![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Por Decreto de Alcaldía de 21 de febrero de 2019 se aprobó el control del estacionamiento en las zonas afectadas por ORA o Zona Azul por el servicio de Grúas. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">DECRETO 2019000539</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">A la Ciudad de Llucmajor, el Alcalde que suscribe, en presencia del Secretario de la corporación, vino a dictar la siguiente </span></span></span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">RESOLUCIÓN</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo al Real Decreto Legislativo 6/2015, de 30 de octubre, por el cual se aprueba el texto refundido de la Ley sobre Transito, Circulación de Vehículos a motor y Seguridad Vial, donde se atribuye a los municipios la competencia de regulación, ordenación, gestión, vigilancia y disciplina del transito en las vías urbanas de titularidad municipal.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo a la Ordenanza Municipal de Circulación, publicada en el BOIB 61, de fecha 22 de abril de 2010, con modificación posterior publicada en el BOIB 56, de fecha 14 de abril de 2011, donde se establece en su Capítulo VI, la regulación del estacionamiento limitado:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Art. 55. Los Servicios de estacionamientos regulados de vehículos en la vía pública (ORA) es un servicio público local que pretende regular los espacios de aparcamiento en superficies disponibles en la ciudad fijando los tempos máximos de permanencia para conseguir una rotación de vehículos que permita distribuir racionalmente i optimizar el uso del dominio público dedicado a tal fin.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Art. 57.4 Por tal de garantizar el cumplimiento de esta Ordenanza, el Servicio &nbsp;de estacionamientos regulados de vehículos estará dotado de los medios materiales y personales necesarios, como también de los medios de control que aseguren la eficacia y la efectividad del servicio. El servicio mencionado se podrá gestionar de manera directa o indirecta mediante concesión administrativa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo que, de acuerdo al articulo 56, la regulación afecta a las modalidades de ORA (estacionamiento sujeto al pago de un precio público) y Zona Azul (estacionamiento que no se condiciona al abono de precio público).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo que en el mismo artículo 56 regula los espacios reservados para carga y descarga y los que puedan estar afectados por un horario limitado en su utilización, cuando estén ubicados en zona de ORA o zona Azul.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo que el estacionamiento en zona regulada, bien por ORA o bien por Zona Azul, no implica el desconocimiento de las normes de circulación, ni el abono del precio público da derecho al no cumplimiento con el resto de la normativa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo a la modificación del personal del servicio de grúas; servicio de gestión y personal municipal.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo a la redistribución de funciones del personal asignado al servicio de grúas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo a que todo el personal destinado al servicio de Grúas ha recibido formación específica en el uso de les pda, propiedad de la ATIB, que han de servir para confeccionar los boletines de denuncia.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo que todo el personal destinado al servicio de Grúas ha recibido la formación pertinente en sobre la ordenanza municipal de circulación, en cuanto al control de vehículos estacionados en la zona regulada y en cuanto a las infracciones que en dicha zona se puedan localizar.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Atendiendo a la potestad reguladora de la administración municipal, de a cuerdo a la Ley 7/1985, de 2 de abril, Reguladora de les Bases de Régimen Local.</span></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">&nbsp;</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">En consecuencia, <strong>RESUELVO</strong>:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000"><em>PRIMERO. </em>El control del estacionamiento en las zonas afectadas por ORA o Zona Azul, será llevado a cabo de manera directa por personal destinado al servicio de Policía Local o por personal integrado en este servicio, en concreto el personal del servicio de Grúas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000"><em>SEGUNDO</em>. Que en las zonas habilitadas con ORA o Zona Azul, puedan denunciar las infracciones a las normas de circulación, por ir en contra de la regulación de los estacionamientos, correspondientes a:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">El estacionamiento en las zonas para peatones.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:normal">El estacionamiento en los pasos de peatones.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:normal">El estacionamiento en los carga y descarga.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:normal">El estacionamiento en los vados permanentes.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:normal">El estacionamiento en los lugares prohibidos por una señal correspondiente.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000"><em>TERCERO</em>. El personal del servicio de Grúas irá vestido con uniformidad del Ayuntamiento y con identificación, así como con piezas de alta visibilidad y gorra.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000"><em>QUARTO</em>. Cada controlador llevará una pda de la ATIB asignada a el, de forma que esté siempre vinculada a una única persona la denuncia efectuada des de un aparato telemático, el cual, además, llevará password para asegurar que no lo ha utilizado otro controlador.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000"><em>QUINTO</em>. Los controladores de la ORA o de la Zona Azul, solo podrán denunciar con sistemas telemáticos que permitan en todo momento identificar verdaderamente quien &nbsp;ha confeccionado la denuncia.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000"><em>SEXTO</em>. Los controladores de la ORA o de la Zona Azul tendrán asignado un distintivo identificativo que será el que figurará en el boletín de denuncias. Este distintivo se corresponderá con la siguiente grafía: G000X; donde G es invariable, 000 se corresponde con los tres últimos números de su DNI y X con la letra de su DNI. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000"><em>SEPTIMO</em>. La relación actualizada, con detalle de la identificación del servicio de vigilancia de la ORA o Zona Azul, que no sean agentes de la autoridad, con expresión del nombre, apellidos, las tres últimas cifras de su NIF y dirección, así como el número de identificación es la que figura al punto OCTAVO. En lAs notificaciones que se tramiten, en su caso, se hará constar el número de controlador y la referencia del presente BOIB.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000"><em>OCTAVO</em>. De acuerdo con lo dispuesto en el artículo 87.2 del Real Decreto 6/2015, de 30 de octubre, por el que se aprueba el texto consolidado de la Ley de Transito, Circulación, Vehículos a Motor y Seguridad Vial, mediante la presente publicación se facilitan los datos de identificación de los denunciantes:</span></span></span><span style="font-family:Times New Roman,Times,serif;
