Con fecha de 16 de julio de 2015 se publicó, en el B<em>oletín Oficial de las Illes Balears</em> nº 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (<span style="color:black">FOGAIBA</span>) por la cual se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. De conformidad con el apartado sexto de la citada Resolución, el plazo para presentar las solicitudes acabó el día 31 de diciembre de 2016. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En fecha 29 de octubre de 2018 se publico en la página web <em>http://www.caib.es </em>una propuesta provisional de concesión de la ayuda solicitada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Durante el plazo establecido en la propuesta provisional de concesión parcial los interesados indicados en el anexo I no han presentado ninguna alegación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Una vez evaluadas la solicitud de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad de la convocatoria, al beneficiario le corresponde una ayuda máxima detallada en el anexo I, después de aplicar la deducción de inversiones y/o actuaciones que no son elegibles por esta línea de ayudas descrita en el anexo II.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Resolución de 10 de julio de 2015 del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (<span style="color:black">FOGAIBA</span>) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>&nbsp;Resolución de concesión parcial</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, se informa favorablemente y se propone al presidente del <span style="color:black">FOGAIBA</span> que dicte una resolución en los siguientes términos:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Conceder la ayuda solicitada a las personas beneficiarias por los importes y con los términos detallados en el anexo I, que son un total de 3 expedientes y que empieza con ALBRANXELLA Y OTROS SRM y termina con SON SENYOR, SAT que suma un total de 183.809,50 euros, relativa a la línea de ayuda «Inversiones a las explotaciones agrarias», deducidas las inversiones/actuaciones no elegibles especificadas en el anexo II.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autorizar y disponer el gasto señalado en cada una de las personas beneficiarias con cargo a los presupuestos y porcentajes de cofinanciación detallados en el <strong>anexo I</strong>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de las personas beneficiarias serán las indicadas en el <strong>anexo II. </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Publicar esta resolución en el <em>Boletín Oficial de las Illes Balears</em>. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ANEXO III<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></strong></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>OBLIGACIONES DEL BENEFICIARIO</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Realizar las inversiones o actividades auxiliadas en el plazo establecido.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en los términos y plazos determinados en la presente Resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Ejercer la actividad agraria en cualquier explotación y mantener las inversiones realizadas durante al menos cinco años, contados desde la fecha de pago de la ayuda.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Cumplir las normas comunitarias aplicables a la inversión de la cual se trate y las específicas que puedan señalarse en función del tipo de explotación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Adoptar las medidas que sean necesarias para proporcionar información al público y dar publicidad.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Someterse a los controles que lleve a cabo la Administración, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.
