&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Aprobado inicialmente por el Ayuntamiento Pleno en sesión de día 26 de febrero de 2019 el reglamento regulador del régimen de uso de huertos ecológicos urbanos del municipio de Marratxí, y dado que durante el plazo de exposición pública no se ha presentado ninguna reclamación, y por tanto, acontece aprobado definitivamente, se publica íntegramente en cumplimiento del dispuesto a la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y a la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares. Recursos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Contra la aprobación definitiva de este reglamento se puede interponer recurso contencioso-administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contados desde el día de la presente publicación, de acuerdo con el dispuesto en los artículos 10.1.b y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los Huertos Urbanos son una iniciativa del Área de Servicios Sociales del Ayuntamiento de Marratxí que tienen por objetivo fomentar la autonomía de las personas, el desarrollo sostenible, la educación ambiental y la agricultura tradicional y ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los huertos urbanos del Área de Servicios Sociales del Ayuntamiento de Marratxí se configuran como áreas de cultivo de hortalizas y de plantas aromáticas que, situadas en un entorno urbano, y gestionadas según los principios de la agricultura ecológica y de las paradas en crestall, además de producir alimentos para el consumo propio tienen una finalidad social, integradora, educativa, de ocio, ambiental y participativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El Ayuntamiento de Marratxí pretende fomentar todas aquellas acciones que repercutan en beneficio de las personas residentes, atendiendo la ocupación del tiempo libre por parte de estas. Con la disposición de los huertos de ocio se pretende que un sector de la población, especialmente las personas pensionistas, personas en riesgo de exclusión social, familias y los jóvenes, adopten una actitud activa y positiva en su tiempo libre y de ocio , con el objeto de que, a la vez que se potencian los valores saludables y ambientales, se ofrece empleo y distracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Mediante este Reglamento se pretende establecer el régimen aplicable a la utilización de estos espacios hortícolas para establecer el procedimiento a seguir para la adjudicación de los huertos, los criterios generales de selección aplicables a la demanda existente, los derechos y obligaciones que incumben a las beneficiarios, y, en general, la regulación del uso y funcionamiento de la red de huertos urbanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;2. Objeto del reglamento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Este Reglamento tiene por objeto definir el procedimiento de adjudicación de parcelas de cultivo de huertos urbanos del municipio de Marratxí así como determinar las condiciones de uso de estas parcelas y las obligaciones de las personas adjudicatarias. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La actividad de cultivo dentro de las parcelas se prestará de acuerdo con lo descrito en este Reglamento, y correrá a cargo de las personas adjudicatarias, en concreto: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) El mantenimiento, el orden y la limpieza de la parcela asignada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) El seguimiento de los principios de la agricultura ecológica y las recomendaciones que pueda establecer el Área de Servicios Sociales del Ayuntamiento de Marratxí al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Correrá a cargo del Ayuntamiento de Marratxí:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Los gastos de agua y de algunas herramientas para el cultivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) La formación sobre el método de cultivo a utilizar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) El seguimiento y control de la actividad llevada a cabo en las parcelas de cultivo mediante la intervención y acompañamiento durante el proceso de profesionales referentes del Área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) Kit básico de herramientas &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;e) Las personas usuarias recibirán cada temporada una dotación de planteles de acuerdo con la estación actual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;3. Fundamento legal&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Este Reglamento se dicta de conformidad con lo dispuesto en los artículos 4.1, 25.2 b) yl) y 49 de la Ley de Bases de Régimen Local; y los artículos 29.2.b), h) yk) y el artículo 100 y siguientes de la Ley 20/2006 Municipal y de Régimen Local de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La adjudicación, mediante licencia, del uso privativo de dominio público sobre las parcelas de cultivo y de los espacios del huerto urbano de titularidad municipal, no supone la transmisión del dominio de la parcela o el espacio de cultivo cedidos, que siguen siendo propiedad del Ayuntamiento de Marratxí, respecto tanto del terreno como de todas las instalaciones existentes en el momento de la adjudicación y de las que las diferentes personas usuarias puedan realizar con la autorización previa y expresa del Ayuntamiento, las cuales quedarán unidas de forma permanente en la parcela.