En fecha 16 de julio de 2015, se publicó en el <em>Boletín Oficial de las Islas Baleares</em> nº 106 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. De conformidad con el apartado sexto de la Resolución mencionada, el plazo para presentar las solicitudes acabó el día 31 de diciembre de 2016. </span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Las personas interesadas señaladas en el a<strong>nexo I</strong> adjunto han presentado, dentro del plazo establecido y en la forma apropiada, toda la documentación necesaria prevista a la convocatoria, y se ha comprobado que cumplen los requisitos exigidos para poder ser beneficiarios de esta ayuda.</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Las actuaciones solicitadas por los interesados cumplen los requisitos establecidos a la convocatoria con el fin de poder ser subvencionables.</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. <span style="color:black">Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria, no hay ningún impedimento para resolver estos expedientes sin afectar a lo que disponen los apartados séptimos y octavos de la convocatoria. </span></span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. <span style="color:black">En fecha 3 de diciembre de 2018, se publicó a la web la propuesta provisional de concesión parcial.</span></span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. <span style="color:black">En fecha 9 de abril de 2019, el beneficiario presentó alegaciones y se admiten, ya que la inversión propuesta tiene el informe favorable de moderación de costes.</span></span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="color:null"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></strong></span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Resolución, de 10 de julio de 2015, del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Orden del consejero de Agricultura, Medio Ambiente y Territorio, de 19 de febrero de 2015, por la cual se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></p> <p style="margin-bottom:0.0001pt; margin-left:0cm; margin-right:0cm; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución de concesión parcial</strong></span></p> <p style="margin-bottom:.0001pt; margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo eso, vista la propuesta de resolución de concesión, ocurre Resolución de concesión parcial en los términos siguientes:</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Conceder la ayuda solicitada a las personas interesadas por los importes y con los plazos detallados en el a<strong>nexo I</strong> —que es un total de un expediente y que empieza y acaba con JAVIER BENITEZ CAPITAN”—, el cual suma un importe total de 65.154&nbsp;euros de la línea de ayudas Inversiones a las explotaciones agrarias.</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autorizar y disponer el gasto señalado con cargo a los presupuestos y porcentajes de cofinanciamiento detallados en el a<strong>nexo I</strong>.</span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Determinar que, de acuerdo con lo que establece la convocatoria, las obligaciones de los beneficiarios serán las indicadas en el a<strong>nexo II.</strong></span></p> <p style="margin-bottom:0.0001pt; margin-right:0cm; margin-top:5pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Realizar las inversiones o actividades auxiliadas en el plazo establecido.</p> <p>2. Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en los términos y plazos determinados en esta Resolución.</p> <p>3. Incrementar un 5%&nbsp;los ingresos agrarios iniciales en uno de los cinco años siguientes en el pago de la ayuda, excepto en los casos de inicio de actividad incluidos en el punto 1.2 del apartado tercero.</p> <p>6. Adoptar las medidas que sean necesarias para proporcionar información al público y dar publicidad.</p> <p>7. Someterse a los controles que lleve a cabo la Administración, necesarios para comprobar la concesión correcta de la ayuda y el mantenimiento posterior de los compromisos.</p> <p>8. Cumplir los compromisos adquiridos para la concesión de la ayuda.</p> <p>9.
