![CDATA[<p><span style="background-color:white; font-family:"Times New Roman",Times,serif">El Pleno del Consejo Insular de Mallorca, en sesión de día 9 de mayo de 2019, adoptó el siguiente:</span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El Plan director sectorial de residuos no peligrosos de la isla de Mallorca (PDSRNPM) es el instrumento de ordenación territorial que tiene por objeto regular el planeamiento, la proyección, la ejecución y la gestión de los sistemas generales de infraestructuras, de equipamientos y de servicios necesarios para la gestión de los residuos no peligrosos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 2. Ámbito de aplicación</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El ámbito territorial de aplicación del presente PDSRNPM es la isla de Mallorca.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El ámbito material son los residuos no peligrosos. De acuerdo con la Ley 2/2001, de 7 de marzo, de atribución de competencias a los consejos insulares en materia de ordenación del territorio, quedan excluidos de este plan director sectorial los residuos peligrosos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Son residuos no peligrosos de tratamiento obligatorio dentro del servicio público insular de gestión de residuos urbanos, siempre y cuando el servicio disponga de las instalaciones de tratamiento adecuadas con la capacidad necesaria; los siguientes:</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="background-color:white"><span style="line-height:115%">Previa solicitud por parte de un municipio y autorización por parte del Consejo de Mallorca se podrá establecer la gestión fuera del ámbito del servicio público insularizado y por un periodo de tiempo determinado.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Son residuos no peligrosos de tratamiento obligatorio en el servicio público insularizado de gestión de residuos de construcción y demolición, de equipos eléctricos y electrónicos y voluminosos -siempre y cuando el servicio disponga de las instalaciones de tratamiento adecuadas con la capacidad necesaria- los siguientes:</span></span></span></p>
<ul>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="background-color:white"><span style="line-height:115%">Familia 17 Residuos de construcción y demolición exceptuando los de código 17 05 y los que tengan consideración de residuo peligroso.</span></span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="background-color:white"><span style="line-height:115%">20 01 36 Equipos eléctricos y electrónicos</span></span></span></span></li>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="background-color:white"><span style="line-height:115%">6. Con autorización y aprobación previa de tarifa específica del Consejo Insular de Mallorca, serán admisibles en las instalaciones de tratamiento de los servicios públicos insularizados en régimen de libre concurrencia, aquellos residuos previstos en las correspondientes Autorizaciones ambientales integradas o autorizaciones sectoriales en materia de residuos.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 3. Objetivos del PDSRNPM</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El objetivo del PDSRNPM es regular en el ámbito de la gestión de residuos no peligrosos de Mallorca el planeamiento, la proyección, la ejecución y la gestión de los sistemas generales de infraestructuras. Este objetivo se concreta en: </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Unificar en un solo plan director todas las tipologías de residuos no peligrosos simplificando así las herramientas de planeamiento y aprovechando las sinergias. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Definir la red de infraestructuras para la gestión correcta de los residuos no peligrosos del ámbito de aplicación del plan de acuerdo a las necesidades de gestión actual y futura en base a los objetivos de gestión de residuos que se prevén a nivel autonómico, estatal y europeo.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Establecer una red de instalaciones para el tratamiento de residuos orgánicos cercana a la población para minimizar el impacto y el coste del transporte de estos residuos y acercar el cierre del ciclo de la materia en los lugares de origen.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Facilitar y potenciar el establecimiento de una red de instalaciones que permitan potenciar la preparación para la reutilización y las recogidas selectivas optimizando los impactos vinculados al transporte y tratamiento.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Definir la ubicación de la red de infraestructuras maximizando el uso de las reservas territoriales actuales definidas para el tratamiento de residuos y reducir de este modo la ocupación de suelo adicional.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f) Identificar las mejoras de accesos e infraestructuras auxiliares en las diferentes zonas de tratamiento de residuos.</span></span></span></p>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">h) Definir a través del Estudio de Impacto ambiental elementos de protección para la salud de la población y del medio minimizando los efectos negativos derivados de la red de instalaciones definida.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 4. Principios</span></strong></span></span></p>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Vertederos ubicados en las Zonas 1 y 2 para las escorias tratadas, como última opción cuando no sea posible su valorización.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. Para los rechazos de los centros de transferencia y pretratamiento y plantas de tratamiento del servicio público de gestión de los residuos de construcción-demolición, residuos de aparatos eléctricos y electrónicos, voluminosos y neumáticos fuera de uso de la isla de Mallorca:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Planta incineradora con valorización energética</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Fuera del ámbito del servicio insularizado se prevén:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Reserva de suelo para instalaciones que fomenten la reutilización y preparación para la reutilización</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Reserva de suelo para la implantación de una planta de lavado de envases, para dar respuesta a nivel de territorio, a las necesidades de espacio vinculadas a la implantación de un modelo SDDR (Sistema Depósito Devolución y Retorno)</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 7. Estaciones de transferencia</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Las estaciones de transferencia son instalaciones donde los residuos que provengan de la recogida municipal admitidos (papel y cartón, vidrio, envases ligeros y resto) se compactan (a excepción del vidrio) para ser trasladados a las plantas de tratamiento con vehículos de mayor capacidad.