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El adjudicatario sólo tiene la posesión precaria de la parcela de cultivo que se le asigne, según libre decisión ya criterio municipal; todo ello en los términos previstos en este Reglamento y la licencia de uso privativo de dominio público que finalmente se otorgue de acuerdo con la legislación vigente: la Constitución Española; el Código civil; la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares; la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local; el Real Decreto Legislativo 781/1986, de 18 de abril, del texto refundido de las disposiciones vigentes en materia de régimen local; el Real Decreto 1372/1986, del reglamento de bienes de las corporaciones locales; la Ley 33/2003, de 3 de noviembre, del Patrimonio de las Administraciones Públicas; el Decreto de 17 de junio de 1955,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Dicho uso privativo tiene carácter personal y en ningún caso las personas titulares podrán ceder, enajenar, gravar o disponer, a título oneroso o gratuito, los derechos que se deriven de la autorización de uso, ni pueden transmitirlo a terceras personas, sin perjuicio del posible apoyo de lo establecido en este Reglamento, en cuanto a la cesión del uso de las parcelas de cultivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;5. Derechos de los adjudicatarios de huertos urbanos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Constituyen derechos de los adjudicatarios: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Cultivar en la parcela de cultivo o mesas de cultivo adjudicadas cualquier variedad de hortalizas, flores y plantas aromáticas en los términos contenidos en las presentes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Emplear la caseta que se pueda asignar para depositar herramientas, semillas y otros elementos que puedan aportar destinados al cultivo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Disponer del asesoramiento del personal destinado a la supervisión de la tarea realizada en huertos urbanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) Los otros que deriven del contenido de este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;6. Prohibiciones de los adjudicatarios de huertos urbanos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;No se permite a los adjudicatarios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Cultivar plantas degradantes del suelo y de plantas psicotrópicas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Aplicar productos fitosanitarios de síntesis para el control de plagas o enfermedades. Sólo se autorizan los productos empleados en producción ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Aplicar abonos de síntesis. Sólo se autorizan los productos empleados en producción ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) La sustracción o el daño a productos o plantas obtenidos en el cultivo por parte de los adjudicatarios de otras parcelas ajenas a la adjudicada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;e) Comercializar, en la forma que sea, los productos obtenidos en el cultivo de la parcela o mesa de cultivo. Si hay excedentes deberán entregar al Departamento de Bienestar Social, que les dará el uso adecuado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;f) Hacer ninguna clase de obra, lo que incluye la prohibición de hacer ningún tipo de nueva valla o separación (mediante muros, cañas, maderas, plásticos, uralitas, etc.), invernaderos, pozos, mesas fijas o bancos, como también la modificación interior o exterior de la caseta, si lo hay, o la construcción o instalación de nuevos elementos o modificación de los existentes; todo ello salvo autorización del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;g) Tener y criar cualquier tipo de animal o ganado y construir casetas o jaulas destinadas a éstos, salvo autorización del Ayuntamiento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;h) Cazar, talar árboles o cualquier otra actividad que pueda causar daño en la fauna y flora que pueda haber en el huerto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;i) Acumular o abandonar cualquier material o desecho, dentro o fuera del huerto, y aportar cualquier tipo de objeto ajeno a la función del huerto susceptible de alterar la estética del lugar; utilizar la parcela como depósito o almacén de materiales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;j) Alterar los caminos y las conducciones de riego del huerto adjudicado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;k) Mover los hitos y vallas que delimiten la parcela municipal. El usuario se obliga a ejecutar su trabajo dentro de los límites de la parcela o mesa adjudicada, sin llevar a cabo su actividad más allá de los límites acotados ni regar con aspersores o con cualquier otro utensilio que pueda invadir o regar otras parcelas o mesas vecinas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;l) Realizar un cultivo que pueda invadir fincas o parcelas colindantes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;m) Dejar el huerto sin trabajar. En caso de imposibilidad temporal, que no se podrá alargar más de tres meses, el usuario deberá comunicar de forma motivada esta circunstancia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;n) Circular por el interior del huerto con vehículos de motor, salvo cuando se utilicen herramientas agrícolas, con la autorización previa del Ayuntamiento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;o) Estacionar automóviles en el interior del huerto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;p) No respetar las normas