documentación que se considere necesaria para justificar la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9. La entidad beneficiaria debe haber efectuado los pagos antes de la finalización del periodo de justificación de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10. El plazo para justificar el importe de la subvención concedida finaliza el día 8 de noviembre de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimocuarto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Obligaciones de los beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Son obligaciones de los beneficiarios de las ayudas las establecidas en el artículo 9 de la Orden de bases reguladoras de 4 de mayo de 2005, en relación con el artículo 11 del Texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimoquinto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interpretación y ejecución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El consejero de Modelo Económico, Turismo y Trabajo puede dictar las resoluciones, circulares e instrucciones que sean necesarias para interpretar y ejecutar esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimosexto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Efectos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La presente convocatoria surtirá efectos el tercer día hábil siguiente al de su publicación en &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimoséptimo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra esta Resolución —que agota la vía administrativa— se puede interponer un recurso de reposición ante consejero de Modelo Económico, Turismo y Trabajo en el plazo de un mes contador desde el día siguiente de su publicación en &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, antes mencionada, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contados desde el día siguiente de la publicación de esta Resolución en &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;(A) Se tiene que consignar el importe del proyecto presentado que ha aceptado la Administración. Este importe tiene que coincidir con el reflejado en la resolución de concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;(B) Se tiene que consignar el importe de la ayuda, de acuerdo con la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;(C) Es el resultado de aplicar al importe de los justificantes el porcentaje de imputación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;(D) El importe elegible lo determina el servicio técnico gestor de la ayuda, después de analizar los justificantes de gasto y de pago presentados por el beneficiario en la cuenta justificativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;(E) El importe de la ayuda justificada tiene que ser, como mínimo, el de la subvención concedida. Este es el importe máximo de ayuda que se tiene que pagar y, por lo tanto, de la obligación reconocida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;(F) Se tiene que consignar el importe total de los pagos anticipados o parciales efectuados por el centre gestor durante la ejecución del proyecto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;(G) Es la diferencia entre el importe de la ayuda justificada (E) y el importe ya pagado (F). Este importe se corresponde con la cantidad para la cual se propone el pago. En el supuesto de que la cantidad ya pagada sea superior al importe de la ayuda justificada, no se propondrá el pago de la ayuda, sino el reintegro de los pagos efectuados en exceso, como también de los correspondientes intereses de demora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
