    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La Alcaldía del Ayuntamiento de Son Servera, mediante el Decreto 2019-0595 de día 23 de abril de 2019, ha resuelto aprobar la segunda convocatoria y las bases reguladoras de la convocatoria pública de concesión de autorizaciones de ocupación de huertos ecológicos urbanos del municipio de Son Servera para el año 2019. Estas bases reguladoras son las que se transcriben literalmente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;“&lt;strong&gt;BASES REGULADORAS DE LA CONVOCATORIA PÚBLICA DE LA ADJUDICACIÓN DE LES PARCELAS DE LOS HUERTOS ECOLÓGICOS URBANOS DE SON SERVERA &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;(CONVOCATORIA 2019)&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;1. OBJETO Y FINALIDAD &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El objeto de estas bases es convocar públicamente la selección de las personas y asociaciones interesadas en la adjudicación de los huertos ecológicos urbanos habilitados por el Ayuntamiento de Son Servera en Cala Millor, concretamente en la Calle Llorer número 6. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Esta convocatoria se rige por el Reglamento regulador del régimen de uso de los huertos ecológicos urbanos del municipio de Son Servera (publicado en el BOIB núm. 24, de 25 de febrero de 2017 y modificado en el BOIB núm. 51, de 29 de abril de 2017). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;2. DESTINATARIOS Y REQUISITOS DE LOS SOLICITANTES &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Pueden participar en esta convocatoria las personas físicas o jurídicas que cumplan los siguientes requisitos: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Personas físicas: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Tener como mínimo 18 años. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Estar empadronado en el municipio de Son Servera, como mínimo durante 1 año antes de la fecha en que finaliza el plazo de presentación de la solicitud de adjudicación. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Tener las capacidades y aptitudes físicas y psíquicas que sean necesarias para ejercer las funciones atribuidas al huerto urbano. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Estar al corriente del pago de las obligaciones tributarias con el Ayuntamiento. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Personas Jurídicas: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Ser asociaciones el objeto social de les cuales incluya actividades divulgativas, formativas o de sensibilización y siempre que cumplan los requisitos establecidos en estas bases. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Estar inscritas en el Registro municipal de entidades ciudadanas del Ayuntamiento de Son Servera. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Tener el domicilio social o sede social en el término municipal de Son Servera. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Estar al corriente de las obligaciones tributarias con el Ayuntamiento. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Serán causas de exclusión del procedimiento de selección: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Haber estado privado del uso privativo para el cultivo de huertos urbanos en cualquier municipio con resolución administrativa firme. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Disponer a la fecha de finalización de la solicitud del uso de otro huerto municipal. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Personas físicas empadronadas con alguna persona a la cual se le haya adjudicado el uso de un huerto urbano en el Término Municipal de Son Servera para el mismo ejercicio. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;3. SOLICITUDES &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las personas y asociaciones interesadas tienen que presentar una solicitud de licencia de uso privativo de los huertos urbanos según el modelo del ANEXO 1, para personas físicas, y ANEXO 2, para personas jurídicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El plazo para presentar solicitudes es de 15 días hábiles a partir de la publicación de estas bases en el BOIB. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Les solicitudes, una vez rellenadas, tienen que presentarse en el Registro del Ayuntamiento de Son Servera o bien mediante cualquiera de los medios establecidos por el artículo 16 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, acompañadas de la siguiente documentación: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1) Personas físicas: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a. Fotocopia del documento nacional de identidad o, en el caso de no ser persona española, del documento acreditativo de la personalidad (NIE, pasaporte o tarjeta de residencia). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b. Declaración jurada de tener les capacidades y aptitudes físicas y psíquicas que sean necesarias para ejercer las funciones derivadas del huerto urbano, según ANEXO 3 de la presente convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c. Informe de los Servicios Sociales que acrediten el grado de necesidad de la persona, si es necesario. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2) Persones jurídicas: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a. Original o copia compulsada de los Estatutos de la persona jurídica. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b. Fotocopia del CIF de la entidad. