    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 14&amp;nbsp;de noviembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para las Inversiones&amp;nbsp;en la Transformación y la comercialización de productos agrícolas, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;del FOGAIBA, con fecha 24&amp;nbsp;de mayo&amp;nbsp;de 2019, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;"INFORME PROPUESTA DE RESOLUCIÓN / RESOLUCIÓN DE REVOCACIÓN &lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 14 de noviembre de 2015 se publicó en el BOIB núm. 168, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en la transformación y la comercialización de productos agrícolas&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;29/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;06&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2017 tuvo entrada en el Registro del GOBIERNO DE BALEARES, número registro 172&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;99&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2017, la solicitud de ayuda presentada por &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;PROPICARN SL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;., &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;on NIF: &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;B&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;07&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;892200&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, para la convocatoria 2017_1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, (expediente ITC 2017_1/039)&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Analizada toda la documentación presentada, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;23&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2018, el vicepresidente del FOGAIBA dictó Resolución de concesión de la ayuda, a cargo de la anualidad 2018, a favor del interesado por un importe de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3.6&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;78&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0 €,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;que corresponde a una inversión aprobada de 31.196,00€, &amp;nbsp;cofinanciados en un 53,00% por el FEADER, 14,10% la AGE, y 32,90% la CAIB, distribuidos de la siguiente manera:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.249,55€ con cargo a la línea FEADER núm. 050460010441104&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.500,20€ con cargo a la CAIB&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.928,65€ con cargo a la AGE&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.La inversión aprobada corresponde a los siguientes capítulos, tal y como se detalla en la Resolución notificada el día 05 de febrero de 2019 (BOIB 16 de 05/02/2019):&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Maquinaria:&amp;nbsp; 19.150,00&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Intangibles: 14.280,00&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Honorarios: 766,00&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Los 'Intangibles' corresponden al presupuesto presentado por el interesado de Cocodin Technology SL nº3068 de 20/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;04/2017. Este presupuesto ponía "Consultoría, análisis y captura &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;r&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;equisitos. Gestión y Seguimiento. Implantación Pruebas, ajustes, formación, des&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;arrollo&amp;nbsp;a medida y parametrización ". En la solicitud ponía "software control calidad IFS". La memoria aportada por el beneficiario explica este presupuesto como "Sistema de control de trabajo interno para evitar posibles alteraciones del producto de forma intencionada, basada en la conexión de las camaras de las zonas de trabajo en el sistema informático de la empresa. Se trata del cumplimiento de una Norma de seguridad alimentaria IFS (International Food Standard) ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;El servicio gestor analizó esta finalidad de la actuación de Intangibles y la consideró elegible, con el concepto de 'software y conexión' de cámaras de zonas de trabajo en el sistema informático, como un intangible para cumplir el IFS.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. El día &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;01/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;04/2019 interesado registró de entrada (riego 9212/2019) la solicitud de pago final de la ayuda, por un importe de inversión de 17.182,94 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Revisados los documentos justificativos de los gastos realizados para llevar a cabo la actuación objeto de la ayuda, el servicio gestor considera que la inversión ejecutada y justificada correctamente es de 9.524,94 €, no llegando al 50% de la inversión concedida .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;30/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;04/2019 el Servicio de Ayudas al Desarrollo Rural ha emitido informe desfavorable y propuesta provisional de revocación total de la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;03/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;05/2019 se notifica al interesado, mediante publicación en la página web http://www.caib.es, dicha propuesta provisional, concediéndole un plazo de 10 días para presentar las alegaciones oportunas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;14/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;05&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2019 (registro 14849/2019) el interesado presenta alegaciones al ementada propuesta provisional, dentro del plazo establecido.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Consideraciones jurídicas&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1. Visto que el importe del proyecto aprobado en la Resolución de Concesión de 23/10/2018 es de 34.196,00 €, desglosado en los conceptos de Maquinaria, Intangibles, y Honorarios.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Visto que con la solicitud de pago presentada ha justificado efectivamente la ejecución y el pago de 9.524,94 € de actuaciones, que supone el 27.85% de la inversión.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Vistas las alegaciones del beneficiario, que dicen que han conseguido el objetivo de elaboración de preparados cárnicos y que se han justificado 9.158,60 € de maquinaria, no demuestran que la actuación de intangibles aprobada en la sol solicitud de ayuda se haya realizado. Por lo tanto, este servicio gestor ratifica que el importe ejecutado es inferior al 50% del importe concedido.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. De acuerdo con el punto 9 del apartado undécimo de la convocatoria: "en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada, se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que la finalidad de la subvención, dada su naturaleza, sea susceptible de satisfacción parcial, y siempre y cuando se acerquen de modo significativo al cumplimiento total de los objetivos previstos y supongan al menos un 50% de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial. "&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. De acuerdo con el Reglamento (UE) 1306/2013, el incumplimiento del Compromiso Básico realizar al menos el 50% de las inversiones implica la reducción del 100% de la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. De acuerdo con el artículo 109 de la Ley 39/2015, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, las Administraciones públicas podrán revocar en cualquier momento sus actos, expresos o presuntos, no declarativos de derechos y los de gravamen, siempre que la revocación no sea contraria al ordenamiento jurídico.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. De acuerdo con el artículo 43 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones, procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención; como consecuencia, queda sin efecto el acto de concesión.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Por todo lo expuesto anteriormente, se considera que la ejecución de al menos un 50% del proyecto aprobado constituye un requisito para el cobro de la ayuda concedida, y el incumplimiento de esta obligación de justificación, por no realizarse con los términos y en los plazos establecidos en la normativa, implica la posibilidad de revocar la ayuda otorgada a PROPICARN SL mediante la Resolución de concesión de la subvención de fecha 23 de octubre de 2018, por incumplimiento de los compromisos adquiridos y por tanto el no reconocimiento de la liquidación y la tramitación del pago o el reintegro de la ayuda ya recibida en su caso.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Vista la Orden de la Consejera de Agricultura y Pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del FOGAIBA, establece a el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero, a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;15. Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), en la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la Consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Conclusión&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo lo expuesto anteriormente, se desestiman las alegaciones presentadas por el interesado. Se ha incumplido el apartado 11.9 de la convocatoria, por no ejecutar un mínimo del 50% de la inversión aprobada, y corresponde revocar toda la ayuda concedida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Informe-Propuesta de Revocación &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.En consecuencia, dejar sin efecto la mencionada resolución de concesión de la ayuda y proceder al archivo de las actuaciones del expediente ITC 2017_1 / 0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;39.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución a los interesados.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Contra esta Resolución se podrá interponer recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con lo establece en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 121 y 122, de la Ley 39/2015 del procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
