    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;LA JUNTA DE GOBIERNO LOCAL, EN SESIÓN ORDINARIA CELEBRADA EL 15 DE NOVIEMBRE DE 2018, VA APROBAR LA CONVOCATORIA DE AYUDAS PARA LA PREVENCIÓN DE INCENDIOS FORESTALES Y LA PROTECCIÓN DEL PAISAJE RURAL, EN EL MUNICIPIO DE SANT JOSEP DE SA TALAIA PARA EL AÑO 2018&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;BDNS ( Identif: 429054)&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;1. OBJETO, FINALIDAD Y ÁMBITO DE APLICACIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;El objetivo de esta convocatoria es dar soporte económico a los autos, las iniciativas y los proyectos de las Sociedades y Asociaciones que gestionen cotos de caza del municipio de San José de la Talaia y las Asociaciones de propietarios de terrenos forestales o rústicos que tengan como objetivo la preservación del entorno, la conservación del paisaje y la prevención de los incendios forestales de los terrenos que gestionen en el municipio de San Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;La Ley de Bases de Régimen Local (Ley 7/85) establece en su artículo 25 que es competencia de los municipios la prevención y extinción de incendios. En este sentido, el Decreto 125/2007 de incendios forestales de las Islas Baleares define como actuaciones de prevención de incendios forestales todas aquellas actividades dirigidas a evitar el inicio del incendio forestal y a crear las condiciones para minimizar la propagación y limitar a máximo a los efectos perjudiciales que puedan ocasionar a personas, bienes, patrimonio rural y medio ambiente en general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Asimismo, la Ley de Montes (Ley 43/2003) establece en su artículo 43 que corresponde a las Administraciones Públicas competentes la responsabilidad de la organización de la defensa contra incendios forestales y que deberán adoptar, de forma coordinada, medidas que conduzcan a la prevención, detección y extinción de los incendios, independientemente de la titularidad de los montes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Por otra parte, la Ley de Patrimonio Natural y Biodiversidad (Ley 42/2007) establece, en su artículo 5, que las administraciones públicas promoverán la participación y las actividades que contribuyan a alcanzar los objetivos de la ley, entre los que se incluye la gestión sostenible de los recursos naturales, la preservación de la variedad, singularidad y belleza de los ecosistemas naturales y del paisaje.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;En el mismo sentido, el Estatuto de Autonomía de las Islas Baleares establece en su artículo 23 que los poderes públicos velarán por la defensa y la protección de la naturaleza, del territorio, del medio ambiente y del paisaje y establecerán políticas de gestión, ordenación y mejora de su calidad armonizándolas con las transformaciones que se producen por la evolución social, económica y ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Así pues, el marco normativo actual establece de forma clara la responsabilidad de las administraciones locales para llevar a cabo actuaciones de prevención de los incendios forestales y de forma más general la responsabilidad para tomar medidas de gestión sostenible de los recursos naturales y de protección del paisaje.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;El desarrollo rural (mediante la conservación de cultivos y limpieza de masas forestales) es un elemento clave en el mantenimiento del paisaje y en la prevención de los incendios forestales, y cabe destacar que gran parte de los terrenos forestales y rurales del municipio de San Josep de sa Talaia se encuentran incluidos en cotos de caza gestionados por sociedades de cazadores y asociaciones de vecinos o están incluidos en asociaciones de propietarios de terrenos forestales o rurales. Estas entidades llevan a cabo actuaciones de mantenimiento de cultivos, recuperación de espacios agrícolas degradados que por otro lado seguirían en estado de abandono, limpieza de bosques, así como actuaciones de mejora y protección del entorno donde realizan su actividad, favoreciendo así la conservación del medio ambiente, la recuperación de usos tradicionales y colaborando en la prevención de incendios forestales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;La Concejalía de Medio Ambiente del Ayuntamiento de Sant Josep de sa Talaia pretende impulsar las actuaciones que permitan la preservación del paisaje y del patrimonio natural del municipio, a la vez que se fomentan las actuaciones orientadas a la prevención de los incendios forestales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;2. RÉGIMEN JURÍDICO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;2.1. La presente convocatoria se somete a la Ley 38/2003, de 17 de noviembre, general de subvenciones, en el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones, a la Ordenanza general de las bases reguladoras de las subvenciones que concede el Ayuntamiento de Sant Josep de la Talaia (BOIB núm. 66 de 30 de mayo de 2017) y en el Plan estratégico de subvenciones del Ayuntamiento de Sant Josep de sa Talaia para el año &lt;/span&gt;2018 (BOIB núm. 85, de 10 de julio de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Esta convocatoria se expondrá en el