&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.- En fecha 8 de mayo de 2018 la consejera de Servicios Sociales y Cooperación dictó Resolución por la cual se convoca el concierto del servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave, para los años 2018-2019. Esta Resolución se publicó en el BOIB núm.59, de 12 de mayo de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.- En fecha 9 de julio de 2017 se firmó el concierto entre la Consejería de Servicios Sociales y Cooperación y la entidad &lt;em&gt;FUNDACIÓN &lt;/em&gt;&lt;em&gt;ES&lt;/em&gt;&lt;em&gt; GARROVER&lt;/em&gt; para llevar a cabo el servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave, para los años 2018-2019, para un total de 11 plazas concertadas de baja intensidad y 7 plazas de alta intensidad y con un coste total del servicio de 273.178,20 €. Este concierto tenía una duración de 12 meses y finaliza el 30 de junio de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3.- En fecha 5 de febrero de 2019 la consejera de Servicios Sociales y Cooperación dictó resolución relativa a la ampliación del concierto del servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave para el año 2019, en la isla de Mallorca, con la entidad &lt;em&gt;FUNDACIÓN &lt;/em&gt;&lt;em&gt;ES&lt;/em&gt;&lt;em&gt; GARROVER&lt;/em&gt;, por la cual se incrementó el crédito del concierto con la entidad &lt;em&gt;FUNDACIÓN &lt;/em&gt;&lt;em&gt;ES&lt;/em&gt;&lt;em&gt; GARROVER&lt;/em&gt;&lt;em&gt; &lt;/em&gt;para atender una ampliación con un número total de 13 plazas estimadas de alta intensidad, para prestar el servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave, durante el periodo que va de día 1 de marzo de 2019 hasta 30 de junio de 2019, dado que a partir del 1 de marzo de 2019 la Consejería de Servicios Sociales y Cooperación pasó a gestionar los servicios de atención residencial comunitaria (SARC) para personas con diagnóstico de salud mental, gestionados por el Servicio de Salud de las Islas Baleares (IB-Salud), según determina el &lt;span style="background-color:#ffffff"&gt;Acuerdo del Consejo de Gobierno &lt;/span&gt;de día 9 de noviembre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Así pues, el número total de plazas del servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave actualmente concertadas con la entidad &lt;em&gt;FUNDACIÓN ES GARROVER &lt;/em&gt;es de 11 plazas plazas de baja intensidad y 20 plazas de alta intensidad hasta día 30 de junio de 2019. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.- En fecha 22 de marzo de 2019 la entidad &lt;em&gt;FUNDACIÓN ES GARROVER&lt;/em&gt; presentó un escrito donde se expone la voluntad de renovar el concierto vigente por el mismo número de plazas que actualmente tiene concertadas junto con una declaración jurada de que la entidad sigue cumpliendo los requisitos exigidos a la firma del concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.- En fecha &lt;/span&gt;&lt;span style="color:#000000"&gt;2&lt;/span&gt;&lt;span style="color:#000000"&gt;5&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;m&lt;/span&gt;&lt;span style="color:#000000"&gt;arzo&lt;/span&gt;&lt;span style="color:#000000"&gt; de 201&lt;/span&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;span style="color:#000000"&gt; se emitió &lt;/span&gt;&lt;span style="color:#000000"&gt;Informe justificativo del director general de Dependencia, relativo a la necesidad y la urgencia de la renovación del concierto del servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave para el año 2019-2020&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;span style="color:#000000"&gt;En&lt;/span&gt;&lt;span style="color:#000000"&gt; este informe se considera necesario renovar el concierto con la entidad &lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;FUNDACIÓN &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ES&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; GARROVER&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;por un total &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;11&lt;/span&gt;&lt;span style="color:#000000"&gt; plazas &lt;/span&gt;&lt;span style="color:#000000"&gt;plazas &lt;/span&gt;&lt;span style="color:#000000"&gt;de baja intensidad &lt;/span&gt;&lt;span style="color:#000000"&gt;y 20 &lt;/span&gt;&lt;span style="color:#000000"&gt;plazas &lt;/span&gt;&lt;span style="color:#000000"&gt;de alta intensidad &lt;/span&gt;&lt;span style="color:#000000"&gt;durante el periodo del 1 de juli&lt;/span&gt;&lt;span style="color:#000000"&gt;o &lt;/span&gt;&lt;span style="color:#000000"&gt;de 201&lt;/span&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;span