es 34984 2019-08-10 ![CDATA[Régimen de dedicación, retribuciones e indemnizaciones de los Consejeros y de las Consejeras del Consejo Insular de Eivissa]] 460 CAIB ![CDATA[<p style="margin-bottom:0.21cm; margin-top:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El Pleno del Consejo Insular de Eivissa, en sesión extraordinaria y urgente de fecha 19 de julio de 2019, aprobó la siguiente propuesta:</span></span></p> <p style="margin-bottom:0.21cm; margin-top:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">“Después de las elecciones del pasado día 26 de mayo de 2019, de acuerdo con lo previsto en el artículo 64.5 del Estatuto de Autonomía de las Islas Baleares (según la redacción dada por la Ley Orgánica 1/2007, de 28 de febrero, que lo reformó; en adelante EAIB) y las disposiciones transitorias primera y segunda de la Ley 7/2009, de 11 de diciembre, electoral de los Consejos Insulares, el día 5 de julio de 2019 se constituyó el Consejo Insular de Eivissa y tomó posesión de su cargo su Presidente, el cual por Decreto de Presidencia 2019000471, de fecha 10-7-2019, estableció le estructura del Gobierno del Consejo Insular y la creación de Departamentos (BOIB Ext. núm. 95, de 11 de julio de 2019).</span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El art. 17 en concordancia con los artículos 29 y 30 del Reglamento Orgánico de este Consejo Insular establece que el Pleno del Consejo, dentro de los treinta días hábiles siguientes al de la sesión constitutiva, tiene que tener una o más sesiones con el único objeto de adoptar, entre otros, las siguientes decisiones:</span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">“5.- Establecer el régimen de dedicación, las retribuciones y las indemnizaciones de los miembros de la Corporación.”</span></span></p> <p style="margin-bottom:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En la anterior legislatura, en el Pleno extraordinario de fecha 16 de julio de 2015 se estableció la retribución anual correspondiente a los Consejeros y Consejeras de la Corporación.</span></span></p> <p style="margin-bottom:0.21cm; margin-top:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">La presente Corporación, también ha nombrado un Consejero no electo (Decreto de Presidencia núm. 472, de 10-7-2019; BOIB núm. 95, de 11-7-2019) y quiere fijar en ocho las dedicaciones exclusivas de los miembros de la Corporación (que pertenecen al equipo de gobierno), cumpliendo con lo previsto en el artículo 75 ter, apartado 3 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local (LBRL), y en 5 las dedicaciones parciales, respetando las limitaciones previstas en la legislación vigente.</span></span></p> <p style="margin-bottom:0.21cm; margin-top:0.21cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Por otro lado, visto el articulo 75 de la LBRL, en relación a las dedicaciones parciales cuando los miembros del Consejo que conformen la oposición, se ha tenido en cuenta las responsabilidades que tienen y las funciones que ejercen derivadas de los artículos 22 y siguientes del Reglamento Orgánico de este Consejo. Así mismo, se tiene en cuenta que dos miembros son portavoces de grupo.
