Se publica el texto íntegro de la Ordenanza reguladora del precio público por la utilización de piscinas, instalaciones deportivas y otros servicios análogos, acuerdo que se considera definitivo dado que no ha habido reclamaciones durante el periodo de exposición pública. Aprobada inicialmente en sesión plenaria de día 30 de abril de 2019.</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#00000a">29. ORDENANZA REGULADORA DEL PRECIO PÚBLICO POR LA UTILIZACIÓN DE PISCINAS, INSTALACIONES DEPORTIVAS Y OTROS SERVICIOS ANÁLOGOS</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#00000a">1. ARTÍCULO 1.- CONCEPTO</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a">El Ayuntamiento de Pollença, en uso de las atribuciones que le otorgan los art. 41 y 127 del Texto refundido de la Ley Reguladora de Haciendas Locales (TRLRHL), aprobado por el Real Decreto Legislativo 2/2004, de 5 de marzo, este Ayuntamiento considera necesario y oportuno establecer y ordenar determinados precios públicos -especificado a las tarifas contenidas en el apartado 2 del artículo 3º siguiente- para financiar el servicio de la actividad deportiva y uso de la infraestructura deportiva municipal que presta directamente este Ayuntamiento, que se rige por la presente ordenanza.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#00000a">1. ARTÍCULO 2.- OBLIGADOS AL PAGO</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a">Están obligados al pago del precio público regulado en esta ordenanza los usuarios y abonados. El precio se devengará en el momento de la prestación del servicio o en el momento de disfrutar, utilización o aprovechamiento del dominio público en beneficio particular. La obligación de pago se exigirá en el momento de efectuar la reserva de plaza o cuando se solicite el abono por la totalidad del importe en concepto de depósito, sin perjuicio de lo estipulado en el artículo 4 de devoluciones.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#00000a">ARTÍCULO 3.- CUANTÍA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La cuantía del precio público y su descripción que regula esta ordenanza es la fijada en el apartado siguiente para cada uno de los diversos servicios o actividades, tal como sigue:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A. OBJETO</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Regula el precio público para la prestación de los servicios, actividades deportivas y utilización de la infraestructura deportiva municipal de titularidad pública municipal.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">B. disposiciones generales</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Tendrá la condición de abonado cualquier persona empadronada o no en el municipio de Pollença, que esté al corriente de pago del recibo del curso.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En la condición de abonado se entrega una tarjeta individual que tiene carácter de personal e intransferible, no caduca y se activa con el pago del recibo correspondiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. En la condición de abonado tiene derecho al uso de las instalaciones que se concretan en las piscinas municipales, el gimnasio y el rocódromo. Además, incluye un descuento para otras actividades reguladas en esta ordenanza y un seguro para caso de accidente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En el caso de no ser abonado, para hacer la inscripción a cualquier actividad deberá pagar la matrícula correspondiente por curso o actividad. Esta matrícula, que no otorga derecho a descuento, incluirá un seguro obligatorio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La condición de empadronado en cuanto a la aplicación de la tarifa será la que figure en el padrón del municipio de Pollença al inicio del año natural. En el caso de abono familiar, para adquirir la condición de empadronado necesario que un miembro del núcleo familiar mayor de 18 años cumpla esta condición.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. En los grupos de centros educativos, clubes o entidades deportivas, etc., el acceso y la utilización de la instalación deportiva reservada está condicionada a la permanencia del profesor, monitor, entrenador o delegado responsable del grupo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">C. font-size:12px">Disposiciones generales aplicables a las tarifas de abonos</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La tarifa joven será para personas de 0 a 25 años (inclusive), empadronados en Pollença.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El abono familiar comprende la unidad familiar formada por una pareja de hecho, un matrimonio o un adulto, incluye hijos menores de 18 años en el momento del pago del abono. Se acreditará mediante el libro de familia, el certificado de pareja de hecho y el DNI de los adultos. Se permite la acreditación mediante cualquier otra documentación donde se acredite la unidad familiar. Este abono otorga el derecho al uso de las instalaciones, (descrito en el punto 3 de las disposiciones generales). En cuanto a la actividad de las estancias de verano y estancias en otros periodos se podrá acceder a la tarifa de abonado exclusivamente en el caso de abono anual.