style="color:#000000"&gt; a&lt;/span&gt;&lt;span style="color:#000000"&gt;l 3&lt;/span&gt;&lt;span style="color:#000000"&gt;0&lt;/span&gt;&lt;span style="color:#000000"&gt; de junio de 20&lt;/span&gt;&lt;span style="color:#000000"&gt;20&lt;/span&gt;&lt;span style="color:#000000"&gt;, para &lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;seguir &lt;/span&gt;&lt;span style="color:#000000"&gt;dando&lt;/span&gt;&lt;span style="color:#000000"&gt; cobertura a este colectivo d&lt;/span&gt;&lt;span style="color:#000000"&gt;e personas con discapaci&lt;/span&gt;&lt;span style="color:#000000"&gt;dad ya que&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;subsisten las caus&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;a&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;s d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;e necesidad&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;de las demandas del servicio&lt;/span&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.- En fecha 26 de marzo de 2019,&lt;/span&gt;&lt;span style="color:#000000"&gt; el director general de Dependencia dictó &lt;/span&gt;&lt;span style="color:#000000"&gt;la propuesta &lt;/span&gt;&lt;span style="color:#000000"&gt;de resolución &lt;/span&gt;&lt;span style="color:#000000"&gt;relativa a la renovación del concierto del servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave, para los años 2019 y 2020, con la entidad &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;FUNDACIÓN ES GARROVER.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social a la comunidad autónoma de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. El Decreto 48/2017, de 27 de octubre, por el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. El Decreto 6/2017, de 7 de abril, de la presidenta de las Islas Baleares, por el cual se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. El Decreto 24/2015, de 7 de agosto, de la presidenta de las Islas Baleares, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. La Resolución de la consejera de Servicios Sociales y Cooperación de 8 de mayo de 2018 por la cual se convoca el concierto del servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave, para los años 2018-2019, publicada en el BOIB núm. 59, de 12 de mayo de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo ello, dicto la siguiente &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.- Autorizar y disponer un gasto a favor de la entidad &lt;em&gt;FUNDACIÓN ES GARROVER&lt;/em&gt;, con NIF G57356057, por importe de 541.860,12 euros (IVA exento), con cargo a las siguientes partidas y anualidades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- 2019, 225.775,05 € correspondientes a los meses &lt;span style="background-color:#ffffff"&gt;de julio&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; a nov&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;i&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;em&lt;/span&gt;bre de 2019, con cargo a la partida 17301.313B01.26104.00, de los presupuestos de la comunidad autónoma para el año 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- 2020, 316.085,07 € correspondientes a los meses de diciembre de 2019 a junio de 2020, con cargo a la partida 17301.313B01.26104.00, (o equivalente que la sustituya), de los presupuestos de la comunidad autónoma para el año 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;3.- El concierto se regirá por las estipulaciones del documento &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;de concierto&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;firmado en fecha &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt; de julio de 201&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;8&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;y por el Plieg&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;o General de prescripciones técnicas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;4.- Notificar esta resolución a l&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;a &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;entidad interesada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra esta Resolución –que agota la vía administrativa– se puede interponer un recurso potestativo de reposición ante la consejera de Servicios Sociales y Cooperación en el plazo de un mes contador desde el día siguiente de haber recibido la notificación de la Resolución, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;También se puede interponer un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contadores desde el día siguiente de haber recibido la notificación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