tablón de anuncios del Ayuntamiento, en la página web del Ayuntamiento de Sant Josep de sa Talaia www.santjosep.org, y será publicada en el BOIB y en la BDNS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;3. CONSIGNACIÓN PRESUPUESTARIA Y CUANTÍA&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Esta convocatoria está dotada con un máximo de 15.000 € a cargo del presupuesto municipal de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;De conformidad con el artículo 56 (tramitación anticipada) del Reglamento de Subvenciones, la concesión de la presente subvención queda condicionada a la existencia de crédito adecuado y suficiente en el momento de la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;La resolución de la concesión de ayudas se realizará durante el ejercicio presupuestario 2019, una vez comprobada la existencia de crédito adecuado y suficiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;4. REQUISITOS GENERALES &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Podrán acogerse a esta convocatoria aquellas sociedades de cazadores y asociaciones de vecinos que gestionen cotos de caza en el municipio de Sant Josep de sa Talaia y las asociaciones de propietarios de terrenos forestales o rústicos, y que cumplan los siguientes requisitos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;a) Gestionar terrenos del municipio de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;b) Tener carácter no lucrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;c) Hallarse el beneficiario al corriente de las obligaciones tributarias, con la seguridad social y con el mismo Ayuntamiento de Sant Josep. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;d) No encontrarse el beneficiario incurso en ninguna de las causas de incompatibilidad y cumplir los requisitos que fija el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;e) Acreditación del cumplimiento de obligaciones por reintegro de subvenciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;f) Estar inscrito en el Registro de Asociaciones del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;5. ACTIVIDADES SUBVENCIONABLES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Sólo se considerarán actividades subvencionables aquellas que se realicen en el municipio de Sant Josep de sa Talaia, que se puedan justificar con facturas y que hayan sido realizadas entre 1 de enero y el 31 de octubre del año 2018. Las actividades objeto de la subvención son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;a) Siembra y recuperación de cultivos: Siembras o recuperaciones de cultivos de parcelas identificadas catastralmente. Con la solicitud se entregará la relación de parcelas identificadas catastralmente y un plano de ubicación de las mismas. Se incluyen en este apartado los gastos de personal, maquinaria, tratamiento de residuos, compra de semillas u otros productos complementarios y otros gastos relacionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;b) Mejoras de hábitats: Serán subvencionables las actividades de poda, limpieza de caminos, trabajos forestales, repoblaciones forestales, retiradas de residuos, y otros gastos relacionados, realizadas siempre de acuerdo con las instrucciones y permisos correspondientes por parte de las administraciones públicas. Con la solicitud se deberá incluir un plano que señale las parcelas o caminos donde se ha realizado la actuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;c) Prevención de incendios forestales: Serán subvencionables las actuaciones de prevención de incendios forestales tales como fajas contra-incendios, depósitos contra-incendios (para medios de extinción aéreos y terrestres) y actuaciones similares, realizadas siempre de acuerdo con las instrucciones y permisos correspondientes por parte de las administraciones públicas. Con la solicitud se deberá incluir un plano que señale las parcelas o caminos donde se ha realizado la actuación. Se incluyen en este apartado los gastos de personal, obras, maquinaria y otros gastos relacionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Todas las actividades para las que se solicite la subvención deberán disponer de los correspondientes permisos, autorizaciones y / o licencias necesarias para su realización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;6. RÉGIMEN DE LAS AYUDAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;6.1. La concesión de la subvención se llevará a cabo mediante el régimen de concurrencia competitiva. Sólo podrán obtener subvención aquellos solicitantes que reúnan los requisitos exigidos en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;6.2. Se establece como único medio de notificación de todos los actos de trámite del presente procedimiento, el tablón de anuncios del Ayuntamiento y la página web del Ayuntamiento (www.santjosep.org).