&lt;p style="text-align:center"&gt;&lt;strong&gt;REGLAMENTO MUNICIPAL PARA LA REGULACIÓN DE LAS PRESTACIONES ECONÓMICAS DE URGENCIA SOCIAL DEL AYUNTAMIENTO DE ESPORLES&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;EXPOSICIÓN DE MOTIVOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El apartado e) del artículo 25.1 de la Ley 7/1985 de 2 de abril, Reguladora de las Bases de Régimen Local, contempla competencia municipal la materia de evaluación e información de situaciones de necesidad social y la atención inmediata a personas en situación o riesgo de exclusión social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El artículo 38 de la Ley 4/2009 de 11 de junio, de Servicios Sociales de las Islas Baleares establece como competencia de los ayuntamientos: “crear, organizar y gestionar los servicios sociales que consideren necesarios dentro de su municipio, tan propios como delegados por otras administraciones, de acuerdo con la cartera de servicios sociales y el plan estratégico correspondiente, los planes estratégicos autonómicos y el insular”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En el capítulo III del artículo 22 de la anterior ley citada, se presentan los elementos que componen el sistema público de servicios sociales, diferenciando entre tres tipos de prestaciones económicas: Las prestaciones económicas de derecho subjetivo, las prestaciones económicas de derecho de concurrencia y las prestaciones económicas de urgencia social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En consecuencia de estas razones, se fomenta la necesidad por parte del Ayuntamiento de Esporles de realizar un marco regulador por las futuras concesiones de las prestaciones económicas de urgencia social, que hace tiempo se van otorgante pero que hay que determinar y establecer sus principios fundamentales para incrementar su eficacia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;CAPÍTULO I.- DISPOSICIONES GENERALES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 1.-Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El objeto de este reglamento es la regulación de las prestaciones económicas de urgencia social del municipio de Esporles, destinadas a atender situaciones de necesidad puntual, urgente y básica y regular su procedimiento de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 2.- Definición&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las prestaciones económicas de urgencia social son ayudas de carácter extraordinario que permiten cubrir las necesidades básicas de personas y núcleos familiares que se han visto privadas, puntualmente, de los recursos económicos necesarios para hacer frente a una determinada situación y en la que concurren circunstancias que pueden ser susceptibles de exclusión social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Funcionan como un instrumento de la Unidad de Servicios Sociales Comunitarios Básicos dirigido a paliar las necesidades sociales y la carencia puntual económica de personas o núcleos familiares, con el objetivo de conseguir su autonomía a medio o largo plazo, mejorar sus condiciones de vida y favorecer la integración social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se considera núcleo familiar, a efectos del presente Reglamento, el grupo de convivencia por vínculo matrimonial o cualquier otro relación estable análoga, por consanguinidad hasta el primer grado en línea descendente o adopción. Las situaciones de tutela también se consideran núcleo familiar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 3.- Características&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Son ayudas puntuales, no periódicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Son ayudas extraordinarias que se conceden en función de la situación en que se encuentra la persona o núcleo familiar para evitar un posible caso de exclusión social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Son ayudas finalistas, se aplican a la finalidad por las cuales han sido concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Son ayudas con una cantidad no exacta, dependen del presupuesto anual y de la situación socioeconómica a resolver.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Son complementarias al trabajo social, actúan de manera adjunta con un trabajo más individualizado, centrado en la persona o familia y con el objetivo de favorecer la autonomía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las prestaciones concedidas no pueden ser invocadas como precedente para la obtención de nuevas prestaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Es un criterio relevante para el otorgamiento que la prestación económica otorgada contribuya a la resolución definitiva o mejora de la situación de carencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las prestaciones reguladas en el presente Reglamento son intransferibles y, por lo tanto, no pueden ofrecerse en garantía de contraprestación, ser objeto de cesión total o parcial, compensación o descuento, excepto para el reintegro de las prestaciones indebidamente percibidas y/o retención o embargo y en los supuestos con los límites previstos a la legislación general del Estado que resulte aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En el supuesto que concurran varias personas solicitantes de un mismo núcleo de convivencia para hacer frente al mismo gasto, solo podrá ser concedida a una de estas, promoviendo el acuerdo entre las partes interesadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En referencia a la compatibilidad o incompatibilidad de estas prestaciones con otras ayudas de las administraciones públicas, cada caso será valorado individualmente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 4.- Modalidades de prestación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El Ayuntamiento de Esporles concederá, a las personas o núcleos familiares que cumplan los requisitos establecidos al artículo 8.2. del presente Reglamento, ayudas económicas puntuales en motivo de las situaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Carencia o insuficiencia de recursos económicos para el acceso o mantenimiento de la vivienda habitual y/o gastos derivados:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;i. Ayudas para garantizar los suministras básicos: gas, luz, agua, butano y otros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;ii. Ayudas por alquileres/hipotecas atrasadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;iii. Ayudas para alquiler de vivienda habitual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;iv. Ayudas en los gastos para hacer frente a la pérdida temporal o permanente de vivienda por desahucio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;v. Ayudas por alojamientos temporales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;vi. Anticipos de fianzas, avales, pagos puntuales de cuotas de hipotecas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;vii. Ayudas para la adquisición de equipación básica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;viii. Ayudas