&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;20 de mayo de 2019 &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Gerente Fundación Orquestra Simfònica Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Bases&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. &lt;strong&gt;Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El objeto de la presente convocatoria es la cobertura en régimen laboral fijo de los puestos de trabajo de solista de trompeta y de solista de trompa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A esta convocatoria de promoción interna, se podrán presentar respectivamente los profesores instrumentistas de la Orquesta Sinfónica de las Islas Baleares, que al término del plazo de presentación de instancias tengan la condición de fijo de plantilla en las especialidades instrumentales mencionadas&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La promoción interna se llevará a efecto mediante el sistema de trials, es decir, mediante la audición de los aspirantes durante los conciertos de la temporada y sus ensayos, valorándose su defensa de los papeles solistas asignados según se explica en el punto siguiente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. &lt;strong&gt;Selección&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los aspirantes deberán remitir a la Gerencia de la Fundación Orquesta Sinfónica Islas Baleares dentro de los 15 días siguientes a la publicación de esta convocatoria en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; una instancia siguiendo el modelo oficial que se anexa a estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Una vez finalizado el plazo y con la publicación de la lista de admitidos y excluidos a la convocatoria y, por tanto, del número de aspirantes, se anunciará el período de duración de los trials y los conciertos que los integran. Igualmente, dependiendo del número de aspirantes, se harán púbicos los cupos de obras del repertorio de la temporada que los aspirantes deberán defender como solistas durante estos trials. Se confeccionarán tantos cupos como aspirantes. Estos cupos los elaborará un experto independiente en el instrumento y serán aprobados por la Comisión Artística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;3. Tribunal calificador&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a)El tribunal deberá estar presente en todas las pruebas del trial ya sea en el podio, en plantilla o en el público, y tendrá la composición siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Presidente: Pablo Mielgo (director titular), suplido o asesorado por el maestro que se designe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Vocales: el concertino, el concertino asociado, todos los solistas de la OSIB (excepto si son aspirantes) y tres músicos no solistas elegidos por sorteo. En suplencia de los solistas, intervendrán los ayuda de solista respectivos (excepto si son aspirantes). En suplencia de los tutti, intervendrán los tutti suplentes, que también serán objeto de sorteo. Todos los miembros del tribunal están sometidos a las normas generales sobre abstención y recusación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Secretaría (sin voto): el gerente de la Fundación. En caso de suplencia, actuará como secretario un funcionario de la Consejería de Cultura, Participación y Deportes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En los conciertos con director invitado, éste podrá participar en las deliberaciones con voz y sin voto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los representantes del comité de empresa podrán asistir tanto a las pruebas como a las deliberaciones en calidad de observadores, sin que puedan intervenir en los debates ni en las deliberaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Una vez constituido al inicio de procedimiento éste no podrá ser objeto de variación y sus miembros con voto deben asistir a todos los servicios que constituyan el trial. Podrá constituirse un tribunal para cada especialidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Para la calificación de los ejercicios el tribunal seguirá las pautas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Cada papel de solista defendido por cada aspirante se considerará un ejercicio y será puntuado inmediatamente después de cada concierto según las reglas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los acuerdos del tribunal se adoptarán en función de la mayor puntuación, fruto de las opiniones numéricas de cada miembro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Cada miembro del tribunal puntuará a cada aspirante con un número del 0 (puntuación más baja) al 10 (puntuación más alta), y podrá añadir como máximo un decimal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Una vez anotadas todas las puntuaciones, se rechazarán la más alta y la más baja.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Con la lista de admitidos y excluidos se hará pública la identificación nominal de los miembros titulares, y los correspondientes suplentes, del tribunal calificador. La abstención y recusación de los miembros del tribunal se hará efectiva de acuerdo con lo dispuesto en los artículos correspondientes de la normativa de régimen jurídico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) El tribunal no se podrá constituir ni actuar sin la asistencia del presidente, el secretario, o sus suplentes y de más de la mitad de sus miembros, titulares o suplentes, indistintamente, y las decisiones se adoptarán por mayoría simple, actuando el secretario, sin voto.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;e) El tribunal queda facultado para resolver las dudas o incidencias que se presenten y tomar los acuerdos necesarios para el buen funcionamiento del procedimiento de selección y de todo lo que no esté previsto en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:normal"&gt;4. &lt;strong&gt;Desarrollo de las audiciones&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Las pruebas de selección consistirán en un procedimiento denominado trial o prueba-concurso que consistirá en la defensa del papel de solista (en cada una de las especialidades), en los conciertos de la orquesta que se determinen, sus ensayos generales y pregenerales y podrá darse durante más de una temporada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Comisión Artística con la propuesta de un experto independiente del instrumento en cuestión preparará y aprobará los cupos de obras en los que los aspirantes deben defender el papel de solista. Ningún aspirante podrá intervenir en esta fase. Será de aplicación a este grupo la misma normativa de abstención o recusación que la aplicable a los miembros del tribunal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Estos cupos de partes solistas en las obras deben efectuarse con el objetivo de que en cada cupo se incluyan papeles de igual o similar dificultad, tesituras, sonoridad, intensidad, etc. Se elaborarán tantos cupos como aspirantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La asignación de cada cupo por aspirante se hará mediante sorteo público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La puntuación que los miembros del tribunal otorguen a cada aspirante será secreta. Cada miembro del tribunal tendrá una hoja para cada prueba, donde pondrá la nota final y las observaciones. Esta hoja será anónima y se recogerá al final de cada concierto / trial por la Secretaría del tribunal. La Secretaría introducirá las calificaciones en un sobre que quedará sellado hasta el final de las pruebas trial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El recuento final, una vez finalizada la fase de trial, será público y se llevará a cabo por parte de la Secretaría del tribunal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La fase de trial debe desarrollarse igualmente aunque sólo quede un aspirante en la lista definitiva de admitidos y excluidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;5. Resultado de las pruebas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Una vez acabadas las audiciones, el tribunal publicará el acta con la lista de candidatos (por orden de mayor a menor puntuación) en el tablón de anuncios de la Fundación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) En caso de empates en la puntuación total, el tribunal podrá efectuar una ronda de desempate con el mismo procedimiento de trial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Contra estas bases selectivas se puede interponer recurso ante la jurisdicción social de acuerdo con lo que prevé la Ley 36/2011, de 10 de octubre, reguladora de la jurisdicción social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
