Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 10 de julio de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.</span></span></p> <p>2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes terminó el di a 30/06/2017, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 341 solicitudes de ayuda.</p> <p>3.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">4 Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados en el Anexo I adjunto no cumplen con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el citado anexo.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">Fundamentos de derecho</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">1. Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, sobre la financiación, gestión y seguimiento de la Política Agrícola Común, por el que se derogan los Reglamentos (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 y (CE) núm. 485/2008 del Consejo.</p> <p>5. Reglamento delegado (UE) núm. 640/2014 de la Comisión, de 11 de marzo de 2014, por el que se completa el Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, con respecto al sistema integrado de gestión y control y en las condiciones sobre la denegación o retirada de los pagos y sobre las sanciones administrativas aplicables a los pagos directos, a la ayuda al desarrollo rural ya la condicionalidad .</p> <p>6. Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER).</p> <p>7. Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, con respecto al sistema integrado de gestión y control, las medidas de desarrollo rural y la condicionalidad.</p> <p>8. Real Decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura ya la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural.</p> <p>9. Real Decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de condicionalidad que deben cumplir los beneficiarios que reciban pagos directos o determinadas primas anuales de desarrollo rural, o pagos en virtud de los programas de apoyo a la reestructuración y reconversión o de apoyo a la cosecha en verde, de la viña.</p> <p>10. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2020.</p> <p>15. Ley 12/2014, de 16 de diciembre, agraria de las Islas Baleares.</p> <p>16. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.</p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">17 Ley 35/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">Propuesta de Resolución de Desistimiento</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">Por todo ello, se informa y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">1. Considerar desistidas las solicitudes presentadas por los interesados relacionados en el Anexo I, que son un total de 4&nbsp;expedientes &nbsp;y que comienza con FEANCESC ARTIGUES BONET, y termina con AGROTURISMO ROQUETA S.L.,&nbsp;por los motivos descritos en el citado anexo.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">2. Finalizar&nbsp;el procedimiento y archivar&nbsp;los expedientes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:114%">3.
