    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El 9 de octubre de 2018 se han producido en la zona de Llevant de Mallorca tormentas y lluvias torrenciales. En pocas horas cayó del cielo un tercio de la lluvia que se produce durante todo el año, hecho que causó el desbordamiento de torrentes de la zona de Llevant de Mallorca y causó destrozos en inmuebles, empresas, comercios, hoteles, vehículos y a profesionales. Todo eso provocó que algunos municipios de la zona de Llevant de Mallorca quedaran totalmente devastados por la fuerza del agua, y que sus casas y empresas resultaran muy perjudicadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Con el objeto de acometer de manera inmediata las medidas adecuadas se ha aprobado el Decreto Ley 2/2018, de 18 de octubre, con el objeto de establecer ayudas y otras medidas de carácter urgente para reparar las pérdidas y los daños ocasionados por el episodio de intensas lluvias y de inundaciones que tuvieron lugar el día 9 de octubre de 2018 en la comarca de Llevant de Mallorca, como también para facilitar la restitución y reposición de los bienes, las infraestructuras, los equipamientos, las instalaciones y los servicios a la situación anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En este Decreto Ley, en concreto en el artículo 2.3, se establece que para compensar las pérdidas y posibilitar la restitución y reposición a la situación anterior las convocatorias que se aprueben para ejecutar este Decreto Ley podrán determinar el alcance de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las medidas que se contemplan en este Decreto Ley son complementarias a las que pueda adoptar el Estado y van encaminadas a reparar los daños sufridos en el patrimonio de las personas físicas y jurídicas, como consecuencia directa de las lluvias e inundaciones mencionadas, con el objeto de restablecer la situación que existía con anterioridad a su producción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En concreto, dentro de las actuaciones previstas en el Decreto Ley mencionado, en el artículo 10 se recogen las ayudas para paliar daños y pérdidas en empresas, autónomos, profesionales y trabajadores por cuenta propia y ajena, y se atribuye la resolución de concesión de estas ayudas al consejero de Trabajo, Comercio e Industria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;De acuerdo con lo anterior, y en virtud de lo que se dispone en el artículo 10 mencionado, mediante esta Orden se establecen las bases reguladoras y se aprueba la convocatoria de las ayudas destinadas a la reparación de los daños ocasionados y las pérdidas producidas en empresas y en profesionales y trabajadores por cuenta propia y ajena por las intensas lluvias y las inundaciones del 9 de octubre de 2018 en la comarca de Llevant de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El procedimiento de concesión de las ayudas referidas en esta Orden se tramitará de acuerdo con lo establecido en el Decreto Legislativo 2/2005, de 28 de diciembre, por lo cual se aprueba el texto refundido de la Ley de subvenciones, si bien con las especializaciones indicadas en el Decreto Ley mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En virtud de todo el expuesto, y de acuerdo con las competencias atribuidas a la Consejería de Trabajo, Comercio e Industria y a la Vicepresidencia y Consejería de Innovación, Investigación y Turismo, en el artículo 10.4 del Decreto Ley 2/2018 y en el Decreto 24/2015, de 7 de agosto, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, dictamos la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;ORDEN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 1&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. Es objeto de esta Orden establecer las bases reguladoras y aprobar la convocatoria para la concesión de las ayudas destinadas a contribuir al reinicio de la actividad mediante la reparación de los daños causados y las pérdidas producidas en las actividades industriales, comerciales, mercantiles, de servicios y turísticas, así como a profesionales y trabajadores por cuenta propia y ajena, producidos en el Llevant de Mallorca como consecuencia de las intensas lluvias e inundaciones del día 9 de octubre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. La concesión de estas ayudas tendrá carácter subsidiario respecto de cualquier otro sistema de cobertura de daños, público o privado, nacional o internacional, del que puedan ser beneficiarios los afectados, hasta el límite del valor de la reposición del daño o pérdida producida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. De acuerdo con lo indicado en el artículo 2.3 del Decreto Ley 2/2018, esta convocatoria determina el alcance de las ayudas para compensar las pérdidas y posibilitar el reinicio de la actividad mediante la restitución y reposición a la situación anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. Las ayudas se regirán por el Decreto Ley 2/2018, por esta Orden y por lo previsto en el resto de la normativa estatal o autonómica aplicable a las subvenciones otorgadas por la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 2&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Ámbito de aplicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El ámbito de aplicación de esta Orden se extiende a los términos municipales que se enmarcan en el ámbito territorial de aplicación del Decreto Ley 2/2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 3&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Actuaciones subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se considerarán actuaciones subvencionables las siguientes, siempre que tengan relación directa y determinante con los hechos causantes de la solicitud de ayuda en relación con las lluvias intensas e inundaciones producidas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. La reposición del utillaje, del mobiliario y de otros elementos esenciales, así como las existencias y productos propios derivados de su actividad, bien sean materias primas, materias en transformación, productos semielaborados o acabados y subproductos susceptibles de comercialización o valorización con anterioridad al desbordamiento, que hayan quedado inservibles o no comercializables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. La reparación de los daños o sustitución de maquinaria, equipos de trabajo y equipos informáticos afectos a las actividades industriales, comerciales y turísticas, así como a profesionales, que hayan sufrido daños como consecuencia de las inundaciones. En el supuesto de actividades industriales se incluirán, en su caso, los costes de la tramitación de los expedientes de seguridad industrial de la Dirección General de Política Industrial que sean necesarios para reanudar la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. Vehículos afectos en su totalidad a las actividades ordinarias de la empresa y profesionales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. Costes de suministro eléctrico, teléfono y alquiler, como también los costes derivados de la Seguridad Social de las empresas y trabajadores autónomos afectados desde el 9 de octubre del 2018 hasta al inicio de la actividad ordinaria, hasta&amp;nbsp; un plazo máximo de seis meses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. En relación a los trabajadores de las empresas afectadas, y en los supuestos en que la Administración del Estado no lo contemple, y, en su caso, previa autorización del Servicio Público de Empleo Estatal (SEPE), el complemento por el importe entre la diferencia de su salario anterior y la prestación de desempleo recibida, en el caso de expediente de regulación temporal de empleo por causa de fuerza mayor, declarado como consecuencia directa de las intensas lluvias e inundaciones producidas, durante el tiempo que dure el ERE y se perciban las prestaciones de desempleo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Artículo 4&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Beneficiarios&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. Podrán ser beneficiarios de estas subvenciones las personas físicas o jurídicas titulares de las actividades industriales, comerciales o profesionales, de menos de 50 trabajadores, o turísticas, sin límite de trabajadores, debidamente registradas a efectos fiscales, y en funcionamiento, que hayan sufrido daños o pérdidas de cualquier naturaleza, siempre que sea como consecuencia directa de las lluvias e inundaciones producidas en el mes de octubre de 2018 en la comarca de Llevant de Mallorca y se encuentren situados en los municipios incluidos en el ámbito de aplicación de esta Orden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Se consideran establecimientos turísticos, a efectos de esta Orden, los previstos en el artículo 26.1 de la Ley 8/2012, de 19 de julio, del Turismo de las Illes Balears (salvo las previstas en el punto c), y a la disposición adicional octava de la Ley mencionada (salvo las viviendas turísticas de vacaciones y las viviendas objeto de comercialización de estancias turísticas), que tengan autorización o licencia turística o hayan presentado la DRIAT de manera correcta con anterioridad al 10 de octubre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. En el caso de los trabajadores de las empresas afectadas será requisito imprescindible para obtener la ayuda mencionada en el artículo 3.5 estar incluido en un expediente de regulación temporal de empleo por causa de fuerza mayor, declarado como consecuencia directa de las intensas lluvias y las inundaciones producidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. No podrán obtener la condición de beneficiario las personas o entidades que se encuentren incursas en alguna de las causas de prohibición previstas en la normativa aplicable en materia de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. No podrán obtener la condición de beneficiario quienes no estén al corriente en el cumplimiento de las obligaciones tributarias, tanto con la Hacienda del Estado como con la Administración de la Comunidad Autónoma de las Illes Balears y ante la Seguridad Social, así como quienes tengan alguna deuda pendiente de pago con la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 5&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Cuantía de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. La cuantía global máxima prevista para esta convocatoria es de dos millones seiscientos mil euros (2.600.000 euros).