	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El Decreto 66/2016, de 18 de noviembre, por el cual se aprueba la Cartera básica de servicios sociales de las Islas Baleares 2017-2020 y se establecen principios generales para las carteras insulares y locales, incluye entre estos servicios, en el punto 2.6.1, el servicio de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapacidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En fecha 9 de octubre de 2018, el director general de Dependencia emitió un informe justificativo relativo a la necesidad y la urgencia de convocar el concierto del servicio de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapacidad, en la isla de Mallorca, para los años 2018-2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En fecha 9 de octubre de 2018, la consejera de Servicios Sociales y Cooperación resolvió iniciar el expediente de concierto del servicio de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapacidad, en la isla de Mallorca, para los años 2018 y 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El Decreto 86/2010, de 25 de junio, por el cual se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El Decreto 24/2015, de 7 de agosto, de la presidenta de las Islas Baleares, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Por todo eso, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Convocar el concierto y establecer el procedimiento de la convocatoria para&lt;span style="color:#000000"&gt; &lt;/span&gt;el servicio de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapacidad, en la isla de Mallorca, para los años 2018-2019, de acuerdo con el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Acreditar la necesidad urgente del concierto social de unidades del servicio de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapacidad, de acuerdo con el informe justificativo del director general de Dependencia de 9 de octubre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Aprobar el Pliego general de condiciones técnicas para la concertación del servicio de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapaci&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;dad&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;el cual&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; se puede consultar &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;en&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; la página web de la Dirección General de Dependencia&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:#ffffff"&gt; (http://serveissocialsicooperacio.caib.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:#ffffff"&gt;Contra esta Resolución –que agota la vía administrativa– se puede interponer un recurso potestativo de reposición ante la consejera de Servicios Sociales y Cooperación en el plazo de un mes contador desde el día siguiente de haber recibido la notificación de la Resolución, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:#ffffff"&gt;También se puede interponer un recurso contencioso administrativo ante la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contadores desde el día siguiente de haber recibido la notificación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Objeto y ámbito de aplicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Se establece la regulación del procedimiento de convocatoria del concierto del servicio de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapacidad, para los años 2018-2019, y se dicta al amparo del Decreto 48/2017, de 27 de octubre, por el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;1.2. Se sujetan a este procedimiento los conciertos de plazas del servicio de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapacidad, en el ámbito territorial de la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;2. Órgano instructor&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El órgano instructor del procedimiento es la Dirección General de Dependencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;3.1. El plazo para presentar las solicitudes es de siete días hábiles contadores desde el día siguiente que se haya publicado esta convocatoria en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;3.2. Las solicitudes, debidamente cumplimentadas, se tienen que presentar en la sede del Servicio de Atención a la Discapacidad, ubicado en la calle de Joan Crespí, 11, de Palma, o en cualquiera de los lugares que establecen el artículo 37.1 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y el artículo 16.4 de la Ley 39/2015, de 1 de octubre de 2015, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Si la solicitud se envía por correo, la documentación correspondiente se tiene que presentar en un sobre abierto, de manera que el ejemplar destinado al Servicio de Atención a la Discapacidad de la Consejería de Servicios Sociales y Cooperación se feche y se selle antes de certificarse, de acuerdo con el artículo 31 del Real decreto 1829/1999, de 3 de diciembre, por el cual se aprueba el Reglamento que regula la prestación de los servicios postales (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;B&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;oletín&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; Oficial de&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;l Estado &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;nº 313, de 31 de diciembre). En caso de que la oficina de Correos no feche y selle la solicitud, se entiende como fecha válida de presentación la de entrada en el Registro General de la&lt;span style="color:#00b0f0"&gt; &lt;/span&gt;Consejería de Servicios Sociales y Cooperación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Si la solicitud se presenta en un lugar diferente