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;6.3. Finalizado el plazo de presentación de solicitudes y una vez revisadas estas por el órgano instructor, se expondrá, según se establece en la base 6.2, la lista provisional de admitidos para participar en el procedimiento así como las reseñas de las solicitudes que tengan algún defecto o deban ser subsanadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Si la solicitud y / o documentación presentada tiene algún defecto, falta alguna documentación o se quieren hacer alegaciones, el interesado dispondrá de un plazo de 10 días, contados a partir del día siguiente de la fecha de requerimiento, para hacer las alegaciones que correspondan. Transcurrido este plazo sin haber efectuado las alegaciones o haber adjuntado la documentación requerida, se considerará desestimada su petición, de acuerdo con lo dispuesto en el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Una vez pasado el plazo para la subsanación de documentación o presentación de alegaciones y una vez resueltas éstas por el órgano colegiado, el órgano instructor publicará la lista definitiva de admitidos y excluidos para participar en el procedimiento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;6.4. Sólo podrán obtener subvención aquellos solicitantes que, reuniendo los requisitos exigidos, cumplan las condiciones señaladas en la base 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;6.5. Las ayudas objeto de esta convocatoria son compatibles con otras ayudas por parte de cualquier otro organismo, administración o institución pública o privada. La suma total de las ayudas percibidas para la misma actividad no podrá ser, en ningún caso, superior al coste total de la actividad subvencionada. El beneficiario está obligado a comunicar al Ayuntamiento la obtención de otras subvenciones o ayudas para la misma finalidad, procedentes de cualquier administración o ente público, nacional o internacional, así como de toda entidad o institución privada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;6.6. Las ayudas no podrán ser superiores a los gastos originados por la actividad objeto de esta convocatoria, sin perjuicio de las limitaciones presupuestarias. Si el total de ayudas a conceder superara la consignación presupuestaria de esta línea de subvenciones, éstas se distribuirán de forma proporcional, garantizando un mínimo para para todos los solicitantes con actuaciones subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Estas subvenciones no generan ningún derecho a la obtención de otras ayudas en ejercicios posteriores y, por tanto, tampoco se pueden alegar como precedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;7. SOLICITUD, DOCUMENTACIÓN Y PLAZO DE PRESENTACIÓN&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="color:#212121"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;7.1. Las solicitudes de subvención se formalizarán mediante el modelo normalizado que se puede encontrar en el Anexo I. Las instancias se dirigirán a la Alcaldía del Ayuntamiento de Sant Josep de sa Talaia y se presentarán en el Registro General de la corporación a Sant Josep o en las dependencias municipales de Cala de Bou y de Sant Jordi, o, también, en la forma establecida en el art. 16 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. En este caso se deberá pasar aviso por correo electrónico a la dirección: &lt;/span&gt;&lt;span style="color:null"&gt;aneira@santjosep.org.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;7.2. Los solicitantes, junto con la solicitud del &lt;/span&gt;&lt;/span&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;Anexo I&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;, deberán presentar la siguiente documentación (originales o fotocopias compulsadas):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;a) Copia del CIF / NIF de la entidad solicitante y copia del DNI / NIF del representante de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;b) Estatutos de la entidad (en caso de no haber sido presentados en convocatorias anteriores).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;c) Cuenta justificativa, la cual tendrá que contener una memoria de actuación y una memoria económica con el detalle previsto en el articulo 72 del RLGS&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;d) Originales o fotocopias compulsadas de las facturas o documentos que justifiquen los gastos realizados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;e) Justificante de pago de las facturas (certificado de la empresa proveedora, extracto bancario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;f) Modelo de solicitud de transferencia bancaria para pagos del Ayuntamiento de Sant Josep de sa Talaia, disponible en las oficinas municipales. (En caso de no haber sido presentado con anterioridad)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;g) Declaración responsable, de no encontrarse incurso en ninguna de las causas de incompatibilidad y cumplir los requisitos que fija el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones (ver &lt;/span&gt;&lt;strong&gt;anexo II&lt;/strong&gt;&lt;span style="background-color:white"&gt;) .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;h) Declaración responsable de encontrarse al corriente de las obligaciones tributarias, con la Seguridad Social y con el mismo Ayuntamiento de Sant Josep y autorización al Ayuntamiento para solicitar a la Agencia Tributaria y a la Seguridad Social los datos fiscales del solicitante, que sean necesarias (ver &lt;/span&gt;&lt;strong&gt;anexo IV&lt;/strong&gt;&lt;span style="background-color:white"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;I) Declaración de las subvenciones recibidas o solicitadas para la misma finalidad y compromiso de comunicar a la entidad local, las que se obtengan en el futuro (&lt;/span&gt;&lt;strong&gt;anexo III).