es CAIB 624594 2019-07-20 es ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">El Sr. Alcalde Presidente de esta Corporación Municipal, entre otros ha adoptado el Decreto núm. 85/2019, de 17 de junio, que literalmente dice así:</span></span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">DECRETO DE ALCALDIA</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Celebradas las elecciones municipales el pasado día 26 de mayo y constituido el nuevo ayuntamiento, y atendiendo a criterios de eficacia y economía organizativa en la gestión municipal, esta alcaldía considera necesario, en uso de las facultades que le confieren los artículos 21.3 y 23.4 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, adoptar los acuerdos pertinentes relativos a la organización política y administrativa de la Corporación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">En consecuencia, resuelvo:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Primero.- Estructurar la organización política y administrativa de la corporación en las siguientes áreas, confiriendo a los concejales que luego se dirán una delegación general de atribuciones de dirección y gestión de los servicios comprendidos en el área asignada, excluyendo las facultades resolutorias :</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. font-size:12px"><span style="line-height:normal"><strong>Segundo.-</strong> Las atribuciones delegadas se ejercerán de acuerdo con lo previsto en el Real Decreto 2568/1986, de 28 de noviembre, mediante el que se aprueba el Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades locales y en los términos y dentro de los límites de esta delegación, no siendo susceptibles de ser delegadas por sus titulares en otro órgano o concejal.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Tercero.-</strong> Las delegaciones territoriales del Puerto de se Canonge tienen carácter preferente sobre las delegaciones de materias genéricas y comportarán la coordinación con los otros delegados.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Cuarto.</strong>- En caso de ausencia, vacante, enfermedad o cualquier otro impedimento de los Concejales delegados, asumirá directamente y automáticamente sus competencias esta alcaldía, como&nbsp;titular de la competencia originaria, entendiéndose a estos efectos ejercitada la potestad de advocación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Quinto.-</strong> Dar publicidad a estas delegaciones a través del Tablón de anuncios municipal y del Boletín Oficial de la Provincia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Sexto.-</strong> Notificar esta resolución a Concejales afectados, entendiéndose afectada la competencia de forma tácita, si no se manifiesta nada en contra o se hace uso de la delegación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
