    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el BOIB número 129, de 21 de octubre de 2017, se publicó el Acuerdo del Consejo de Gobierno de 20 de octubre de 2017 por el que se aprueba la propuesta de la Comisión de Impulso del Turismo Sostenible en relación con los proyectos que deben financiarse con el fondo para promover el turismo sostenible, correspondiente al plan anual de 2017, en el que se aprueba un paquete de medidas para la promoción de la movilidad sostenible, entre las que se incluye el establecimiento de nuevas puntos de recarga para vehículo eléctrico rápida y semirrápida. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 (BOIB nº 72, de 24 de mayo) establece las bases reguladoras para la concesión de subvenciones en materia de energía en las Illes Balears, entre las que se encuentran las de promoción del ahorro y la diversificación energéticas, la implantación de energías renovables, la mejora de la eficiencia energética y la generación de nuevas tecnologías con vistas a permitir un desarrollo más sostenible del uso de la energía, así como el fomento de actuaciones en transporte eficiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Consejería de Territorio, Energía y Movilidad tiene, entre los objetivos del Plan Director Sectorial Energético de las Illes Balears, aprobado definitivamente por el Decreto 96/2005, de 23 de septiembre, y publicado en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; número 143, de 27 de septiembre de 2005, la planificación de las actuaciones encaminadas a suministrar la demanda energética futura a cada una de las Illes Balears, ya sea con fuentes de energía convencionales como renovables y, al mismo tiempo, impulsar el ahorro y la racionalización del uso de la energía en cada uno de los sectores económicos, con el fin de minimizar, en la medida en que pueda, el incremento de la demanda de energía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Gobierno de las Illes Balears apuesta por un proceso de implantación de la movilidad eléctrica en el que el desarrollo del vehículo eléctrico supone un paso adelante hacia un modelo de economía medioambiental más sostenible, dado que la sustitución de los motores de combustión por vehículos eléctricos implica un ahorro de combustibles fósiles y una reducción de las emisiones de CO2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Las Illes Balears son un territorio idóneo para el fomento del vehículo eléctrico, tanto por la singularidad geográfica, con distancias pequeñas y necesidad de optimizar los recursos energéticos, como por la vocación turística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Así pues, con esta convocatoria de subvención de puntos de recarga de vehículo eléctrico se intenta dar un impulso a la implantación del vehículo eléctrico en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El objeto de la convocatoria es fomentar la instalación de puntos de recarga rápida y semirrápida en zonas de acceso público para conseguir una red mínima de puntos de recarga rápida con la finalidad de facilitar la progresiva implantación del vehículo eléctrico en las Illes Balears y conseguir una movilidad más sostenible.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Reglamento (UE) nº 651/2014, de 17 de junio, de la Comisión, por el que se declaran determinadas categorías de ayudas compatibles con el mercado interior en aplicación de los artículos 107 y 108 del Tratado (Reglamento general de exención por categorías) exime a determinadas categorías de ayudas de la obligación de notificación previa, entre las que están las ayudas a la inversión sobre protección del medio ambiente. El artículo 36 de este Reglamento establece que la intensidad de la ayuda no debe superar el 40&amp;nbsp;% de los costes subvencionables, intensidad que incluso se puede incrementar en 20 puntos porcentuales en el caso de pequeñas empresas, y en 10 puntos en el de medianas empresas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo ello, vistos los informes preceptivos, de conformidad con el artículo 5 de la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía en las Illes Balears, y el artículo 15 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, y haciendo uso de las facultades que me atribuyen la Ley 4/2001, de 14 de marzo, del Gobierno de las Illes Balears, y la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Comunidad Autónoma de las Illes Balears, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;1. Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El objeto de esta Resolución es aprobar y regular, dentro del marco del impuesto sobre estancias turísticas en las Illes Balears y de medidas de impulso del turismo sostenible, la convocatoria pública de ayudas para fomentar la instalación de puntos de recarga rápida y semirrápida de uso público para vehículo eléctrico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;2. Beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Podrán ser beneficiarios de estas ayudas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Las empresas públicas, los consorcios y las fundaciones que lleven a cabo su actividad en el ámbito territorial de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Los consejos insulares, los ayuntamientos y las entidades locales menores de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; Las empresas, con cualquier figura jurídica admitida por el ordenamiento jurídico (personas físicas, personas jurídicas de derecho privado y comunidades de bienes) que lleven a cabo su actividad en el ámbito territorial de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d)&lt;/em&gt; Las asociaciones empresariales, en los edificios destinados a su actividad social, que tengan el domicilio y desarrollen su actividad en el ámbito territorial de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;3. Importe económico&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.1. El importe económico de esta convocatoria será de 4.000.000&amp;nbsp;€. Las subvenciones se concederán con cargo al presupuesto de la Comunidad Autónoma para los ejercicios 2019 y 2020; concretamente, del centro de coste 25601, subprograma 731A01, capítulo 7, artículo 76 y artículo 77. