    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Mediante acuerdo de la Junta de Gobierno Local de fecha 14 de septiembre de 2018, se aprobó el Convenio de Colaboración entre el Ajuntament de Sant Joan de Labritja y la Empresa Privada PROVIASOL PLUS SL para la realización conjunta de obras de BT subterránea en la C/ Aigua Blanca de Portinatx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;3.5.- ACUERDO QUE PROCEDA EN EL EXPEDIENTE 1104/2018 SOBRE APROBACIÓN DE CONVENIO ENTRE EL AYUNTAMIENTO Y LA MERCANTIL PROVIASOL PLUS SL SOBRE REALIZACIÓN CONJUNTA DE LAS OBRAS DE BT SUBTERRÁNEAS DE LA CALLE AIGUA BLANCA EN PORTINATX.-&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El Secretario formula la siguiente propuesta de acuerdo a la Junta de Gobierno Local:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Visto el borrador de convenio, expediente 1104/2018, entre el Ayuntamiento de Sant Joan de Labritja y la mercantil Proviasol Plus SL para la realización conjunta de las obras de BT subterránea en la Calle Aigua Blanca de Portinatx.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En el año 2004 el Ayuntamiento realizó una dotación de infraestructuras que incluía una canalización destinada a la soterración de líneas aéreas de baja tensión. La obra estaba contemplada en el proyecto de Dotación de Infraestructuras de Calle S’Aigua Blanca (licencia municipal de obra 12/2004 y expediente de Endesa EI 04003.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El promotor ha presentado en el 2016 (NRFE 3940 de 29.09.2016, proyecto de realización de Red de Baja Tensión en la Calle Aigua Blanca de Portinatx. Dicho proyecto ha previsto una canalización paralela a la ya ejecutada por el Ayuntamiento. La nueva canalización prevista por el promotor implica la rotura del pavimento de la calle de hormigón impreso de difícil reparación, además de existir afectación a otros servicios que existen endicha calle (agua, teléfono, línea de MT).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Visto lo anterior y con el fin de coordinar infraestructuras y minimizar la rotura del pavimento de la calle (hormigón impreso), el proyecto presentado por el promotor debería modificarse y aprovechar la canalización ejecutada en su día por el Ayuntamiento. Para ello es necesario establecer Convenio entre el promotor y el Ayuntamiento.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-----------------&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Visto el Convenio entre el Ayuntamiento de Sant Joan de Labritja y el promotor de las obras Proviasol Plus, SL, para la realización conjunta de Red de BT subterránea en la Calle Aigua Blanca. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;La finalidad de este Convenio por parte de los promotores, es la electrificación de la parcela ubicada en la Calle de Aigua Blanca nº 10 usando la canalización existente ejecutada por el Ayuntamiento y condicionada a la previsión de la elección de los conductores que puedan soportar la conexión del resto de usuarios cuando pasen a conectarse desde la línea soterrada.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Visto el&lt;strong&gt; informe del Arquitecto de 6 de junio de 2018&lt;/strong&gt;, en el que &lt;strong&gt;dice:&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“Examinado el Convenio que suscribe el Ayuntamiento, junto con el promotor del proyecto, Proviasol Plus SL. El Técnico Municipal; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;INFORMA:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El convenio recoge diversas actuaciones:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;El Ayuntamiento:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Aportará las canalizaciones eléctricas ejecutadas en el marco del proyecto de soterramiento de líneas aéreas de la Calle Aigua Blanca, en Portinatx.(Canalización para soterración de LBT, desde punto A a punto D1 y armario de obra en punto D).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;El promotor:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Aportará el proyecto de Baja Tensión Calle S’ Aigua Blanca, que incluye la parcela del promotor y los suministros actuales en dicha calle.(Canalización para soterración de LBT, desde CT al punto A, resto de armarios y cajas de distribución, conductores eléctricos y trabajos de Endesa.)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;En fecha 20 de abril de 2.017 se realizó por parte del Técnico Municipal el siguiente informe que transcribo literalmente:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;“Se solicita licencia municipal para el Proyecto de Ampliación Subterránea de Red de Baja Tensión desde el C.T. “Portinatx-4” N.º 30.446, con objeto de dar suministro eléctrico a un edificio de viviendas situado en C/ S'Aigua Blanca N.º 10, Portinatx, T.M. de Sant Joan de Labritja. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Para la ampliación de la Red de Baja Tensión, al tratarse de una línea nueva, partirá del C.T. y seguirá su trazado hasta llegar a una caja de seccionamiento y CGP desde la que partirá la Línea General de Alimentación del edificio a electrificar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La línea irá alojada en todo su recorrido en el interior de tubo de polietileno corrugado de alta densidad, de 160mm de diámetro como mínimo. Se instalará un tubo adicional de reserva, que deberá dejarse convenientemente taponado par su utilización cuando sea precisa. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se han previsto las siguientes potencias para las parcelas a electrificar: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La línea que se proyecta es Subterránea para Baja Tensión instalada en zanja que discurre por calzada, ya que se trata de una calle en la que todo el pavimento es igual, y en el que podrán circular vehículos. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El presupuesto de ejecución material es de&amp;nbsp;&lt;strong&gt;7.881.67€.&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La finca de conformidad con el régimen establecido por el Plan Territorial Insular de Eivissa i Formentera (PTI), aprobado definitivamente el 21 de marzo de 2005 por acuerdo de Pleno del Consell Insular (BOIB 31-03-2005 Num. 50) y las Normas Subsidiarias de Planeamiento de Sant Joan , aprobadas definitivamente por la CIOTUPHA el 29 de abril 2.011 (BOIB Nº 104 de 07/07/2011), se emplaza dentro de la categoría de SUELO URBANO.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El promotor solicita realización de red de baja tensión con canalización paralela a otra canalización ejecutada por el Ayuntamiento en 2003 – 2004 dentro de proyecto de Dotación de Infraestructuras.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La nueva canalización implica la rotura del pavimento de la calle (hormigón impreso).por lo que el tecnico que suscribe informa:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Con el fin de coordinar infraestructuras y minimizar la rotura del pavimento de la calle (hormigón impreso), el proyecto redactado debería modificarse y coordinarse con proyecto de Dotación de Infraestructuras ejecutado por el Ayuntamiento. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El proyecto debería modificarse para aprovechar la canalización existente y permitir la futura soterración de red aérea existente en el mismo vial, para ello se contemplarán las potencias de la edificaciones existentes y se asignarán estas a los armarios correspondientes. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El Ayuntamiento cedería la canalización para baja tensión y el Promotor instalará la línea y armarios de forma que permita la futura soterración. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Con el fin de garantizar la correcta gestión de los residuos generados en la obra, se exige el depósito de una fianza y otra garantía financiera equivalente, que responda de la correcta gestión de los residuos de construcción y demolición que se produzcan en la obra en los términos previsto en la legislación autonómica y municipal, (50% de la valoración del coste de residuos incorporada al estudio de gestión de RCD que el promotor entrega junto con el proyecto de acuerdo con el art. 6.1.7.) &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Paralización en Zona Turística durante la temporada Estival.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Al situarse las obras en Suelo Urbano se dará cumplimiento al art. 62 de las Ordenanzas municipales de Sant Joan, queda prohibida la ejecución de obras de estructura, desmonte o cualesquiera otras que pudieran ocasionar molestias al vecindario o en la vía pública, en Zonas Turísticas durante el período comprendido entre el 1 de Mayo y el 31 de octubre, coincidiendo con la temporada turística. Durante dicho período, las licencias otorgadas en dichas zonas quedan suspendidas, prorrogándose por el mismo plazo. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Es de lo que informo según mi leal saber y entender sometiendo el presente a mejor criterio de autoridad superior.” &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En la Junta de Gobierno Local de fecha 13 de abril de 2018 se informó favorable para la ejecución de la urbanización de la calle de S’ Aigua Blanca en Portinatx.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;En base a lo expuesto anteriormente se informa FAVORABLEMENTE al Convenio, condicionado a que para la concesión de la licencia municipal de obras se deberá presentar proyecto de urbanización con las modificaciones reseñadas en el informe, debiéndose de aprobar por la Junta de Gobierno Local de este Ayuntamiento.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;I.