para mantener las condiciones mínimas de higiene de la vivienda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;ix. Ayudas por reparaciones o adaptación de la vivienda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Necesidades básicas primarias de alimentación, higiene, ropa y calzado:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;i. Ayudas para la alimentación y necesidades básicas de subsistencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;ii. Ayudas para dietas especiales de inscripción médica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;iii. Ayudas para la alimentación infantil e higiene/lactancia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;iv. Ayudas para ropa y calzado: cobertura por medio de la colaboración con otros recursos de la comunidad y también en el casos que se necesite ropa laboral especial según valoración y situación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Necesidades de integración sociolaboral:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;i. Ayudas individuales para promover la integración sociolaboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;ii. Ayudas por el transporte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. Necesidades de apoyo a la infancia en riesgo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;i. Reducción de la cuota de escolarización de educación infantil de la Escoleta Municipal de Esporles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;ii. Ayudas por el material escolar y libros en situaciones de grave necesidad socioeconómica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;iii. Ayudas de comedor escolar complementarias al sistema educativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;iv. Ayudas para actividades extraescolares y de ocio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;v. Ayudas individuales para el transporte escolar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. Situaciones de desamparo y carencia de recursos de carácter urgente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;i. Adelanto de gastos urgentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;ii. Pago de entierros de beneficencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;iii. Ayudas para el traslado en caso de circunstancias graves.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;F. Prevención y mantenimiento de la salud y atención sanitaria:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;i. Ayudas técnicas complementarias que no entran en el sistema de prestaciones técnicas de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;ii. Ayudas para medicamentos vitales y de urgencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;iii. Ayudas por tratamientos terapéuticos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;G. Desplazamientos habituales por necesidad formativa o de atención sanitaria:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;i. Ayudas de transporte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;ii. Desplazamientos para recibir atención sanitaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;H. Otros:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;i. Ayudas para la atención de situaciones de urgente y grave necesidad que no puedan ser atendidas por ninguno de los conceptos previstos a los epígrafes anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 5.- Ámbito de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El presente Reglamento se aplicará a personas físicas y núcleos familiares empadronados y residentes al municipio de Esporles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 6.- Naturaleza jurídica de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las ayudas presentadas al Reglamento son considerados a todos sus efectos como gasto de derecho público. En el casos de carencia de presupuesto, la dirección puede limitar las ayudas y en algunos casos, priorizar por baremo de libre disposición las situaciones de mayor riesgo de exclusión o necesidad más urgente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las ayudas son puntuales y voluntarias. Mayoritariamente son solicitadas por la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las ayudas contempladas al presente Reglamento tienen la naturaleza jurídica de subvención y su concesión está amparada en el artículo 22.2.c) de la Ley 38/2003, de 17 de diciembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 7.- Dotación presupuestaria&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El ayuntamiento de Esporles establece una única partida presupuestaria del total de prestaciones económicas de urgencia social dirigidas a personas y núcleos familiares en situación de riesgo de exclusión social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La mencionada partida podrá ser incrementada en función de las modificaciones de créditos que eventualmente pueda aprobar la corporación, ante la circunstancia de agotar la dotación y a conveniencia de la disponibilidad presupuestaria de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las prestaciones económicas vinculadas no disfrutarán del efecto de la consolidación de las mismas en el presupuesto municipal del siguiente ejercicio y quedarán condicionadas a la disponibilidad efectiva de liquidez, condicionada a la vez por la aprobación del programa o subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;CAPÍTULO II.- PERSONAS BENEFICIARIAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 8.- Personas beneficiarias, requisitos, obligaciones y derechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;8.1. Personas beneficiarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se puede beneficiar de las ayudas cualquier persona y/o núcleo familiar que cumple los requisitos menciones al artículo 8.2. , que se encuentre en una situación de dificultad social y/o económica y donde las ayudas establecidas sean necesarios por paliar o evitar el empeoramiento de la situación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Tendrán un acceso prioritario aquellas personas o núcleos familiares que se encuentren en las situaciones de necesidad descritas al artículo 6 de la Ley 4/2009, de 11 de junio, de Servicios Sociales de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;8.2. Requisitos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las personas solicitantes de las prestaciones tienen que cumplir los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Ser mayor de 18 años o estar emancipado/da legalmente o, en su defecto, haber iniciado el trámite legal de emancipación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Residir y estar empadronado/da al municipio de Esporles con una antelación mínima de 3 meses desde la fecha de solicitud, excepto las personas y niños en situación de pobreza extrema.