![CDATA[<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Antecedentes</strong></span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>1.</strong> El 14 de diciembre de 2018, la presidenta del Instituto Mallorquín de Asuntos Sociales (IMAS) aprobó el expediente de convocatoria del primer concierto social del servicio de vivienda superviada para personas con discapacidad intelectual y/o del desarrollo, incluido en la red pública de servicios para personas con discapacidad de Mallorca.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>2.</strong> Con esta resolución se autorizó el gasto derivado de este expediente por el importe total máximo de 17 .367.317,30.-€ (IVA exento) con cargo a la partida presupuestaria 402312822709.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>3. </strong>Habiéndose detectado un error material de transcripción en el importe máximo del concierto fijado en el punto 14 (Financiamiento) de los Pliegos de prescripciones técnicas, dado que consta que es de “17.343.559,00 euros), procede su rectificación de conformidad a lo previsto en el artículo 109.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. </span></span></span></p>
<p><span style="line-height:100%"><span style="color:#000000"><strong>4.</strong> La convocatoria se publicó en el BOIB núm. 157, de 15 de diciembre de 2018, y una vez finalizado el plazo de presentación de solicitudes han presentado solicitud para el primer concierto social del servicio de vivienda supervisada para personas con discapacidad intelectual y/o del desarrollo las siguientes entidades:</span></span></p>
<ul>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">ASOCIACIÓN DE MADRES Y PADRES DE PERSONAS CON DISCAPACIDAD DE LAS ISLAS BALEARES (en adelante AMADIBA).</span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">AMADIP. ESMENT FUNDACIÓ ( en adelante AMADIP).</span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">ASSOCIACIÓ DE PROTECCIÓ A LES PERSONES AMB DISMINUCIÓ PSÍQUICA DE MANACOR I COMARCA (en adelante APROSCOM FUNDACIÓ).</span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">ASOCIACIÓN PRO AYUDA DE LAS PERSONAS CON DISCAPACIDAD DE SOLLER (en adelante ASANIDESO).</span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">ASOCIACIÓN SÍNDROME DE DOWN DE BALEARES (en adelante ASNIMO).</span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">INSTITUT DE TREBALL SOCIAL I DE SERVEIS SOCIALS (en adelante INTRESS)</span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">CENTRO MATER MISERICORDIAE (en adelante MATER MISERICORDIAE).</span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">PATRONAT DE L'AGRUPACIÓ PROMINUSVÀLIDS PSÍQUICS DE LA COMARCA D'INCA (en adelante PATRONAT D'INCA).</span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px">ASSOCIACIÓ PRO-AJUDA A PERSONES DISCAPACITADES DE POLLENÇA (en adelante PRODIS).</span></li>
</ul>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>5.</strong> Por parte del Servicio de Autorizaciones, Registro e Inspección de Centros y Servicios Sociales, en fecha 22 y 24 de enero de 2019, se informó sobre los servicios autorizados y vigentes de las entidades solicitantes, así como de la inexistencia de expediente sancionador en materia de servicios sociales por infracciones de las que constan en los artículos 128 y 129 de la Ley 4/2009, de Servicios Sociales de las Islas Baleares durante los últimos 24 meses.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>6.</strong> La responsable del Servicio de Personas con Discapacidad emitió informe técnico, de fecha 24 de enero de 2019, para la Comisión Evaluadora, en el cual se detalla, entre otras, las solicitudes recibidas y el análisis efectuado por parte de la Dirección Insular.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>7. </strong>La Comisión Evaluadora se reunió en fechas 28 de enero de 2019, 18 de febrero de 2019 y 4 de marzo de 2019, acordando, tras el pertinente trámite de subsanación, admitir a las entidades AMADIBA, AMADIP, APROSCOM, ASANIDESO, ASNIMO, INTRESS, MATER MISERICORDIAE, PATRONAT D'INCA y PRODIS, y presentar el informe propuesta para la concesión del primer concierto social del servicio de vivienda supervisada para personas con discapacidad intelectual y/o del desarrollo.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>8. </strong>Dado que, tuvo entrada en el Servicio Jurídico-Administrativo la propuesta de resolución del vicepresidente del IMAS, de fecha 4 de marzo de 2019, según la cual se propone que la presidenta del IMAS resuelva la adjudicación de 322 plazas del concierto del servicio de vivienda supervisada para personas con discapacidad intelectual y/o del desarrollo, 35 plazas de complemento de vivienda supervisada de alta intensidad y 7 plazas de complemento por necesidades excepcionales de soporte de tipo conductual o médico, por un periodo de dos años prorrogables dos años más, a favor de las entidades solicitantes y admitidas, de conformidad a la siguiente distribución de plazas:</span></span></span></p>

<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong><span style="color:#000000"><strong>Consideraciones jurídicas </strong></span></strong></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>1.</strong><strong> </strong>La<strong> </strong>Ley 9/2017, 8 de noviembre, de Contratos del Sector Público, por la que se transponen las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014, en su artículo 11.6 establece que: "<em>Queda excluida de la presente Ley la prestación de servicios sociales por entidades privadas, siempre que ésta se realice sin necesidad de celebrar contratos públicos, a través, entre otros medios, del simple financiamiento de estos servicios o la concesión de licencias o autorizaciones a todas las entidades que cumplan las condiciones previamente fijadas por el poder adjudicador, sin límites ni cuotas, y que este sistema garantice una publicidad suficiente y se ajuste a los principios de transparencia y no discriminación».</em></span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>2.