de la sede del Servicio de Atención a la Discapacidad, se tiene que enviar la hoja de la solicitud, con el sello de registro de entrada, al servicio de Atención a la Discapacidad, por correo electrónico&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:#ffffff"&gt; (concerts@dgad.caib.es), &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;en el plazo máximo de las 24 horas siguientes al fin del plazo hábil de presentación. De la misma manera, si se envía por correo certificado, se tiene que enviar por correo electrónico la hoja de la solicitud, fechada y sellada por la oficina de Corre&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;os, en la que conste que se ha enviado dentro del plazo hábil de presentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;4. Requisitos de las entidades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;4.1. Los requisitos que tienen que cumplir las entidades que se presenten a la convocatoria de este concierto social son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol style="list-style-type:lower-alpha"&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Tener el servicio autorizado de conformidad con el Decreto 86/2010, de 25 de junio, por el cual se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población, y la normativa complementaria insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Haber solicitado la acreditación del servicio a la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Tener una experiencia mínima de un año en materia de servicios de vivienda supervisada para personas con diagnóstico de salud mental, necesidad de apoyo extenso y discapacidad, en el ámbito de los servicios sociales de las Islas Baleares. La experiencia sólo se puede acreditar con los documentos que establece el punto 5.3, apartado &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;,&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;4.2. Asimismo, las entidades tienen que cumplir los requisitos mínimos que se establecen en despliegue del título VII de la Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares, así como los requisitos que fija el artículo 4 del Decreto 48/2017, de 27 de octubre, por el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales, excepto con respecto a la acreditación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;5. Documentación que se tiene que presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;5.1. Las entidades interesadas que cumplan los requisitos que establece el punto 4 de esta convocatoria tienen que formular una solicitud, que tiene que firmar la persona representante legal de la entidad. Este modelo de solicitud se encuentra disponible en la web&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#ff0000"&gt; &lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:#ffffff"&gt;http://serveissocialsicooperacio.caib.es.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;5.2. Las entidades tienen que presentar una solicitud para&lt;span style="color:#000000"&gt; &lt;/span&gt;el servicio de vivienda supervisada que gestionen y tienen que indicar el número de plazas que ofrezcan para concertar con la Administración, según el nivel de intensidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;5.3. En la solicitud se tiene que adjuntar la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol style="list-style-type:lower-alpha"&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Certificado de autorización o acreditación del servicio a concertar. En caso de que no esté acreditado, hay que haber solicitado la acreditación de los servicios a la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Declaración responsable de que la entidad no está sometida a las prohibiciones de contratar con la Administración, de acuerdo con el artículo 71 de la Ley 9/2017,de 8 de noviembre, de contratos del sector público, ni a ninguno de los supuestos de prohibición para ser beneficiaria de subvenciones, establecidos en los apartados 1 y 2 del artículo 10 del Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Declaración responsable de no incurrir en ninguna de las prohibiciones que establece el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, y de no haber sido sancionada por resolución firme en los últimos cuatro años por la comisión de infracciones graves o muy graves en materia de relaciones laborales, empleo, empresas usuarias de empresas de trabajo temporal, seguridad social, emigración, movimientos migratorios y trabajo de extranjeros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Acreditación de solvencia financiera, según el documento disponible en la web&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:#ffffff"&gt; &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;http://serveissocialsicooperacio.caib.es.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;

	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Certificado de estar al corriente en las obligaciones tributarias y de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Acreditación de la titularidad de las viviendas o de la disponibilidad por cualquier título jurídico válido por un periodo no inferior a un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Declaración del número total de plazas autorizadas, firmada por la dirección del servicio, diferenciando entre disponibles y no disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;5.4. La presentación de la solicitud supone que la entidad autoriza a los técnicos de la Dirección General de Dependencia para que puedan pedir a otras administraciones cualquier documentación, los datos y los informes que consideren necesarios para tramitar el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;6&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Tramitación