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Que el núcleo de convivencia de la persona solicitante tenga unos ingresos iguales o inferiores al resultado del IPREM (Indicador Público de Lava de Efectos Múltiples), cálculo disponible al anexo 3 del presente Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. No disponer de bienes amuebles e inmuebles diferentes de la vivienda habitual sobre el cual se disponga derecho de propiedad, posesión o usufructo ni rentas de la actividad económica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. No recibir prestaciones económicas otras administraciones que podrían cubrir la necesidad surgida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;F. Tener expediente abierto en el área de Servicios Sociales del Ayuntamiento de Esporles y encontrarse insertado en un plan de trabajo consensuado con el/la profesional del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;G. Los núcleos familiares con menores en edad de escolarización obligatoria tienen que acreditar la asistencia regular a los centros escolares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;H. No haber solicitado ayuda económica a esta administración en los últimos 6 meses, con la excepción de aquellos casos que requieran renovar la atención urgente e inmediata y con un previo informe técnico que lo justifique.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;8.3. Obligaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las personas beneficiarias de las ayudas tienen que cumplir las obligaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Acreditar los requisitos exigidos para tener acceso a las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Aceptar ofertas de trabajo tutelado y/o protegido formuladas por los servicios públicos de ocupación u otras instituciones competentes, siempre que no se acredite impedimento y a discreción del informe técnico de referencia de los Servicios Sociales Comunitarios Básicos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Comunicar a los Servicios Sociales del Ayuntamiento de Esporles las variaciones o cambios existentes en la situación social y económica de la persona o núcleo familiar que puedan modificar las circunstancias que dieron lugar a la solicitud y resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. Destinar la prestación a la finalidad que la motivó.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. En los casos que se proponga al informe técnico, el destinatario tendrá que consentir la cesión del crédito a favor de la persona que tenga que ser retribuida con la ayuda o en su defecto, a la entidad a la cual va destinado la ayuda para beneficiar a la persona en cuestión, y el Ayuntamiento de Esporles quedará facultad para hacer el pago directo a esta última.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;F. A todos los efectos, la concesión de la ayuda queda condicionado a la aceptación de obligatoriedad de seguir un plan de trabajo individual y/o familiar por parte de la persona usuaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;G. Justificar la ayuda mediante la presentación de facturas acreditativas del gasto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;H. Comunicar a los Servicios Sociales del Ayuntamiento de Esporles la obtención otras ayudas por la misma finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;I. Someterse a las actuaciones de comprobación y control financiero que efectúe el Ayuntamiento de Esporles y facilitar toda la información y documentación que le sea requerida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;J. Mantener el empadronamiento y la residencia efectiva en el municipio de Esporles durante el tiempo de percepción de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;K. Cualquier otra obligación relacionada directamente con el objeto de la ayuda que específicamente se establezca al acuerdo de concesión de esta y que será propuesta conforme al criterio profesional de los Servicios Sociales Municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;8.4. Derechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las personas beneficiarias de las ayudas tienen los derechos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Derecho a recibir información de las posibles modificaciones que puedan producirse en el régimen de la prestación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Derecho a la intimidad y tratamiento confidencial de la documentación de carácter personal incluida en el expediente. Tanto el/la Regidor/a de el área de Servicios Sociales, Bienestar y Sanidad como el personal técnico que tramite las ayudas están obligados a mantener el secreto de la información de los expedientes, puesto que la intimidad de las personas está afectada y quedará sujeta a reserva y tratamiento confidencial de acuerdo con el arte.18 de la Constitución Española y con el que dispone la Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Derecho a ejercer el derecho de queja conforme a las disposiciones vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. Derecho al abandono efectivo de la ayuda o prestación una vez se haya resuelta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. Cualesquiera otros derechos reconocidos por la Ley 4/2009 de 11 de junio de Servicios Sociales de las Islas Baleares y que puedan ser ejercidos ante esta administración en virtud de las competencias que tenga atribuidas, disponibles al anexo 5 del presente documento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;strong&gt;CAPÍTULO III.- OTORGAMIENTO DE LAS PRESTACIONES&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 9.- Criterios de otorgamiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El otorgamiento de la ayuda dependerá del presupuesto disponible al Ayuntamiento de Esporles tal como dispone el artículo 7 del capítulo I del presente Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El otorgamiento de la ayuda también se ajustará a los requisitos planteados al artículo 8.2 del capítulo II del presente Reglamento. Aun así, los/las profesionales poder proponer excepciones cuando la situación lo requiera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Según el decreto 56/2011 de 20 de mayo de aprobación de la Cartera básica de Servicios Sociales, el otorgamiento de la prestación requerirá la valoración previa por parte de los/de las profesionales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En los casos de otorgamiento de la ayuda, al informe de resolución favorable de la prestación (anexo 4) se tiene que presentar el cimiento y las causas que justifican esta aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Conjuntamente con el informe antes mencionado, se tiene que presentar la valoración sociolaboral y económica de la persona o núcleo familiar beneficiario que a continuación se detalla. El baremo para la regulación de las prestaciones económicas de los servicios sociales del Ayuntamiento de Esporles está disponible al anexo 3.