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. El importe máximo de las ayudas será:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;a) En el caso de actividades industriales, actividades de comercio al por mayor y actividades de mantenimiento y reparación de vehículos de motor, cien mil euros (100.000 euros) por beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) El resto de actividades comerciales, de servicios y profesionales, treinta mil euros (30.000 euros) por beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;c) En el caso de empresas turísticas, cien mil euros (100.000 euros) por beneficiario, en el caso de las empresas de alojamiento previstas en el artículo 31.1 y en la disposición adicional octava de la Ley 8/2012, de 19 de julio, del Turismo de las Illes Balears; y treinta mil euros (30.000 euros) por beneficiario, en el caso de las empresas previstas en los puntos d), e), f) y g) del artículo 26.1 de la Ley 8/2012.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. El importe de las ayudas derivadas de los costes de la Seguridad Social de las empresas serán las cuotas empresariales durante el tiempo que esté suspendida su actividad ordinaria. En el caso de los trabajadores autónomos se calculará en base a la última cuota ingresada durante el tiempo que esté suspendida la actividad ordinaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. En ningún caso la cuantía de las ayudas junto con las concedidas por el resto de las Administraciones Públicas u organismos públicos nacionales o internacionales, y las indemnizaciones que puedan percibir los damnificados de los seguros contratados, podrá superar el importe total del objeto de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. Siempre que las disponibilidades presupuestarias lo permitan, se puede aumentar el importe de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 6&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Presentación de solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. Las solicitudes de ayuda se formalizarán según el modelo normalizado que figura en el anexo de esta Orden y se dirigirán al consejero de Trabajo, Comercio e Industria. Este modelo se podrá obtener en la página web: www.caib.es.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. El plazo para presentar solicitudes empezará a partir del día siguiente de la fecha de publicación de esta Orden en el Boletín Oficial de las Illes Balears, y finalizará el día 14 de noviembre de 2018 inclusive. Durante este plazo los interesados podrán presentar una o varias solicitudes, cuya suma no podrá ser superior a los límites establecidos en el artículo 5.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. Las solicitudes se tienen que presentar en los registros de los ayuntamientos, en cuyo término municipal se hayan producido los daños, sin perjuicio de que las personas interesadas puedan optar por presentarlas en cualesquiera de las dependencias o formas previstas en el artículo 16 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 7&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Instrucción y tramitación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. La instrucción del procedimiento corresponde a la Consejería de Trabajo, Comercio e Industria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. El procedimiento de concesión de ayudas se efectuará por un procedimiento que no es de concurso, dado que no es necesaria la comparación y la prelación en un único procedimiento de todas las solicitudes entre sí, en virtud de la urgencia y de lo que dispone el artículo 17.2 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. Las solicitudes de subvención se resolverán individualmente, mediante régimen de concesión directa con convocatoria abierta, en virtud de la cual las subvenciones se irán concediendo conforme se vayan solicitando por los interesados, en base a los requisitos establecidos en esta Orden, siempre que haya crédito suficiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. Cuando la solicitud no disponga de los requisitos exigidos en la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, se tiene que requerir el solicitante para que —en el plazo de diez días hábiles desde el día siguiente de la recepción del requerimiento— enmiende la falta, con la advertencia de que si no lo hace se considerará que desiste de la solicitud, con la resolución previa dictada en los términos que prevé la legislación administrativa, de conformidad con el artículo 68.1 de la Ley mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. El órgano instructor tiene que realizar de oficio las actuaciones que estime necesarias para la determinación, conocimiento y comprobación de los datos en virtud de los que se tiene que pronunciar la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 8&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El consejero de Trabajo, Comercio e Industria es el órgano competente para dictar las resoluciones de las ayudas correspondientes a esta Orden. Esta resolución tiene que ser motivada y se tiene que notificar