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La distribución de los fondos para el establecimiento de nuevos puntos de recarga se realizará anualmente, conforme a los programas indicados en el punto 5 y las cantidades siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Programa 1: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Año 2019: 1.950.000&amp;nbsp;€ &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Año 2020: 1.850.000&amp;nbsp;€&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Programa 2: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Año 2019: 100.000&amp;nbsp;€&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Año 2020: 1.000.00&amp;nbsp;€&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Esta convocatoria se tramita como expediente de gasto anticipado, y de acuerdo con el artículo 43.1 del Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears, queda sometida a la condición suspensiva de la existencia de crédito adecuado y suficiente en los presupuestos generales de la Administración de la Comunidad Autónoma de las Illes Balears para los años 2019 y 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.2. En caso de que no se cubra la totalidad del presupuesto inicial asignado a cada anualidad, el importe remanente se asignará a la siguiente anualidad. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.3. En caso de que no se cubra la totalidad del presupuesto inicial asignado al programa 2, el importe remanente se asignará al programa 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.4. Siempre que las disponibilidades presupuestarias lo permitan, se podrán incrementar los importes de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;4. Definiciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.1. Se considera &lt;em&gt;centro de recarga&lt;/em&gt; la infraestructura de recarga para vehículo eléctrico en un emplazamiento determinado y que conste al menos de un punto de recarga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.2. Se considera &lt;em&gt;punto de recarga&lt;/em&gt; la plaza específica de estacionamiento de vehículos eléctricos destinada a la recarga de las baterías, dotada del sistema de conexión del vehículo a la red adecuada para gestionarla y llevarla a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.3. Se considera un &lt;em&gt;sistema de alimentación específico para vehículo eléctrico&lt;/em&gt; (SAVE) el conjunto de equipos montados con el fin de suministrar energía eléctrica para la recarga de un vehículo eléctrico, que incluye las protecciones de la estación de recarga, el cable de conexión (con conductores de fase, neutro y protección) y la base de toma de corriente o el conector. Este sistema permite, en su caso, la comunicación entre el vehículo eléctrico y la instalación fija. En el modo de carga 4 el SAVE incluye también un convertidor alterno-continuo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.4. Se considera &lt;em&gt;modo de carga 3&lt;/em&gt; la conexión directa del vehículo eléctrico a la red de alimentación de corriente alterna utilizando un SAVE, en el que la función de control de piloto se amplía al sistema de control del SAVE, que está conectado permanentemente a la instalación de alimentación fija.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.5. Se considera &lt;em&gt;modo de carga 4&lt;/em&gt; la conexión indirecta del vehículo eléctrico a la red alterna utilizando un SAVE incorporando un cargador externo, en que la función piloto se extiende al equipo conectado permanentemente a la instalación de alimentación fija.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.6. Se considera que un punto de recarga está situado en zonas de acceso público cuando pueda acceder al mismo de manera no discriminatoria cualquier ciudadano libremente y sin restricciones. Para acceder al punto de recarga podrá requerirse, según el caso, un registro, una autentificación o el pago de una tarifa, entre otras medidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.7. Se considera un &lt;em&gt;sistema de control de potencia de la recarga&lt;/em&gt; un sistema de protección de la línea general de alimentación o de la derivación individual contra sobrecargas mediante la disminución momentánea de la potencia destinada a la recarga del vehículo eléctrico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.8. A los efectos de esta convocatoria se definen dos tipos de puntos de recarga:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Tipo A: punto con modo de recarga 3 y 4 que debe permitir la carga rápida en corriente continua y en corriente alterna, y disponer de los sistemas de conexión según el IEC 62196: Combo, Chademo y alterna (conector tipo 2). La potencia del punto será igual o superior a 20 kW.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Tipo B: punto con modo 3 y que debe ser compatibles con modo 3 completa IEC 61.851-1 y los conectores serán tipo 2 según el IEC 62.196-2 con medida de energía integrada. La potencia del punto será igual o superior a 7,2 kW.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4.9. La Red MELIB es el sistema interoperable de gestión de los puntos de recarga de vehículos eléctricos en las Illes Balears. Este red está formada por los puntos de recarga de las entidades públicas que hayan firmado un convenio con la Consejería de Territorio, Energía y Movilidad y por las entidad privadas que así lo manifiesten y cumplan los requisitos de integración. Esta sistema se integrará en el sistema de gestión del transporte de las Illes Balears (TIB).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;5. Actuaciones y gastos subvencionables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.1. Se podrá recibir ayuda para los siguientes programas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Programa 1. Instalación de nuevos puntos de recarga rápida y semirápida que cumplan los requisitos establecidos en el punto 6 de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los beneficiarios indicados en los apartados 2 &lt;em&gt;c&lt;/em&gt; y 2 &lt;em&gt;d&lt;/em&gt; de esta Resolución podrán solicitar ayudas para los puntos de recarga tipo A y tipo B; y los beneficiarios indicados en los apartados 2 &lt;em&gt;a&lt;/em&gt; y 2 &lt;em&gt;b&lt;/em&gt; podrán solicitar ayudas para los puntos de recarga tipo A.