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El PDSRNPM tiene como objetivo la modificación y adecuación de las instalaciones actuales para optimizar la logística de transporte de las distintas fracciones. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Los residuos urbanos recogidos en los municipios se destinarán a las siguientes estaciones de transferencia, las cuales les darán servició con la siguiente distribución:</span></span></span></p>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) ET-5 Levante (Artà, Capdepera, Manacor, Sant Llorenç y Son Severa).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. Los residuos procedentes de Palma, Bunyola, Esporles, Valldemossa, Sóller, Deià, Fornalutx, Llucmajor, Estellencs, Banyalbufar, Marratxí y Puigpunyent serán entregados directamente a las respectivas plantas de tratamiento insulares. En el caso de las fracciones de papel-cartón y vidrio, la planta de destino estará localizada fuera del ámbito insular ya que actualmente no existe ninguna en las islas.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. El Consejo Insular de Mallorca podrá autorizar, con carácter temporal y condicionado a su capacidad, el cambio de destino de los residuos generados por un municipio previa petición razonada de su ayuntamiento.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. El Consejo Insular de Mallorca, de esta forma, previa motivación i en función de las necesidades del servicio, podrá ordenar el cambio de destino de los residuos generados por un municipio.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">7. El Consejo Insular de Mallorca estudiará la posibilidad de incluir la transferencia de otros residuos de su competencia si resulta una opción de interés des de la perspectiva ambiental, social y económica. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 8. Centros de transferencia y pretratamiento de los residuos de construcción – demolición, residuos de aparatos eléctricos y electrónicos, voluminosos y NFU</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos de construcción - demolición, voluminosos y los neumáticos fuera de uso (NFU) recogidos por los ayuntamientos o por transportistas registrados y que serán tratados en el ámbito territorial de la isla de Mallorca deben destinarse a las correspondientes plantas de tratamiento o en los siguientes centros de transferencia y pretratamiento (CTP):</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos admitidos en estas instalaciones son la fracción orgánica de los residuos domésticos / municipales, el tratamiento insularizado de la cual es competencia del Consejo Insular, y restos vegetales. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Les plantes de compostaje de FORM previstas son les siguientes:</span></span></span></p>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Zona 6 (Llucmajor)</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. El Consejo Insular determinará el orden de ejecución de las plantas de compostaje en función de las necesidades de tratamiento de la FORM. En el momento de la realización del anteproyecto se realizará un análisis de las mejores técnicas disponibles. Las priorizaciones de las inversiones también deberán ajustarse a las necesidades de nuevas instalaciones.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. En función de les necesidades del servicio, el Consejo Insular de Mallorca podrá autorizar el tratamiento de lodos a estas plantas de compostaje de FORM.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Con el fin de dar respuesta a los principios básicos de la economía circular y de preparación para la reutilización y avanzar en el cumplimiento de la normativa comunitaria y estatal en materia de residuos, se permiten tanto el autocompostaje como aquellas iniciativas, incluidas las municipales, que tengan como objetivo el tratamiento de materia orgánica de forma ambientalmente segura a los efectos de obtener compost, con un límite de tratamiento de 300 toneladas de residuos LER 20 01 08 y LER 20 02 01 en total, por año, y dentro cada municipio, y previa obtención de las autorizaciones que correspondan. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En todo caso será obligatorio informar semestralmente al Consejo Insular de Mallorca de las toneladas de residuos tratados, las toneladas de compost obtenido y la calidad de este compuesto.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 11. Planta de metanización y compostaje</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos admitidos en esta instalación son la fracción orgánica de los residuos domésticos / municipales, los lodos de las depuradoras de aguas residuales y otros residuos orgánicos, así como restos vegetales para el proceso de compostaje.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta de metanización y compostaje se ubica a la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En función de les necesidades del servicio se irán poniendo en marcha los tres digestores previstos en el anteproyecto de la instalación. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. El digestato resultante del proceso de metanización será compostado en la misma instalación de forma diferenciada según su origen (Lodos o FORM).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Les características técnicas de la instalación se encuentran recogidas en el anteproyecto.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. El Consejo Insular de Mallorca podrá substituir la tipología de residuos a tratar en cada digestor en función de les necesidades reales en los dos flujos. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 12. Plantes de compostaje de lodos</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos admitidos en estas instalaciones son la fracción de lodos que se obtienen como residuos del procedimiento de la depuración de las aguas, así como restos de podas y otros residuos vegetales como estructurante. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Las plantas de compostaje de lodos previstos son las siguientes:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Zona 2 (Santa Margalida)</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Zona 6 (Felanitx)</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. A causa de las disfuncionalidades identificadas, se establece la desafectación de las instalaciones existentes en los siguientes municipios:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Ariany</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Sa Pobla</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. En el momento de la realización de los anteproyectos se realizará un análisis de las mejores técnicas disponibles. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Los titulares de las estaciones depuradoras de aguas residuales urbanas serán responsables de:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Cumplir las condiciones de entrada de las instalaciones que incluyen un porcentaje de humedad de los lodos a entrar con un máximo del 80%. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Transportar los lodos hasta las plantas de tratamiento que designa el Consejo Insular de Mallorca. Los medios de transporte utilizados estarán herméticamente tapados y serán estancos para evitar la dispersión de malos olores durante dicho transporte de lodos.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Cumplir la normativa vigente en cuanto a la producción y control de los lodos producidos en las estaciones depuradoras de aguas residuales. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. En función de les necesidades del servicio, el Consejo Insular de Mallorca podrá autorizar el tratamiento de FORM en estas plantas de compostaje de lodos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 13. Planta de secado de lodos digeridos y digestato</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos admitidos en esta instalación son los lodos digeridos procedentes de las EDAR y el digestato procedente de la planta de metanización. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta de secado de lodos digeridos y digestato se ubica en la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 14. Otros posibles tratamientos para lodos de las EDAR y digestato</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El Consejo Insular de Mallorca podrá tratar el digestato de metanización y los lodos digeridos y no digeridos que no se puedan destinar a compostaje, metanización o secado solar a través de la planta incineradora con valorización energética mediante la instalación de una tolva para facilitar su descarga.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El Consejo Insular de Mallorca podrá autorizar otros tratamientos específicos según el desarrollo científico - tecnológico que venga establecido por las nuevas tecnologías de tratamiento de estos residuos sin perjuicio de la obtención de las correspondientes autorizaciones sectoriales competencia del Gobierno de las Islas Baleares.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 15. Planta selección envases y planta de conteo y almacenamiento</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El residuo admitido en esta instalación es la fracción de envases ligeros procedentes de la recogida municipal o de las plantas de transferencia. El Consejo Insular podrá ampliar la tipología de residuos aceptados en esta instalación, con o sin modificaciones de los procesos, si así lo permite la legislación vigente.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta de selección de envases se ubica en la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En función de la evolución del modelo de gestión de envases, en la Zona 1 se ampliará la planta de selección de envases ligeros o implantará una planta de conteo y almacenamiento.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. Las ampliaciones futuras serán modulares para facilitar la incorporación de las mejores técnicas disponibles (MTDs), favoreciendo de esta manera:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) El incremento de la eficiencia de la planta.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) La viabilidad de separación y posterior recuperación de los flujos de residuos valorizables.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 16. Planta incineradora con valorización energética</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos admitidos en esta instalación provienen de la fracción resto de los residuos municipales. También se pueden tratar otros residuos como los residuos sanitarios tipo II o restos de animales, así como otros residuos autorizados por el Consejo Insular de Mallorca como alternativa previa a la disposición final. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta incineradora con valorización energética se ubica a la Zona 1. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Se prevé la incorporación de una tolva para la canalización de lodos en los hornos para que, en caso de necesidad, se en pueda gestionar una parte a través de la planta incineradora con valorización energética</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. El Consejo Insular de Mallorca cerrará las líneas 1 y 2 de incineración cuando la cantidad mensual de rechazo no supere las 40.000 t durante un periodo consecutivo de tres años y, durante el año, se pueda realizar la parada de mantenimiento.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 17. Tratamiento residuos de origen animal y sanitarios de grupo II</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Se llevará a cabo el tratamiento de residuos de origen animal y el grupo II de residuos sanitarios en la planta incineradora con valorización energética.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En cuanto al tratamiento de residuos de origen animal el Consejo Insular de Mallorca podrá autorizar otros tratamientos, en base a la normativa vigente.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En caso de cadáveres de animales que no pueden ser incinerados por razones técnicas, se depositarán en la celda la específica para cadáveres animales en el vertedero de residuos no peligrosos de la zona 1 (vertedero de cola).</span></span></span></p>