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Los Ayuntamientos podrán establecer convenios con Empresas privadas para gestionar aspectos de su interés.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;II.- &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Legislación: artículos 55 y 57 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local; artículo 4.1.c) del Texto Refundido de la Ley de Contratos del Sector Público, aprobado por Real Decreto Legislativo 3/2011, de 14 de noviembre; artículos 82, 83 y 84 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;III.- &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Durante todo el proceso de habrá de cumplirse con las exigencias de publicidad activa en virtud de lo dispuesto en el artículo 21.4 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas y en la normativa vigente en materia de transparencia.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;IV.- &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;De conformidad con lo establecido en el artículo 4.1.d del Texto Refundido de la Ley de Contratos del Sector Público, aprobado por el Real Decreto Legislativo 3/2011, de 14 de noviembre, están excluidos del ámbito de aplicación de dicha ley los convenios que, con arreglo a las normas específicas que los regulan, celebre la Administración con personas físicas o jurídicas sujetas al derecho privado, siempre que su objeto no esté comprendido en el de los contratos regulados en esta ley o en sus normas administrativas especiales.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;V.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; La celebración de un convenio de colaboración no supondrá, en ningún caso, alteración del régimen de contratación, ni alterará la obtención de permisos, licencias, etc. Ni dará lugar a prerrogativas en la actividad reglada municipal, ni modificará el régimen de competencias atribuido a los órganos administrativos.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;VI.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; De conformidad con lo previsto en el artículo 53 de Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público en relación con la instrucción relativa a la remisión telemática al Tribunal de Cuentas de convenios y de relaciones anuales de los celebrados por las entidades del sector público local, aprobada por Resolución de 2 de diciembre de 2016, de la Presidencia del Tribunal de Cuentas, dentro del plazo de los tres meses siguientes a la suscripción de cualquier convenio cuyos compromisos económicos superen los 600.000 euros, se deberá remitir al Tribunal de Cuentas u órgano externo de fiscalización de la Comunicad Autónoma, copia del documento de formalización del convenio, acompañada de la correspondiente memoria justificativa. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se entiende por compromisos económicos asumidos, el importe total de las aportaciones financieras que se comprometan a realizar el conjunto de los sujetos que suscriben el convenio, independientemente de la aportación que corresponda a la entidad local remitente de la documentación.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Asimismo, las entidades locales deberán remitir anualmente una relación certificada comprensiva de los convenios formalizados, con independencia de su cuantía, en aplicación del artículo 53.3 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público y la instrucción relativa a la remisión telemática al Tribunal de Cuentas de convenios y de relaciones anuales de los celebrados por las entidades del sector público local, aprobada por Resolución de 2 de diciembre de 2016, de la Presidencia del Tribunal de Cuentas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;VII.- &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Procedimiento:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Aprobación del Convenio por la Junta de Gobierno Local. autorizando al Sr Alcalde para su firma. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Notificación del acuerdo a los interesados, de acuerdo con lo establecido en el artículo 40 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, en el plazo de diez días a partir de la fecha en que el acto haya sido dictado, y deberá contener el texto íntegro de la resolución, con indicación de si es o no definitivo en la vía administrativa, la expresión de los recursos que procedan, órgano ante el que hubieran de prestarse y plazo para interponerlos, sin perjuicio de que los interesados puedan ejercitar, en su caso, cualquier otro que estimen procedente.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Publicar en el BOIB y en la dirección electrónica del Ayuntamiento el texto íntegro del convenio. Dentro del mes siguiente a su aprobación. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo ello, de conformidad con lo establecido en el artículo 175 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, aprobado por Real Decreto 2568/1986, de 28 de noviembre, INFORMO FAVORABLEMENTE el expediente de referencia y elevo la siguiente&lt;strong&gt; PROPUESTA DE ACUERDO A LA JUNTA DE GOBIERNO LOCAL:&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Primero.- &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Aprobar el texto del Convenio administrativo de colaboración entre este Ayuntamiento de Sant Joan de Labritja y la mercantil Proviasol Plus SL, para la realización conjunta de las obras de BT subterránea en la Calle Aigua Blanca de Portinatx, cuyo texto es el siguiente:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Participantes&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Don Antonio Marí Marí, con NIF 41437091S, alcalde y en representación del Ayuntamiento de Sant Joan de Labritja, con CIFP0705000H,&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Don Miguel Hevia González NIF 10823473H en representación de PROVIASOLPLUS SL CIF B33582446, promotora y propietaria de la parcela, ubicada en la Calle de Aigua Blanca nº10, en Portinatx. (en adelante Promotor).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. &lt;em&gt;En el año 2004 el Ayuntamiento realizó una dotación de infraestructuras que incluía una canalización destinada a la soterración de líneas aéreas de baja tensión. La obra estaba contemplada en el ​Proyecto de Dotación de Infraestructuras de Calle S’Aigua Blanca (licencia municipal de obras nº12 2004 y expediente Endesa EI04003).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. &lt;em&gt;El Promotor ha presentado en el 2016 (NRE 3940 de 29.09.2016) proyecto de realización de red de baja tensión en la Calle Aigua Blanca de Portinatx. Dicho proyecto ha previsto una canalización paralela a la ya ejecutada por el Ayuntamiento. La nueva canalización prevista por el Promotor implica la rotura del pavimento de la calle de hormigón impreso de difícil reparación, además de existir afectación a otros servicios que existen en dicha calle (agua, teléfono, línea de MT). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Visto lo anterior y con el fin de coordinar infraestructuras y minimizar la rotura del pavimento de la calle (hormigón impreso), el proyecto presentado por el Promotor debería modificarse y aprovechar la canalización ejecutada en su día por el Ayuntamiento. Para ello es necesario establecer un CONVENIO entre el Promotor y el Ayuntamiento.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Objetivos de las partes.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Ayuntamiento&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Realizar la infraestructura que permita la futura soterración de líneas aéreas de baja tensión existentes en su proyecto de Dotación e Infraestructuras.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Reducción de costes, puesto que los conductores eléctricos y los armarios y cajas de distribución pendientes de ejecutar los instala el Promotor.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Promotor&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Dotar de suministro eléctrico a la parcela de su propiedad.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Reducción de costes, puesto que se reduce la obra civil, al aprovechar la canalización y un armario realizados por el Ayuntamiento.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Minimizar la rotura del vial de pavimento impreso.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Objeto del CONVENIO&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El proyecto debería aprovechar la canalización existente ejecutada por el Ayuntamiento y dotar de conductores eléctricos suficientes que permitan la futura soterración de red aérea existente en el mismo vial. Para ello se contemplarán las potencias de las edificaciones existentes y se asignarán estas a los armarios correspondientes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El Ayuntamiento cedería a ProviasolPlus SL la canalización ejecutada ​para baja tensión; ProviasolPlus SL finalizaría técnicamente dicha canalización realizando las catas de comprobación requeridas por Gesa-Endesa y la construcción de los armarios eléctricos señalados; se certificaría el Final de Obra de toda la canalización ejecutada hasta el momento y se entregaría a Endesa-Explotación. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Recibida por Endesa-Explotación y dada por válida dicha canalización, ProviasolPlus SL procedería a la instalación de las cajas eléctricas y de los conductores que falten de forma que se permita la futura soterración.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En definitiva, realizar la obra de forma conjunta en colaboración entre el Ayuntamiento y el PROMOTOR, con el fin reducir los costes de la obra, y aprovechar los trabajos realizados previamente por el Ayuntamiento. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;No forma parte del convenio la realización de acometidas, instalaciones de enlace, reubicación de contadores, derivaciones individuales y desmontaje de la red aérea actual.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;El presente convenio entrará en vigor una vez el mismo cuente con la aprobación de Gesa-Endesa como empresa suministradora de energía y se resolverá si Endesa, por circunstancias no previsibles en este momento, no recibe la canalización ya ejecutada por el Ayuntamiento.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Situación de partida&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las partes han realizado diversas actuaciones, previas a este CONVENIO, que se consideran aportaciones al mismo y que se listan a continuación:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;em&gt;El ayuntamiento:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. &lt;em&gt;Aportación de las canalizaciones eléctricas ejecutadas en el marco del proyecto de soterramiento de líneas aéreas de la calle Aigua Blanca, en Portinatx.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;em&gt;El promotor:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. &lt;em&gt;Proyecto de baja tensión calle S’Aigua Banca, que incluye la parcela del promotor y los suministros actuales en dicha calle. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;CONVENIO de proyecto ejecutivo de soterramiento de línea aérea y utilización de las canalizaciones para la electrificación de una parcela.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Con la firma de este CONVENIO, las partes muestran su conformidad con el trazado y configuración del proyecto ejecutivo para proceder a su tramitación ante la compañía suministradora y las administraciones competentes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La finalidad de este CONVENIO por parte de los promotores, es la electrificación de la parcela ubicada en la Calle de Aigua Blanca nº10 usando la canalización existente ejecutada por el ayuntamiento y condicionada a la previsión de la elección de los conductores que puedan soportar la conexión del resto de usuarios cuando pasen a conectarse desde la línea soterrada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;CONVENIO de asignación de partidas y costes.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Las partes de la obra se repartirán de la siguiente forma:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;PARTE CORRESPONDIENTE AL AYUNTAMIENO:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Canalización para soterración de LBT, desde punto A a punto D1. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Armario de obra en punto D.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;PARTE CORRESPONDIENTE AL PROMOTOR:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Canalización para soterración de LBT, desde CT al punto A. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;em&gt;Resto de armarios y cajas de distribución.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Cuarto.- &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;Facultar al Alcalde, como Presidente de esta Corporación y en representación de este Ayuntamiento, de conformidad con lo establecido en el artículo 21.1.b) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, para suscribir el citado Convenio de Colaboración y cuantos documentos sean necesarios en su ejecución.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;LA JUNTA DE GOBIERNO LOCAL POR UNANIMIDAD ACUERDA APROBAR LA PRECEDENTE PROPUESTA EN LOS TÉRMINOS EN QUE SE HA TRANSCRITO.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la presente Resolución&lt;em&gt;, &lt;/em&gt;que pone fin a la vía administrativa, puede interponer alternativamente recurso de reposición potestativo ante&amp;nbsp;la Junta de Gobierno Local de este Ajuntament de Sant Joan de Labritja, en el plazo de un mes a contar desde el día siguiente al de la recepción de la presente notificación, de conformidad con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas; o bien interponer directamente recurso contencioso-administrativo, ante el Juzgado de lo Contencioso-Administrativo de Palma de Mallorca, en el plazo de dos meses, a contar desde el día siguiente al de la recepción de la presente notificación, de conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa. Si se optara por interponer el recurso de reposición potestativo no podrá interponer recurso contencioso-administrativo hasta que aquel sea resuelto expresamente o se haya producido su desestimación por silencio. Todo ello sin perjuicio de que pueda interponer Vd. cualquier otro recurso que pudiera estimar más conveniente a su derecho.&lt;/span&gt;&lt;/p&gt;