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Programa 2. Adaptación de sistemas actuales de gestión de puntos de recarga para que puedan funcionar con el sistema de gestión de la Red MELIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Gastos de adaptación de los sistemas actuales de gestión pública de carga al sistema de gestión de la Red MELIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Este programa está destinado a los beneficiarios indicados en el apartado &lt;em&gt;c&lt;/em&gt; del punto 2 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.2. Las inversiones subvencionables serán:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Puntos de recarga&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Serán subvencionables los equipos de recarga o sistema donde se conecta el vehículo eléctrico necesarios para la recarga del vehículo eléctrico, la infraestructura eléctrica, el proyecto técnico y la dirección de obra, la obra civil y la señalización de los puntos de recarga. Los sistemas de control de potencia de la recarga se considerarán incluidos dentro de la infraestructura eléctrica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; &lt;em&gt;Software&lt;/em&gt; de la adaptación MELIB&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Serán subvencionables los gastos en &lt;em&gt;software&lt;/em&gt; para la adaptación del sistemas de gestión actuales para que puedan funcionar con la Red MELIB. No serán subvencionables los gastos internos ni los gastos en equipos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.3. Las inversiones objeto de la solicitud se llevarán a cabo en el ámbito territorial de las Illes Balears y se realizarán durante el periodo que va desde el día de la presentación de la solicitud hasta el plazo que fije la resolución de otorgamiento, que no podrá ser superior al 30 de septiembre de 2019 para la anualidad 2019 y al 30 de septiembre de 2020 para la anualidad 2020; y computará como fecha de solicitud el día que se realice el envío de la documentación mediante el trámite telemático. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.4. El IVA será subvencionable siempre que el beneficiario no lo pueda recuperar o compensar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;6. Requisitos y gestión de la recarga&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.1. Los puntos de recarga cumplirán, como mínimo, los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Ser nuevos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Estar situados en el ámbito territorial de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; Dar servicio al público en general y estar situados en zonas de acceso público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d)&lt;/em&gt; Disponer de plaza de aparcamiento señalizada horizontalmente y verticalmente para vehículo eléctrico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e)&lt;/em&gt; Permitir la carga rápida o semirrápida y tener las características según el tipo de punto establecido. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;f)&lt;/em&gt; Instalarse de acuerdo con la reglamentación vigente, especialmente con el Reglamento electrotécnico de baja tensión, concretamente el ITC-BT-52. Grado de protección IP e IK adecuado en función de la ubicación según REBT. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;g)&lt;/em&gt; Disponer la estación de recarga de la correspondiente declaración CE.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;h)&lt;/em&gt; Estar equipados los dispositivos de protección diferencial de la instalación y los equipos de recarga con dispositivos de rearme automático.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;i)&lt;/em&gt; Tener indicación luminosa de estado de carga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;j)&lt;/em&gt; Facilitar información de que la carga ha empezado y ha finalizado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;k)&lt;/em&gt; Tener conexión y memoria para almacenaje local de datos de operación con apertura del punto de recarga aunque falte la conexión con el centro de control (funcionamiento con listas blancas).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;l)&lt;/em&gt; Ser compatible con el protocolo OCPP v1.5, mediante el uso de servicios web (SOA). El fabricante o suministrador del punto instalará el OCPP v1.5 y lo actualizará gratuitamente como mínimo hasta la versión OCPP 2.0. En caso de integración en el sistema de gestión MELIB, se deberá configurar el APN según las indicaciones de la Dirección General de Energía y Cambio Climático.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;m)&lt;/em&gt; Tener comunicaciones 3G/GPRS u otros, con el centro de gestión MELIB. En caso de integración en el sistema MELIB, la Dirección General de Energía y Cambio Climático proporcionará la tarjeta de comunicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;n)&lt;/em&gt; Tener la identificación local del usuario mediante la tarjeta de contacto RFID según el ISO 14443A.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;o)&lt;/em&gt; Medir la potencia y la energía transferida según contador MID.