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;9.1. Valoración sociolaboral&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La valoración sociolaboral corresponde a los profesionales de los Servicios Sociales Municipales, que tendrán en cuenta los aspectos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Familia monoparental formada por padre o madre sola con niños, siempre que estos convivan con él o ella y dependan económicamente de forma exclusiva. En el supuesto de que el tutor o tutora monoparental tenga una pareja de convivencia estable, se tendrán en cuenta los ingresos de todo el núcleo de convivencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Familias numerosas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Familias con personas dependientes a cargo y/o con alguna discapacidad reconocida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. Personas solas sin apoyo familiar o vecinal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. Condiciones laborales precarias, desocupación y pobreza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;F. Problemas de salud que pueden dificultar la integración familiar o comunitaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;G. Dificultades de vivienda (deficiencias estructurales, hacinamiento, carencia de suministros eléctricos y de agua, infravivenda, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;H. Núcleos familiares con causas sobrevenidas (en trámites de separación y/o divorcio en el año en curso, muerto de algún progenitor, siniestros del hogar, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;I. Vulnerabilidad, riesgo o desamparo de la gente mayor, los niños y las persones adolescentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;J. Situaciones que suponen un riesgo para la integridad de las personas (mujeres y menores que sufren violencia de género, maltratas a personas mayores, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;K. Discriminación por razón de sexo, lugar de procedencia, discapacidad, dolencia, etnia, cultura, religión o por cualquier otra razón.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;L. Dificultad de integración familiar o comunitaria derivada de la drogodependencia u otras adicciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;M. Vulnerabilidad, exclusión y aislamiento social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;N. Problemas de convivencia y/o cohesión social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;O. Urgencias sociales por causas sobrevenidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;P. Situación laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Q. Pronóstico: la implicación, motivación hacia el cambio, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;9.2. Valoración económica&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Para establecer la situación económica familiar se consideran los gastos y los ingresos netos percibidos durante los 3 meses anteriores a la fecha de solicitud para el conjunto de miembros del núcleo familiar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En los gastos se tienen que tener en cuenta:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Vivienda&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Suministra de agua, electricidad y/o gas&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Salud&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. Otros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En los ingresos se tienen que tener en cuenta:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Ingresos del trabajo por cuenta ajena&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Beneficios y pérdidas del trabajo por cuenta propia&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Prestaciones sociales&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Otros ingresos: arrendamiento de habitaciones, otras casas, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Del cómputo de los ingresos del núcleo de convivencia, podrán ser beneficiarias las personas solicitantes que no superen los ingresos (descontando los gastos) de los siguientes porcentajes del IPREM (Indicador Público de Lava de Efectos Múltiples) por número de miembros del núcleo de convivencia y de forma mensual (ver anexo 3).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;CAPÍTULO IV.- CUANTÍA DE LAS PRESTACIONES&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 10.- Cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las prestaciones económicas de urgencia social serán de cuantía variable, determinada por el resultado de la suma de las puntuaciones obtenidas en el baremo socioeconómico disponible al anexo 3 del presente Reglamento. En caso de necesidad extrema y severa, apreciada al informe técnico, el importe será íntegramente financiado por parte de la corporación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se establece 2.500€ como cuantía máxima otorgable por núcleo familiar y año. Por cualquier situación extraordinaria que necesite superar esta cantidad, se requerirá la aprobación de la dirección técnica del área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El importe total de las ayudas no podrá superar, en ningún caso, el coste de la necesidad a cubrir, incluyendo las concurrencias con otras subvenciones destinadas a la misma finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;CAPÍTULO V.- PROCEDIMIENTO DE LA CONCESIÓN&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 11.- Órgano competente para resolver y órgano gestor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El órgano competente para resolver la concesión o denegación de las ayudas solicitadas es la Alcaldía Presidencial o el/la regidor/a o teniente de alcalde/sa del área de Servicios Sociales del Ayuntamiento de Esporles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La competencia de llevar a cabo la gestión administrativa y técnica de las prestaciones solicitadas son la unidad administrativa y el área de Servicios Sociales del Ayuntamiento de Esporles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 12.- Procedimiento de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El procedimiento se inicia con la solicitud de la persona interesada por medio del modelo de solicitud general (anexo 1) o, en los casos en que ya se está efectuando una intervención, a propuesta del/la profesional de los Servicios Sociales y posterior presentación de la solicitud. Las ayudas serán tramitadas por el trabajador/a social de los Servicios Sociales del Ayuntamiento de Esporles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La solicitud se puede realizar en cualquier momento, en función de la aparición de la situación de emergencia, y se tiene que presentar físicamente al Registro General de Entrada del Ayuntamiento de Esporles y dirigida en el área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Una vez recibida la solicitud, si la persona solicitando no ha aportado la documentación necesaria, se requerirá presentarla en un plazo de 10 días hábiles y se informará que el incumplimiento de este hecho supondrá el archivo del expediente sin más trámites.