    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;&lt;strong&gt;Primero.&lt;/strong&gt;- Transcurrido el plazo de exposición pública del Acuerdo Plenario adoptado por el Pleno municipal en sesión ordinaria de fecha 5 de septiembre de 2018, de aprobación provisional de modificación de la ordenanza reguladora del precio público del servicio de teleasistencia y atención domiciliaria, con el fin de incluir el cobro del servicio de comida a domicilio; y no habiéndose presentado alegaciones, se eleva a definitivo el mencionado acuerdo conforme a lo que dispone el artículo 49 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, y el artículo 56 del Real decreto Legislativo 781/1986, de 18 de abril, por el cual se aprueba el Texto Refundido de las disposiciones legales vigentes en materia de Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt;- El texto refundido completo de la ordenanza se inserta a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;&lt;strong&gt;TEXTO REFUNDIDO DE LA ORDENANZA REGULADORA DE PRECIOS PÚBLICOS PARA LAS PRESTACIONES SOCIALES: SERVICIO De ASISTENCIA DOMICILIARIA (SAD) Y TELEASISTENCIA&lt;/strong&gt;&lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;La creciente demanda de prestaciones sociales que se ha traducido en una diversidad de casos para atender, procedentes de diferentes condiciones económicas, pero con derecho a ser atendidas, y de conformidad con el principio de universalización de los servicios hace necesario proceder a la regulación económica de las prestaciones a través de la aplicación de una ordenanza municipal, en la cual se regularicen y formalicen las características de prestación de los servicios, sus costes y las aportaciones de sus usuarios, previendo las reducciones que se tengan que aplicar por razón de las condiciones sociales, económicas, etc. de los solicitantes o/y usuarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;FUNDAMENTO Y NATURALEZA&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="color:#333333; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;ARTÍCULO 1&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, y de conformidad con lo que disponen los artículos 15 a 19 del Texto refundido de la Ley Reguladora de las Haciendas Locales, aprobado por RDL 2/2004, de 5 de marzo, este Ayuntamiento establece el precio público por el servicio de asistencia domiciliaria (SAD) y teleasistencia, que se regirá por esta ordenanza fiscal, las normas de la cual atienden a lo que disponen el artículo 41 y siguientes del mencionado Texto refundido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;HECHO IMPONIBLE&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="color:#333333; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;ARTÍCULO 2&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;Constituyen el hecho imponible de este precio público las prestaciones sociales de asistencia domiciliaria y de teleasistencia del Ayuntamiento de Mancor de la Vall, así como el servicio de comida a domicilio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;SUJETE PASIVO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;ARTÍCULO 3&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;Están obligados al pago del precio público, regulado en esta Ordenanza,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;a) Las personas que se beneficien de los servicios sociales prestados por este Ayuntamiento (asistencia domiciliaria, teleasistencia y servicio de comida a domicilio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;b) En sustitución de éstas, los familiares que tengan la obligación legal o pactada de atender a las personas usuarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;En el supuesto de quedar pendiente de abonar alguna cantidad del presente servicio, al morir la persona beneficiaria, la susodicha cantidad tendrá el concepto de deuda del causante a la liquidación de herencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;CUOTA TRIBUTARIA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;ARTÍCULO 4&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;La cuota tributaria del precio público regulada en esta ordenanza será la fijada en la tarifa contenida en el apartado siguiente para cada uno de los distintos servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;Tipo de Servicio:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="color:#333333; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;A) Servicio de ayuda a domicilio&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;1. Por 30 minutos............................ 4,5 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;Por mes 10 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="color:#333333; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;C) Las personas usuarias del servicio de comida a domicilio tendrán que cubrir el coste íntegro del servicio.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;OBLIGACIÓN DE PAGO. DEVENGO Y NORMAS DE GESTIÓN&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;ARTÍCULO 5&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;1.- La obligación de pago del precio público regulado en esta ordenanza, nace desde que se presta o se realiza el servicio, cualesquiera de los servicios o actividades especificadas en el artículo anterior.&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;2.- El precio público se meritará en el momento en que se inicie la prestación del servicio.&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;El pago del precio público se realizará durante los cinco primeros días del mes siguiente de utilizar el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;El pago de las cuotas correspondientes, cuando se trate de servicios eventuales, se realizará en el momento de solicitar el servicio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="color:#333333; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;EXENCIONES Y BONIFICACIONES&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;ARTÍCULO 6&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;A instancia de parte, y en todo caso previo informe favorable de los servicios sociales municipales, el Ayuntamiento de Mancor de la Vall por acuerdo del Pleno, podrá otorgar la exención total o parcial de las cuotas meritadas, cuando las circunstancias socieconòmiques del/la solicitante manifiesten una situación de subsistencia que aconsejen la concesión de las mencionadas bonificaciones o exenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;El Ayuntamiento podrá pedir cualquier tipo de prueba que acredite la situació socio - económico del/la solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;INFRACCIONES Y SANCIONES&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;ARTÍCULO 7&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;En todo aquello relativo a la calificación de infracciones tributarias y de las sanciones que les corresponda en cada caso, se atenderá a lo que dispone el artículo 178 y siguientes de la Ley General Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;DISPOSICIÓN DEROGATORIA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;Esta Ordenanza deroga cualquier ordenanza anterior aprobada por el Ayuntamiento de Mancor de la Vall y referida al precio público de Servicio de Asistencia a domicilio o Teleasistencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;&lt;strong&gt;ISPOSICIÓN FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;La presente Ordenanza Fiscal fue aprobada originariamente por el Pleno del Ayuntamiento en sesión de día 5 de mayo de 2010 y entrará en vigor a partir del día siguiente a su publicación.&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#333333"&gt;&amp;nbsp; &amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