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;p)&lt;/em&gt; Restringir el acceso a la toma de energía a usuarios no autorizados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;q)&lt;/em&gt; Disponer de Display LCD o pantalla de visualización multiidioma con texto personalizable o sistema equivalente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.2. Las estaciones de recarga incorporarán logotipos de imagen del MELIB de acuerdo con el manual de aplicación que establecerá la Consejería de Territorio, Energía y Movilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.3. Asimismo, en aquellos puntos donde se quieran cobrar las recargas, se instalará un cartel claramente visible en el que se indicará la potencia de carga del punto, el precio de la carga expresado en €/kWh y el horario de funcionamiento del centro de recarga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;7. Integración en la Red MELIB&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los puntos de recarga objeto de esta convocatoria se integrarán de forma obligatoria en la Red para el Desarrollo de una Infraestructura de Recarga de Vehículos Eléctricos en las Illes Balears (Red MELIB) cuando correspondan a los beneficiarios descritos en los apartados 2 &lt;em&gt;a&lt;/em&gt; y 2 &lt;em&gt;b&lt;/em&gt; del punto 2 de la convocatoria; en cambio, los correspondientes a los apartados 2 &lt;em&gt;c&lt;/em&gt; i 2 &lt;em&gt;d&lt;/em&gt; lo podrán hacer de manera opcional. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los puntos que no se integren en la plataforma MELIB deberán incorporar un sistema de gestión del beneficiario que proporcione el estado en tiempo real de los puntos de recarga, con el formato y el protocolo establecido por la Dirección General de Energía y Cambio Climático, en la plataforma MELIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El sistema de gestión del beneficiario deberá permitir el pago para el acceso y uso de los puntos en el centro de recarga en efectivo, mediante una tarjeta de crédito o a través de una aplicación web, sin necesidad de un registro previo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;8. Gestión de las recargas. Precio máximo de la recarga&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La gestión de las recargas y los precios máximos de las mismas cumplirán las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. La reventa energética para la recarga de los vehículos eléctricos se realizará de acuerdo con la reglamentación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. En la solicitud se indicará el precio de la recarga (P) en €/kWh (IVA incluido) y se diferenciará el precio entre el tipo A y el tipo B.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Los centros de recarga indicarán al público los precios de la recarga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. El precio (P) de la recarga indicado en los puntos anteriores se mantendrá durante un periodo mínimo de cinco años desde la fecha máxima de justificación establecida en la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;No obstante, en el primer trimestre de cada año, se analizará la evolución del mercado de la energía durante el año anterior, y en el caso de que haya variaciones en el precio, los cargos o los peajes, la Dirección General de Energía y Cambio Climático podrá autorizar el aumento proporcional del precio de la recarga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Cualquier cargo adicional al precio del kWh indicado en el apartado 8.2 que se incluya en el precio final de la recarga deberá ser aprobado previamente por la Dirección General de Energía y Cambio Climático.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;9. Solicitudes y documentación &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.1. El plazo para presentar las solicitudes se iniciará a partir del quinto día de la publicación de esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears &lt;/em&gt;y&lt;em&gt; &lt;/em&gt;finalizará a los tres meses de la publicación de esta Resolución en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.2. Las solicitudes se realizarán de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; En el programa 1 se realizará una solicitud para cada centro de recarga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; En el programa 2 se realizará una solicitud para cada empresa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.3. Las solicitudes, dirigidas a la Consejería de Territorio, Energía y Movilidad, se presentarán mediante el trámite telemático que se habilitará en la web de la Dirección General de Energía y Cambio Climático.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.4. Los solicitantes, para cada actuación, presentarán la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Programa 1 &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; La solicitud de subvención de esta convocatoria y la declaración responsable de veracidad de los datos aportados, disponible en &amp;lt;http://energia.caib.es&amp;gt; y que incluye la autorización a la Administración para acceder a los datos. La presentación de la solicitud supondrá que el solicitante acepta las prescripciones contenidas en la correspondiente convocatoria, así como que también autoriza al órgano instructor del procedimiento para que, en su caso, obtenga de forma directa la acreditación de las obligaciones tributarias y con la Tesorería General de la Seguridad Social. En caso de que el solicitante deniegue expresamente la autorización a que se refiere el párrafo anterior, aportará un certificado de la Agencia Estatal de la Administración Tributaria y de la Tesorería de la Seguridad Social que justifique que está al corriente de las obligaciones tributarias y ante la Seguridad Social. Se indicará en el anexo si ha solicitado o recibido otra ayuda por el mismo concepto, y especificará el organismo, la fecha de resolución de concesión y la cuantía, así como los datos bancarios a efectos del ingreso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; La ficha resumen de la inversión (anexo 3).