font-size:12px"><span style="color:#000000">De conformidad con el acuerdo plenario de este Ayuntamiento sobre las modificaciones puntuales de las ordenanzas fiscales, y en cumplimiento del artículo 17.4 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo, se publica el texto íntegro de la siguiente ordenanza fiscal (incluyendo las modificaciones aprobadas):</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em>«</em><strong>ORDENANZA REGULADORA DE LA TASA POR SERVICIOS ESPECIALES MOTIVADOS POR ESPECTÁCULOS, TRANSPORTES Y OTROS</strong></span></span></p> <p><strong style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Artículo 1.- Fundamento y naturaleza.</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En uso de las facultades concedidas por los Artículos 133.2 y 142 de la Constitución y por el Artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, y en conformidad con el dispuesto en los artículos 15 a 19, del Texto Refundido de la Ley Reguladora de las Haciendas Locales (RDL 2/2004, de 5 de marzo), este Ayuntamiento establece la “Tasa por Servicios Especiales motivados por espectáculos, transportes y otros”, que se regirá por la presente Ordenanza Fiscal, las normas de la cual se atienen a lo previsto en el artículo 57 en relación con el artículo 20.4 letra g, del citado Texto Refundido.</span></span></p> <p><strong style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Artículo 2.- Hecho imponible.</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- Constituye el hecho imponible de la Tasa la prestación de los siguientes servicios especiales, de competencia municipal, a instancia de parte:</span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Vigilancia, protección, ordenación y regulación del tráfico, estacionamiento de vehículos y cualesquiera otros que sean motivados por la celebración de espectáculos y esparcimientos públicos que, por su naturaleza, por la aglomeración de público que los mismos provoquen o por las necesidades de ordenar el acceso y salida de público y vehículos así lo exijan.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Conducción, vigilancia y acompañamiento de transportes pesados, grandes transportes y caravanas a través de vías urbanas e interurbanas dentro del Término Municipal.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El Examen sanitario de productos alimenticios y bebidas y de sus condiciones de transporte en los supuestos de decomiso por venta ambulante sin Licencia Municipal.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El depósito y vigilancia en dependencias municipales de artículos no alimenticios intervenidos para ofrecerse en venta fuera de establecimientos legalmente autorizados sin Licencia Municipal, así como de mobiliario y enseres procedentes de alzamientos efectuados por orden Judicial.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Los servicios de inspección relativos a la determinación sobre el origen e identidad de artículos no alimenticios destinados a la venta fuera de establecimientos legalmente autorizados, sin Licencia Municipal.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">El traslado y/o remolque de embarcaciones y otros objetos flotantes hasta la costa, mediante la utilización de elementos materiales y personal del </span>Ayuntamiento.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Estudios de señalización y materialización de estos.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Elaboración de informes técnicos de accidentes a petición de interesados, Compañías de seguros, Abogados, Procuradores, etc; o a través de Autoridad Judicial.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Elaboración de informes de actividades de unidades policiales.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Realización de inspecciones de comprobación de medidas correctoras, aparatos, precintos, y cualquier actividad, aquellas que se realicen por la modificación de las condiciones de funcionamiento y, cualquier otra de las establecidas en los puntos 4 y 5 del Art. 9 de la Ordenanza Municipal de Protección del Medio ambiente contra la contaminación por ruidos y vibraciones.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Cualesquiera otros servicios especiales que sean motivados por otras actividades que exijan su prestación.</span></span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2.- A estos efectos, se entenderán prestados a instancia de parte los referidos servicios cuando estos hayan sido provocados por el particular o redunden en su beneficio, aunque no haya intervenido solicitud expresa.</span></span></p> <p><strong style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Artículo 3.- Sujeto pasivo.</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Son sujetos pasivos contribuyentes, las personas físicas y jurídicas y las entidades que se refiere el artículo 35.4 de la Ley 58/2003 de 17 de diciembre General Tributaria que sean:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- en el supuesto del Artículo 2.1.a): los titulares, empresarios u organizadores, si procede, de los espectáculos y esparcimientos que motiven u obliguen en este Ayuntamiento a prestar los servicios especiales señalados en el artículo anterior.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- en el supuesto del artículo 2.1.b): Los titulares de la empresa de los servicios de transporte y, de no estar los vehículos afectos a una actividad empresarial, los propietarios de estos.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">- en los restantes supuestos del artículo 2.1: Los peticionarios de los otros servicios especiales y provocadores y beneficiarios de los mismos aunque no los soliciten.</span></span></p> <p><strong style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Artículo 4.- Responsables.</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- Responderán solidariamente de las obligaciones tributarias del sujeto pasivo, las personas físicas y jurídicas a que se refieren los artículos 41 y 42 de la Ley 58/2003 General Tributaria.</span></span></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">2.- Serán responsables subsidiarios los administradores de las sociedades y los síndicos, interventores o liquidadores de quiebras, concursos, sociedades y entidades en general, en los supuestos y con el alcance que señala el artículo 43 de la Ley 58/2003 General Tributaria.</span></p> <p><strong style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">Artículo 5.- Cuota tributaria</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- La cuota tributaria se determinará en función del número de efectivos, tanto personales como materiales, que se empleen en la prestación del servicio y el tiempo invertido, así como en función del tiempo de utilización de los almacenes y dependencias municipales.</span></span></p> <p><span style="color:#000000; Junto con el escrito de solicitud presentarán la correspondiente autoliquidación de esta tasa.</span></span></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">2.- Por la Administración Municipal, se emitirá el correspondiente informe técnico, si es el caso, y se comprobará que el interesado ha aportado la correspondiente acreditación de haber abonado la tasa correspondiente. Todo esto con carácter previo, y como requisito necesario para poder llevar a cabo la prestación del servicio. En todo caso será el interesado quien tendrá que justificar el pago de la tasa.</span></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">3.- Una vez efectuado este, y determinada la cuota tributaria definitiva conforme al artículo 5, se practicará liquidación con carácter definitivo, siempre que no coincida con el importe autoliquidado, que será notificada al interesado.</span></p> <p><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">4.- Respecto de los servicios regulados en los restantes epígrafes del antes citado artículo, por parte de la Administración Municipal se procederá, en el momento de la intervención de artículos no alimentarios o de decomiso de productos alimenticios, a notificar al interesado obligado al pago la liquidación de la Tasa que proceda por Examen Sanitario e Inspección de los artículos o productos.