&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;j) Declaración responsable del cumplimiento de obligaciones por reintegro de subvenciones &lt;/span&gt;&lt;strong&gt;(anexo II)&lt;/strong&gt;&lt;span style="background-color:white"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;k) Declaración responsable sobre la situación relativa al IVA del solicitante &lt;strong&gt;(annex V)&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Si los documentos exigidos en la solicitud ya se hubieran presentado en el Ayuntamiento en otra ocasión, la persona solicitante podrá acogerse a lo establecido en el artículo 53.d) de la Ley 39/2015 , de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, siempre que se haga constar la fecha y el órgano o dependencia en que fueron presentados o emitidos. La presentación de la solicitud supone la aceptación, por parte de la persona interesada, de las prescripciones contenidas en la convocatoria correspondiente. El Ayuntamiento de Sant Josep de sa Talaia, en cualquier momento, puede solicitar a los interesados ​​la documentación y la información complementaria que considere necesaria para resolver el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;7.3. Plazo de presentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;El plazo de presentación de solicitudes será de 10 días contados a partir del día siguiente &lt;/span&gt;de la publicación del extracto de la convocatoria en el BOIB&lt;span style="color:#212121"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;8) CUANTÍA DE LAS AYUDAS Y CRITERIOS DE VALORACIÓN &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;8.1) Cuantía de las ayudas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;La cuantía de las subvenciones podrá ser del 100% del coste de la actividad, siempre y cuando el importe de la ayuda, aisladamente o en concurrencia con otras subvenciones o ayudas, no supere el coste de la actividad para la que se solicita la subvención. En ningún caso será subvencionable el pago de impuestos, tasas o tributos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;En cualquier caso, el importe máximo de la subvención para cada entidad será de 9.000. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;En caso de que las solicitudes formuladas que cumplan los requisitos superen la cantidad disponible, se distribuirá el fondo de manera proporcional a la puntuación obtenida según los criterios de valoración establecidos en estas bases, garantizando un mínimo para para todos los solicitantes con actuaciones subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;8.2) Criterios de valoración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Los criterios para la valoración de las solicitudes será el siguiente (máximo de 60 puntos):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;a) Calidad de las actividades realizadas: Puntuación máxima 20 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;a.1) Siembras y recuperación de cultivos: 10 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;a.2) Mejora de hábitats: 15 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;a.3) Prevención de incendios forestales: 20 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;b) Número de socios de la entidad: Hasta 20 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;c) Superficie de terreno: Hasta 20 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;El apartado c) se refiere a la superficie del coto de caza o en la superficie de los terrenos que forman parte de la asociación en el municipio de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;9. ÓRGANO COLEGIADO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;El órgano colegiado realizará, a partir de un informe del técnico del Área de Medio Ambiente, la valoración técnica de las solicitudes y elaborará la propuesta de resolución de concesión, la cual, a través del órgano instructor, elevará al órgano resolutorio para la concesión de las subvenciones. El órgano instructor tiene atribuidas las siguientes funciones: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;a) Examinar las solicitudes, la documentación presentada y el informe técnico y comprobar los datos en virtud de los cuales se deberá adoptar la resolución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;b) Analizar y valorar las solicitudes y el informe técnico de acuerdo con los criterios establecidos en esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;c) Requerir a los solicitantes la corrección o mejora de sus solicitudes, en su caso. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;d) Formular la propuesta de concesión de subvenciones correspondiente y elevarla al órgano competente para su resolución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;e) Resolver cualquier duda que se presente en la interpretación y aplicación de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;10. INSTRUCCIÓN Y RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;10.1. El órgano instructor del procedimiento será personal administrativo del departamento de Medio Ambiente, que tiene atribuidas las funciones establecidas en el artículo 24 de la Ley General de Subvenciones y artículo 12 de la Ordenanza general de las bases reguladoras de las subvenciones que concede la Ayuntamiento de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;El órgano instructor, a la vista del expediente y del informe del órgano colegiado, formulará la propuesta de resolución provisional concediendo un plazo de 10 días, contados a partir del día siguiente de la publicación de la propuesta, para que los interesados ​​puedan presentar alegaciones, en su caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Finalizado este plazo y examinadas las alegaciones que, en su caso, hubieran presentado los interesados, el órgano instructor, previo informe del órgano colegiado, formulará la propuesta de resolución definitiva que dirigirá al órgano competente para resolver, que dictará resolución definitiva con la lista de solicitantes que hayan obtenido ayudas y la cuantía de las ayudas concedidas, que se notificará de conformidad con lo expuesto en la base 6.2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;10.2. El órgano competente para resolver las convocatorias de subvenciones es el alcalde de Sant Josep de sa Talaia, sin perjuicio de que pueda ser asistido por la Junta de Gobierno Local, según las atribuciones que le confiere el artículo 23.2) de la Ley 7 / 1985, de 2 de abril, reguladora de las bases de régimen local y en relación con el artículo 10.4 de la Ley 38/2003 general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;La resolución será pública de conformidad con lo previsto en el artículo 18.2 de la Ley 38/2003 General de Subvenciones y el artículo 17 de la Ordenanza general de las bases reguladoras de las subvenciones que concede el Ayuntamiento de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;El plazo para la resolución y notificación del procedimiento es de un mes desde la fecha de finalización del plazo para presentación de las solicitudes a que se refiere esta convocatoria&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;La resolución debe especificar los siguientes aspectos: beneficiario; importe de la actividad que se subvenciona; cuantía de la ayuda; partida presupuestaria a la que se aplica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;11. PUBLICIDAD DE LOS PROYECTOS SUBVENCIONADOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Cada entidad beneficiaria de una subvención reflejará, en las actividades que realice, la colaboración de la corporación y se expresará que ha sido subvencionada por el Ayuntamiento de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;La persona o entidad beneficiaria deberá dar adecuada publicidad al carácter público de la financiación del programa, actividad, inversión o actuación objeto de subvención. Las medidas de difusión pueden consistir en la inclusión de la imagen institucional de la entidad concedente, así como en leyendas relativas a la financiación pública en carteles, placas conmemorativas, materiales impresos, medios electrónicos o audiovisuales, o bien, en menciones realizadas en medios de comunicación u otras que resulten adecuadas al objeto subvencionado y de eficacia equivalente a las mencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;12. FACTURA JUSTIFICATIVA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;12.1. Las facturas originales y otros documentos de valor probatorio equivalente serán estampillados por el Ayuntamiento de Sant Josep de sa Talaia y se indicará el importe de la factura que justifica la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;12.2. Se deberá acreditar el pago de la factura justificativa con anterioridad a la finalización del periodo de solicitud de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;12.3. El pago de la factura se acreditará de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;La acreditación del abono del gasto del proyecto se llevará a cabo a través de la documentación que a continuación se indica, dependiendo de los medios de pago que se hayan utilizado:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a. &lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Pago en efectivo: factura, firmada y sellada por el proveedor, en la que se especificará el gasto a la que corresponde el pago, la fecha y la expresión «recibido en metálico», «pagado en metálico», «pagado» o similar. Bajo la firma debe figurar el nombre, apellidos y número de documento de identidad de la persona que firma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b. &lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Pago mediante tarjeta de crédito:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Ticket de compra en el que figure el pago con tarjeta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Ticket de compra y resguardo del pago con tarjeta en caso de que no figure en el ticket de compra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Extracto de la cuenta en la que figure el cargo de pago con tarjeta. El extracto de la cuenta puede sustituirse por un certificado o título similar de la entidad bancaria en la que, como mínimo, conste el titular y el número de cuenta corriente en la que se carga el pago de la tarjeta, la persona beneficiaria, el concepto por el que se hace la transferencia y el importe y la fecha de la