    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015, por la que se convocan subvenciones para inversiones en las explotaciones agrarias, correspondientes a los años 2015 hasta 2019 , especifica que la resolución expresa se notificará a los interesados mediante la publicación en el Boletín Oficial de las Islas Baleares, de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas .&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El vicepresidente, en fecha 8 de abril&amp;nbsp;de 2019, firmó la Resolución:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;1.En fecha 16 de julio de 2015, se publicó en el BOIB núm. 106 la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;2.De conformidad con el apartado sexto de la Resolución mencionada, el plazo de presentación de solicitudes finalizó el día 31 de diciembre de 2016, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 211 solicitudes de ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;3.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;4.Los interesados señalados en el anexo I han presentado una solicitud de desistimiento de la ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;3. &lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Propuesta de resolución &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Por todo ello, se informa desfavorablemente sobre las solicitudes de ayuda y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;1.Dar por desistida la solicitud de ayuda detalladas en el anexo I, que contiene un total de 8 expedientes y que comienza con MIGUEL VADELL MASCARO y termina con JAIME JOSE LLABRES MIQUEL.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;2.Finalitzar el procedimiento y archivar los expedientes.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;3.Notificar esta Resolución al interesado, mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