Depósito controlado de cenizas</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos admitidos en esta instalación son las cenizas estabilizadas procedentes de la depuración de gases de la incineración de las etapas de valorización energética del rechazo; sin perjuicio de la posibilidad de valorar otros destinos que se ajusten a la pirámide jerárquica de la gestión de residuos de las directivas europeas y la legislación estatal y autonómica, previa autorización sectorial.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El depósito controlado de cenizas se ubica en la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 19. Planta de tratamiento de escorias</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos admitidos en esta instalación son las escorias procedentes de la incineración con valorización energética; sin perjuicio de la posibilidad de valorar otros destinos que se ajusten a la pirámide jerárquica de la gestión de residuos de las directivas europeas, la legislación estatal y la autonómica.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta de tratamiento de escorias se ubica en la Zona 1. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. El almacenamiento temporal de las fracciones procedentes del tratamiento de las escorias, como paso previo a su valorización material, se ubica en la Zona 1. El Consejo de Mallorca puede autorizar otras zonas que no estén específicamente detalladas en el presente plan director sectorial sin perjuicio de las autorizaciones sectoriales pertinentes.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 20. Depósito de rechazo</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los residuos admitidos en estas instalaciones son los residuos no valorizables materialmente y que, por razones técnicas o en situaciones excepcionales, no puedan ser destinados a la planta incineradora con valorización energética.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Existen dos depósitos de rechazo en la isla de Mallorca.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Depósito de emergencia (Vertedero de cola) a la Zona 1 en el área de Son Reus.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Depósito de rechazo de la Zona 2 (Vertedero Corral Serra)</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 21. Red de puntos limpios municipales</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Todos los municipios deben garantizar el servicio de punto limpio a sus ciudadanos, ya sea de forma independiente o mancomunada, para la recepción, almacenamiento selectivo y preclasificación de productos usados destinados a la reutilización de residuos municipales en espera de tratamientos posteriores, como la preparación para la reutilización, la valorización y la eliminación. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Los puntos limpios deben de estar previstos en los respectivos instrumentos de planeamiento urbanístico, debiendo cumplir con las prescripciones técnicas que sean aprobadas por el Gobierno de las Islas Baleares y contar con las autorizaciones previstas por la normativa sectorial en materia de residuos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Corresponderá a los municipios, o a los entes en que hayan delegado, regular las normas de funcionamiento de los puntos limpios a través de las ordenanzas correspondientes.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 22. Otras instalaciones para la gestión y prevención de residuos</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Se garantiza la disponibilidad de suelo para actividades de gestión de residuos no peligrosos, para la reutilización como materia prima de algunos de ellos y para la preparación para la reutilización en el área empresarial de gestión de residuos (AGIR) de la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Este AGIR garantiza disponibilidad de suelo para la instalación de una planta de lavado de envases para dar respuesta a un cambio de modelo en su gestión.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Para el fomento de la prevención y la correcta gestión de los residuos se dispone del Centro de información y educación ambiental (CIEA) de la Zona 1 de tratamiento de residuos como una herramienta estructural de formación, divulgación y apoyo de las actividades e iniciativas ambientales según un plan de usos y gestión que es aprobado y revisado periódicamente por el Consejo Insular de Mallorca.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">CAPÍTULO II. UBICACIÓN DE LAS ACTUACIONES Y PRIORIZACIÓN</span> </span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 23. Localización de las instalaciones y reservas de suelo</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Las instalaciones previstas se ubican en los lugares que se especifican en el anexo I.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Las reservas de suelo planificadas incorporan, adicionalmente a las instalaciones de tratamiento, otros usos complementarios (zona administrativa) y zonas requeridas como medidas compensatorias de la actuación (zonas verdes, zona recreativa, etc.).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 24. Prioridades y programación de las actividades</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. La priorización del desarrollo del PDSRNPM responde a una previsión de necesidades de tratamiento por flujo donde, de manera inmediata, se procede a efectuar aquellas mejoras necesarias en la gestión actual relativas a incrementar capacidad de tratamiento de lodos de depuradora, FORM y mejoras en las estaciones de transferencia, entre otros.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En función de la consecución de los objetivos del modelo de gestión de residuos de Mallorca, se irán poniendo en marcha las otras instalaciones.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">CAPÍTULO III. EFICIENCIA ENERGÉTICA</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo. 25. Eficiencia energética</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. La implantación de las instalaciones de residuos previstas en este Plan Director Sectorial, incluidas los puntos limpios, se regirá bajo los criterios de eficiencia energética, mediante la incorporación de medidas ambientales y de ecodiseño en los edificios y potenciando el uso de energías renovables. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En la fase de clausura de los vertederos y en otros espacios degradados se potenciarán las instalaciones de energías renovables en los términos previstos en el Plan Director Sectorial Energético de las Islas Baleares. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En la fase de autorización será necesario realizar la evaluación sobre la viabilidad de las soluciones tecnológicas implantadas.