&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;En el procedimiento de referencia se ha dictado la resolución del tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;SENTENCIA&amp;nbsp;&amp;nbsp; Nº &amp;nbsp;&amp;nbsp;418/18&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;En Ibiza, a 20 de noviembre de 2.018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;D. ALFONSO MANUEL FERNÁNDEZ GARCÍA, Magistrado-Juez Titular del Juzgado de Primera Instancia nº 2 de Ibiza, habiendo visto los autos seguidos en este Juzgado al Juicio Ordinario número 89/2017, a instancia de D. ANTONIO RIBAS BONED, como parte demandante, representada por el procurador D. HUGO VALPARÍS SÁNCHEZ y asistida por el letrado D. JOSEP CAMPANYÁ FIGUERES, contra D. ARNOLD ANDRÉ HOFMANNER y Doña VALERIE RIVIERE, como partes codemandadas, declaradas en situación de rebeldía procesal, procede &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;EN NOMBRE DE S.M. EL REY &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;a dictar la presente resolución&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PARTE&lt;/strong&gt; &lt;strong&gt;DISPOSITIVA&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Que estimando íntegramente las pretensiones deducidas a instancia de D. ANTONIO RIBAS BONED, como parte demandante, contra Doña VALERIE RIVIERE, como parte demandada, declarada en situación de rebeldía procesal, debo condenar y condeno a esta a que eleve a escritura pública el contrato privado de compraventa de fecha 5 de agosto de 2.005 celebrado con la parte demandante correspondiente al inmueble inscrito en el Registro de la Propiedad nº 2 de Ibiza con el nº de finca registral 10.755, bajo apercibimiento de que en su defecto se llevará a cabo judicialmente y en ejecución de sentencia, con imposición de las costas a la parte demandada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Que desestimando íntegramente las pretensiones deducidas a instancia de D. ANTONIO RIBAS BONED, como parte demandante, contra D. ARNOLD ANDRÉ HOFMANNER, como parte demandada, declarada en situación de rebeldía procesal, debo absolver y absuelvo a este de las pretensiones deducidas en su contra, con imposición de las costas a la parte demandante. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Notifíquese la presente resolución a las partes, haciéndoles saber que contra la misma podrá interponerse en este Juzgado recurso de apelación dentro del término de VEINTE días, a partir de su notificación, y cuyo conocimiento le corresponderá a la Audiencia Provincial, de conformidad con lo dispuesto en el art. 458 y siguientes de la LEC.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Así por esta mi sentencia, la pronuncio, mando y firmo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Y como consecuencia del ignorado paradero de VALERIE RIVIERE Y ARNOLD ANDRE HOFMÄNNER, se extiende la presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;En EIVISSA, a veintiocho de noviembre de dos mil dieciocho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