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El abono individual comprende el adulto mayor de edad (18 años o más en el momento del pago) y menores con autorización previa del padre / madre o tutor / a legal. Este abono otorga el derecho a utilizar determinadas actividades programadas en la medida que haya disponibilidad, además de acceder al descuento en tarifas de esta ordenanza que tengan la condición de abonado además del derecho al uso de las instalaciones ciones (descrito en el punto 3 de las disposiciones generales). En cuanto a la actividad de las estancias de verano y estancias en otros periodos se podrá acceder al descuento, en el caso de abono individual anual, exclusivamente y en las limitaciones descritas en el artículo 3, punto 1 y 2 anteriores .</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los abonos serán gratuitos para mayores de 65 años empadronados en Pollença (de 7.00 a 15.00 h).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Los abonados tendrán derecho a un descuento de un 50% sobre el precio / hora en el alquiler de pistas de tenis y squash (todas las pistas). El descuento será individual si se cumple la condición de abonado, no sobre el total del precio de alquiler de la pista.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El acceso para técnicos y deportistas de clubes federados estará vinculado a una reserva de uso de espacio de la temporada y previa autorización temporal del Área de Deportes, de acuerdo con el punto 4 de las disposiciones sobre otras cuotas .</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. La duración del abono, tanto individual como familiar, podrá ser anual, semestral (seis meses consecutivos), trimestral (tres meses consecutivos) y mensual (mes natural). Todos los plazos descritos son naturales dentro del año.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Descuentos sobre la tarifa de abonos del 90% en los siguientes casos (con aportación del soporte documental adecuado):</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; Los abonos 1, 3, 10, 30 incluyen el derecho de disfrutar de los mismos espacios que los abonados durante 1, 3, 10 y 30 días respectivamente, por los usuarios durante el año natural.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los abonos con uso de exclusividad de espacio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Disposiciones aplicables a la cesión de uso temporal de las instalaciones</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Para la cesión de uso de espacio temporal es necesaria una autorización previa del Área de Deportes. La tarifa se regula por día y duración de tiempo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En caso de que la duración de la cesión de espacio sea de forma continuada previa solicitud por registro dirigida al Área de Deportes se podrán aplicar descuentos de hasta un 80%.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. En la cesión temporal en exclusividad, en fracciones de hora, de carriles de piscina para entrenamientos, el precio / hora será de 25 euros, previa solicitud y autorización del Área de Deportes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los clubes de deportes federados y asociaciones deportivas federadas podrán hacer uso de las instalaciones, previa autorización mediante tarifa; en este grupo se podrá aplicar un descuento de hasta un 95%, o como segunda opción mediante un convenio con el propio Ayuntamiento. En el caso de un convenio se podrá eximir del pago de la tarifa por uso de espacio, siempre atendiendo a criterios de interés general, eficiencia y equidad. Todos los convenios seguirán su tramitación según las leyes aplicables.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Las AMPA y las AMIPAS inscritas en el REMEC tendrán un descuento de hasta un 50% en el alquiler de las instalaciones deportivas en horario extraescolar de lunes a viernes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Para tramitar autorizaciones temporales deberá presentar una solicitud en el registro y dirigida al Área de Deportes, junto con una declaración responsable mediante la aportación de un listado nominal, firmada por el presidente o por el secretario del club, donde se confirme que todos los deportistas cumplen el requisito de tener licencia federativa o estar inscritos en el deporte escolar del Consejo de Mallorca. Todas las autorizaciones temporales seguirán el trámite correspondiente según las leyes aplicables.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. font-size:12px">Disposiciones específicas aplicables a cada epígrafe de las tarifas que se detallan a continuación:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. En cuanto al pago de cursillistas o usuarios de la escuela deportiva o de actividades físicas:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· Tiene la condición de cursillista el usuario que esté al corriente de pago del recibo del curso.