básicas de convivencia ni estética del huerto, mantener una conducta insolidaria, hacer un gasto excesivo de agua o utilizar productos tóxicos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;q) Cualquier otro uso no previsto anteriormente y que produzca molestias o malos olores, limite el uso y disfrute del resto de parcelas o afecte el entorno del lugar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;7. Obligaciones de los adjudicatarios de los huertos urbanos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los adjudicatarios estarán obligados a: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Cultivar cualquier variedad de hortalizas, flores y plantas aromáticas en los términos contenidos en las bases y siempre que no sean especies prohibidas por alguna disposición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Avisar inmediatamente al Ayuntamiento de Marratxí si detectan cualquier daño o desperfecto en la parcela, espacio, mesa, caseta o sus instalaciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Las obras y las reparaciones de renovación o reposición en la parte exterior de la parcela (continente), espacio, mesa o caseta o en sus elementos, debidas al envejecimiento u otras causas en las que no se de daño o negligencia del adjudicatario o de su ayudante o acompañante serán a cargo del Ayuntamiento de Marratxí. En caso contrario serán a cargo del adjudicatario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) Mantener limpios y en perfecto estado de conservación las herramientas y los útiles necesarios para el cultivo que sean propiedad del Ayuntamiento y que éste pueda poner a su disposición si lo considera adecuado. El Ayuntamiento podrá requerir que compensen su desperfecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;e) Mantener el entorno de sus parcelas y espacios con mesas de cultivo en perfecto estado, limpio y libre de todo tipo de hierbas y plantas espontáneas. También deberán hacerse cargo de gestionar adecuadamente los residuos que se produzcan, separando las de origen orgánico del resto y depositando cada tipo de residuo en el contenedor específico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;f) Cumplir las ordenanzas municipales y demás normativa local, autonómica o estatal que pueda afectar. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;g) Responder de los daños de todo tipo, robos o actos vandálicos que puedan afectar el interior de las parcelas, los espacios o las casetas asignadas, y de cualquier responsabilidad en caso de accidente personal o de su ayudante o acompañante. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;h) Mantener la adecuación de la parcela o espacio asignado, incluida la caseta asignada en su caso, las instalaciones y los productos obtenidos, en las condiciones de higiene, salubridad y sanidad que sean exigibles según la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;i) Facilitar la entrada a los huertos a los escolares y otros colectivos autorizados que bajo la dirección de monitores, quieran conocer los trabajos agrícolas o las producciones que se hacen. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;j) Responder a la plena responsabilidad en cuanto al cumplimiento de la normativa referente al fuego ya la protección civil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;8. Horario y acceso&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El horario en que se puede acceder a los huertos urbanos será el siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Mayo - Octubre: 7'00 - 21'30 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Noviembre - Abril: 8'00 - 19'00 horas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El Ayuntamiento podrá modificar dicho horario en los casos concretos en que resulte necesario según criterio municipal por Decreto de Alcaldia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El acceso a los huertos queda restringido al personal municipal autorizado, a las personas adjudicatarias, los acompañantes de estas, y al que las suplan en caso de imposibilidad temporal, conforme a lo establecido en el apartado siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En caso de imposibilidad temporal y justificada de la persona adjudicataria para llevar a cabo las tareas de cuidado y mantenimiento del huerto, esta persona puede autorizar otra el tiempo imprescindible hasta que se resuelva la imposibilidad de realizar las tareas la persona adjudicataria por sí misma. El Ayuntamiento emitirá una autorización provisional de acceso a la persona designada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Las causas justificadas de imposibilidad temporal son: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Estar en periodo de embarazo, de maternidad o de paternidad, de adopción o acogimiento permanente o preadoptivo, incluyendo el periodo en que sea procedente la concesión de excedencia para cuidado de hijos e hijas por cualquiera de los casos anteriores . &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Padecer enfermedad o incapacidad temporal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Encontrarse en fase inminente de realización de un viaje de duración larga o media. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Las personas adjudicatarias o las autorizadas por imposibilidad justificada de la persona adjudicataria pueden introducir en el recinto hasta un máximo de cuatro personas acompañantes simultáneamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En caso de las personas jurídicas, asociación o entidades autorizadas no se regirá por este número máximo de personas acompañantes simultáneamente, sino que podrá ser más elevado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;9. Duración de la licencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La adjudicación del uso privativo de las parcelas de cultivo de los huertos se otorga por un período de un año, a contar a partir del día siguiente a la recepción de la notificación de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La licencia se puede prorrogar por un período de un año, hasta llegar a un máximo total de 3 años, a menos que antes de este plazo tenga lugar la renuncia o la revocación de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Agotado este plazo, se puede volver a optar a la adjudicación de una licencia, mediante la presentación de una solicitud, conforme a lo regulado en este Reglamento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En caso de que el adjudicatario deje la parcela sin trabajar más de 3 meses sin que haya una comunicación expresa y motivada en el Ayuntamiento de Marratxí, esta parcela queda libre y puede ser adjudicada nuevamente, una vez resuelta o declarada caducada la licencia, según prevé este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;10. Caducidad y renovación de la licencia. Efecto de la extinción de la autorización.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a. La licencia de uso privativo caduca por los siguientes motivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Por vencimiento del plazo final, junto con las prórrogas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Por renuncia del titular de la licencia antes del vencimiento del plazo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Por muerte o incapacidad sobrevenida del adjudicatario antes del vencimiento de la licencia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Por voluntad unilateral del Ayuntamiento de no prorrogar la licencia por motivos justificados o incumplimiento de las normas establecidas en este reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b. La licencia de uso privativo puede ser revocada por los siguientes motivos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Por pérdida de las condiciones de acceso a ser beneficiario de una licencia de uso privativo objeto de este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Por tener que disponer de las parcelas para obras, servicios o instalaciones de la Administración o para llevar a cabo las actuaciones previstas en el planeamiento urbanístico. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Por haber cesado en el cultivo de la parcela de cultivo adjudicada durante más de 3 meses sin que haya una comunicación expresa y motivada en el Ayuntamiento de Marratxí y éste lo acepte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Por incumplir reiteradamente las instrucciones dadas por el Ayuntamiento, las cláusulas contenidas en este Reglamento u otra normativa de aplicación, aunque no se haya sancionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c. A los efectos de la extinción de la licencia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El Ayuntamiento de Marratxí ha de iniciar un expediente contradictorio con audiencia pública de la persona titular de licencia de uso privativo, previamente a la aprobación de la caducidad o la revocación de la licencia. Este expediente debe contener un acta de comprobación del estado de la parcela asignada, realizado por el órgano competente que tiene que hacer la propuesta de resolución y extinción de la licencia municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Dentro de los 15 días hábiles siguientes a la fecha de recepción de la notificación del acuerdo mencionado, la persona usuaria debe dejar el huerto municipal vacío ya plena disposición del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Las obras y las plantaciones que tengan el concepto de mejora efectuada por la persona usuaria y que no puedan ser retiradas sin daño al terreno municipal, quedan en propiedad del Ayuntamiento sin que ello genere un derecho a indemnización. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Respecto de las cosechas, al extinguirse la licencia de uso privativo quedan a disposición de los Servicios Sociales municipales si el adjudicatario o personas familiares autorizadas no las han recolectadas en el plazo de 15 días hábiles antes mencionados. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Las personas usuarias no tienen derecho a ningún tipo de indemnización por pérdida de cosechas, por mejoras de la parcela o por otras incidencias que se deriven de la extinción o resolución de la licencia de uso privativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;11. prerrogativas municipales&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El Área de Servicios Sociales del Ayuntamiento de Marratxí, sin generar ningún derecho de indemnización a favor de la persona interesada o adjudicataria, puede concretar y modificar las condiciones generales de uso de las parcelas o espacios y otros elementos que se puedan asignar, y modificar los límites, los trazados de los caminos, las instalaciones de riego y otros servicios de la zona. A raíz de dichas actuaciones, que se le comunicarán, el adjudicatario podrá solicitar que se revoque la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Corresponde también al Área de Servicios Sociales interpretar el contenido de este Reglamento y resolver las dudas o lagunas, sin