270 ![CDATA[<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">No habiendo sido presentada por los interesados, durante el plazo de exposición al público, ninguna reclamación o sugerencia contra el acuerdo de modificación de <strong>la Ordenanza</strong><strong> reguladora del Precio Público por servicios de préstamo de bicicleta pública BiciPalma, concepto 341,14,</strong> aprobado provisionalmente por el Ayuntamiento Pleno en sesión de día 25 de octubre de 2018, se entiende definitivamente aprobado, según lo que dispone el artículo 49 de la Ley 7/1985, de 2 de abril, de bases de régimen local, y por este motivo, se publica el texto íntegro del mencionado acuerdo, que es el siguiente: </span></span></p> <p style="text-align:center"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>ACUERDO</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>“Primero.</strong>- Aprobar la modificación de la <strong>ordenanza reguladora de Precio Público por servicios de préstamo de bicicleta pública BiciPalma, concepto 341,14; </strong>todo ello en base a la legislación vigente en la materia, constituida singularmente por los artículos 41 al 47 del Texto Refundido de la Ley de Haciendas locales, aprobado por Real decreto legislativo 2/2004, de 5 de marzo y en el artículo 49 de la Ley de bases de régimen local, y según la nueva redacción que se adjunta a esta propuesta. </span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">La nueva redacción de la Ordenanza reguladora del precio público por servicios de préstamo de bicicleta pública quedará así:</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Segundo.- </strong>Que una vez adoptado el acuerdo provisional referido, se publique en el BOIB y en uno de los diarios de mayor difusión de la Comunidad Autónoma el correspondiente anuncio de exposición al público del expediente, a efectos de reclamación. La citada exposición se hará en el tablón de edictos de este Exmo. Ayuntamiento durante el plazo de treinta días, durante los cuales los interesados podrán examinar el expediente y presentar las reclamaciones que estimen oportunas, entendiendo que si durante el mencionado plazo no se hubiesen presentado reclamaciones, se entenderá definitivamente adoptado el acuerdo provisional.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Tercero.- </strong>La expresada modificación entrará en vigor el día siguiente de su publicación en el BOIB. </span></span></p> <p style="text-align:center"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Ordenanza reguladora del precio público por servicios de préstamo de bicicleta pública, BiciPalma&nbsp;</strong></span></span><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Concepto 341,14</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Artículo 1</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Concepto</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">De conformidad con el artículo 127, en relación con el artículo 41, ambos del Texto refundido de la Ley de haciendas locales aprobado por el Real decreto legislativo 2/2004,de 5 de marzo, este Ayuntamiento establece el precio público por servicios de préstamo de bicicleta pública, que se regirá por la presente Ordenanza. </span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">El objeto de este precio público es la utilización, por los usuarios de las bicicletas del Servicio de préstamo de la bicicleta pública.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Artículo 2</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Obligados al pago</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Están obligadas al pago las personas usuarias a las que se refiere el Reglamento del Servicio de préstamo de la bicicleta pública (BiciPalma) que soliciten el servicio.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Artículo 3</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Cuantía</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">1. Las reducciones no son acumulables.</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Artículo 5</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Normas de gestión</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">1. Las personas interesadas en la utilización de los servicios señalados en esta Ordenanza lo solicitarán a los encargados de su gestión, de acuerdo con las especificaciones del Reglamento del Servicio de préstamo de la bicicleta pública (Bicipalma). En este momento nacerá la obligación del pago del precio público, que tendrá carácter de autoliquidación, conforme a lo previsto en el artículo 45 del Texto refundido de la ley de haciendas locales. El pago se hará en línea (on line) con tarjeta bancaria a través de la pagina Web de MobiPalma o por cualquier otro medio que se ponga en marcha par facilitar el servicio.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">2. No se hará ningún tipo de devolución del precio público, ni total, ni parcial, a excepción de los casos en que se acredite que el servicio no se ha podido prestar por causas no imputables al obligado al pago, en los cuales sí que procederá la devolución del importe correspondiente.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">3. La gestión de los servicios a los que se refiere esta Ordenanza podrá ser objeto de concesión anual por parte del Ayuntamiento, a favor de&nbsp; persona natural o jurídica, mediante cualquiera de los tipos de licitación legalmente establecidos.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">4. Se aplicará un recargo de 150 € en la tarjeta bancaria de las personas usuarias cuando estas no devuelvan la bicicleta antes de las 24 horas des de su retirada de la estación.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Disposición final</strong></span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Esta ordenanza fue aprobada originariamente por el Ayuntamiento pleno en sesión de día 26 de julio de 2012. La última modificación fue aprobada por acuerdo plenario de ..., entra en vigor a partir de día … </span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Segundo.-</strong> Que una vez adoptado el acuerdo provisional referido, se publique en el BOIB y en uno de los diarios de mayor difusión de la Comunidad Autónoma el correspondiente anuncio de exposición al público del expediente, a efectos de reclamación. La citada exposición se hará en el tablón de edictos de este Excmo. Ayuntamiento durante el plazo de treinta días, durante los cuales los interesados podrán examinar el expediente y presentar las reclamaciones que estimen oportunas, entendiendo que si durante el plazo no se hubieran presentado reclamaciones, se entenderá definitivamente adoptado el acuerdo provisional.</span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><strong>Tercero.- </strong>La expresada modificación entrará en vigor el 1 de enero de 2019. </span></span></p> <p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif">Lo que se publica para que se tenga conocimiento general y a los efectos oportunos, y se comunica que, conforme a lo que dispone el artículo 52.1 de la Ley 7/1985, de 2 de abril, los interesados podrán interponer recurso contencioso administrativo, de acuerdo con el artículo 19 de la Ley 29/98, de 13 de julio, reguladora de la jurisdicción contencioso administrativa, ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Islas Baleares, contra el acuerdo definitivo de modificación de la mencionada ordenanza, en el plazo de dos meses contados a partir del día siguiente al de su publicación en el BOIB.