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· Si no es abonado, dentro del primer recibo del curso debe pagar la matrícula de inscripción. Cuando se interrumpa la condición de cursillista por un periodo superior a doce meses hay que volver a abonar la matrícula.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· Las cuotas son mensuales. La renovación de los curso se hace mediante el pago de la mensualidad que se hará día 21 de cada mes anterior al vencimiento, de lo contrario se pierde la plaza.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· La no asistencia continuada y no justificada durante dos meses a un curso o actividad programada es baja automática y otorga la plaza al siguiente usuario de la lista de espera.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· Los cambios de grupo o bajas se harán por correo electrónico al coordinador de las instalaciones o mediante formulario en el registro del Ayuntamiento.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· En el caso de baja de recibos domiciliados, la baja será efectiva el primer mes que no se haya pagado el recibo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· El Ayuntamiento se reserva el derecho de modificar el programa de actividades, el número de sesiones, su contenido y su horario. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. En cuanto a las escuelas deportivas de verano (estancias de verano) y estancias en otros períodos:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· Descuento de hasta un 10% por segundo inscrito en calidad de hermano o hermana de la persona inscrita.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· Descuento de hasta un 15% por tercer inscrito y en adelante en calidad de hermanos o hermanas de los inscritos.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">· Hay una prelación en cuanto a plazas para personas empadronadas respecto de las no empadronadas. font-size:12px"><strong>ARTÍCULO 4.- DEVOLUCIONES</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se podrá efectuar la devolución cuando se den las siguientes condiciones:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. En las reservas anuladas con una antelación mínima de 72 horas a excepción de las estancias de verano, en las que la anulación se debe hacer con una antelación mínima de 15 días naturales. En caso contrario se abonará la tarifa completa del servicio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">b. En el alquiler de pistas exteriores por causas meteorológicas adversas, siempre que no se permita desarrollar la actividad o el juego por causas imputables al Ayuntamiento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">c. En términos generales cuando por causas no imputables al obligado de pago del precio, el servicio o actividad no se preste o desarrolle, se procederá a la devolución del importe correspondiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 5.- EXENCIONES</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Las personas con graves dificultades económicas empadronadas en Pollença, al menos al inicio del año natural, pueden solicitar la exención del precio público a un abono o un cursillo por mes. Se consideran personas con graves dificultades económicas las que forman parte de una unidad familiar en la que la suma de los ingresos de todos sus miembros en edad laboral es igual o inferior al salario mínimo interprofesional. Para acceder a la exención debe presentarse la solicitud en las Oficinas de Atención a la Ciudadanía (OAC).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las actividades o competiciones organizadas por el Ayuntamiento de Pollença, el Consejo Insular o el Gobierno de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los equipos que lleven de referencia el nombre de Pollença y disputen las ligas insulares o nacionales.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Uso de las instalaciones deportivas por parte del personal del Ayuntamiento para tareas y actuaciones propias de su puesto de trabajo, si han sido encomendadas por su jefe.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DISPOSICIÓN TRANSITORIA</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Será de aplicación únicamente durante el ejercicio 2019 y en consecuencia se modifican los siguientes puntos de esta ordenanza:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A. Con respecto al punto 2 del las disposiciones generales aplicables a las tarifas de abonos a Estancias de Verano se modifica la redacción en el sentido de que se podrá acceder a la tarifa de abonado a Estancias de Verano los socios familiares o los socios individuales del ejercicio 2019 en vigencia de la anterior ordenanza. Los socios sólo podrán disfrutar del descuento de forma personal y no es transferible el derecho. También será aplicable la tarifa de abonado en el caso del abono semestral regulado en esta ordenanza.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">B. En cuanto a las Tarifas de cursos y actividades dirigidas así como el alquiler de pistas se podrá también acceder a la tarifa de abonado además del casos descritos en la ordenanza, en el caso de tener la condición de socio individual o familiar del ejercicio 2019 en vigencia de la anterior ordenanza.