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">TÍTULO III. VINCULACIONES A PLANES URBANÍSTICOS</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 26. Vinculación al planeamiento urbanístico municipal</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Las previsiones de este plan director sectorial relativas a zonas de ubicación de instalaciones • instalaciones, infraestructuras, equipamientos, servicios o actividades de explotación, usos del territorio y otras determinaciones asimiladas, de acuerdo con lo previsto en el Artículo 15 de la Ley 14/2000, de 21 de diciembre, de ordenación territorial, vinculan a todos los instrumentos de planeamiento urbanístico, por tratarse de aspectos en los que predomina el interés público insular.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Los ayuntamientos de la isla de Mallorca que resulten afectados por las previsiones a que se refiere el apartado 1 anterior, deben adaptar sus instrumentos de planeamiento urbanístico correspondientes en el plazo máximo de un año desde la entrada en vigor de este plan sectorial, sin perjuicio de la aplicación directa de las determinaciones vinculantes previstas. La superación del plazo de adaptación legitima la subrogación del Consejo Insular de Mallorca en el ejercicio de la competencia municipal para llevar a cabo la redacción y la tramitación del planeamiento urbanístico afectado.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En todo caso, si el municipio lleva a cabo la formulación del nuevo planeamiento urbanístico o su revisión antes del plazo de un año desde la vigencia de este plan sectorial, debe adaptarse necesariamente a sus previsiones.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. En los supuestos en que la previsión de instalaciones, infraestructuras, equipamientos, servicios o actividades de explotación propias de este plan sectorial no estén previstas con grado de detalle, concreción y programación de las obras asociadas, el Consejo Insular de Mallorca ha de elaborar y aprobar en desarrollo de estas determinaciones los planes especiales que sean necesarios, de acuerdo con el artículo 45 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Islas Baleares</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 27. Declaración de utilidad pública y exención del régimen de autorización preventiva</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Todas las obras, instalaciones y servicios, sean de primera implantación, ampliación, modificación o reforma, incluidos los accesos necesarios y los trazados de líneas de suministro eléctricas que corresponda, que se prevén de forma concreta en este plan director sectorial o en los planes especiales que lo desarrollen, llevan implícita la declaración de utilidad pública a los efectos previstos en la legislación sobre expropiación forzosa, de acuerdo con lo que determina el artículo 16 de la Ley 14/2000, de 21 de diciembre , de ordenación territorial, y el artículo 67 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Islas Baleares.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Las actuaciones a que se refiere el apartado 1 anterior, se excluyen de la sujeción a licencia o del régimen de comunicación previa, de acuerdo con el apartado 2 del artículo 149 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Islas Baleares.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"></span></strong></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 28. Suelo sujeto a regulación sectorial específica (AP)</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Quedan excluidos de las determinaciones de este Plan Director Sectorial de Residuos No Peligrosos los suelos sujetos a la siguiente regulación sectorial específica:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Las zonas de Servicio Aeroportuario de acuerdo con la Ley 13/1996</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Así en relación con los Ámbitos con regulación específica correspondientes a los terrenos incluidos en las zonas de servicio de los Aeropuertos de Palma o de Son Bonet, se estará a lo dispuesto en la normativa estatal en materia aeroportuaria y, en su caso, a las disposiciones los Planes Directores de los Aeropuertos de Palma o de Son Bonet, según corresponda, siendo los usos admisibles en estos terrenos exclusivamente el uso público aeroportuario.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Las zonas definidas como de servicio portuario de los puertos de Palma y Alcúdia así como el suelo de dominio público portuario afecto como sistema general portuario y demás prescripciones desarrolladas en el texto refundido de la Ley de Puertos del Estado y de la Marina mercante (RD 2/2011).</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) De acuerdo con la Ley 10/2005 de Puertos de las Islas Baleares, y el Decreto 11/2011 por el que se aprueba el reglamento que la desarrolla se excluyen de la regulación de este plan las zonas de servicio portuarias relativas a los puertos de competencia del Gobierno de Islas Baleares.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Las zonas de dominio público marítimo terrestres.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Estos suelos se rigen por su normativa sectorial correspondiente y los usos que en ellas se permiten están ligados al interés específico sectorial por el que han sido excluidos de este plan.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">TÍTULO IV. MINIMIZACIÓN E IMPACTOS AMBIENTALES DE LAS INFRAESTRUCTURAS</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 29. Compensación ambiental</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Los presupuestos de los proyectos que desarrollarán las instalaciones previstas en este plan director sectorial deberán incluir una partida económica relativa a los recursos naturales afectados. Específicamente en la fase de anteproyecto de la infraestructura se analizará el coste de las medidas necesarias para evitar con carácter preventivo los daños previsibles sobre la calidad ambiental, el paisaje y los recursos naturales, y para establecer la adecuada aplicación de los procesos económicos terciarios con la conservación y el mantenimiento del patrimonio natural y paisajístico.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 30. Programa de Vigilancia Ambiental</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El Consejo Insular de Mallorca supervisará la vigilancia ambiental de las instalaciones previstas en el presente plan director sectorial de acuerdo con las autorizaciones ambientales integradas y el resto de autorizaciones sectoriales que le sean de aplicación.