Con fecha de registro de entrada 17 de septiembre de 2018 la Federación Balear de Cofradías de Pescadores, en representación de los armadores de los barcos pesqueros </span>“PACO Y MARIA”, “SARA Y THESA”, “NUEVO CARRILLO”&nbsp; y “SEÑORA DE LOS ANGELES” <span style="color:black">, en cumplimiento del artículo 3 del Decreto 5/2015, de 13 de febrero, solicitó el uso temporal de un puerto diferente de su puerto base por el periodo comprendido entre los días 16/10/2018 y el 15/11/2018 para las embarcaciones de cerco y de los días 01/10/2018 y 31/12/2018 para la embarcación de artes menores des del puerto de Palma de Mallorca a los puertos de Alcudia y Andratx respectivamente,</span> expedient DGMRM 505 /2018CPB.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. En fecha 17 de septiembre &nbsp;esta Administración&nbsp; solicitó a Puertos de las Islas Baleares, disponibilidad de amarre en el puerto de Andratx para la embarcación de artes menores. Así mismo el 24 de septiembre de 2018 solicitó a Autoridad Portuaria la disponibilidad de amarre para los buques de cerco en el puerto de Alcudia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. El día 8 de octubre de 2018 tuvo entrada en esta Administración informe de Autoridad Portuaria comunicando que no dispone de ningún amarre disponible en el puerto de Alcudia para las embarcaciones de cerco por encontrarse actualmente todos ocupados.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5. Por su parte Ports de les Illes Balears informó que actualmente hay un amarre disponible en la zona de servicio del puerto de Andratx para las características de la embarcación solicitada, no obstante , el servicio de Recursos Marinos ha informado desfavorablemente la utilización temporal del puerto de Andratx por un periodo inferior a tres meses por parte del buque pesquero “SEÑORA DE LOS ANGELES” por contravenir las medidas específicas de contención del esfuerzo pesquero y no puede pescar ni en la reserva marina del Toro, ni de las Islas Malgrats y del Freu de Sa Dragonera.</span></span></p> <p></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Fundamentos de derecho</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. Los artículos 67.1 y 68.1 de la Ley 3/2001, de 26 de marzo, de pesca marítima del Estado.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. Real Decreto&nbsp; 1035/2017, de 15 de diciembre por el cual se regula el establecimiento y cambio de puerto base.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. Los artículos 48 y 49 de la ley 6/2013, de 7 de noviembre, de pesca marítima, marisqueo y acuicultura en las Islas Baleares.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. El Decreto 5/2015 de 13 de febrero por el cual se regula el cambio de puerto base y las autorizaciones de uso temporal de puerto base de las embarcaciones pesqueras en la comunidad autónoma de las Islas Baleares.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5. El Decreto 12/2015, de 2 de julio de la presidenta de las Islas Baleares, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Resuelvo</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. Denegar el la utilización temporal de puertos diferentes de sus puertos base de las embarcaciones pesqueras indicadas a continuación, por el periodo comprendido entre el día 16 de octubre hasta el día 15 de noviembre de 2018, des del puerto de Palma de Mallorca al puerto de Alcudia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Publicar la resolución en el Boletín Oficial de las Islas Baleares y en la web de la Dirección general de Pesca y Medio Marino.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Interposición de recursos</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Contra esta resolución —que no agota la vía administrativa— se puede interponer un recurso de altura ante el Consejero de Medio ambiente, Agricultura y Pesca, en el plazo de un mes contador desde el día siguiente de la publicación en el Boletín Oficial de las Islas Baleares , de acuerdo con el artículo 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común, y el artículo 58 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares. El recurso de altura se tiene que entender desestimado si habiendo transcurridos tres meses desde que se interpuso no se ha dictado resolución.
