    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) &lt;/span&gt;&lt;span style="color:#000000"&gt;de 10 de julio de 2015, por la que se convocan subvenciones para inversiones a las explotaciones agrarias, correspondientes a los años 2015_2019, es&lt;/span&gt;&lt;span style="color:#000000"&gt;pecifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El presidente, en fecha 22 de noviembre de 2018, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;“INFORME PROPUESTA DE RESOLUCIÓN / RESOLUCIÓN DE CONCESIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Programa de Desarrollo Rural de las Islas Baleares 2014-2020&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Grupo: INEA2016_2-10-RES;&lt;span style="color:#000000"&gt; Id&lt;/span&gt;: 5580&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;1. Con fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Illes Balears nº 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la cual se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.&lt;/p&gt;

&lt;p&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo para presentar las solicitudes acabó el día 31 de diciembre de 2016.&lt;/p&gt;

&lt;p&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/p&gt;

&lt;p&gt;4. Las personas interesadas señaladas en el anexo I adjunto han presentado, en tiempo y forma, toda la documentación necesaria prevista en la convocatoria, y se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda.&lt;/p&gt;

&lt;p&gt;5. Las actuaciones solicitadas por los interesados cumplen con los requisitos establecidos en la convocatoria con el fin de poder ser subvencionables.&lt;/p&gt;

&lt;p&gt;6. Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria no hay ningún impedimento para resolver estos expedientes sin afectar a dispuesto en los apartados séptimo y octavo de la convocatoria.&lt;/p&gt;

&lt;p&gt;7. El día 25 de octubre de 2018 el vicepresidente del FOGAIBA presentó su abstención de intervenir en el procedimiento INEA2016_2/007, de acuerdo con el artículo 23 de la de la Ley 40/2015, de 1 de oc&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;tubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.Resolución de 10 de julio de 2015 del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (&lt;span style="color:#000000"&gt;FOGAIBA&lt;/span&gt;) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones a las explotaciones agrarias modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Propuesta de resolución de concesión&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, se informa favorablemente y se propone al presidente del &lt;span style="color:#000000"&gt;FOGAIBA&lt;/span&gt; que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aceptar la abstención presentada por el &lt;span style="color:#000000"&gt;vicepresidente del FOGAIBA, de intervenir en el procedimiento INEA2016_2/007, de acuerdo con el artículo 23 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Conceder la ayuda solicitada a &lt;span style="color:#000000"&gt;FRANCESC GINARD FIOL&lt;/span&gt;, con &lt;span style="color:#000000"&gt;NIF 37342575 &lt;/span&gt;M, con los términos detallados en el anexo I, por un importe total de 6.412,42 euros, relativa a la línea de ayuda “Inversiones a las explotaciones agrarias”, expediente INEA2016_2/007.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Autorizar y disponer el gasto señalado en cada una de las personas beneficiarias con cargo a los presupuestos y porcentajes de cofinanciación detallados en el anexo I.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones de las personas beneficiarias serán las indicadas en el anexo II. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Publicar esta resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y el a&lt;span style="color:#000000"&gt;rtículo 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Realizar las inversiones o actividades auxiliadas en el plazo establecido.&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en los términos y plazos determinados en la presente Resolución.&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ejercer la actividad agraria en cualquier explotación y mantener las inversiones realizadas durante al menos cinco años, contados desde la fecha de pago de la ayuda.&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cumplir las normas comunitarias aplicables a la inversión de la cual se trate y las específicas que puedan señalarse en función del tipo de explotación.&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Adoptar las medidas que sean necesarias para proporcionar información al público y dar publicidad.&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;
	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Someterse a los controles que lleve a cabo la Administración, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos.&lt;/span&gt;&lt;/p&gt;