a los interesados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. La resolución de concesión tiene que especificar los aspectos siguientes: beneficiario, presupuesto total de la actividad que se subvenciona, importe de la subvención concedida, partida presupuestaria a la que se aplica, plazo para llevar a cabo la actividad, justificación de las actividades objeto de ayuda y plazo para presentar los justificantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. El plazo máximo para resolver y notificar la resolución es de tres meses contadores desde la publicación de esta Orden en el Boletín Oficial de las Illes Balears. Transcurrido el plazo sin que se haya notificado la resolución expresa, los solicitantes tienen que entender desestimadas sus solicitudes por silencio administrativo, todo ello sin perjuicio de la obligación de resolver expresamente que incumbe a la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. La resolución de concesión o denegación pone fin a la vía administrativa. Contra esta se puede interponer un recurso potestativo de reposición en el plazo de un mes; o bien un recurso contencioso administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses, contadores a partir del día siguiente de haberse notificado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 9&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Pago de la ayuda a las empresas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. La Consejería de Trabajo, Comercio e Industria tiene que efectuar el pago de la totalidad de la ayuda de forma anticipada una vez se dicte la resolución de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. En caso de que el pago lo realice una entidad bancaria, el beneficiario cederá sus derechos de cobro respecto de la administración autonómica a la entidad mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 10&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Obligaciones de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las obligaciones de los beneficiarios para la concesión de subvenciones son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. Los beneficiarios quedan obligados a destinar los fondos recibidos a las finalidades para las que se les ha otorgado la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. En el caso de empresas y profesionales tienen que continuar con la actividad empresarial, industrial o económica para la que han recibido la subvención, como mínimo un año desde la fecha de resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. El beneficiario tiene la obligación de comunicar de inmediato al órgano otorgante cualquier otra subvención, ayuda o ingreso que para la misma finalidad y de cualquier procedencia haya solicitado o se le haya otorgado o pagado. También tiene que comunicar las indemnizaciones que, por el mismo concepto, haya solicitado o recibido de las entidades aseguradoras.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. Justificar ante el órgano de concesión de la subvención la realización de la actuación subvencionada de acuerdo con lo que establece esta Orden.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. Facilitar a la Administración de la Comunidad Autónoma de las Illes Balears cualquier información o documentación adicional que se requiera para poder comprobar la aplicación de los fondos o de la subvención otorgada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6. Los beneficiarios tienen que facilitar a los representantes de la Administración de la Comunidad Autónoma cualquier actuación de comprobación o inspección, así como las actuaciones de control financiero que pueda llevar a cabo la Intervención General de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;7. Cualquiera otra obligación impuesta a los beneficiarios por la normativa estatal o autonómica aplicable, en esta Orden o resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 11&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Justificación de las ayudas a empresas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. En todo caso los proyectos objeto de subvención se tienen que ejecutar del 9 de octubre de 2018 al 30 de mayo de 2019, y el plazo de presentación de la documentación justificativa es hasta el 30 de junio de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las inversiones objeto de las solicitudes se tienen que hacer y pagar en el periodo comprendido entre el 9 de octubre de 2018 y el 30 de mayo de 2019 (ambos inclusive). No se tienen que tener en consideración, como justificantes de la inversión subvencionada, las facturas emitidas ni los pagos hechos con anterioridad al 9 de octubre de 2018 ni con posterioridad al 30 de mayo de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. La justificación de la ayuda se tiene que hacer por medio de la aportación de justificantes de gasto. En cualquier caso, tiene que comprender la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;a) Memoria que recoja de forma detallada la actividad subvencionada y relación de las facturas objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Copia de la documentación acreditativa de la titularidad del establecimiento afectado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;c) Certificado del ayuntamiento que acredite que el establecimiento está ubicado en la zona afectada por las inundaciones y lluvias intensas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;d) Justificantes de gasto y pago.