operación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c. &lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Pago mediante transferencia bancaria o ingresos en una cuenta bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Copia del justificante de la orden de transferencia bancaria o del documento bancario acreditativo del pago en el que figuren el concepto de la transferencia o el ingreso, la fecha del documento, el importe, la identificación del concepto, a fin de que quede identificado el pago de la factura, y los datos del ordenante y del destinatario, que deben coincidir con la persona beneficiaria y con el emisor de la factura, respectivamente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Extracto de la cuenta bancaria de la persona beneficiaria de la ayuda en el que figure el cargo de esta transferencia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d. &lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Pago mediante cheque nominativo: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Copia del cheque nominativo o pagaré nominativo emitido a nombre del proveedor que expide la factura o documento equivalente, siempre que esté vencido. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Extracto de la cuenta corriente de la persona beneficiaria de la ayuda en el que figure el cargo de este cheque o pagaré.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e. Pago mediante pagarés, letras de cambio o similares:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Documento acreditativo del cargo en cuenta del efecto mercantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Extracto de la cuenta en la que figure el cargo del efecto mercantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Esta documentación se puede sustituir por un certificado o documento similar emitido por la entidad bancaria que contenga el titular y el número de cuenta en el que se ha cargado el efecto mercantil, el librador y el librado de la letra de cambio, la persona beneficiaria, el concepto por el que se hace el efecto mercantil, el importe de la letra de cambio y la fecha de emisión de la letra y del abono por parte del librado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f. &lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Pago mediante domiciliación bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Notificación bancaria del cargo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Extracto bancario en el que figure el cargo de la domiciliación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;13) PAGO DE LA AYUDA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;El pago de la subvención aprobada sólo se podrá hacer efectivo una vez dictada la resolución correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;14) RÉGIMEN DE RECURSOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;Contra la resolución que recaiga en este procedimiento, la cual pondrá fin a la vía administrativa, se podrán interponer los recursos previstos en la legislación vigente. Estos son los siguientes, alternativamente: El recurso de reposición potestativo ante el órgano que dictó la resolución, en el plazo de un mes, a contar a partir del día siguiente al de la notificación de la misma. Contra la desestimación expresa del recurso de reposición, se podrá interponer el recurso contencioso administrativo, en el plazo de dos meses, a contar a partir del día siguiente al de la notificación de la desestimación del recurso de reposición. Contra la desestimación por silencio del recurso de reposición, se podrá interponer el recurso contencioso administrativo, en el plazo de seis meses, a contar a partir del día siguiente al de la desestimación presunta. El recurso contencioso administrativo ante la jurisdicción contencioso administrativa, en el plazo de dos meses, a contar a partir del día siguiente al de la notificación de la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;15) GRADUCACIÓ LOS INCUMPLIMIENTOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#212121"&gt;El incumplimiento de cualquiera de las condiciones impuestas con motivo de la concesión de las subvenciones en los términos que establece el artículo 37 de la LGS o su cumplimiento extemporáneo, cuando el cumplimiento total de las condiciones o el del plazo fuera determinante para la consecución del fin público perseguido, será causa de pérdida total del derecho y de reintegro, en su caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#212121"&gt;Fuera de los casos expresados ​​en el párrafo precedente, el cumplimiento parcial de las condiciones o la realización en plazo de sólo una parte de la actividad, siempre que se acredite una actuación de la persona o entidad beneficiaria inequívocamente tendente a la satisfacción de los compromisos o se debiera a fuerza mayor, dará lugar al pago parcial de la subvención o, en su caso, al reintegro parcial aplicando la proporción en que se encuentre la actividad realizada respecto de la total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#212121"&gt;16) DIFERENCIAS ENTRE VERSIONES &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#212121"&gt;En caso de diferencias entre las versiones en catalán y castellano de esta convocatoria, se tomará como válida la versión en catalán.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