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; La memoria técnica o anteproyecto. Se incluirá, como mínimo, la descripción de la instalación y de la ubicación de los puntos de recarga; el plano de emplazamiento con coordenadas UTM; el horario de apertura al público; el precio ofrecido en la recarga (€/recarga) los cinco primeros años, desde el vencimiento del plazo para presentar la justificación a cargo del beneficiario; la marca, el modelo y las características de los puntos de recarga; el tipo de recarga, la potencia y la intensidad máxima de la recarga; el sistema de control; la descripción de la instalación fotovoltaica, en su caso, y el presupuesto con la anualidad 2019 o 2020 en que se realizarán las inversiones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Programa 2&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La memoria técnica en la que se incluirá una descripción funcional del sistema actual con los puntos, una relación de los puntos de recarga que gestiona, y una descripción y valoración de las adaptaciones que sean necesarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.5. El solicitante no podrá fraccionar un contrato con la finalidad de disminuir su cuantía y eludir así los requisitos de publicidad o los relativos al procedimiento de adjudicación que correspondan. De acuerdo con el artículo 15 de la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 (BOIB nº 72, de 24 de mayo de 2008) que establece las bases reguladoras para la concesión de subvenciones en materia de energía en las Illes Balears, los beneficiarios deberán estar al corriente de sus obligaciones tributarias y de la Seguridad Social ante la Administración del Estado, y de sus obligaciones tributarias ante la Hacienda autonómica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.6. Cuando el solicitante aporte en la solicitud una dirección de correo electrónico, se entenderá que esta se facilita a efectos de notificaciones, y se podrán practicar, a través del correo que se haya indicado, las notificaciones a los efectos que determina el artículo 40 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.7. La presentación de la solicitud supone que la persona o entidad interesada acepta las prescripciones que contiene esta convocatoria, como también que autoriza al órgano instructor del procedimiento para que, en su caso, obtenga de forma directa los datos del Registro Mercantil y la acreditación de las obligaciones tributarias y con la Tesorería General de la Seguridad Social. En caso de que el solicitante deniegue expresamente la autorización a que hace referencia el párrafo anterior, aportará un certificado de la Agencia Estatal de la Administración Tributaria y de la Tesorería de la Seguridad Social que justifique que está al corriente de las obligaciones tributarias y ante la Seguridad Social y, en caso de empresas societarias, el certificado o la nota simple del Registro Mercantil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.8. En el supuesto de que alguno de los documentos mencionados ya se haya presentado con motivo de la tramitación de otros expedientes en la Consejería de Territorio, Energía y Movilidad, no será necesario aportarlo de nuevo, siempre que se haga constar la fecha y el órgano o dependencia en que se presentó o, en su caso, en que se emitió, que no hayan transcurrido más de cinco años desde la finalización del procedimiento correspondiente y que no haya sufrido modificaciones. Este plazo de cinco años no será de aplicación a los certificados de obligaciones tributarias y con la Seguridad Social, así como en los certificados o notas simples del Registro Mercantil establecidos en el punto anterior, cuya vigencia se regirá por su normativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;9.9. &lt;span style="color:black"&gt;En caso de que el expediente no contenga toda la documentación requerida, se enviará un escrito que requiera la presentación de la documentación que falta en el plazo de diez días. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;9.10. Cualquier cambio que se realice se deberá comunicar a la Consejería de Territorio, Energía y Movilidad, de acuerdo con el artículo 6.9 de la Orden de bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9.11. La Consejería de Territorio, Energía y Movilidad, en cualquier momento, podrá solicitar a los interesados la documentación y la información complementaria que considere necesarias para resolver el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;10. Plazo de presentación de solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El plazo para presentar las solicitudes se iniciará a partir del quinto día de la publicación de esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; y finalizará a los tres meses su publicación en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;11. Competencia y resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11.1 La Dirección General de Energía y Cambio Climático será el órgano competente para tramitar los expedientes y realizará de oficio todas las actuaciones que considere necesarias para determinar, conocer y comprobar los datos en virtud de los que se pronunciará la Comisión Evaluadora. Esta emitirá un informe que servirá de base para elaborar la propuesta de resolución. El director general Energía y Cambio Climático elevará al consejero de Territorio, Energía y Movilidad la propuesta de resolución, que se notificará a los interesados para que aleguen lo que consideren oportuno en el plazo máximo de diez días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11.2. La resolución expresa del consejero de Territorio, Energía y Movilidad finalizará el procedimiento de concesión de la subvención. Esta se motivará y fijará, con carácter definitivo, la cuantía individual de la subvención concedida. Asimismo, la resolución especificará los siguientes aspectos: beneficiario, descripción e importe de la actividad que se subvenciona; cuantía; partida presupuestaria a la que se aplica; forma de pago; plazo para llevar a cabo la actividad, justificación de las actividades objeto de ayuda y plazos para presentar justificantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11.3. El plazo máximo para resolver las solicitudes será de seis meses a partir del día de la presentación de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11.4. La resolución se notificará a los interesados, de acuerdo con los artículos 40 y 42 de la Ley 39/2015; y se dictará y notificará dentro del plazo de seis meses desde la fecha de finalización del plazo para presentar las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;12. Comisión Evaluadora&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Estará integrada por los siguientes miembros:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Presidenta: la secretaria general de la Consejería de Territorio, Energía y Movilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Vocales: el director general de Energía y Cambio Climático; el jefe del Servicio de Energías Renovables y Eficiencia Energética; un técnico de la Dirección General de Energía y Cambio Climático, que hará las funciones de secretario, y un representante del Servicio Jurídico de la Consejería de Territorio, Energía y Movilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;13. Procedimiento de selección y distribución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;13.1. La concesión de subvenciones se realizará por el procedimiento de concurso, mediante la comparación en un único procedimiento de las solicitudes presentadas, con el fin de establecer una prelación entre las mismas, de acuerdo con los criterios de valoración que se mencionan en el siguiente apartado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;13.2. La valoración del programa 1 se realizará para cada centro de recarga y se establecerá una lista de expedientes susceptibles de ser subvencionados, clasificados por orden decreciente, hasta agotar la dotación presupuestaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;13.3. Con el fin de asegurar una correcta distribución territorial, se asignarán para cada uno de los programas un máximo de cinco centros por municipio; excepto en Palma, en que serán quince. No obstante, una vez resueltas las solicitudes de acuerdo con el anterior criterio, en caso de que quede crédito disponible el resto de las solicitudes se asignarán de acuerdo con el orden de prelación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;13.4. La valoración del programa 2 se realizará para cada solicitud de cada empresa y se establecerá una lista de expedientes susceptibles de ser subvencionados, clasificados por orden decreciente, hasta agotar la dotación presupuestaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;13.5. En todos los casos, a igualdad de puntuación entre los solicitantes, el orden de entrada determinará la preferencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;13.6. En caso de que el expediente no tenga la documentación que requiere el punto 9 de esta Resolución, se enviará un escrito que requiera la presentación de la documentación que falta en el plazo de diez días. En este caso, la fecha de presentación de la subsanación será la que determine la preferencia en caso de igualdad de puntuación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;14.Criterios de preferencia y valoración&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los criterios de valoración para programas serán:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;14.1. Programa 1 &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Número de puntos de recarga en el mismo centro de recarga:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 12 puntos por cada punto de recarga de tipo A. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 4 puntos por cada punto de recarga de tipo B.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Situado en puntos estratégicos para la movilidad, con lugares con acceso directo desde la vía pública o aparcamientos públicos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 10 puntos si está situado en aeropuertos, puertos comerciales o paradas de taxis. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 5 puntos si está situado en otro lugar de acceso directo desde la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; Precio de la recarga (donde P es el precio en €/kWh IVA incluido):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 50·* (1-P) puntos para puntos de recarga de tipo A.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 40·* (1-P) puntos para puntos de recarga de tipo B.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En caso de que el centro disponga de puntos de recarga de tipo A y tipo B sólo se considerará la puntuación más alta. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d)&lt;/em&gt; Instalación fotovoltaica conectada a la red interior (autoconsumo) (máximo 20 puntos):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 1 punto por cada kW de potencia fotovoltaica instalada.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e)&lt;/em&gt; Compra certificada de origen renovable:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 5 puntos si el suministro del que se alimenta adquiere la energía con compra certificada de origen renovable.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;f)&lt;/em&gt; Horario de apertura al público al día:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 10 puntos si está abierto al público 24 horas 365 días.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;14.2. Programa 2&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; Número de puntos de recarga rápida (potencia igual o superior a 40 kW) gestionados en las Illes Balears:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 5 puntos para cada punto de recarga (máximo 20 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Número de puntos de recarga lentos y semirrápidos (potencia igual o superior a 7,2 kW e inferior a 40 kW) gestionados en las Illes Balears:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 0,5 puntos para cada punto de recarga (máximo 20 puntos).