de los conciertos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;6.1. Los servicios técnicos de la Dirección General de Dependencia tienen que examinar las solicitudes y la documentación adjunta para determinar si cumplen los requisitos establecidos en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;6.2. En caso de que las solicitudes no cumplan los requisitos legales o los que exige esta convocatoria o no incorporen la documentación mencionada en el apartado anterior, se requerirá a la entidad interesada para que, en el plazo de diez días hábiles, enmiende el defecto o aporte la documentación que falta, con indicación que, si no lo hace, se considerará que desiste de su petición, con la resolución previa que se tiene que dictar en los términos que dispone el artículo 21 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;6.3. Se tiene que resolver el procedimiento de concierto de acuerdo con los criterios siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol style="list-style-type:lower-alpha"&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Si el cómputo total de plazas que ofrecen las entidades no supera el número total máximo de plazas previstas en el servicio y, por lo tanto, hay disponibilidad presupuestaria suficiente para atender toda la oferta, las plazas se adjudicarán directamente a las entidades solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Si el cómputo total de plazas que ofrecen las entidades supera la disponibilidad presupuestaria, se actuará según el procedimiento previsto en el Decreto 48/2017, en el artículo 14.3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En caso de que se produzca una renuncia por parte de alguna entidad, las plazas que haya ofrecido se distribuirán de la misma manera entre el resto de entidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;7. Formalización de los conciertos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;7.1. Los conciertos que se establecen al amparo de esta convocatoria se tienen que formalizar mediante un documento administrativo en el cual se hagan constar los derechos y las obligaciones recíprocos, así como las características concretas del servicio y otras circunstancias derivadas de la Ley 4/2009, de los decretos de despliegue y aplicación de esta Ley, y del Pliego general de condiciones técnicas del concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;7.2. En el momento de formalizar el concierto, se tiene que presentar una declaración responsable de que se siguen cumpliendo los requisitos exigidos para poder concertar el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;8. Plazas del servicio y distribución territorial&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;La previsión del número total máximo de plazas para concertar es de 10 en el ámbito territorial de la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9. Vigencia del concierto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El régimen del concierto se iniciará el 1 de diciembre de 2018, o en la fecha que se firme, y finalizará doce meses después.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;10. Presupuesto y precio máximo del servicio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;10.1. El importe máximo estimado para asignar es de &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;247.032,00 €&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt; (exento de IVA), a cargo de&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; la anualidad de 201&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;9. En todo caso, este valor estimado tiene carácter orientativo y no vinculante. El gasto real quedará limitado por el número total de unidades que ofrezca la entidad y por los servicios que requiera efectivamente la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;10.2. Este importe se indica únicamente a efectos de publicidad y no supone ningún compromiso de gasto. Por eso, no consta una consignación presupuestaria, que se tendrá que acreditar en el momento en que se materialice el servicio de concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;10.3. El precio de referencia máximo por plaza de la prestación del servicio de vivienda supervisada para personas con diagnóstico de salud mental, de acuerdo con el informe de la jefa del Servicio de Atención a la Discapacidad &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;sobre el módulo de servicio de 9 de octubre de 2018, es de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;67,68&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt; €/&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;plaza/&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;día&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;11. Condiciones técnicas de ejecución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;11.1. Las condiciones técnicas de ejecución se tienen que ajustar al Decreto 86/2010, de 25 de junio, por el cual se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población, en el Decreto 66/2016, de 18 de noviembre, por el cual se aprueba la Cartera básica de servicios sociales de las Islas Baleares 2017-2020 y se establecen principios generales para las carteras insulares y locales, y a la normativa insular complementaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;11.2. El Pliego general de condiciones técnicas detalla el objeto, los derechos y las obligaciones de ambas partes, los servicios que se tienen que prestar, los criterios de intervención con los usuarios, los medios que tiene que aportar la entidad concertada y el sistema de coordinación con la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;11.3. Las aplicaciones informáticas del Servicio de Atención