&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;HECHOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;ÚNICO.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; El Procurador de los Tribunales, Don Juan Balaguer Bisellach, en nombre y representación de Doña JUANA MUNAR SOCIAS, presentó escrito solicitando la adopción de medidas cautelares contra Don PEDRO DE JESÚS DA LUZ. Conferido traslado a la parte demandada, se citó a las partes para el acto de la vista, que tuvo lugar el 23 de julio de 2018, a la que únicamente compareció la parte actora. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;(…)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;PARTE DISPOSITIVA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Declaro: &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;Estimar la petición de medida cautelar instada por El Procurador de los Tribunales, Don Juan Balaguer Bisellach, en nombre y representación de Doña JUANA MUNAR SOCIAS frente a Don PEDRO DE JESÚS DA LUZ y, por tanto, SE ACUERDA la adopción de la siguiente medida cautelar: &lt;strong&gt;embargo preventivo del sobrante de la subasta&lt;/strong&gt; del Juzgado de Primera Instancia nº 3 de Inca, Modificación de Medidas Supuesto Contencioso nº 315/2015, actualmente EFM 163/2017 por la cantidad de DOCE MIL NOVENTA Y SEIS CON SESENTA Y SIETE EUROS (12.096,67 EUROS). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Subsidiariamente,&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; para el caso en que la subasta quede desierta o que la misma se suspenda, se acuerdo L&lt;strong&gt;A ANOTACIÓN PREVENTIVA del embargo sobre la mitad indivisa &lt;/strong&gt;de la finca cuyo titular es el demandado PEDRO DE JESÚS DA LUZ (X0158887A) FINCA 2614, TOMO 3673, LIBRO 56, FOLIO 213, inscrita en el Registro de la Propiedad de Inca nº 2. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Expídase exhorto a dicho Juzgado a fin de que se proceda al embargo preventivo del sobrante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Se hace necesaria la prestación, por la parte actora, de una &lt;strong&gt;caución en la suma de cien euros (100 euros)&lt;/strong&gt;, para dar efectividad a la medida cautelar acordada. Importe que deberá ser ingresado en la Cuenta de Depósitos y Consignaciones de este Juzgado, número 0425-0000-04-062916 de la entidad bancaria BANCO SANTANDER, debiendo aportar a las presentes actuaciones justificante de pago, una vez realizado dicho ingreso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Se imponen las costas a la parte demandada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Notifíquese la presente resolución a las partes, haciéndoles saber que frente a la misma cabe recurso de apelación (Art. 735 LEC).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Así lo acuerdo, mando y firmo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Y como consecuencia del ignorado paradero de PEDRO DE JESUS DA LUZ, se extiende la presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;En INCA, a veinticuatro de septiembre de dos mil dieciocho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
