2019-07-15 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En relación con el asunto de referencia, y de acuerdo con lo establecido en el artículo 24 del Real Decreto Legislativo 1/2016, de 16 de diciembre, por el que se aprueba el texto refundido de la Ley de prevención y control integrados de la contaminación, se publica el Acuerdo del Pleno de la CMAIB, en sesión de 30 de mayo de 2019,</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">CONSIDERANDO</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Que GAS Y ELECTRICIDAD GENERACIÓN SAU ha solicitado una modificación de la AAI consistente en la modificación de los VLE de aplicación a los grupos MAN1-4.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Que la documentación aportada justifica que se trata de una modificación no sustancial, en cumplimiento del art. 10.4 y 10.5 del Real Decreto Legislativo 1/2016, de 16 de diciembre y del art. 14 del RD 815/2013.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Que de acuerdo a los informes remitidos por la Dirección General de Energía y Cambio Climático, se propone cambiar los límites de los grupos MAN 1 a 4 siempre que se cumplan unos condicionantes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Visto el contenido del acta del subcomité técnico de día 23 de mayo de 2019 en cuanto a la posibilidad de establecer el régimen de forma transitoria.</span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">ACUERDA</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Primero.- Conceder la modificación no sustancial de la Autorización Ambiental Integrada CT Ibiza, a solicitud de GAS Y ELECTRICIDAD GENERACIÓN SAU, consistente en la modificación de los VLE de aplicación a partir del 1 de enero de 2020 a los grupos MAN1 -4, mientras sean necesarios para garantizar el suministro eléctrico del sistema y no haya otras alternativas posibles, a fin de poder proceder al cierre definitivo de los grupos de fuel BW5, 6 y 7.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Es decir, los VLE transitorios serán aplicables mientras no se puedan efectuar inversiones ambientales reconocidas por el Ministerio para la Transición Ecológica que permitan que los grupos MAN operen bajo los nuevos parámetros, o bien, mediante la llegada y puesta en funcionamiento de un nuevo enlace submarino que aporte la potencia necesaria para que estos grupos dejen de funcionar, u otras alternativas posibles.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todo ello, sin perjuicio de las consecuencias de la revisión exhaustiva de la autorización ambiental integrada durante el año 2019 que se llevará en cabo en cumplimiento de la Disposición Adicional Cuarta de la Ley 10/2019, de 22 de febrero, de cambio climático y transición energética, y para incorporar los requisitos establecidos en las mejores técnicas disponibles (Decisión UE 1442/2017).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se recuerda que, con motivo del cierre de los grupos BW5, 6 y 7 se deberá solicitar la modificación de la AAI en los términos que correspondan.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por tanto, se sustituyen los puntos 8.3.10 y 8.3.11 de la AAI que pasan a tener la siguiente redacción:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">"8.3.10. Grupos FC-MAN1, FC-MAN2, FC-MAN3 y FC-MAN4</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estos grupos son motores de gas, que usan gas natural como combustible y funcionan con ciclo Otto.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
