font-size:12px"><span style="color:#212121">Notificación de Resolución de concesión a las personas beneficiarias de las ayudas, R29 de fecha 27 de noviembre de 2018, al amparo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 10 de julio de 2015, por la que se convocan subvenciones para inversiones a las explotaciones agrarias, para los anos 2015-2019</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">El apartado 9.3. de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 10 de julio de 2015, por la que se convocan subvenciones para inversiones a las explotaciones agrarias, correspondientes a los años 2015_2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el </span><em><span style="color:#212121">Boletín Oficial de las Illes Balears</span></em><span style="color:#212121"> de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;<span style="color:#212121">Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. <span style="color:black">Con fecha de 16 de julio de 2015 se publicó, en el B</span><em><span style="color:black">oletín Oficial de las Illes Balears</span></em><span style="color:black"> nº 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la cual se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. <span style="color:black">De conformidad con el apartado sexto de la citada Resolución, el plazo para presentar las solicitudes acabó el día 31 de diciembre de 2016. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. <span style="color:black">Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. <span style="color:black">Las personas interesadas señaladas en el anexo I adjunto han presentado, en tiempo y forma, toda la documentación necesaria prevista en la convocatoria, y se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. <span style="color:black">En fecha 9 de abril de 2018 se publicó en la web <em><span style="color:black">http://www.caib.e</span></em><span style="color:black">s</span> una propuesta provisional de concesión de la ayuda solicitada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. <span style="color:black">Durante el plazo establecido en la propuesta provisional de concesión parcial las personas interesadas señaladas en el anexo I no han presentado alegaciones. De los expedientes con reducción por moderación de costes se ha vuelto a realizar una revisión de oficio por parte del órgano gestor.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. <span style="color:black">De acuerdo con los criterios de elegibilidad de la convocatoria, a las personas interesadas les corresponde una ayuda máxima detallada en el anexo I, después de aplicar la deducción de inversiones y/o actuaciones que no son elegibles para esta línea de ayuda descrita en el anexo II.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Fundamentos de derecho</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. <span style="color:black">Resolución de 10 de julio de 2015 del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. <span style="color:black">Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. <span style="color:black">Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Propuesta de resolución de concesión</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Por todo ello, se informa favorablemente y se propone al presidente del FOGAIBA que dicte una resolución en los siguientes términos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. <span style="color:black">Conceder la ayuda solicitada a las personas beneficiarias por los importes y con los términos detallados en el anexo I, que son un total de 6 expedientes y que empieza con JAIME JOSE LLABRÉS MIQUEL y acaba con ECO SON MAYOL SLU que suma un importe total de 268.960,95 euros, relativa a la línea de ayuda “Inversiones a las explotaciones agrarias”, deducidas las inversiones/actuaciones no elegibles especificadas en el anexo II.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. <span style="color:black">Autorizar y disponer el gasto señalado en cada una de las personas beneficiarias con cargo a los presupuestos y porcentajes de cofinanciación detallados en el anexo I.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. <span style="color:black">Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de las personas beneficiarias serán las indicadas en el anexo III. </span></span></p> <p style="margin-bottom:0px; font-size:12px">4. <span style="color:black">Cumplir las normas comunitarias aplicables a la inversión de la cual se trate y las específicas que puedan señalarse en función del tipo de explotación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
