    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0.21cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De conformidad con el acuerdo plenario de este Ayuntamiento sobre las modificaciones puntuales de las ordenanzas fiscales, y en cumplimiento del artículo 17.4 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo, se publica el texto íntegro de la siguiente ordenanza fiscal (incluyendo las modificaciones aprobadas):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;«&lt;/em&gt;&lt;strong&gt;ORDENANZA REGULADORA DEL PRECIO PÚBLICO POR LA PRESTACIÓN DE LOS SERVICIOS DE ESCUELAS MUNICIPALES INFANTILES.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;Artículo 1.- Fundamento y naturaleza&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De acuerdo con el que prevén los artículos 127 y 41 del Texto refundido de la Ley reguladora de las haciendas locales (Real decreto legislativo 2/2004), el Ayuntamiento de Andratx establece el precio público por la prestación de los servicios de Escuelas Municipales Infantiles de Andratx y del Puerto de Andratx, especificados en las tarifas del artículo 4, que se regirán por esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;Artículo 2.- Obligación de pago&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La obligación de pagar el precio público nace desde que se inicia la prestación de los servicios de asistencias y estancias a las Escuelas Infantiles Municipales de Andratx o del Puerto de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;Artículo 3.- Obligados al pago&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Están obligadas a pagar las personas que se beneficien de los servicios, entendiéndose como tales los padres o tutores legales de los usuarios de los servicios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;Artículo 4.- Cuantía&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.1. La cuantía del precio público regulado en esta ordenanza es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En el supuesto de que algún usuario pueda ser incluido en distintos grupos de tarifas, el precio público a aplicar será el de menor cuantía.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.3. Los lactantes que estén en la escuela durante toda la jornada tienen que abonar la cuota correspondiente a jornada completa con servicio de comedor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.4. La matrícula se tiene que abonar una sola vez con la inscripción en las Escuelas Infantiles Municipales de Andratx o del Puerto de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.5.- Si por parte del Ayuntamiento no se presta el servicio, en un día marcado como lectivo en el calendario de la escuela infantil, se deducirá de la cuota la siguiente cantidad por día no prestado:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Igualmente servirán de base para calcular la cuota a pagar el mes de septiembre, en el caso de los niños que empiezan al escoleta por primera vez y por los que por motivos de edad sean baja para empezar educación infantil; en este caso la cuota resultante será el resultado de multiplicar la cuota anterior por los días de servicio prestados.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En el caso de usuarios con necesidades educativas especiales o con discapacidad igual o superior al 33% se tendrá que acreditar documentalmente la existencia del dicho condición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;Artículo 5.- Exenciones&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las familias con una problemática social grave, previo informe motivado del Departamento de Servicios Sociales. Esta exención será de carácter rogado y resuelta la petición de exención por Decreto de la Concejalía de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;Artículo 6.- Normas de gestión&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6.1. La matrícula graba la actividad administrativa de inscripción, por lo cual una vez que se haya llevado a cabo no es procedente devolverla. La matrícula es única por niño admitido. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.2. Las personas admitidas en el plazo establecido por la Consellería de Educación abonarán la matrícula por autoliquidación, y la liquidación de los meses se hará mediante domiciliación bancaria. El resto abonarán la matrícula y el primer mes por autoliquidación, y la liquidación de los siguientes meses se hará mediante domiciliación bancaria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.3. Las tarifas mensuales se tienen que abonar dentro de los debe primeros días.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.4. Las altas que se produzcan dentro de los quince primeros días de cada mes abonarán la cuota mensual.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Si la matrícula se formaliza en la segunda quincena del mes, se abonará el 50% de la cuota que corresponda.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.5. El mes de septiembre, los alumnos que se den de baja por haber acabado la etapa escolar en el centro y los que empiecen por primera vez abonarán las cuotas especificadas en el apartado 5 del artículo 4.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.6. Las bajas definitivas en la prestación del servicio o las modificaciones en el régimen de estancia tienen que ser comunicadas por los padres o tutores con anterioridad al día 20 del mes anterior en qué tengan que producir efecto, y tienen que ser presentadas con el impreso elaborado a tal efecto en el registro general de entrada.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La falta de asistencia de un niño durante un periodo de un mes sin aviso previo implica la baja definitiva de la escuela, sin que esto afecte el recibo del mes no asistido.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Igualmente implica la baja definitiva de la escuela el impago de un recibo en el plazo establecido.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.7. Si el niño no asiste en la escuela en un periodo igual o superior a un mes, los padres o tutores pueden solicitar la devolución de la mitad de la cuota correspondiente. Para el cálculo de la cuantía a volver en el caso de un periodo superior a un mes, se utilizará la cuota establecida al artículo 4.5.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Hay que acompañar la solicitud de devolución de cuota por dolencia con un certificado médico en el cual conste el motivo y la duración de la baja. Posteriormente, el Ayuntamiento tiene que solicitar un informe en la escuela infantil que corrobore la no-asistencia.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.8. Para la aplicación de las cuotas contempladas al artículo 4.1.B, en el caso de familias numerosas tendrán que aportar el carné de familia numerosa en vigor.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Para la aplicación de las cuotas contempladas al artículo 4.1.C, en el caso de familias que tengan un hijo con necesidades educativas especiales tendrán que aportar el informe del especialista correspondiente.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Para la aplicación de las cuotas contempladas al artículo 4.1.C, en el caso de familias que tengan un hijo con discapacidad igual o superior al 33% tendrán que aportar la declaración administrativa de discapacidad expedida por el órgano competente de la Comunidad Autónoma o certificado del IMSERSO.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.9. De forma general, todo el que no se prevé en esta ordenanza se tiene que atener a aquello que dispone el Reglamento de régimen interno del Servicio.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;6.10. Asistencia en clase: es obligatorio estar al corriente de pago de matrícula y cuotas. A principios de curso será obligatoria la presentación del recibo de matrícula y de la 1ª cuota. A lo largo del curso se podrá también exigir la acreditación de estar al corriente de pago.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;Artículo 7.- Infracciones y sanciones&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las infracciones y las sanciones en materia tributaria se tienen que regir por aquello que dispone la Ley general tributaria y la normativa que la despliega.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;Artículo 8.- Delegación en la Junta de Gobierno Local&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En conformidad con el que prevé el artículo 47.1 del Texto refundido de la Ley reguladora de las haciendas locales, en relación con el artículo 23.2 b) de la Ley reguladora de las bases de régimen local, se delega en la Junta de Gobierno Local la fijación o la modificación de la cuantía de los precios públicos por usuario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;strong&gt;DISPOSICIÓN FINAL&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Esta ordenanza entra en vigor el 1 de enero de 2018 y continuará hasta que se modifique o se derogue expresamente.&lt;em&gt;» &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