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">TÍTULO V. FINANCIACIÓN</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 31. Financiación de las actuaciones del servicio público</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La financiación de las actuaciones del servicio público derivadas del presente plan director sectorial se realizará a cargo de: </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Les tarifas de tratamiento aprobadas por el Consejo de Mallorca.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) La venta de productos y sub-productos resultado del tratamiento de residuos.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Los Sistemas Integrados de Gestión previstos en la Ley 11/1997, de 24 de abril, de envases y residuos de envases que estén autorizados a las Islas Baleares mediante las aportaciones económicas contempladas en los correspondientes convenios de colaboración firmados con el Consejo Insular de Mallorca.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Subvenciones o aportaciones de otras Administraciones Públicas. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Otras aportaciones del Consejo Insular de Mallorca.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Este Plan Director Sectorial tiene vigencia indefinida, sin perjuicio de su modificación o revisión en los términos establecidos en la Ley 14/2000, de 21 de diciembre, de ordenación territorial.</span></span></span></p>

Revisión</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Este Plan Director Sectorial se deberá de evaluar y revisar a los seis años de su aprobación en cumplimiento del punto 5 del artículo 14 de la Ley 22/2011, de 28 de julio, de residuos y suelos contaminados.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">TÍTULO VII. GESTIÓN DE INFORMACIÓN Y TRANSPARENCIA</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 34. Suministro de información</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Los Municipios que realicen la recogida en masa y selectiva prevista en el presente plan por sus propios medios deben presentar al Consejo Insular de Mallorca, anualmente y antes del 31 de enero, la siguiente información:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Los datos de recogida en masa y selectiva, separando por tipo de residuo. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) El tipo de recogida, indicando si se hace solo a generadores singulares cualificados o a todos los usuarios.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El Consejo Insular de Mallorca, anualmente y durante el primer trimestre del año, entregará a la Consejería de Medio Ambiente del Gobierno de las Islas Baleares el correspondiente informe del año anterior sobre el tratamiento de los residuos; con el siguiente contenido mínimo: </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Producción total de residuos urbanos, en toneladas/año, separando por municipios y/o mancomunidades.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Porcentaje de residuos tratados mediante las diferentes técnicas previstas. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Listado de municipios con sistema de recogida selectiva. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Datos de la recogida selectiva, separando por tipo de residuos y por municipios y/o mancomunidades. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Síntesis de los resultados obtenidos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3 Toda la información se subministrará en soporte informático y, en su caso, se detallará mediante los formularios previstos en la normativa vigente. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 35. Comisión de seguimiento</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. La Comisión de Seguimiento estará formada por representantes de los grupos políticos que forman el plenario del Consejo Insular de Mallorca, de los ayuntamientos con instalaciones en su término municipal, representantes de grupos ecologistas, representantes de colegios profesionales, Universidad de las Islas Baleares, asociaciones de vecinos de los municipios afectados por instalaciones, fundaciones que trabajan en el sector, representantes del sector de los gestores de residuos, representantes de los sistemas de responsabilidad ampliada del productor presentes en la isla, representantes de los concesionarios de los servicios públicos de la gestión de residuos, sin detrimento de otras incorporaciones y se reunirá, como mínimo, una vez al año.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En el marco de la comisión el Consejo Insular de Mallorca informará y expondrá las memorias anuales, los cambios producidos y propuestos en las instalaciones, cumplimientos de objetivos en materia de residuos, así como los datos del programa de medidas y vigilancia ambiental.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Esta Comisión tiene carácter consultivo e informativo y tendrá la función de debatir, reflexionar, proponer y recomendar todo aquello que sea una mejora significativa en la gestión de los residuos urbanos de la isla de Mallorca.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. Corresponderá a la Comisión hacer un exhaustivo seguimiento del cumplimiento de los objetivos de recogida selectiva y de la consecuente disminución de la incineración.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Artículo 36. Transparencia en los datos</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El Consejo Insular de Mallorca pondrá a disposición de las ciudadanas y ciudadanos toda la información en materia de residuos mediante:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) La “Comisión de Seguimiento de la gestión de residuos de Mallorca”. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Un visor que permita hacer el seguimiento de los datos de las instalaciones.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) La página web donde se publicarán los datos vinculados a la gestión de residuos no peligrosos de la isla.