es CAIB 2019-04-27 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No habiendo sido presentada por los interesados, durante el plazo de exposición al público, ninguna reclamación o sugerencia contra el acuerdo de modificación de la Ordenanza reguladora del Precio Público por servicios de temporada en las zonas delimitadas de las playas del término municipal, concepto 341,04, aprobado provisionalmente por el Ayuntamiento Pleno en sesión de día 25 de octubre de 2018, se entiende definitivamente aprobado, según lo que dispone el artículo 49 de la Ley 7/1985, de 2 de abril, de bases de régimen local, y por este motivo, se publica el texto íntegro del mencionado acuerdo, que es el siguiente:&nbsp;&nbsp;&nbsp; &nbsp;</span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">ACUERDO</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>“Primero.- </strong>Aprobar la modificación de la ordenanza reguladora de Precio Público por servicios de temporada en las zonas delimitadas de las playas del término municipal, concepto 341,04; todo ello en base a la legislación vigente en la materia, constituida singularmente por los artículos 41 al 47 del Texto Refundido de la Ley de Haciendas locales, aprobado por Real decreto legislativo 2/2004, de 5 de marzo y el artículo 49 de la Ley de bases de régimen local, y según la nueva redacción que se adjunta a esta propuesta.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La nueva redacción de la Ordenanza reguladora del precio público por servicios de temporada en las zonas delimitadas de las playas del término municipal, quedará así:</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ordenanza reguladora del precio público por servicios de temporada en las zonas delimitadas del término municipal&nbsp;</span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Concepto &nbsp;341,04</span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 1</span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Concepto</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el artículo 127, en relación con el artículo 41, ambos del Texto Refundido de la Ley de Haciendas Locales aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo, reguladora de las Haciendas Locales, este Ayuntamiento establece el precio público por servicios de temporada en las zonas delimitadas de las playas del Término municipal, que se regirá por la presente Ordenanza.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El objeto de este precio público es el disfrute, por parte de los usuarios, de elementos no fijos, como hamacas, tumbonas, etc., ubicados en las zonas de la playa debidamente delimitadas.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 2</span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Obligados al pago.</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Están obligadas al pago las personas o entidades que soliciten el servicio objeto de este precio público.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 3</span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cuantía</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;La cuantía de este precio público reguladora en esta Ordenanza será la fijada en la tarifa contenida en el apartado siguiente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. margin-right:0px; margin-top:0px"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Normas de Gestión</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;Las personas interesadas en la utilización de los servicios señalados en esta ordenanza lo solicitarán a los encargados de su gestión. En este momento nacerá la obligación de pago del precio público.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;La gestión de los servicios a que esta ordenanza se refiere podrá ser objeto de concesión anual por parte del Ayuntamiento, a favor de persona natural o jurídica, mediante cualquiera de los tipos de licitación legalmente establecidos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.&nbsp;En caso de concesión a que se refiere el número anterior, el concesionario deberá limitar su actividad a la zona de playa que haya sido anualmente delimitada por la Jefatura de Costas y Puertos de Baleares y sobre la cual recaiga la concesión de la prestación de los servicios.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.&nbsp;Respecto de las futuras tarifas, de acuerdo con lo que dispone el artículo 47 del Texto refundido de la Ley reguladora de las haciendas locales y el artículo 23.2.b) de la Ley 7/1985, de régimen local, la cuantía del nuevo precio público será fijado por la Junta de gobierno de Palma a propuesta del Regidor/a titular del área competente en materia de interior, atendiendo al estudio económico que se efectuará por el técnico responsable sobre el servicio de playas.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Disposición final</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La presente Ordenanza, originariamente aprobada por el Ayuntamiento Pleno en sesión celebrada el día 28 de &nbsp;Septiembre de 1989, su última modificación de la cual se aprobó por acuerdo plenario de ___ de __________ de 20119, entra en vigor a partir de _______________.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segundo.- </strong>Que una vez adoptado el acuerdo provisional referido, se publique en el BOIB y en uno de los diarios de mayor difusión de la Comunidad Autónoma el correspondiente anuncio de exposición al público del expediente, a efectos de reclamación. La citada exposición se hará en el tablón de edictos de este Ayuntamiento durante el plazo de treinta días, durante los cuales los interesados podrán examinar el expediente y presentar las reclamaciones que estimen oportunas, entendiendo que si durante el mencionado plazo no se hubiesen presentado reclamaciones, se entenderá definitivamente adoptado el acuerdo provisional.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tercero.- </strong>La expresada modificación entrará en vigor el día siguiente de su publicación en el BOIB.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Lo que se publica para que se tenga conocimiento general y a los efectos oportunos, y se comunica que, conforme a lo que dispone el artículo 52.1 de la Ley 7/1985, de 2 de abril, los interesados podrán interponer recurso contencioso administrativo, de acuerdo con el artículo 19 de la Ley 29/98, de 13 de julio, reguladora de la jurisdicción contencioso administrativa, ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Islas Baleares, contra el acuerdo definitivo de modificación de la mencionada ordenanza, en el plazo de dos meses contados a partir del día siguiente al de su publicación en el BOIB.