</strong> El artículo 89.1 de la Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares, establece que "<em>las administraciones públicas de las Islas Baleares, en el ámbito de sus competencias, pueden organizar la prestación de los servicios del Catálogo de Prestaciones y servicios Sociales de las Islas Baleares a través de las fórmulas siguientes: gestión directa, régimen de concierto previsto en esta Ley, gestión indirecta en el marco de la normativa de contratación de las administraciones públicas y convenios con entidades sin ánimo de lucro</em>".</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El artículo 89 bis de esta norma dispone que las entidades de iniciativa privada que ofrecen servicios sociales previstos en la cartera de servicios y/o en la planificación autonómica o insular pueden acogerse al régimen de conciertos en los términos establecidos en esta Ley.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>3.</strong> El Decreto 48/2017, de 27 de octubre (BOIB número 132 de 28 de octubre de 2017) por el que se establecen los principios generales a los que deben someterse los conciertos sociales.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>4.</strong> El Instituto Mallorquín de Asuntos Sociales, como organismo autónomo creado por el Consejo de Mallorca, adscrito al Departamento de Bienestar y Derechos Sociales del Consejo de Mallorca, es el organismo que ejerce las competencias atribuidas por cualquier título al Consejo de Mallorca en materia de servicios sociales, de acuerdo con el Texto consolidado de los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 140, de 5 de noviembre de 2016).</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>5. </strong>En el Pleno del Consejo de Mallorca del 13 de julio de 2017 se da aprobación definitiva al reglamento por el que se aprueba la Cartera Insular de Servicios Sociales y los Servicios a Menores y Familia de Mallorca (BOIB núm. 97, de 18 de julio de 2017 y corrección de errores materiales publicada BOIB núm. 161, de 30 de diciembre de 2017).</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>6.</strong> El 8 de febrero de 2018 se aprobó en el Pleno del Consejo de Mallorca el reglamento por el que se regula el funcionamiento de los servicios sociales para personas con discapacidad incluidos en la Cartera Insular de servicios sociales, y se establecen los requisitos de autorización y acreditación (BOIB núm. 21, de 15 de febrero de 2018). Esta normativa establece, entre otras, las condiciones técnicas y materiales y los requisitos de calidad de los servicios de servicios sociales para poder optar al régimen de concierto social.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>7.</strong> Resolución de la presidenta del Instituto Mallorquín de Asuntos Sociales, de fecha 14 de diciembre de 2018, por la que se convoca el primer concierto social del servicio de vivienda supervisada para personas con discapacidad intelectual y/o del desarrollo (BOIB Núm. 157, de 15 de diciembre de 2018).</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>8.</strong> Una vez fiscalizada por la intervención delegada del IMAS, el órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.3 del Texto Refundido de los Estatutos del IMAS y con el punto 10.1 de la resolución de aprobación de la convocatoria del concierto del servicio de vivienda supervisada para personas con discapacidad intelectual y/o del desarrollo, incluido en la red pública de servicios para personas con discapacidad de Mallorca.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>9.</strong> En virtud del punto 10.3 de la resolución de convocatoria, la resolución de concesión o denegación del concierto social se notificará a las entidades interesadas y se publicará en el BOIB.</span></span></span></p>

<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Respecto a las plazas de los servicios y soportes complementarios adjudicadas, se adjunta a la presente, como Anexo I, la relación de personas físicas a quiénes han sido asignadas.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">La ejecución del gasto correspondiente a los ejercicios de 2020 y 2021 está condicionada a la existencia de crédito adecuado y suficiente en el presupuesto de gastos de dichos ejercicios.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Tercero. </strong>DECLARAR desiertas 3 plazas del servicio de vivienda supervisada, así como 8 plazas de complemento para necesidades excepcionales de soporte extraordinario de tipo conductual o médico, y LIBERAR el importe de 361.837,69.-€ correspondiente al apunte previo nº 920189000770, de conformidad a lo previsto en el antecedente 7 de esta resolución, y revertir este importe a la partida presupuestaria número 40.23128.22709. </span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Cuarto.</strong> REQUERIR a las entidades adjudicatarias al efecto de que formalicen el presente concierto social en un plazo de diez días hábiles, a contar desde la notificación de la presente resolución, previa presentación de la declaración responsable que se continúan cumpliendo los requisitos exigidos para concertar.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Quinto.</strong> ORDENAR la publicación de esta resolución en el Boletín Oficial de las Islas Baleares y que se formalice el concierto de acuerdo con los puntos 10.3 y 11 de la resolución de la presidenta del IMAS de día 14 de diciembre de 2018 que aprobó la convocatoria.<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><strong>Sexto</strong>. NOTIFICAR esta resolución a las entidades solicitantes, así como a la Dirección Insular de Personas con Discapacidad, el Servicio de Gestión Económica y la Intervención Delegada.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 27.1 del Texto consolidado de los Estatutos del IMAS aprobado por el Pleno del Consejo de Mallorca de fecha 13 de octubre de 2016 (BOIB núm. 140, de 5 de noviembre de 2016), recurso de alzada ante el Consejo Ejecutivo del Consejo Insular de Mallorca, en el plazo de un mes, contado a partir del día siguiente al de la notificación de la presente resolución.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación del mencionado recurso.</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).</span></span></span></p>
<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">No obstante lo anterior, se puede ejercitar, en su caso, cualquier otro recurso que se estime pertinente. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso Administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. </span></span></span></p>