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La instrucción del expediente corresponderá en el área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En un plazo de 30 días hábiles desde la recepción completa de la documentación acreditativa, el/la trabajador/a social realizará un informe en el cual se propondrá, o no, la concesión de la ayuda solicitada y, si procede, la cuantía. El informe de propuesta contiene los apartados siguientes (incluido al anexo 3):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Perceptor/s de la ayuda o número de expediente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Si es procedente o no su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. La cuantía de esta, si procede.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. Compromiso del beneficiario de acuerdo con el establecido al plan de intervención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La resolución de la concesión de ayuda será acordada por el alcalde o la alcaldesa del Ayuntamiento de Esporles o por el órgano en quién hubiera delegado, y quedará sujeto al mismo deber de secreto profesional a que está obligado/da por ética profesional el trabajador/a social. No se hará publicidad de las ayudas concedidas, visto el que dispone el artículo 18.3 de la Ley 38/2003 de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La resolución de la ayuda (anexo 4) se tendrá que producir en un plazo máximo de 3 meses desde la fecha de registro de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La resolución adoptada será notificada a los interesados en el domicilio que figure en la solicitud de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Posteriormente se presentará al Departamento de Intervención la resolución por la cual, si se tercia, se conceda la ayuda porque se pueda hacer efectivo el pago de la cuantía concedida de acuerdo con las condiciones que se establezcan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El personal técnico valorará la temporización de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 13.- Documentación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La documentación específica para realizar el trámite es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Contrato asistencial firmado (anexo 2).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Solicitud de ayuda, según modelo normalizado, debidamente rellenada (anexo 1).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Dentro del expediente tiene que constar la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. DNI original de la persona solicitada y de las personas mayores de 16 años del núcleo familiar o documentación acreditativa de la identidad. En el supuesto de personas que no tengan la nacionalidad española, original del NIE, pasaporte o documento que legalmente los sustituya.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. Tarjeta sanitaria de todos los miembros del núcleo familiar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. Libro de Familia cumplido y, en su caso, sentencia de separación o divorcio, o convenio regulador donde conste pensión alimentaria y custodia de hijos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;F. En el supuesto de que la persona solicitada o alguno otro miembro del núcleo familiar esté afectado por algún tipo de discapacidad, dictamen de valoración del grado de discapacidad certificado por el órgano o entidad que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;G. En caso de dolencia grave de algún miembro del núcleo familiar, informes médicos u otros documentos que lo acrediten.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;H. Si es necesario, la tarjeta de paro o mejora de la ocupación de las personas mayores de 16 años que se encuentren en situación de paro laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Otra documentación que se puede requerir:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;I. Certificado bancario del número de cuenta donde va dirigida la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;J. Certificado unidad de convivencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;K. Si es necesario, original del título de familia numerosa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;L. Si en el núcleo familiar hay algún caso de acogida, el correspondiente documento acreditativo de esta situación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;M. Si es necesario, certificado que acredite si perciben prestación por paro los miembros adultos del núcleo familiar y del importe de la prestación o, en su caso, certificado negativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;N. Si es necesario, certificado de vida laboral de los miembros adultos del núcleo familiar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;O. Si es necesario, original de la declaración de la renta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;P. Declaración jurada de ingresos del núcleo familiar, únicamente en el supuesto en que quede suficientemente justificada la imposibilidad de aportar la documentación requerida en el apartado anterior (declaración de renta).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Q. En el caso de personas trabajadoras por cuenta ajena: original del contrato de trabajo y de las tres últimas nóminas de las personas mayores de 16 años que realicen actividad laboral.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;R. En el caso de personas trabajadoras autónomas: última liquidación trimestral de IRPF y/o boletín de cotización a la Seguridad Social y, en todo caso, declaración jurada de los ingresos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;S. Si es necesario, certificado de percibir o no pensiones de la Administración Pública y en caso afirmativo de su cuantía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;T. Si es necesario, justificando del capital mobiliario en el que consten los rendimientos y los saldos de todas las cuentas abiertas a nombre de la persona solicitada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;U. Uno. Justificación de gastos fijos mensuales: contrato de alquiler de la vivienda, últimos recibos de préstamos bancarios, gastos de agua, luz y gas, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;V. En caso de separación o divorcio, documento notarial, los justificantes de interposición de la demanda, la sentencia judicial u otros documentos que demuestren esta situación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;W. Declaración acreditativa de la reclamación de la pensión de alimentos (en caso de separación y cuando no se cumple esta medida).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;X. Cualquier otra documentación que para la correcta valoración de la solicitud pueda ser requerida durante su tramitación, que podrá ser solicitada por el personal técnico de referencia de los equipos de servicios sociales o aportada por la persona interesada si lo considera conveniente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La documentación mencionada en este Reglamento es de carácter general y se reclamará, a cada caso en particular, la documentación necesaria para realizar correctamente la valoración social y económica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las fotocopias de la documentación recibida serán guardadas en el expediente de la persona correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se garantiza la confidencialidad de los datos y su procesamiento adecuado, respetando en todo caso el que establece la Ley Orgánica de Protección de Datos. La persona solicitante tiene que firmar la autorización exprés en el contrato asistencial de tratamiento de datos de carácter personal (incluido al anexo 2).