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">DISPOSICIONES ADICIONALES</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición adicional primera. Tratamiento de residuos no procedentes de Mallorca</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Aunque, en un principio, los residuos a tratar en las instalaciones previstas en este Plan Director Sectorial son los procedentes de Mallorca, en casos justificados a nivel ambiental, social y económico se podrán tratar residuos procedentes de Menorca, Ibiza y Formentera a petición de los respectivos Consejos Insulares, respetando el cumplimiento de la normativa en materia de traslado de residuos, con acuerdo del Gobierno de las Islas Baleares, y previa aceptación del Consejo Insular de Mallorca que evaluará unas condiciones de temporalidad, de volumen y de entrada, sin que se pueda aceptar fracción de rechazo que no haya sido sometida a un tratamiento previo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición adicional segunda. Intervenciones dentro del Ámbito de intervención paisajístico –AIP II</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En tanto no se redacte el Plan Especial a que se refiere la norma 39 del Plan Territorial Insular de Mallorca (PTIM) con relación al Ámbito de Intervención Paisajística - AIP II «Entornos de Son Reus», las actuaciones, las intervenciones y los proyectos de implantación dentro de este ámbito se ajustarán a los criterios y los contenidos del anexo III del Plan Territorial Insular de Mallorca.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Igualmente, en aplicación de la Disposición transitoria décima del Plan Territorial Insular de Mallorca, deberá solicitar el correspondiente informe al Departamento del Consejo Insular de Mallorca competente en materia de ordenación del territorio, con el fin de analizar la compatibilidad de la actuación, intervención o proyecto con los objetivos de integración paisajística previstos para el AIP.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición adicional tercera. Desarrollo de medidas correctoras para recuperar suelos contaminados</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Estarán obligados a realizar las operaciones de limpieza y recuperación de los posibles suelos contaminados afectados por este Plan Director Sectorial, los causantes de la contaminación, que cuando sean varios responderán de estas obligaciones de forma solidaria y, subsidiaria, por este orden, los poseedores de los suelos contaminados y los propietarios no poseedores. Estas obligaciones de limpieza y recuperación de los suelos contaminantes serán exigibles de acuerdo con lo establecido en la Ley 22/2011 y el Real Decreto 9/2005, de 14 de enero, por el que se establece la relación de actividades potencialmente contaminantes del suelo y los criterios y estándares para la declaración de suelos contaminados.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición adicional cuarta. Afecciones aeronáuticas</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. La ejecución del PDSRNPM se encuentra sometida al cumplimiento de las obligaciones legales y reglamentarias derivadas de las restricciones impuestas por la normativa en materia de seguridad aeronáutica según los apartados siguientes.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En las Zonas de Servicio de los Aeropuertos de Palma de Mallorca y de Son Bonet, se estará a lo dispuesto en la normativa estatal en materia aeroportuaria y, en su caso, a las disposiciones de los respectivos Planes directores. El uso público aeroportuario es el único uso admisible en estos terrenos. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Los instrumentos de planeamiento que se elaboren, revisen o modifiquen en desarrollo del PDSRNPM, cuando el ámbito se encuentre total o parcialmente afectado por las Servidumbres aeronáuticas acústicas del Aeropuerto de Palma de Mallorca o por la huella acústica incluida dentro el Plan director del aeropuerto de Son Bonet, deberán incorporar los planos de las servidumbres mencionadas. En los ámbitos afectados no se consideran compatibles los nuevos usos residenciales, dotacionales educativos o sanitarios, ni las modificaciones de la ordenación que supongan el incremento del número de personas afectadas en relación al planeamiento vigente.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. En las Zonas de Servidumbres Aeronáuticas correspondientes a los aeropuertos de Palma de Mallorca y de Son Bonet y de las instalaciones radioeléctricas aeronáuticas VOR / DME, NDB, centros de comunicaciones, centros emisores y centros receptores existentes, sintetizados en los planos Anexo 3 "Afecciones aeronáuticas", se aplicarán las siguientes restricciones en aplicación de la normativa aeronáutica:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a. Las superficies limitadoras de las servidumbres aeronáuticas de las infraestructuras mencionadas determinan la altura respecto del nivel del mar que no debe sobrepasar ninguna modificación del terreno, elemento de construcción o de instalación fija, así como el gálibo de carretera y de las vías de ferrocarril. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b. Las propuestas de nuevas infraestructuras y la revisión o modificación que se elaboren en el PDSRNPM, cuyo ámbito se encuentre total o parcialmente afectado por las servidumbres aeronáuticas de las instalaciones mencionadas, deberán informar por la Dirección General de Aviación Civil en aplicación y en los términos que establece la normativa vigente de seguridad aeronáutica.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c. En las zonas y ámbitos afectados por servidumbres aeronáuticas, la ejecución de cualquier construcción, instalación, medios necesarios para la construcción o plantación, requerirá de acuerdo favorable de la Agencia Estatal de Seguridad Aérea (AESA) en aplicación y en los términos que establezca la normativa vigente de seguridad aeronáutica.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. La superficie comprendida dentro de la proyección ortogonal sobre el terreno del área de las servidumbres aeronáuticas de los aeropuertos de Palma de Mallorca y Son Bonet, en aplicación de la normativa de seguridad aeronáutica queda sujeta a una servidumbre de limitación de actividades, en virtud de la que AESA puede prohibir, limitar o condicionar actividades que puedan suponer un peligro para las operaciones aéreas o el correcto funcionamiento de las instalaciones radioeléctricas. Esta prohibición se podrá extender a los usos del suelo que faculten para la implantación de las actividades mencionadas. Entre otros se incluirán:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a. Las actividades que supongan o impliquen la construcción de obstáculos que puedan inducir turbulencias</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b. El uso de luminarias, incluidos proyectores o emisores láser, que puedan crear peligros o inducir a confusión o error de navegación</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c. Las actividades que impliquen la utilización de muy grandes superficies reflectantes que puedan provocar deslumbramiento. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d. Las actuaciones que puedan estimular la actividad de la fauna en el entorno de la zona de movimientos del aeródromo.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e. Las actividades que den lugar a la implantación o funcionamiento de fuentes de radiación no visible o la presencia de objetos fijos o móviles que puedan interferir en funcionamiento de los sistemas de comunicación, navegación y vigilancia aeronáuticas o afectar negativamente</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f. Las actividades que faciliten o impliquen la implantación o funcionamiento de instalaciones que produzcan humo, nieblas o cualquier otro fenómeno que suponga un riesgo para las aeronaves.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">g. El uso de medios de propulsión o sostenimiento aéreo para la realización de actividades deportivas o de cualquier otro tipo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. En aplicación de la normativa vigente en seguridad aeronáutica, en los terrenos incluidos en las Zonas de seguridad de las instalaciones radioeléctricas para la navegación aérea se prohíbe cualquier construcción, o modificación temporal o permanente del terreno, de la superficie o de los elementos que se encuentren sobre ella, sin consentimiento previo de la Agencia Estatal de Seguridad Aérea (AESA).</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">DISPOSICIONES TRANSITORIAS</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición transitoria primera. Plantas de Ariany y Calvià</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Hasta la recepción definitiva de la fase 2 de la planta de metanización se mantendrá operativa la instalación que actualmente está en funcionamiento en Ariany.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Hasta su sustitución por la nueva planta de compostaje de Calvià, se deberá mantener operativa la actual instalación de Calvià para el tratamiento de lodos de depuradora.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición transitoria segunda. Tratamiento de residuos peligrosos</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mientras esté vigente el actual contrato de gestión de servicio público relativo a la transferencia y tratamiento de residuos de construcción, demolición, voluminosos y neumáticos fuera de uso, los residuos con consideración de peligrosos con LER 20 01 21*, 20 01 23*, 20 01 35* y 16 02 11* se entregarán a los centros e instalaciones previstos en los artículos 8 y 9 del presente Plan Director Sectorial.</span> </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición transitoria tercera. Tratamiento de neumáticos fuera de uso</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mientras esté vigente el actual contrato de gestión de servicio público relativo a la transferencia y tratamiento de residuos de construcción, demolición, voluminosos y neumáticos fuera de uso, los neumáticos fuera de uso con LER 16 02 16 se entregarán a los centros e instalaciones previstos en los artículos 8 y 9 del presente Plan Director Sectorial.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición transitoria cuarta. Régimen transitorio AGIR de la zona 1</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mientras no sea elaborado un plan especial de acuerdo con lo previsto en el apartado 4 del artículo 26 de estas normas, mantienen su vigencia las normas complementarias y subsidiarias de planeamiento aprobadas por el pleno del Consejo Insular en fecha 7 de mayo de 2007 relativas a la AGIR 1.1 para su aplicación a la AGIR de la zona 1 del presente Plan Director Sectorial. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición transitoria quinta. Almacenamiento de fracción vegetal</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mientras no se pongan en marcha las instalaciones de compostaje, la fracción vegetal se podrá almacenar en condiciones adecuadas que garanticen la conservación de sus propiedades para poder incorporarlas al proceso de compostaje de la FORM.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">DISPOSICIONES DEROGATORIAS</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición derogatoria primera. Plan Director Sectorial para la gestión de residuos urbanos de Mallorca</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. A la entrada en vigor de este plan sectorial, queda derogado el documento de revisión del plan director sectorial para la gestión de los residuos urbanos de la isla de Mallorca, aprobado por el pleno del Consejo de Mallorca, en sesión celebrada en fecha 6 de febrero de 2006 (BOIB Núm. 35, de 9 de marzo de 2006), quedando sin aplicación el régimen establecido en el artículo 21 del Decreto 21/2000, de 18 de febrero, de aprobación definitiva del Plan Director para la Gestión de los residuos Urbanos de Mallorca para las áreas empresariales de residuos de las zonas 1 y 2.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. No obstante, lo establecido en el apartado anterior, mientras no sean objeto de una regulación específica, se mantienen vigentes: los artículos 16 y 17, y DA 5ª, DA 9ª y DA 10ª de la Revisión del Plan Director Sectorial para la gestión de los residuos urbanos de la isla de Mallorca aprobado definitivamente mediante acuerdo del Pleno del Consejo Insular de Mallorca de 6 de febrero de 2006 (BOIB Núm. 35, de 9 de marzo de 2006).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposición derogatoria segunda. Plan Director Sectorial para la gestión de residuos de construcción-demolición, voluminosos y neumáticos fuera de uso de la isla de Mallorca</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Queda derogado el Plan Director Sectorial para la gestión de residuos de construcción-demolición, voluminosos y neumáticos fuera de uso de la isla de Mallorca publicado en el BOIB núm. 141, de 23 de noviembre de 2002.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. No obstante, lo establecido en el apartado anterior, mientras no sean objeto de una regulación específica, se mantienen vigentes los siguientes preceptos: el artículo 9 con la redacción conferida por el artículo 20 de la Ley 25/2006, de 27 de diciembre, los artículos 11 y 12 y las DA 3ª y 4ª.</span></span></span></p>