perjuicio del resto de prerrogativas amparadas por la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;12. Procedimiento para la concesión de las licencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento dictará Decreto que aprobará las Bases donde se concretarán los requisitos, plazos y condiciones de la convocatoria. Las Bases se publicarán en la página web y en el tablón de anuncios municipal. Una vez publicadas, los interesados ​​deberán presentar las correspondientes solicitudes en el plazo que se fije en la convocatoria. Concluido este plazo, el área que tramite la convocatoria evaluará provisionalmente las solicitudes presentadas y convocará una comisión municipal de la que formarán parte representantes del Área de Servicios Sociales y los Servicios Jurídicos Municipales. Esta comisión realizará una propuesta de adjudicación que será publicada en la página web municipal, con la apertura de un plazo de cinco días para la presentación de alegaciones. En caso de que no se presenten alegaciones, la propuesta será elevada para su aprobación de la adjudicación por Decreto de Alcaldía. En el caso de presentación de alegaciones, éstas serán informadas por la comisión antes de dictar resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La resolución del procedimiento se realizará en el plazo de 3 meses a contar desde la publicación de la convocatoria. Esta resolución se publicará en los sitios de información antes señalados y expresará la lista de beneficiarios y las que quedarán en lista de espera, así como la lista de excluidos con una indicación de la causa de exclusión.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;13. Requisitos para acceder a la adjudicación de huertos urbanos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Para participar en la convocatoria, las personas interesadas deben cumplir, en la fecha de finalización del plazo de presentación de solicitudes, los siguientes requisitos, en posesión de los cuales deben estar durante todo el proceso selectivo: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;- Personas físicas:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Tener 18 años cumplidos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Estar empadronado o empadronada en el municipio de Marratxí. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Tener las capacidades y aptitudes físicas y psíquicas que sean necesarias para ejercer las funciones atribuidas en el huerto urbano. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Quedan excluidas del procedimiento de selección aquellas personas físicas que concurran en algunas de las siguientes circunstancias: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Que hayan sido privadas del uso privativo para el cultivo de los huertos urbanos en el municipio de Marratxí u otras localidades, mediante un expediente con resolución firme.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Que dispongan, como mínimo hasta la fecha de finalización de presentación de la solicitud, del uso de otro huerto municipal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Que estén empadronadas con alguien a quien ya se haya adjudicado el uso de un huerto urbano en el término municipal de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;- Personas jurídicas:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Asociaciones o entidades sin ánimo de lucro cuyo objeto social incluya actividades divulgativas, formativas o de sensibilización y siempre que cumplan los requisitos establecidos en estas bases. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Tener el domicilio social o sede social en Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Haber realizado las actividades divulgativas, formativas o de sensibilización durante el año anterior a la convocatoria. A efectos de acreditar este extremo se presentará una memoria donde justificará documentalmente la realización de estas actividades en el periodo señalado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) Listado de las personas que atiende (por protección de datos, en el listado sólo aparecerán los DNI)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Quedan excluidas del procedimiento de selección aquellas personas jurídicas que concurran en algunas de las circunstancias siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Que hayan sido privadas del uso privativo de los huertos urbanos en el municipio de Marratxí u otras localidades, mediante un expediente con resolución firme. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Que dispongan, como mínimo hasta la fecha de finalización de presentación de la solicitud, del uso de otro huerto municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;14. Criterios de valoración general&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Personas físicas:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La proporción de huerto estará en función de la puntuación obtenida. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;1. Renta anual familiar &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Cuatro niveles de renta: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Nivel 1: Rentas totales de la unidad familiar iguales o inferiores a 16.325,00 euros: 10 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Nivel 2: Rentas totales de la unidad familiar iguales o inferiores a 18.068'40 euros: 9 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Nivel 3: Rentas totales de la unidad familiar iguales o inferiores a 27.102'60 euros: 6 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Nivel 4: Rentas totales de la unidad familiar iguales o inferiores a 36.136'80 euros: 4 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Decreto de convocatoria podrá actualizar estas cantidades.