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 14.- Pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El abono de la ayuda se puede realizar directamente a la persona destinataria o, en el casos donde se proponga al informe técnico, la persona destinataria tendrá que consentir la cesión del crédito a favor de la persona que tenga que ser retribuida con la ayuda o, en su defecto, a la entidad prestamista del servicio o motivo de la ayuda. El Ayuntamiento de Esporles quedará facultad para hacer el pago directo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se tramitarán preferentemente vía transferencia bancaria al número de cuenta aportado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 15.- Comprobación del uso de la ayuda&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Los/las profesionales de referencia comprobarán el adecuado cumplimiento de la finalidad por la cual ha sido aprobada la ayuda económica contemplada en este Reglamento. La comprobación se adjuntará al expediente de la persona beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El no destino de la ayuda al fin correspondiente es motivo de infracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 16.- Justificación del gasto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La justificación del gasto se acreditará presentando las facturas de los pagos y gastos realizados o mediante otros documentos justificativos, ante el/la profesional de referencia de los Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La justificación se tendrá que efectuar una vez haber hecho uso de la ayuda y al menos, en un plazo máximo de 2 meses desde la fecha de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La carencia de justificación o la justificación incorrecta de la ayuda recibida puede ser motivo de penalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El/la profesional de referencia adjuntará al expediente de la persona beneficiaria la correcta justificación de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;CAPÍTULO VI.- DENEGACIÓN, REVOCACIÓN E INFRACCIONES&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 17.- Procedimiento de denegación, modificación, suspensión y renuncia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;17.1. Denegación de la prestación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Podrán ser denegadas aquellas solicitudes, a pesar de cumplir con los requisitos establecidos al artículo 8.2, donde pueda concurrir alguna de las circunstancias siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. La falta de todos o algunos de los requisitos necesarios para su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Que la persona solicitante no resida efectivamente en el municipio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Dificultar la tarea técnica de valoración de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. Que exista una persona legalmente obligada y con posibilidad de prestar ayuda a la persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. Que la ayuda solicitada no sea adecuada o suficiente para la resolución de la problemática planteada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;F. Que no exista crédito suficiente por la atención de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;G. Que en el plazo de los 6 meses anteriores a la solicitud le haya sido extinguida o revocada cualquier otra ayuda o prestación social por incumplimiento de las condiciones establecidas en su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;H. El falseamiento u ocultamiento de cualquier de los datos declarados por las personas solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;I. Que se demuestre que la persona solicitante puede satisfacer adecuadamente sus propias necesidades y/o con el apoyo de sus familiares, representantes legales o guardadores de hecho.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;J. Que la atención de la persona solicitante, en cuanto a la naturaleza de la prestación o por razón de residencia, corresponda a otra Administración pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;También es susceptible de denegación cualquier otra circunstancia que previa valoración del equipo profesional así lo declare. Quedará constancia escrita al expediente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;17.2. Modificación de la prestación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se puede producir una modificación en la prestación cuando las circunstancias que motivaron la solicitud varíen. Se podrá modificar la finalidad y la cantidad de la prestación a propuesta de la persona beneficiaria o del/la profesional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;17.3. Suspensión de la prestación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se puede proceder a la suspensión de la prestación por alguna de estas causas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Por voluntad o renuncia de la persona beneficiaria a la prestación económica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Muerto de la persona beneficiaria. Cuando la ayuda se haya concedido a un núcleo familiar el equipo de profesionales valorarán si es pertinente o no su continuidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Por la aparición de causas sobrevenidas que produzcan la imposibilidad material de continuar con la prestación de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;17.4. Dejación y renuncia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La persona solicitante podrá desistir de su solicitud o renunciar a su derecho a la prestación reconocida por medio de un escrito dirigido en el Ayuntamiento. Este dictará una resolución donde se exprese la circunstancia en que concurre, indicando los hechos producidos y las normas aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 18.- Revocación de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Será procedente la revocación de las prestaciones en motivo de las causas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. En caso de incumplimiento de los requisitos por parte de la persona beneficiaria (cumplimiento del plan de trabajo individualizado, aceptación de ofertas de trabajo, escolarización de los niños, etc.). Serán los servicios básicos de atención social los que determinarán, en una propuesta de resolución, la valoración sobre el cumplimiento o eventual incumplimiento de estas circunstancias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Cuando la persona beneficiaria incumpla todas o algunas de las obligaciones adquiridas con la aceptación de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. Falsear, ocultar o mostrar obstrucción a las actuaciones de comprobación por parte del personal municipal de servicios sociales y servicios económicos, a pesar de reunir la persona solicitante los requisitos para la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. Que haya transcurrido el plazo de tres meses desde el otorgamiento de la ayuda sin que el ingreso económico se haya podido hacer efectivo por causas imputables a la parte interesada. Este hecho se comunicará por correo ordinario en el domicilio que la persona solicitante declaró.