8024 8022 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Adoptado por la Junta de Gobierno Local, en sesión extraordinaria celebrada el 22 de febrero de 2019, acuerdo definitivo de modificación de Ordenanza reguladora del Precio Público para la prestación de Servicios Municipales de Formación y Actividades Musicales, se publica el citado acuerdo y el texto íntegro de su ordenanza, a los efectos previstos en el Artº 70.2 de la Ley 7/85, de 2 de abril reguladora de las Bases de Régimen Local.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Acuerdo definitivo:</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1º- <span style="color:#000000">Transcurrido el plazo de exposición al público del acuerdo provisional de modificación de la Ordenanza reguladora del “Precio Público por la prestación de Servicios Municipales de Formación y de Actividades Musicales”, adoptado por la Junta de Gobierno local en sesión ordinaria de fecha 23 de enero de 2018, ha sido presentado dentro de este plazo un escrito de alegaciones, subscrito por Bartomeu Ignasi Oliver Vidal en representación de la Asociación Cultural Musical “Pere Josep&nbsp;Cañelles”, acordándose su estimación y la aprobación definitiva del referido acuerdo de modificación en idénticos términos a los de su aprobación inicial con las alegaciones estimadas conforme al texto anejo de la Ordenanza. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El “Institut Balear de la Dona”, remitió el informe sobre el impacto de género de la citada Ordenanza en fecha 4 de abril de 2018 y recomienda que en la redacción de la norma se sustituyera en todo el articulado "los integrantes" por "las personas integrantes" y "gigantes" por "gigantes y gigantas". </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2º- El texto de la citada Ordenanza se publicará en el BOIB y entrará en vigor en la fecha prevista en su Disposición Final.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3º- De conformidad con lo dispuesto en el Artº. 19.1 del R.D.L. 2/2004 , de 5 de Marzo, contra el presente acuerdo y Ordenanza anexa, los interesados podrán interponer a partir de su publicación en el BOIB, recurso contencioso-administrativo en la forma y plazos que establecen las normas reguladoras de dicha Jurisdicción.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Texto de la Ordenanza:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">TÍTULO: “Ordenanza Reguladora del Precio público para la prestación de Servicios Municipales de Formación y Actividades Musicales”.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">NORMAS REGULADORAS</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 1º.&nbsp;</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el artículo 127, con relación al artículo 41, ambos del R.D.L. 2/2004 , de 5 de Marzo , por el que se aprueba el texto refundido de la Ley reguladora de las Haciendas Locales, el Ayuntamiento de Calvià seguirá percibiendo el precio público para la prestación de los Servicios Municipales de Formación y Actividades Musicales, que se regirán por la presente Ordenanza.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">HECHO IMPONIBLE</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 2º.</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El objeto de este precio público es la prestación de cursos de formación y la realización de actuaciones musicales de:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Banda Municipal de Música de Calvià.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. font-size:12px">Se establece una bonificación para cualquier miembro de familia numerosa que se matricule en actividades municipales no reglada. La cuantía de la bonificación será:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;- Del 10% para familias numerosas generales.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;-&nbsp;Del 25% para familias numerosas especiales.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">NORMAS DE GESTIÓN</span></strong></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 6º. </span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>1.-Contratación de los servicios</em></span><span style="color:#000000">.- La contratación de los servicios se realizará mediante solicitud dirigida al Servicio de Cultura. El citado concesionario establecerá un calendario de actuaciones y lo pondrá en conocimiento del Ayuntamiento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>2.-Duración de las actuaciones</em>.- Las actuaciones, fuera de las actuaciones para el Ayuntamiento de Calvià que serán gratuitas, tal como indica el contrato, serán de una duración máxima de una hora y media para la Banda de Música y de una hora para el del Coro de Calvià.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>3.-Cobro de tarifas.</em></span><span style="color:#000000">- La persona adjudicataria del servicio presentará una factura una vez realizada la actuación, al departamento o entidad que haya realizado la solicitud de dicha actuación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>4.-Actualización de tarifas</em>.- La cuantía de las tarifas del artículo 4 podrán actualizarse, cada inicio de año natural, mediante la aplicación como máximo, sobre las que en aquel momento estén vigentes, de la variación porcentual experimentada por el índice general de precios al consumo (IPC) durante el periodo transcurrido desde la anterior determinación de tarifas.