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; Disponibilidad de aplicación móvil (app) con la información de recarga:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Puntuación: 10 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;15.Cuantía de las ayudas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La cuantía de ayudas será la siguiente en función del tipo de beneficiario y del tipo de punto de recarga:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1) Programa 1: las ayudas para puntos de recarga de tipo A que se mencionan en el punto 5 de esta Resolución serán del 40% del coste de la inversión subvencionable con un máximo de subvención de 15.000&amp;nbsp;€ por punto de recarga; mientras que para los puntos de recarga de tipo B serán del 40&amp;nbsp;% del coste de la inversión subvencionable con un máximo de subvención de 1.500&amp;nbsp;€ para punto de pared; 2.000&amp;nbsp;€ para punto tipo pilón de una carga simultánea, y 3.000&amp;nbsp;€, para punto de dos cargas simultáneas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;De forma complementaria a las ayudas descritas en el párrafo anterior, en los puntos de recarga incluidos en el programa 1 serán subvencionables los costes de mantenimiento asociados al término de potencia contratada durante los cinco años que establece la convocatoria que se mantendrán las condiciones indicadas a la solicitud de ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Teniendo en cuenta, que de acuerdo con las vigentes tarifas eléctricas, el coste del término de potencia contratada es de unos 100 €/kW y año, se aplicarán los siguientes módulos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— 200&amp;nbsp;€/kW en los puntos de recarga de tipo A (equivalente a un 40&amp;nbsp;% del término de potencia durante cinco años). Esta potencia será la potencia contratada del suministro que da servicio a la instalación de recarga (en el período de menor potencia contratada) y tendrá como límite la suma de las potencias reales que pueden dar de forma simultánea todos los puntos de recarga de la instalación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— 100&amp;nbsp;€/kW en los puntos de recarga de tipo B (equivalente a un 40&amp;nbsp;% del término de potencia durante cinco años). Esta potencia será la potencia contratada del suministro que da servicio a la instalación de recarga (en el período de menor potencia contratada) y tendrá como límite la suma de las potencias reales que pueden dar de forma simultánea todos los puntos de recarga de la instalación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2) Programa 2: el 40&amp;nbsp;% del coste de adaptación del sistema de gestión a la Red MELIB con un máximo de 20.000&amp;nbsp;€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3) El importe de las subvenciones que establece esta Resolución no podrá ser, en ningún caso, de tal cuantía que, de forma aislada o en concurrencia con otras subvenciones o ayudas, supere el coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4) La cantidad máxima por beneficiario en caso de que se agote el presupuesto del programa correspondiente será la siguiente: en el programa 1, 300.000&amp;nbsp;€; y en el programa 2, 20.000&amp;nbsp;€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;16. Pago y justificación de actividades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;16.1. El pago de la subvención aprobada únicamente se podrá hacer efectivo una vez que se haya dictado la correspondiente resolución y que se haya justificado suficientemente la realización de la actividad, con la presentación de la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; La solicitud de pago acompañada de la cuenta justificativa, en la forma que permita constatar la realización de la actividad subvencionada y su coste, dentro de los plazos que fije la resolución de concesión. El modelo se pondrá a disposición de los beneficiarios en la página web de la Dirección General de Energía y Cambio Climático.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Las facturas originales o los documentos de valor probatorio equivalente en el tráfico jurídico mercantil o con eficacia administrativa que justifiquen los gastos. Estas facturas serán convenientemente selladas por la Consejería y después devueltas al beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; El Justificante de pago. Los justificantes se acreditarán de alguna de las siguientes maneras:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1r. Con la fotocopia del justificante de la orden de transferencia bancaria o documento bancario acreditativo del pago en el que figurará la fecha de la transferencia, el importe que se transferirá, la identificación del concepto de transferencia a fin de que quede identificado el pago de la factura, así como los datos del ordenante y del destinatario, que coincidirán con el beneficiario y con el emisor de la factura, respectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2n. Con la copia del cheque nominativo o pagaré nominativo, siempre que esté vencido, acompañado del extracto bancario correspondiente del beneficiario de la ayuda en que aparezca el cargo de este cheque o pagaré.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A pesar de ello, para los pagos inferiores a 500&amp;nbsp;€ es justificante suficiente el recibo de pago firmado por el proveedor. No se admitirán facturas justificativas inferiores a 100&amp;nbsp;€ (IVA incluido).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3r. No se admitirá la compensación de pagos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d)&lt;/em&gt; El documento fotográfico de los elementos principales de la instalación (aparcamiento para la recarga, equipo de recarga, cuadro eléctrico, cartel indicativo de la potencia de carga, el precio por kWh y el horario en que se puede utilizar, sólo en caso de que esta no sea gratuita, etc.). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e)&lt;/em&gt; El certificado que acredite que el IVA de la operación cofinanciada es no recuperable, en su caso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;f)&lt;/em&gt; La factura eléctrica o el contrato de suministro de la instalación que acredite que dispone de potencia suficiente para el centro de recarga, y el certificado del instalador que acredite, de forma razonada, la potencia real de funcionamiento simultáneo de los puntos de recarga instalados en cada centro, teniendo en cuenta las características de los equipos instalados, las protecciones eléctricas y el cableado existente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;g)&lt;/em&gt; La copia del documento de la inscripción de la instalación en la UDIT.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;h)&lt;/em&gt; En caso de que el solicitante sea Administración pública:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— El certificado del secretario o del órgano competente de que las actuaciones objeto de la ayuda se han llevado a cabo de acuerdo con la legislación de contratación de la Administración pública y del sector público. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— La copia de la contabilidad separada de las inversiones subvencionadas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;16.2. En caso de que el expediente de pago no tenga la documentación necesaria para comprobar la justificación y la aplicación de la subvención, el órgano competente solicitará al beneficiario que subsane los defectos de la justificación dentro de los diez días siguientes, desde el día siguiente de haber recibido el requerimiento de subsanación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;16.3. La resolución de otorgamiento de la subvención fijará el plazo concreto para justificar la realización de las actividades subvencionadas, que en ningún caso podrá ser posterior al 30 de setiembre de 2019 para la anualidad 2019 y al 30 de septiembre de 2020 para la anualidad 2020. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;16.4. En el supuesto de que no se haya justificado totalmente la realización de la actividad subvencionada, pero se haya cumplido, aunque parcialmente, la finalidad para la que se concedió la subvención, esta se minorará proporcionalmente en lo que no se haya justificado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;16.5. Toda alteración de las condiciones que se hayan tenido en cuenta para conceder la subvención y, en todo caso, la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones o entes públicos o privados, nacionales o internacionales, podrá dar lugar a la modificación de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;16.6. La falta de justificación en los términos y los plazos que establezca la resolución de otorgamiento de la subvención, la modificación del proyecto presentado sin que esta Consejería la haya aprobado previamente, así como la desviación de las subvenciones o la aplicación diferente a las que establece la norma, determinarán la revocación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;17.Obligaciones de los beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;De acuerdo con el artículo 15 de la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 y el artículo 11 del Texto refundido de la Ley de Subvenciones, los beneficiarios estarán obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;17.1. Obligaciones generales&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a)&lt;/em&gt; No superar el precio máximo de la recarga indicado en la solicitud en un plazo mínimo de cinco años a partir del plazo máximo de justificación. También se mantendrán en un plazo mínimo de cinco años a partir del plazo máximo de justificación las otras condiciones presentadas para la valoración de las solicitudes; no obstante, se podrán mejorar estas condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b)&lt;/em&gt; Justificar la correcta realización de la actividad en el plazo fijado por la resolución que otorgue la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c)&lt;/em&gt; Informar a la Dirección General de Energía y Cambio Climático sobre cualquier alteración de las condiciones que se hayan tenido en cuenta para conceder la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d)&lt;/em&gt; Dar cumplimiento a la normativa comunitaria, nacional y autonómica aplicable en el ámbito de contratación, subvenciones, contabilidad, publicidad, medio ambiente e igualdad de oportunidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e)&lt;/em&gt; Reintegrar los fondos percibidos indebidamente como consecuencia de las actuaciones de comprobación realizadas por los órganos de control competentes, y según lo establecido en el artículo 44 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;f)&lt;/em&gt; Encontrarse al corriente de sus obligaciones tributarias con el Estado, la Seguridad Social y la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;17.2. Obligaciones específicas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a) &lt;/em&gt;Cumplir las condiciones establecidas para la adhesión a la Red MELIB, en su caso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b) &lt;/em&gt;Participar y colaborar con la Dirección General de Energía y Cambio Climático en el buen funcionamiento de la Red MELIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;c) &lt;/em&gt;Proporcionar la información necesaria para el funcionamiento del sistema de gestión (horarios, precios, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;d) &lt;/em&gt;Actualizar e incorporar las actualizaciones requeridas por el sistema de gestión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;e) &lt;/em&gt;Realizar el mantenimiento de los centros de recarga y corregir las incidencias de los puntos de recarga en un plazo máximo de 48 horas, excepto causas justificadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;f) &lt;/em&gt;Disponer de un servicio de incidencias en aquellas horas en que el punto esté disponible.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;g) &lt;/em&gt;Los equipos de los puntos de recarga incorporarán logotipos de imagen &lt;em&gt;de Illes Sostenibles&lt;/em&gt; de acuerdo con el manual de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;18. Normativa de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;18.1. La convocatoria se regirá por lo que disponen esta Resolución y la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 (BOIB nº 72, de 24 de mayo de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;18.2. En todo aquello que no establecen ni esta Resolución ni la Orden mencionada se aplicará el Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;19.Tramitació telemática&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;La solicitud de subvención se realizará de forma telemática a través del enlace que habilitará la Dirección General de Energía y Cambio Climático en la página web &amp;lt;http://energia.caib.es&amp;gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;20. Publicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esta Resolución se publicará en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