a la Discapacidad son las únicas válidas para gestionar las unidades de servicio y para cualquier uso aplicable que se derive de la ejecución de este concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;12. Seguimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;12.1. Los técnicos del servicio de vivienda supervisada para personas con diagnóstico de salud mental son los responsables del seguimiento de los casos atendidos y se tienen que coordinar con el Servicio de Atención a la Discapacidad y los servicios sociales comunitarios básicos, de salud, educativos o de otros que se requieran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;12.2. Los técnicos del Servicio de Atención a la Discapacidad pueden hacer visitas de comprobación del funcionamiento del servicio y requerir documentación cuando lo consideren necesario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;12.3. La entidad concertada tiene que facilitar las actuaciones de seguimiento y comprobación que lleve a cabo la Dirección General de Dependencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;12.4. Asimismo, la entidad concertada tiene que facilitar toda la información que le requiera el órgano instructor, la Intervención General de la Comunidad Autónoma de las Islas Baleares, la Sindicatura de Cuentas u otros órganos de control externo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;13. Obligaciones de las entidades concertadas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Mediante el concierto social, las entidades que presten el servicio se obligan a cumplir el Pliego general de condiciones técnicas que establece las obligaciones de las entidades concertadas, y las normas establecidas en el título VII de la Ley 4/2009 y en los decretos de despliegue y de aplicación correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;14. Penalidades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El incumplimiento de las condiciones previstas para la prestación del servicio puede dar lugar a la imposición de penalizaciones, de acuerdo con el Pliego general de condiciones técnicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;15. Criterios de acceso de los usuarios y lista de espera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;15.1. El criterio de acceso de los usuarios y la lista de espera del servicio de vivienda supervisada se rige de acuerdo con los capítulos II y III del Decreto 7/2016, de 12 de febrero, por el cual se regulan el acceso al servicio ocupacional para personas con discapacidad por trastorno mental grave y la gestión de la lista de espera de las plazas de este servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;15.2. Una vez que los profesionales del Servicio de Atención a la Discapacidad las hayan valorado, las personas que hayan solicitado el acceso al servicio de vivienda supervisada serán derivadas a la entidad prestadora del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;16. Publicidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;16.1. Las entidades de iniciativa privada acogidas al concierto social, junto con su denominación, tienen que hacer constar en la documentación, en todas las comunicaciones (informes, hojas, documentos, trípticos de difusión, mensajes electrónicos, webs, inserciones en prensa, artículos en diarios y en revistas especializadas) y en la publicidad la condición de entidad perteneciente a la red pública de promoción de la autonomía personal, según las indicaciones del &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Manual de identidad corporativa&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt; que les facilitará la Administración, siempre con el visto bueno de la Consejería de Servicios Sociales y Cooperación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;16.2. Las entidades de iniciativa privada acogidas al régimen de concierto social tienen que colocar en un lugar visible de sus instalaciones la indicación «Servicio de vivienda supervisada concertada con el Gobierno de las Islas Baleares» con el logotipo correspondiente, que les proporcionará la Consejería de Servicios Sociales y Cooperación. Asimismo, se tiene que hacer referencia a esta circunstancia en las comunicaciones y en las relaciones que establezcan por escrito con las personas usuarias del servicio concertado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;17. Prerrogativas de la Administración&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;17.1. El órgano instructor del procedimiento de concertación tiene la prerrogativa de interpretarlo y resolver las dudas que surjan durante el cumplimiento. Por otra parte, el órgano competente para resolver el procedimiento tiene, además, la prerrogativa de modificarlo por razones de interés público, acordar la resolución y determinar los efectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;17.2. Los acuerdos que adopte el órgano competente para resolver el procedimiento a partir de las prerrogativas mencionadas ponen fin a la vía administrativa y son inmediatamente ejecutivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;18. Causas de extinción&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Son causas de extinción del concierto social las que establece el artículo 28 del Decreto 48/2017, de 27 de octubre, por el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;19. Jurisdicción competente&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;La jurisdicción contencioso-administrativa es la competente para resolver las cuestiones litigiosas relativas a la formalización de este concierto y también las surgidas entre las partes sobre la interpretación, la modificación, el cumplimiento, los efectos y la extinción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