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Para justificar el pago de las facturas objeto de la subvención se tiene que presentar la documentación siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;— Una copia del documento bancario que acredite la transferencia o el pago domiciliado, en el que figure la fecha del pago, el importe pagado, el concepto del pago de manera tal que se identifique este con la factura, y el número de factura abonada, también los datos del ordenante y del destinatario, que tienen que coincidir con el beneficiario y con el emisor de la factura respectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;— Una copia del extracto bancario del beneficiario de la ayuda en el que figuren los cargos de los pagos mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;— No se admiten tiques de caja.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;— En el caso de pagos realizados mediante tarjeta de crédito se tendrá que aportar un extracto bancario de estos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. La Consejería de Trabajo, Comercio e Industria puede solicitar cualquier justificación adicional de las actividades realizadas cuando estas no estén suficientemente acreditadas en la memoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. En caso de que la Administración no tenga la documentación necesaria para comprobar la justificación y la aplicación de la subvención, el órgano competente tiene que solicitar al beneficiario que enmiende los defectos de la justificación dentro de los diez días siguientes contadores desde el día siguiente de haber recibido el requerimiento de enmienda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. Toda alteración de las condiciones que se han tenido en cuenta para conceder la subvención y, en todo caso, la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones o entes, públicos o privados, nacionales o internacionales, puede dar lugar a la modificación de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;No se considerará alteración de las condiciones a las que se refiere el párrafo anterior la sustitución del objeto de la subvención por otro similar, siempre y cuando forme parte de las actividades subvencionables de esta Orden, con independencia de la cuantía siempre que no supere los límites establecidos en el artículo 5.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6. La falta de justificación en los términos y los plazos que establezca la resolución de otorgamiento de la subvención, la modificación del proyecto presentado sin que esta Consejería la haya aprobado previamente, como también la desviación de las subvenciones o la aplicación diferente a la que establece la norma determinarán la revocación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Artículo 12&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Reintegro&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. En caso que se verifique el incumplimiento de las condiciones y obligaciones previstas en esta Orden, en la normativa aplicable, en esta convocatoria o en la resolución de concesión, se iniciará un procedimiento de reintegro de las cuantías recibidas de forma indebida, así como la exigencia de los intereses correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. También se iniciará el oportuno procedimiento de reintegro cuando el conjunto de las ayudas recibidas en concepto de subvención y de las cuantías recibidas por las entidades aseguradoras superen el valor del daño producido objeto de la subvención. No obstante, el beneficiario podrá reintegrar voluntariamente el importe que exceda el coste de la actividad subvencionada sin interés de demora, siempre y cuando se cumplan los requisitos establecidos en el artículo 44.3 del Decreto Legislativo 2/2005, de 28 de diciembre, mediante el cual se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Disposición adicional primera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Convocatoria de ayudas a los trabajadores&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En función de los expedientes de regulación de empleo temporal que se hayan tramitado, el consejero de Trabajo, Comercio e Industria podrá convocar la línea de ayudas referida en el artículo 3.5.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Disposición adicional segunda&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Disponibilidad presupuestaria&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En caso de que las disponibilidades presupuestarias lo permitan se abrirá, por medio de una nueva convocatoria de ayudas, un nuevo plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Disposición final única&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Entrada en vigor&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Esta Orden empezará a regir al día siguiente de haberse publicado en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
