Todos estos ingresos se instrumentan, bien mediante la suscripción de un convenio, bien mediante la tramitación de una solicitud de subvención, y se refieren a materias que son gestionadas por el Instituto Mallorquín de Asuntos Sociales (IMAS).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">III. Esto, sin perjuicio de que se instrumenten los mecanismos correspondientes para que los ingresos se hagan efectivos en favor del Consejo de Mallorca y que la Intervención General del Consejo de Mallorca ejerza el control de estos ingresos, para luego transferirlos a la IMAS.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">IV. La Intervención Delegada del IMAS ha emitido el informe favorable para este expediente.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000"><strong>Consideraciones jurídicas:</strong></span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">I. De acuerdo con el artículo 17 c) de los Estatutos del Instituto Mallorquín de Asuntos Sociales, aprobados por por acuerdo del Pleno de Consejo de Mallorca de día 13 de octubre de 2016 (BOIB núm. 140 de 5 de noviembre de 2016), son recursos económicos sus las subvenciones y aportaciones de la Unión Europea, el Estado, la comunidad autónoma de las Islas Baleares y otras entidades públicas, o de particulares, que sean transferidos al Consejo de Mallorca para fines propios de el IMAS.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">II. De acuerdo con el art. 2.3 de sus Estatutos, el IMAS ejerce cualquier otra competencia que le encomiende el Consejo, directamente mediante delegación o encomienda o, indirectamente, a través de convenios con otros entes territoriales o institucionales con fines coincidentes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">III. De acuerdo con el Decreto de organización del Consejo de Mallorca de 10 de julio de 2015 (BOIB núm. 109 de 18 de julio de 2015) dictado por el presidente del Consejo de Mallorca, corresponde al Consejo Ejecutivo, entre otros, aprobar los convenios con otras entidades públicas o privadas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La base 23.4 de las Bases de Ejecución del Presupuesto del Consejo de Mallorca de 2019 establece que corresponde al Consejo Ejecutivo aprobar convenios independientemente de su cuantía.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">IV. El arte. 11 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público prevé que la realización de actividades de carácter material, técnico o de servicios de la competencia de los órganos administrativos o de las entidades de derecho público puede ser encomendada a otros órganos o entidades de la misma o de otra diferente, por razones de eficacia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">V. Asimismo, el artículo 12 del mismo texto legal prevé que los titulares de los órganos administrativos pueden, en una materia de su propia competencia, delegar la firma de sus resoluciones y actos administrativos a los titulares de los órganos o unidades administrativas que dependientes, dentro de los límites señalados por el artículo 11. la delegación de firma no altera la competencia del órgano delegante, y no será necesaria su publicación para que sea válida.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