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En los siguientes casos se sumará la siguiente puntuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Ser beneficiario de la renta mínima de inserción: 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Estar parado sin prestación por desempleo: 5 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Estar parado con prestación por desempleo: 2 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Ser mayor de 65 años o pensionista: 2 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;2. Existencia de discapacitados &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Por discapacidad física, psíquica o sensorial en la unidad familiar con calificación de discapacidad igual o superior a un 33%: 3 puntos por cada miembro con discapacidad con un máximo de 6 puntos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;3. situación familiar &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Familia numerosa:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- 3 hijos: 2 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Más de 3 hijos: 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Partes múltiples: 1 punto &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Familias monoparentales (un solo progenitor, viudedad o separación y dependen económicamente de un progenitor): 1 punto&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Situación de violencia de género: 2 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- &lt;/span&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;personas jurídicas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Habrá un espacio reservado para la adjudicación a personas jurídicas, asociaciones o entidades sin ánimo de lucro, que lo soliciten, el objeto social incluya actividades divulgativas, formativas o de sensibilización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los criterios de adjudicación serán los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;1. Local de atención&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Dispone de un local de atención: 10 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;2. Número de personas que atiende mensualmente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Atiende entre 30 y 60 personas: 5 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Atiende entre 60 y 90 personas: 10 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Atiende a más de 90 personas: 15 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;15. Criterios de valoración para la concesión de la proporción de huerto urbano a las personas o familias en situación de vulnerabilidad y / o precariedad económica&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los / las técnicos / as de Servicios Sociales podrán determinar la adjudicación de huerto urbano a las personas o familias que consideren de riesgo social, en situación de vulnerabilidad y / o precariedad económica, mediante la emisión de un informe donde se constatará la existencia de esta situación y se determinará la adjudicación de huerto urbano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El baremo de la puntuación será la misma que se establece en el punto anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;16. Las listas de espera y su vigencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Las personas admitidas que no sean adjudicatarias de ningún huerto permanecen en una lista de personas suplentes, según el lugar en que hayan quedado según la puntuación obtenida. En caso de empate, el orden se determinará según la de ata de solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Cuando haya un huerto vacante, se debe ofrecer de acuerdo con el orden estricto de prelación de la lista de espera correspondiente al tipo de persona solicitante. La notificación se realizará por correo electrónico o por vía telefónica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Si la persona solicitante al que se ofrece el cultivo de un huerto no manifiesta en el plazo de tres días la conformidad con la propuesta, se entiende que renuncia al cultivo del huerto urbano y se la excluye de la adjudicación, aunque puede continuar dentro de la lista de espera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;17. Régimen de responsabilidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento de Marratxí no se hace responsable de los robos o actos vandálicos que puedan afectar a las personas usuarias, pero se responsabilizará de las reparaciones ocasionadas por mantener el huerto en condiciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Igualmente, queda exento de cualquier responsabilidad en caso de accidente de la persona adjudicataria o de las personas acompañantes en el desarrollo de las tareas de cultivo y en la estancia en el recinto. Es a cargo de la persona adjudicataria cualquier responsabilidad por estos conceptos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición Final&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este Reglamento entrará en vigor al día siguiente de su publicación en el BOIB y siempre que haya transcurrido el plazo de quince días a los que se hace mención en los artículos 103 y 113 de la Ley 20/2006 Municipal y de Régimen Local de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;
