es 220 2019-01-03 CAIB CAIB 617426 218 es 2019-01-03 13471 text/html 2018-12-28 ![CDATA[Resolución del expediente de otorgamiento de las ayudas económicas del IMAS a entidades que llevan a cabo actividades en materia de servicios sociales para el año 2018]] 230 ![CDATA[<p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El 27 de diciembre de 2018, la presidenta del Instituto Mallorquín de Asuntos Sociales ha dictado la siguiente resolución:</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">«Resolución del expediente de otorgamiento de las ayudas económicas del IMAS a entidades que llevan a cabo actividades en materia de servicios sociales para el año 2018</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Antecedentes</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. El 17 de septiembre de 2018, la presidenta del Instituto Mallorquín de Asuntos Sociales (IMAS) aprobó la convocatoria pública de ayudas económicas del Instituto Mallorquín de Asuntos Sociales a entidades que llevan a cabo actividades en materia de Servicios Sociales para el año 2018.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Esta convocatoria se publicó en el BOIB nº 118 de 25 de septiembre de 2018</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. En esta resolución se autorizó el gasto derivado de este expediente por el importe total de cuatrocientos mil euros (300.000,00 €), con cargo a la partida 40.23142.48905 del vigente presupuesto de gastos del IMAS (referencia contable 222017012609).</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. El 17 de octubre de 2018 finalizó el plazo para presentar solicitudes de la citada convocatoria.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Una vez revisadas las solicitudes admitidas y subsanadas, si era posible, las deficiencias que presentaban, la Comisión Evaluadora se reunió el 16 de noviembre de 2018. Aplicados los criterios de valoración establecidos en las bases y la convocatoria, formuló la correspondiente propuesta de resolución, proponiendo otorgar las ayudas a 25 de las entidades n solicitantes y denegando una de las solicitudes presentadas.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. El 27 de noviembre de 2018 entró a servicio Jurídico administrativo el informe propuesta de la Jefe del servicio de la Dirección Insular de personas con discapacidad, para que se hagan las gestiones oportunas con el fin de otorgar las ayudas económicas de esta convocatoria.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. El Servicio Jurídico Administrativo y la Intervención Delegada del IMAS han emitido los informes favorables correspondientes.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Fundamentos de derecho:</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Visto el Texto consolidado de los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 140, de 5 de noviembre de 2016) aprobado por acuerdo del Pleno del Consejo de Mallorca de fecha 13 de octubre de 2016, en especial la establecido en su artículo 2, de acuerdo con el que este organismo tiene como objeto fundamental el ejercicio, en forma directa y descentralizada, de las competencias atribuidas por cualquier título al Consejo de Mallorca en materia de servicios sociales y menores.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El IMAS en el marco de sus competencias y de la actividad de fomento propia de las administraciones públicas, quiere promover acciones dirigidas a apoyar a entidades que sin ánimo de lucro desarrollan actividades de servicios sociales dirigidas a diferentes perfiles sociales, mediante actividades de carácter preventivo, de información, atención y apoyo social, psicológico y emocional a personas afectadas por situaciones que generan vulnerabilidad, dependencia, riesgo de aislamiento, discriminación , marginación y exclusión social, así como, actividades de inserción, rehabilitación e integración sociolaboral de personas y / o colectivos con dificultades sociales, más desfavorecidos y / o excluidos socialmente; así como actuaciones que complementen programas de asistencia, inserción y reinserción social del Instituto Mallorquín de Asuntos Sociales y / o de los servicios sociales de atención primaria que se gestionen desde el ámbito municipal.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Vista la Ley 12/1993, de 20 de diciembre, de atribución de competencias a los consejos insulares en materia de servicios sociales y asistencia social, las atribuidas por la Ley 14/2001, de 23 de octubre, de atribución de competencias a los consejos insulares en materia de servicios sociales.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Considerando la Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares que establece como principios rectores del sistema de servicios sociales balear la descentralización y la desconcentración.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Visto el Texto consolidado de los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 140, de 5 de noviembre de 2016) aprobado por acuerdo del Pleno del Consejo de Mallorca de fecha 13 de octubre de 2016, y de acuerdo con el artículo 2.c) y d), el IMAS tiene de entre sus funciones desarrollar políticas de protección y atención a personas dependientes.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">De acuerdo con la Ley 38/2003, General de Subvenciones, con carácter previo al otorgamiento de las subvenciones, deberán aprobarse las normas que establezcan las bases reguladoras de concesión en los términos previstos en la Ley.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Vista la Ordenanza General de Subvenciones (BOIB núm. 21 de 18 de febrero de 2017) aprobada mediante acuerdo del Pleno del Consejo de Mallorca de 23 de diciembre de 2016, así como sus modificaciones aprobadas por el acuerdo del Pleno del Consejo de Mallorca de 14 de junio de 2018 y publicadas en el BOIB núm 96 de 4-08-2018, en especial referencia a lo establecido en su artículo 1 que determina que tiene por objeto regular el régimen jurídico general de las subvenciones otorgadas por el Consejo de Mallorca, los organismos autónomos dependientes y las entidades de derecho público con personalidad jurídica propia vinculadas o dependientes que otorguen subvenciones dentro del ejercicio de potestades administrativas. Así como, visto que esta Ordenanza da cumplimiento a lo previsto en el Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones adecuando, de acuerdo con la Disposición adicional segunda de este Decreto legislativo, la actividad de concesión de subvenciones del Consejo a lo establecido en la misma Ley.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">De acuerdo con la convocatoria pública de ayudas económicas del Institut Mallorquí d'Afers Socials a entidades que llevan a cabo actividades en materia de Servicios Sociales para el año 2018, publicada en el BOIB 118 de 25 de septiembre de 2018, en especial los puntos 8 y 9 relativos a la instrucción y resolución.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">De acuerdo con el artículo 3 de los Estatutos del IMAS, este organismo tiene personalidad jurídica propia y la capacidad de obrar necesaria para cumplir sus fines.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">El artículo 7.2 g) de los Estatutos del IMAS que establecen que corresponde a la Presidencia aprobar y resolver los procedimientos de ayudas y subvenciones relativas a las competencias atribuidas al IMAS.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Por todo ello,</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">RESUELVO</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Primero.