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. La utilización de la ayuda con una finalidad diferente de aquella para la cual fue concebida, constituirá causa determinante de su revocación y el órgano competente promoverá la acción ejecutiva que corresponda, sin perjuicio de las actuaciones civiles, penaltis o de otro orden que en cada caso sea procedente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;F. Desaparición de todas o algunas de las circunstancias que dieron lugar a su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;G. Por la aparición de causas sobrevenidas que produzcan la imposibilidad material de continuar con la prestación de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;H. Para ser beneficiario/a simultáneamente de otra prestación con la misma finalidad, es decir, que tenga la misma naturaleza y atienda las mismas necesidades, sin que tal circunstancia haya sido comunicada al Departamento de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;I. Otras causas de naturaleza análoga y carácter grave imputables a la persona beneficiaria, no previstas en los apartados anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La revocación supondrá, en los casos pertinentes, a la tramitación de un expediente sancionador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La revocación irá precedida por un plazo de 10 días hábiles desde la comunicación de la revocación por correo certificado, porque la persona beneficiaria pueda presentar los documentos o justificaciones pertinentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 19.- Infracciones y penalidades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Constituyen infracciones las acciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. El falseamiento u ocultamiento de cualquier de los datos declarados por las personas solicitantes, incluido cuando la persona solicitante reúna los requisitos por la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. La no aplicación, en todo o en parte, de la cantidad recibida a las finalidades para las cuales fue concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. El incumplimiento reiterado y continuo, por razones imputables a la persona beneficiaria, del plan de trabajo individualizado y de los acuerdos relacionados con la prestación concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;D. La falta de justificación del uso dado a los fondos recibidos, la justificación incompleta o inexacta y la justificación fuera de plazo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;E. La obstrucción, excusa o negativa a las actuaciones de valoración, seguimiento y/o comprobación por parte del equipo de profesionales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;F. Incumplimiento de la obligación de comunicar al/a la profesional cualquier cambio o mejora en las circunstancias que propiciaron la concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las personas beneficiarias de la ayuda o los/las representados de los mismos serán los responsables de estas infracciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las infracciones mencionadas podrán suponer las penalidades siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A. Cierre temporal, entre dos y seis meses, del expediente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B. Extinción de las prestaciones concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C. La no valoración de la situación de la persona beneficiaria durante un periodo de seis meses a contar desde la imposición de la penalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;DISPOSICIÓN FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La Alcaldia queda facultada para dictar las disposiciones internas que sean necesarias para el desarrollo y aplicación del presente Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Esta Ordenanza entrará en vigor cuando haya transcurrido el plazo de quince días hábiles que indica el artículo 113 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares y cuando se haya publicado íntegramente en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Entendemos por ingresos del núcleo de convivencia la suma de todos los ingresos netos de todas las personas que forman parte del núcleo x 12 o 14 pagas /12 meses, a excepción de aquellos núcleos familiares que conviven de forma provisional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Entendemos por renta por cápita, los ingresos del núcleo de convivencia menos el importe del recibo de alquiler o hipoteca, el importe del suministro de agua, electricidad y/o gas, los gastos de salud, educación y otras, dividido por el número de miembros del núcleo de convivencia. En caso de estar pagando dos viviendas, se computará solo la de lava superior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se entiende por IPREM como el Indicador Público de Renta de Efectos Múltiples que se utiliza en España como referencia por las concesiones de ayudas, subvenciones o subsidio de paro. Sustituye el Salario Mínimo Interprofesional como referencia por estas ayudas y se publica anualmente a través de la Ley de Presupuestos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Derecho a recibir información suficiente y verídica, en términos comprensibles, sobre las prestaciones y los recursos disponibles y sobre los requisitos necesarios para acceder a los servicios, y también sobre otros recursos de protección social y sobre las competencias de las administraciones públicas en este ámbito. Para hacerlo efectivo, se tiene que disponer de las ayudas y los apoyos necesarios para comprender la información que los sea dada si tienen dificultades derivadas del desconocimiento de la lengua, si tienen alguna discapacidad o por otras razones que lo justifiquen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;c) Derecho a recibir la valoración de su situación y, si es procedente, la valoración de las necesidades sociales de los familiares o de las personas que tienen cura, en un lenguaje claro y entendedor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;d) Derecho a disponer de un plan individual de atención personal o familiar de acuerdo con la valoración de su situación, que tienen que aplicar técnicamente profesionales mediante procedimientos reconocidos y acreditados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;e) Derecho a estar informadas del proceso de intervención social y a participar en la elección de los servicios o las prestaciones entre las opciones que los presenten las administraciones, siempre que estos hechos no vayan en contra del normal desarrollo de la atención o perjudiquen a alguna de las partes que intervienen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;f) Derecho a recibir información previa con relación a cualquier intervención que los afecte, para que puedan dar consentimiento específico y libre. El consentimiento tiene que ser en todo caso por escrito cuando la intervención implique ingreso en un centro residencial. El consentimiento de las personas incapacitadas y de las personas menores de edad se otorga en conformidad con el procedimiento legalmente establecido para estos casos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;g) Derecho a renunciar a las prestaciones y a los servicios concedidos en los términos establecidos por la legislación vigente, salvo que la renuncia afecte los intereses de las personas menores de edad o de personas incapacitadas o presuntamente incapaces.