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c. Relación de las personas que hayan de desarrollar el proyecto en nombre de la asociación o entidad, haciendo declaración que cumplen con todos los requisitos del apartado 2 de esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Solo se admite una solicitud por persona solicitante y, por tanto, solo podrá resultar beneficiaria de una única parcela. No obstante, las personas físicas adjudicatarias pueden disponer del soporte de hasta un máximo de dos (2) personas acompañantes, previa comunicación al Ayuntamiento, de acuerdo con lo establecido en el artículo 5.4. del reglamento de huertos urbanos de Son Servera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;4. ADMISIÓN DE LAS PERSONAS SOLICITANTES &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Finalizado el plazo de presentación de solicitudes y la comprobación que se cumplan los requisitos, se elaborará una lista provisional de personas admitidas y excluidas, con la indicación de las causas de exclusión. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se otorgará un plazo de 3 días hábiles, contados a partir del día siguiente al de la publicación de las listas provisionales en el tablón de edictos del Ayuntamiento, para poder presentar alegaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Una vez finalizado este plazo, el Ayuntamiento dictará una resolución, en el plazo máximo de 10 días hábiles, con la lista definitiva de personas admitidas y excluidas, y determinará el día, la hora y el lugar de realización del sorteo de selección en el caso que las solicitudes superen las parcelas disponibles. Esta resolución tiene que hacerse pública en los mismos lugares indicados para la resolución provisional. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En caso que no se presenten reclamaciones, la lista provisional quedará elevada a definitiva de forma automática. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;5. CARACTERÍSTICAS DE LAS PARCELAS &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En esta convocatoria se habilitan 8 parcelas que permanecen disponibles de la primera convocatoria, cada una con una superficie de 24 m² (8 metros de longitud y 3 metros de amplitud) en el siguiente emplazamiento: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Huertos urbanos, delante de la Policía Local de Son Servera &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Cala Millor - Calle Llorer núm. 6 &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;07550 – Son Servera &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Referencia catastral núm. 2741916ED3824S0001HZ. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Cada parcela dispondrá de un contador individual instalado por el Ayuntamiento y el sistema de riego será mediante manguera exudante o por goteo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La persona adjudicataria dispone, por tiempo limitado, del usufructo de la parcela de cultivo que se le asigne y de las instalaciones accesorias. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;6. PROCEDIMIENTO DE ADJUDICACIÓN &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Si hay parcelas suficientes para atender a todas las solicitudes de las personas admitidas, se adjudicará, mediante Decreto, una parcela a cada una de les personas admitidas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Cuando el nombre de personas admitidas sea mayor que el de parcelas disponibles, se seguirá el procedimiento siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6.1. Adjudicación de parcelas destinadas a particulares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;De las parcelas destinadas a personas físicas, se reservará un 50% para las personas que formen parte de familias con necesidades y que lo acrediten mediante un informe del Departamento de Servicios Sociales del Ayuntamiento. Si las solicitudes que cumplen el anterior criterio son superiores a las parcelas ofertadas, se adjudicarán mediante sorteo. Una vez adjudicadas las parcelas reservadas a personas derivadas de Servicios Sociales, se adjudicarán las parcelas restantes. Se tienen que tener en consideración todas las personas admitidas y que no hayan resultado adjudicatarias de las parcelas mencionadas en el punto anterior. En caso que aun haya más solicitudes que parcelas disponibles, se adjudicaran igualmente por sorteo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6.2. Adjudicación de las parcelas destinadas a personas jurídicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se tiene que adjudicar una parcela a cada una de las solicitudes admitidas, siempre que el número de solicitudes no supere el número de parcelas disponibles. Si hay más solicitudes que parcelas disponibles, se adjudicarán por sorteo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Si es necesario, de acuerdo con el que prevé el punto anterior, se hará un sorteo público para adjudicar las parcelas disponibles a las personas físicas y jurídicas admitidas, ante la secretaria del Ayuntamiento y el regidor responsable. La fecha, hora y lugar del sorteo se tienen que comunicar a todas las personas admitidas mediante correo electrónico, por vía telefónica y mediante una publicación en la página web del Ayuntamiento Son Servera. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En el sorteo se tienen que extraer todas las papeletas y la orden de extracción tiene que determinar el orden de prelación de las personas aspirantes. Del sorteo, tienen que salir dos listas que el Ayuntamiento de Son Servera pondrá a disposición de los ciudadanos, una para personas físicas y otra para personas jurídicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Una vez realizado el sorteo, el Ayuntamiento tiene que dictar resolución de adjudicación de las licencias de uso privativo de dominio público para el cultivo de los huertos urbanos del término municipal de Son Servera, de acuerdo con la orden de prelación derivada del sorteo público y del número de parcelas habilitadas para cada convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;7. LICENCIA DE USO Y ACCESO A LOS HUERTOS &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La adjudicación del uso privativo de las parcelas de cultivo de los huertos se otorga por un periodo de un (1) año. La licencia se puede prorrogar por un periodo de un (1) año más, hasta llegar a un máximo total de tres (3) años, salvo que antes de este plazo tenga lugar la renuncia o la revocación de la licencia. En caso de dejar la parcela sin faenar más de cuatro (4) meses, ésta quedará libre y podrá ser adjudicada nuevamente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El acceso a los huertos queda restringido al personal municipal autorizado y a las personas adjudicatarias. Las personas físicas pueden disponer, comunicando al Ayuntamiento, del apoyo de terceras personas por un plazo máximo consecutivo de 3 meses. El Ayuntamiento tiene que emitir una autorización provisional de acceso a la persona designada por la persona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Tanto las personas adjudicatarias como las autorizadas por imposibilidad justificada de la persona adjudicataria, pueden introducir en el recinto hasta un máximo de 2 personas acompañantes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las personas y asociaciones titulares de las licencias podrán acceder a los huertos urbanos dentro del horario de apertura que se fije.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;8. VACANTES Y VIGENCIA DE LAS LISTAS DE ESPERA &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las personas admitidas que no hayan estado adjudicatarias de ningún huerto tienen que formar parte de una lista de personas suplentes, según el lugar en que hayan quedado en el sorteo. En esta lista se tienen que añadir, por orden cronológico, aquellas personas que posteriormente presenten solicitudes que manifiesten que están interesadas en la adjudicación de una parcela.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Cuando haya un huerto vacante, se tiene que ofrecer de acuerdo con el orden estricto de prelación de la lista de espera correspondiente al huerto y al tipo de persona solicitante. La notificación se tiene que formalizar por medio de correo electrónico o por vía telefónica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Si la persona solicitante a quien se ofrece el cultivo de un huerto no manifiesta su conformidad en el plazo de tres días, se entenderá que renuncia al cultivo del huerto urbano y se le excluirá de la adjudicación, aunque podrá continuar dentro de la lista de espera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;9. CADUCIDAD Y REVOCACIÓN DE LA LICENCIA &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. La licencia de uso privativo caduca por los siguientes motivos: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Por vencimiento del plazo final. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Por renuncia de la persona titular de la licencia antes del vencimiento del plazo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Por muerte o incapacidad sobrevenida de la persona adjudicataria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d) Por voluntad unilateral del Ayuntamiento de Son Servera. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. La licencia de uso privativo puede ser revocada por los motivos siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Por pérdida de las condiciones de acceso, de acuerdo con el artículo 11 del reglamento de huertos urbanos de Son Servera. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Por tener que disponer de les parcelas para obras, servicios o instalaciones de la Administración, o para llevar a cabo las actuaciones previstas en el planeamiento urbanístico municipal. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Por haber cesado en el cultivo de la parcela de cultivo adjudicada durante más de 4 meses, sin comunicación expresa y motivada al Ayuntamiento. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d) Por haber cometido una infracción muy grave prevista en el reglamento de huertos urbanos de Son Servera. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;e) Por incumplimiento reiterado de les instrucciones exigidas por el Ayuntamiento o cualquier normativa de aplicación, aunque no se haya sancionado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;10. OBLIGACIONES Y PROHIBICIONES &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;De acuerdo con lo establecido en el artículo 21 del reglamento de huertos urbanos de Son Servera las personas que disponen de una licencia de uso privativo tienen derecho a cultivar dentro de la parcela adjudicada. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Lea personas adjudicatarias están obligadas a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Asumir los gastos generados por la conservación y el mantenimiento de la parcela adjudicada. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Avisar inmediatamente al Ayuntamiento de Son Servera si detectan cualquier daño o desperfecto en la parcela o en sus instalaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Las obras y las reparaciones de renovación o reposición de la parte exterior de la parcela, del espacio o de sus elementos debido al envejecimiento o a otras causas en las que no se perciba daño o negligencia por parte de la persona adjudicataria o de la persona ayudante o acompañante, serán a cargo del Ayuntamiento de Son Servera. En caso contrario, serán a cargo de la persona adjudicataria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d) Mantener limpios y en perfecto estado de conservación las herramientas y los enseres necesarios para el cultivo que sean propiedad del Ayuntamiento. Se podrá requerir que se compensen los desperfectos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;e) Mantener el entorno de las parcelas en perfecto estado, limpios y libres de todo tipo de hierbas o residuos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;f) Cumplir las ordenanzas municipales y el resto de normativa vigente que les pueda afectar. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;g) Responder de los daños por robos, actos vandálicos y otros, así como de cualquier responsabilidad en caso de accidente personal. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;h) Hacerse cargo de las indemnizaciones económicas y de las reparaciones que se generen derivadas de los daños causados al huerto y a las correspondientes instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;i) Comunicar al Ayuntamiento los datos de la persona que ayude o acompañe y responder solidariamente delante del Ayuntamiento por sus actos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;j) Facilitar la entrada puntual a los huertos del personal municipal y de las personas autorizadas a este efecto, y colaborar en la resolución de todas las cuestiones que se planteen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;k) Resto de obligaciones que se deriven de las bases de la correspondiente convocatoria o de las instrucciones fijadas por el Ayuntamiento de Son Servera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;De acuerdo con el artículo 22 del reglamento de huertos urbanos de Son Servera, no se permite a les personas adjudicatarias:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Cultivar ninguna especie que no sea para el consumo humano, excepto flores y plantas aromáticas. No se permite plantar árboles o arbustos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Cultivar plantas degradantes del suelo ni plantas psicotrópicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Aplicar productos fitosanitarios de síntesis para el control de plagas o enfermedades. Solo se pueden aplicar los productos autorizados en agricultura ecológica. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d) Aplicar abonos de síntesis. Solo se pueden utilizar los productos autorizados en agricultura ecológica. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;e) La sustracción o el daño a productos o plantas obtenidos en el cultivo por parte de las personas adjudicatarias de otras parcelas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;f) Hacer alguna clase de obra, lo que incluye la prohibición de hacer algún tipo de nueva valla o separación (mediante muros, cañas, maderas, plásticos, uralitas, etc.), barbacoas, invernaderos, pozos, mesas fijas o bancos, como también la modificación interior o exterior de la caseta, si hay, o la construcción o instalación de nuevos elementos o modificación de los existentes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;g) Tener y criar cualquier tipo de animal o ganado y construir casetas o jaulas destinadas a éstas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;h) Cazar, talar árboles ya existentes en el huerto o realizar cualquier otra actividad que pueda causar daño a la fauna o a la flora que pueda haber en el huerto. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;i) Acumular o abandonar cualquier material o residuo, dentro o fuera del huerto, y aportar cualquier tipo de objeto ajeno a la función del huerto susceptible de alterar la estética del lugar; y utilizar la parcela como depósito o almacén de materiales. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;j) Alterar los caminos y las conducciones de riego del huerto adjudicado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;k) Mover los jalones y vallas que delimiten cada parcela. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;l) Realizar un cultivo que pueda invadir las parcelas adyacentes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;m) Dejar el huerto sin trabajar. En caso de imposibilidad temporal, que no se puede alargar más de 4 meses, la persona usuaria tendrá que comunicar de manera motivada esta circunstancia al Ayuntamiento. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;n) Circular por el interior del huerto con vehículos de motor. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;o) Estacionar automóviles en el interior del huerto. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;p) No respectar las normas básicas de convivencia ni estética del huerto; mantener una conducta insolidaria o hacer un gasto excesivo de agua. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;q) Cualquier otro uso no previsto anteriormente y que produzca molestias o malos olores, limite el uso y el goce del resto de parcelas o afecte el entorno del lugar. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
