&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;09 ORDENANZA FISCAL REGULADORA DE LA TASA DE CEMENTERIO LOCAL, CONDUCCIÓN DE CADÁVERES Y OTROS SERVICIOS FUNERARIOS DE CARÁCTER LOCAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTULO I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;FUNDAMENTO Y NATURALEZA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;ARTÍCULO 1 &lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución y de acuerdo con lo dispuesto en los artículos 15 y 19 del Real Decreto Legislativo 2/2004, de 5 de marzo por el que se aprueba el texto refundido de la Ley reguladora de las haciendas locales, este Ayuntamiento seguirá aplicando la tasa del Cementerio local y otros servicios funerarios de carácter local, que se regirá por la presente ordenanza fiscal, cuyas normas atienden a lo previsto en el artículo 57 de la dicho texto refundido.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTULO II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;HECHO IMPONIBLE&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 2 &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituye el hecho imponible de la tasa la prestación de los siguientes servicios del cementerio municipal: concesiones de nichos y sepulturas, asignación de espacios para enterramientos, permisos de construcción de panteones o sepulturas, su empleo, reducción, incineración, movimiento de lápidas, colocación de lápidas, verjas y adornos, conservación de los espacios destinados al descanso de los difuntos, y cualesquiera otros que, de acuerdo con lo previsto en el Decreto 11/2018, de 27 de abril, por el que se regula el ejercicio de la sanidad mortuoria de las Islas Baleares, procedan o se autoricen a instancia de parte, así como otros servicios funerarios. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTULO III&lt;/strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;strong&gt;SUJETO PASIVO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 3 &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son sujetos pasivos contribuyentes las personas solicitantes de la concesión de la autorización o de la prestación del servicio y, en su caso, los titulares de la autorización concedida. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTULO IV&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESPONSABLES&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 4 &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a las que se refieren los artículos 38.1 y 39 de la Ley General Tributaria. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Serán responsables subsidiarios los administradores de las sociedades y los síndicos, interventores o liquidadores de quiebras, concursos, sociedades y entidades en general en los supuestos y con el alcance que señala el artículo 40 de la Ley General Tributaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTULO V&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;EXENCIONES SUBJETIVAS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 5 &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estarán exentos del pago de la tasa los servicios que se presten por:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Enterramientos los asilados procedentes de la beneficencia, siempre que la conducción se verifique por cuenta de los establecimientos mencionados y sin ninguna pompa fúnebre que sea pagada por la familia de los fallecidos. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Enterramientos de cadáveres de pobres de solemnidad, previa acreditación. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Inhumaciones que ordene la autoridad judicial y que se efectúen en la fosa común. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTULO VI&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuota tributaria&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se devenga la tasa y nace la obligación de contribuir cuando se inicia la prestación de los servicios sujetos a gravamen, a cuyos efectos se entiende que esta iniciación se produce con la solicitud de estos servicios.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTULO VIII&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;DECLARACIÓN, LIQUIDACIÓN E INGRESO&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTÍCULO 8&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Los sujetos pasivos solicitarán la prestación de los servicios de que se trate. La solicitud de permiso para construir mausoleos y panteones irá acompañada del correspondiente proyecto y memoria, autorizados por facultativo competente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Cada servicio será objeto de liquidación individual y autónoma, que será notificada, una vez haya sido prestado este servicio, para su ingreso directo en las arcas municipales en la forma y plazos señalados en el Reglamento general de recaudación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTULO IX&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Infracciones y sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todo lo que haga referencia a la calificación de infracciones tributarias, así como las sanciones que correspondan a cada caso, se estará a lo dispuesto en los artículos 178 y siguientes de la Ley General Tributaria. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;DISPOSICIÓN DEROGATORIA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente ordenanza deroga la ordenanza fiscal publicada en el BOIB núm. 178 de 27 de diciembre de 2003.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;DISPOSICIÓN FINAL&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente ordenanza fiscal entrará en vigor el día de su publicación en el Boletín Oficial de las Islas Baleares y comenzará a aplicarse a partir del 1 de enero de 2020. Su período de vigencia se mantendrá hasta que se produzca su modificación o derogación expresas.&lt;/span&gt;&lt;/p&gt;