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;h) Derecho a la confidencialidad respecto de la información que conozcan los servicios sociales, de acuerdo con la legislación de protección de datos de carácter personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;y) Derecho al acceso, en cualquier momento, a su expediente individual, de acuerdo con el que establece la legislación vigente, y en todo el que no vulnere el derecho a la intimidad de terceras personas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;j) Derecho a la asignación de personal profesional de referencia, en los términos establecidos reglamentariamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las personas destinatarias de los servicios sociales tienen los deberes siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;a) Cumplir las normas, los requisitos, las condiciones y los procedimientos establecidos en las prestaciones y los servicios; seguir el programa de atención y las orientaciones que se hayan acordado con el personal profesional competente, y comprometerse a participar activamente en el proceso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Facilitar información verídica sobre las circunstancias personales, familiares y económicas, siempre que su conocimiento sea necesario para valorar y atender su situación, y también comunicar las variaciones que se produzcan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;c) Destinar la prestación económica a la finalidad para la cual fue concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;d) Acudir a las entrevistas a las cuales las cite el personal profesional de los servicios sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;e) Contribuir a la financiación del coste del servicio cuando se tenga capacidad económica y así se establezca normativamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;f) Informar sobre cualquier cambio que se produzca en cuanto a su situación personal, familiar, social y económica, que pueda dar lugar a modificar, suspender o extinguir la prestación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;g) Cumplir el reglamento de régimen interno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;h) Firmar el contrato asistencial pertinente con la entidad prestamista del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;y) El resto de deberes que establezca la normativa reguladora de los centros y servicios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;OBLIGACIONES&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Artículo 8.2. del Reglamento Municipal para la regulación de las prestaciones económicas de urgencia social del Ayuntamiento de Esporles&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las personas beneficiarias de las ayudas tienen que cumplir las obligaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;a) Acreditar los requisitos exigidos para tener acceso a las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Aceptar ofertas de trabajo tutelado y/o protegido formuladas por los servicios públicos de ocupación u otras instituciones competentes, siempre que no se acredite impedimento y a discreción del informe técnico de referencia de los Servicios Sociales Comunitarios Básicos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;c) Comunicar a los Servicios Sociales Municipales las variaciones o cambios existentes en la situación social y económica de la persona o núcleo familiar que puedan modificar las circunstancias que dieron lugar a la solicitud y resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;d) Destinar la prestación a la finalidad que la motivó.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;e) En los casos que se proponga al informe técnico, el destinatario tendrá que consentir la cesión del crédito a favor de la persona que tenga que ser retribuida con la ayuda, y el Ayuntamiento de Esporles quedará facultad para hacer el pago directo a esta última.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;f) A todos los efectos, la concesión de la ayuda queda condicionada a la aceptación de obligatoriedad de seguir un plan de trabajo individual y/o familiar por parte de la persona usuaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;g) Justificar la ayuda mediante la presentación de facturas acreditativas del gasto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;h) Comunicar a los Servicios Sociales del Ayuntamiento de Esporles la obtención otras ayudas para la misma finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;y) Someterse a las actuaciones de comprobación y control financiero que efectúe el Ayuntamiento de Esporles y facilitar toda la información y documentación que le sea requerida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;j) Reintegrar los importes concedidos cuando no se apliquen a las finalidades para las cuales se concedieron.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;k) Mantener el empadronamiento y la residencia efectiva en el municipio de Esporles durante el tiempo de percepción de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;l) Cualquier otra obligación relacionada directamente con el objeto de la ayuda que específicamente se establezca al acuerdo de concesión de esta y que será propuesta conforme al criterio profesional de los Servicios Sociales Municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Y habiendo transcurrido el plazo de exposición al público de treinta (30) días de duración a contar desde el mencionado anuncio sin que se haya presenta ninguna reclamación o sugerencia, se entiende en conformidad por lo que dispone el arte. 17 del RDL 2/2004 de 5 de marzo por el que se aprueba el texto Refundido de la Ley Reguladora de las Haciendas Locales, definitivamente aprobadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Lo cual se hace pública para general conocimiento y a los efectos pertinentes de acuerdo con el arte. 17 del mencionado texto legal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
